Over the last decade, legal recognition of same-sex relationships in Canada has accelerated. By and large, same-sex cohabitants are now recognised in the same manner as opposite-sex cohabitants, and same-sex marriage was legalised in 2005. Without diminishing the struggle that lesbians and gay men have endured to secure this somewhat revolutionary legal recognition, this article troubles its narrative of progress. In particular, we investigate the terms on which recent legal struggles have advanced, as well as the ways in which resistance (...) to the legal recognition has been expressed and dealt with. We argue that to the extent that feminist critiques of marriage, familial ideology, and the privatisation of economic responsibility are marginalised, conservative and heteronormative discourses on marriage and family are reinforced. Our case studies include two pivotal moments in the quest for legislative recognition of same-sex relationships: the Hearings of the Canadian House of Commons Standing Committee on Justice and Human Rights on Bill C-23, The Modernization of Benefits and Obligations Act, in 2000 and the hearings on Same-Sex Marriage in 2003. We find that the debates operated within a narrow paradigm that bolstered many existing hierarchies and exacerbated conditions for those who are economically disadvantaged. (shrink)

Feminism is the movement to end women’s oppression. One possible way to understand ‘woman’ in this claim is to take it as a sex term: ‘woman’ picks out human females and being a human female depends on various anatomical features (like genitalia). Historically many feminists have understood ‘woman’ differently: not as a sex term, but as a gender term that depends on social and cultural factors (like social position). In so doing, they distinguished sex (being female or male) from gender (...) (being a woman or a man), although most ordinary language users appear to treat the two interchangeably. More recently this distinction has come under sustained attack and many view it nowadays with (at least some) suspicion. The religious right often aligns its patriarchal opposition to same-sex marriage with the defence of religious freedom. In this article, I identify resources for confronting such prejudicial religiosity by surveying two predominant feminist approaches to same-sex marriage that are often assumed to be at odds: discourse ethics and queer critical theory. This comparative analysis opens up to view commitments that may not be fully recognizable from within either feminist framework: commitments to ideals of selfhood, to specific conceptions of (...) justice, and to particular definitions of secularism. I conclude by examining the "postsecular" turn in feminism, suggesting that we can see the same-sex marriage debate not in terms of an impasse between differing feminist approaches, but in terms of shared existential and ethical affinities. The French philosopher Michel Foucault's work has had a significant impact on feminist and lesbian/gay scholarship in the United States. These explorations of gender and/or sexuality in which feminist, lesbian, and gay scholars rely on Foucault's ideas carry significant implications for the organization of knowledge in our culture beyond the issues of gender and sexuality narrowly defined. Many feminist, lesbian, and gay scholars in the United States initially read Foucault primarily as a historian. Since roughly 1985, many (...) such scholars have increasingly considered and critiqued the philosophical implications of his work, elaborating an account of the assumptions about gender and sexuality that reside at the core of ostensibly universal descriptions of human subjectivity. ;Participants in debates about the "social construction" of sexuality during the 1980s observed that Foucault did not originate social constructionist work in the field, widespread assumptions to the contrary notwithstanding. Indeed, the social constructionist position differs importantly from Foucault's analysis of sexuality as the truth of subjectivity. Historians in the United States have modified many of the substantive claims in Foucault's The History of Sexuality, Volume One: An Introduction. More recently, scholars have attended less to Foucault's substantive claims in favor of his approach to questions of knowledge and subjectivity. ;Feminist, lesbian, and gay scholars have long suspected that gender and sexuality play a major role in authorizing subjects to produce knowledge. Many such scholars continue within existing modes of inquiry to substitute their own, sympathetic versions of their selves for prejudicial, hegemonic versions. Scholars working off of Foucault and other poststructuralist thinkers increasingly suspect that prejudicial assumptions about gender and sexuality lie embedded in the very definition of current modes of inquiry, and thus require a fundamental reconceptualization of knowledge. In 2000, the Netherlands became the first European country to legalize prostitution, a policy supported by Dutch feminists. It distinguishes forced from voluntary prostitution, defining the latter as ‘sex work’, in contrast to feminist positions viewing it as ‘sexual domination’. This article examines the discourses used by parliamentarians in the debates since the 1980s and charts the shift from a traditional moral view to the sex-work frame, creating new meanings of ‘ prostitutes’, ‘clients’ and ‘brothel keepers’ in the process. (...) The new discourse allows for an active female sex worker but desexualizes the nature of the prostitution exchange. Neither does it offer an account of why it is mainly men buying sex from women. The analysis also highlights the contradictions created by the forced/voluntary distinction when speaking of the trafficking of women from poor countries and current anti-migration discourse, as well as the near obliteration of the racial differences between ‘clients’ and ‘workers’ in parliamentary discourse. It is not enough to simply claim that one has every right to do whatever they desire to do because there is always the possibility of false empowerment. Through the presence of BDSM in mass media, it has caught enough attention for it to elicit influence and uneducated inclusion to their lifestyle. I attempt to revive the debate between the abolitionist versus the sex-positive because there is a necessity to provide a critical analysis of BDSM today in the age (...) of post-sex revolution. Despite of the backlash it received from the thinkers from different walks of field, it is an empowering act because there is mutual respect, condemnation of abuse, and recognition of one’s individuality despite of its coercive, violent, and possessive act. In Sex, Gender and Science , Myra Hird outlines the social study of science and nature, specifically in relation to sex, sex differences, and sexuality. In this article, we interpret sex education from the perspective of feminist care ethics, emphasizing the concept of caring democracy, advanced by Joan Tronto one of the most influential feminist political theorists. According to Tronto, these theories show that a deficit of care and a lack of democracy are mutually conducive. We argue that, as in other areas of life, a lack of care in sexuality and sex education leads to social inequalities that eventually translate into an unequal (...) approach to freedom, equality, and justice, and to a deficit of democracy in the lives of some people. At the same time, we believe that, as a moral theory, care ethics, with its emphasis on the needs of men and women, can be adequately applied to the design of research projects, as well as to sexuality policies and practices. This chapter surveys essentialist and anti-essentialist theories of sex and gender. It does so by engaging three approaches to sex and gender: externalism, internalism, and contextualism. The chapter also draws attention to two key debates about sex and gender in the feminist literature: the debate about the sex/gender distinction (the distinction debate) and the debate about whether sex and gender have essences (the essentialism/anti-essentialism debate). This paper develops the conceptual framework of ’sex contextualism’ for the study of sex-related variables in biomedical research. Sex contextualism offers an alternative to binary sex essentialist approaches to the study of sex as a biological variable. Specifically, sex contextualism recognizes the pluralism and context-specificity of operationalizations of ’sex’ across experimental laboratory research. In light of recent policy mandates to consider sex as a biological variable, sex contextualism offers constructive guidance to biomedical researchers for attending to sex-related biological variation. Feminist debates on sex trafficking have become entrenched and polarised, with abolitionists producing images of helpless abused victims, while sex worker advocates work hard to achieve some recognition of the agency of migrant sex workers. This article explores constructions of embodiment, subjectivity and agency in the debate, showing how abolitionist views, in spite of their efforts to challenge liberal pro-sex perspectives, rely on a familiar vision of the body as a singular, bounded and sovereign entity whose borders must (...) be secured against invasion. The result is a vision in which victimisation is taken to epistemically compromise the subjectivities of sex workers, forcing them and their advocates to argue for recognition of their agency according to familiar liberal models of consent in order to be able to enter the debate. Drawing on the recent work of Judith Butler on consent and vulnerability, this article argues that what is needed is a rethinking of bodily ontology so that the vulnerability of sex workers is not opposed to their agency, but rather seen as an inevitable aspect of embodied sociality, constituting a call to ethical engagement and a recognition of the inequitable global distributions of precarity that produce sex trafficking as part of contemporary geopolitics. From this perspective, the alignment between radical feminist efforts to secure women's bodily borders and global efforts to secure national borders no longer appears as coincidence. (shrink)

This article indicates a reflective paradigm generally ignored in feminist research regarding the sex/gender debate, as presented in the work of Judith Butler ( Gender Trouble ). First, I address the fact that Butler’s philosophy is inscribed in the hermeneutical tradition of suspicion. Second, I put into relief the implicitly Platonic concept of mimesis , which is central to the anticipated subversion of gender, but uncriticized by Butler and others who follow her line of thought. Third, since Butler’s (...) feminism can’t ward off dualism, nor consider idem and ipse identity , I emphasize Paul Ricoeur ’s concept of triple mimesis and narrative identity, which allows us to depart from dichotomies and hierarchies. Following the path of Ricoeur and Françoise Heritier, I finally defend a feminist hermeneutical point of view, which is differentialist and universal. (shrink)

Birthing is a natural phenomenon. However, in the era of modernisation, it has dramatically changed and transformed into a technological affair. Some feminists claim that advances in medicine and assisted reproductive technologies have opened up numerous opportunities and choices for women to free themselves from their destined role of maternity by separating sex from reproduction. But are these technological artefacts always there to emancipate women or just another way to keep them subordinated to serve social needs? Other feminists argue that (...) technology is a controlling tool. It eliminates a woman’s choice and uses her body as a baby-manufacturing machine to perpetuate pervasive social roles and responsibilities. Again, if technology is simply a patriarchal trap, then can technological exclusion be the key to all reproductive issues? It seems not! Technology is the inevitable new reality of the world influenced by socio-cultural practices, values, norms and belief system that has a strong impact on human existence. The present paper is an attempt to critically explore and evaluate the ethical challenges posed by technicization of motherhood from two opposite feminist perspectives. I argue that these ART-centred debates are significant but polarised and insufficient to resolve maternal problems. Thus, we need an egalitarian model of technology that saves women from the threat of technicization, and be able to provide a dignified use of it. The paper discusses the impact of technicization on maternal self in relation to ARTs and proposes suggestions to overcome this problem. (shrink)

The feminist sex wars have been characterized by debates between radical feminists and sex radical feminists about women's experiences of empowerment versus oppression in the sex industry. Based on a qualitative study of the experiences of exotic dancers, this article introduces a new theoretical paradigm to the feminist sex wars that values the contributions of both sex radicals and radical feminists. It articulates a twofold temporal dimension of sex workers' experiences: how women's feelings of pleasure and empowerment gradually (...) decline over time and how good and bad experiences rapidly transform into their opposites over the course of a single evening, making the strip bar a volatile and unsettling space for performers. Feminism” and the theoretical positions of two influential contemporary thinkers in Philosophy of Science from a postmodern feminist perspective. Haraway and Harding debate around the History of Science (...) and its andocentric slants, as well as on the concept “identity” from the c yborg paradigm. Within the postmodern paradigm they assume the poststructuralist and deconstructionist inheritance and defend the necessity of a critical and autorreflexive social science like model of all sciences, but they have controversies about the gendered social space. Haraway understands that the social space is not homogenous, and that the three dimensions that Harding detects: generic symbolism, partner-sexual division of the work and processes of gendered individual identity, they are intercepted in multiple dimensions. Conflict over who belongs in women-only spaces is now part of mainstream political debate. Some think women-only spaces should exclude on the basis of sex, and others think they should exclude on the basis of a person’s self-determined gender identity. Many who take the latter view appear to believe that the only reason for taking the former view could be antipathy towards men who identify as women. In this paper, we’ll revisit the second-wave feminist literature on separatism, in (...) order to uncover the reasons for women-only spaces as feminists originally conceived them. Once these reasons are understood, those participating in debates over women-only spaces will be in a better position to adjudicate on whether shifting from sex to gender identity puts any significant interests at stake. A number of theorists have defended the legalization and destigmatization of sex work by arguing that sex work is analogous to other kinds of labour that are socially accepted and even valorized. In contrast, one reason that anti-sex work feminist theorists have rejected the analogy between prostitution and other jobs, including professions that are potentially exploitative and dangerous, is that sex is tied up with personal identity and integrity in a way that other activities are not. This makes the (...) selling of one’s body or the use of parts of one’s body for sexual services psycho-sexually harmful in a way that distinguishes it from other forms of labour involving the sale or use of one’s body parts. This essay argues that Foucault’s work on sexuality helps to bring together what seems right about both sides of this debate. Drawing on Foucault, we can explain the fact that sex is experienced as intrinsic to identity in the modern West, as well as lend support to the view that this is a contingent and undesirable state of affairs. Moreover, this essay argues that Foucault’s proposal for desexualization suggests a way out of one of the main occupational hazards associated with sex work. (shrink)
