PurposeThe purpose of this paper is to explore a particular philosophical underpinning for Information Systems (IS) research – critical systemic thinking (CST). Drawing upon previous work, the authors highlight the principal features of CST within the tradition of critical research and attempt to relate it to trends in the Italian school of IS research in recent years, as exemplified by the work of Claudio Ciborra but also evident in work by, e.g. Resca, Jacucci and D'Atri.Design/methodology/approachThis is (...) a conceptual paper which explores CST, characterised by a focus on individual uniqueness, and socially‐constructed, individual worldviews as generators of human knowing.FindingsThe paper draws on work by Heinz Klein in which he elaborated three constitutive stages in critical research: interpretive, genealogical and constructive. The authors introduce a fourth, reflective stage and discuss five categories of critical research, reflecting different perspectives on emancipation, culminating in emergent expressionism, associated with Ciborra and the Italian school more generally.Research limitations/implicationsThis paper discusses approaches to CST and how they might have practical implications in IS development. The distinction between approaches founded in logical empiricism and those founded in hermeneutic dialectics are considered and the development of critical and systems strands are discussed.Practical implicationsThe paper addresses CST as an approach to development of information systems. Such approaches enable users to explore their individually unique understandings and create a constructive dialogue with one another, which emancipates and empowers users to own and control their own development processes and hence build more productive and usable systems.Social implicationsA focus on research which is oriented towards emancipation in the tradition of critical social theory.Originality/valueThe paper draws on extensive theoretical research carried out by the authors over a period of more than ten years in CST and synthesises the practical implications. Besides their skepticism about universal reason and universal morality, the Frankfurt Schools of Critical Systems Theory and Critical Theory share basic assumptions: (1) the thinking in societal-systemic, institutional concepts, which transcend simple reciprocal relations by dint of their complexity; (2) the assumption that society is based on fundamental paradoxes, antagonisms, antinomies; (3) the strategy to conceptualize justice as a contingent and transcendental formula; (4) the form of immanent (and not morality-based, external) critique as an attitude of (...) transcendence; (5) the aim of societal (and not only political) emancipation in an ‘association of free individuals’ (Marx). This volume brings together a selection of papers written by Patricia Werhane during the most recent quarter century. The book critically explicates the direction and development of Werhane’s thinking based on her erudite and eclectic sampling of orthodox philosophical theories. It starts out with an introductory chapter setting Werhane’s work in the context of the development of Business Ethics theory and practice, along with an illustrative time line. Next, it discusses possible interpretations of the papers that have been divided (...) across a range of themes, and examines Werhane’s contribution to these thematic areas. Patricia H. Werhane is a renowned author and innovator at the intersection of philosophy and Applied Business Ethics. She is professor emerita and a senior fellow at the Olsson Centre for Applied Ethics at Darden and was formerly the Ruffin Professor of Business Ethics. She is also professor emerita at DePaul University, where she was Wicklander Chair in Business Ethics and director of the Institute for Business and Professional Ethics. A prolific author whose works include Moral Imagination and Management Decision-Making and Organization Ethics for Health Care, Werhane is an acclaimed authority on employee rights in the workplace, one of the leading scholars on Adam Smith and founder and former editor-in-chief of Business Ethics Quarterly, the leading journal of Business Ethics. She was a founding member and past president of the Society for Business Ethics and, in 2001, was elected to the executive committee of the Association for Practical and Professional Ethics. Before joining the Darden faculty in 1993, Werhane served on the faculty of Loyola University Chicago and was a Rockefeller Fellow at Dartmouth College and Senior Fellow at Cambridge University. This essay considers Kant’s concept of the highest good from a systematic point of view. The two spheres of freedom and nature—of the practical and theoretical—need to be brought into a causal relation for the highest good to be achieved. Kant seems to offer numerous possibilities for how human beings are able to think that it is possible for the highest good to be attainable. I argue that it is only in the third Critique, however, that Kant articulates an answer (...) that also establishes freedom and nature within a larger system. The third Critique does this by positing a third, independent and mediating sphere of human experience that allows a transition between freedom and nature to be effected. This answer to the problem of the highest good is distinctive because the causal efficacy of reason in attaining its own demands is preserved. The legal system – from the jury room to the deliberations of the Supreme Court – offers an abundance of rich resources for the study and teaching of critical thinking.The courts have (often for centuries) struggled with many of the issues central to critical thinking. The courts not only provide fascinating examples and exercises for students to examine, but in many areas – the appropriate use of ad hominem arguments, the distinction between argument and testimony, the (...) proper placing of the burden of proof, the distinction between necessary and sufficient conditions, the legitimate (and fallacious) use of appeals to authority, the nature of arguments by analogy – jurists and legal scholars have analyzed these issues carefully, and their insights are of great value to anyone concerned with rigorous critical thinking. Study of those legal resources has also had an impact on my views concerning the moral responsibility system. (shrink)

A large body of evidence suggests that the Personalized System of Instruction (PSI) improves learning. In courses that use PSI, the material is divided into units, students must pass a test on each unit before advancing to the next unit, there’s no group-level instruction, and students advance in the course at their own pace. While studies find that PSI improves learning outcomes in a wide range of settings, researchers haven’t studied the effectiveness of PSI in critical thinking classes. (...) In this paper, I argue that teaching critical thinking with PSI can effectively promote critical thinking skills. I describe a course that uses PSI to teach critical thinking and I present evidence from pre- and post-tests that indicates that students substantially improved their reasoning skills in this course. Social enterprises are seen as innovative towards solving societal problems, but little research exists on possible negative aspects, the so‐called dark sides. In this study, the emphasis is on dark sides of social entrepreneurship, how they are managed, and how systems thinking can contribute towards managing these effects. Dark sides of social entrepreneurship can take many forms, like unethical or insincere motives and unintended outcomes like the negative impact on the well‐being of founders and employees, but they are (...) also a call for a critical reflection on the role of the government in society and the economic system social enterprises have to operate in. This paper aims to contribute to the dark side theory of social entrepreneurship by linking system archetypes to themes of dark side thereby stressing how management strategies act as balancing feedback loops to mitigate or prevent dark sides. A qualitative research was conducted by interviewing 21 respondents who play an important role in the world of social entrepreneurship in Belgium. The results show that dark sides of social enterprises manifest itself mostly in the form of trade‐offs and financial, business, and management related issues. Taking over the habits of profit‐oriented companies emerged as a new dark side element. Management strategies include anchoring goals, transparency, obtaining external views, changing the system, and above all reflection. The latter is an important first step to become aware of these issues to be able to change the negative dynamism of these dark sides. (shrink)

Robert Jervis's System Effects was published just as systems thinking began to decline among political scientists, who were adopting increasingly strict standards of causal identification, privileging experimental and large-N studies. Many politically consequential system effects are not amenable to research designs that meet these standards, yet they must nonetheless be studied if the most important questions of international politics are to be answered. For example, if nuclear weapons are considered in light of their effect on the international system (...) as a whole, it becomes clear that they have obviated the need for a global balance of power by allowing states to counterbalance threats by acquiring nuclear weapons rather than investing in massive conventional balancing efforts. Similarly, systems thinking should inform our understanding of the impact of a “unipolar power” such as the United States, which has enjoyed an overwhelming preponderance of conventional military power since the fall of the Berlin Wall. A unipolar power is likely to become involved in frequent conflicts because it is not restrained by the presence of a peer competitor. (shrink)

Definition of the problemQuality of care also includes a professional approach to ethical challenges. This involves the moral interpretation of an issue and the management of intra- and interpersonal reflection processes. Combining both is the central task of clinical ethics consultation (CEC). Despite its importance only a few studies have dealt with the appropriate methods for steering reflection processes.ArgumentsCEC requires a theory-based and methodological approach. The argumentation shows the effects that systems theory and systemic methods have on the effectiveness (...) of CEC. The main methods such as clarification of mandates and handling complexity are presented, and their impact on dealing with ethical challenges is shown through the discussion of two cases.ConclusionThe paper provides insight into systems thinking. It discusses the influence that systemic tools have on dealing with typical challenges within clinical ethics counselling. It also shows how specific counselling methods impact a normative level. Yugoslavia was the site of unorthodox thinking on multiple fronts during the postwar period. In addition to the geopolitical innovation of the “non-aligned movement” and its domestic attempt at “self-management socialism,” the intellectual environment in the country after Tito’s 1948 break with Stalin also allowed for the development of theoretical work that departed from the Marxism-Leninism of the rest of the communist bloc. One of the most important attempts to blend Marxism with decidedly non-Leninist elements comes from the Slovenian (...) politician and intellectual, France Bučar. In the postwar period, Bučar sought to link his political activity to his intellectual work by developing his own critical systems theory. Unlike the thinkers within the Soviet Union, he was able to explore theoretical resources beyond Karl Marx, focusing in particular the groundbreaking work of Max Weber. This resulted in an agent-centric approach to systems theory that highlights the importance of the individual and geopolitical ethics. This paper aims to situate Bučar’s work in the context of postwar Yugoslavia. In so doing, I bring Bučar into conversation with the most important movement that sought to bring Marx together with Weber from the Western side of the Iron Curtain, i.e. the Frankfurt School of critical theory. I argue that certain aspects of Bučar’s critical systems theory bear a striking resemblance to Habermas’s own attempts to integrate Weberian insights into his own version of critical theory. I conclude by reflecting on how Bučar’s work can be understood as a combination of Eastern praxis with Western critique. (shrink)

The Human Image System and Thinking Critically in the Strong Sense.

We define social innovation as strategic decision making to improve social conditions and facilitate social changes in a desirable direction by dealing with crucial issues and solving fundamental societal problems. This paper proposes a framework that enables the decision maker to implement social innovation effectively. The framework consists of three influential theories or ways of thinking, that is, design thinking, systems thinking, and learning organization. The dual-process model of cognition but most especially its reflective component, system 2 processing, shows strong conceptual links with critical thinking. In fact, the salient characteristics of system 2 processing are so strikingly close to that of critical thinking, that it is tempting to claim that critical thinking is system 2 processing, no more and no less. In this article, I consider the two sides of that claim: Does critical thinking always require (...) system 2 processing? And does system 2 processing always result in critical thinking? I argue that it is plausible and helpful to consider that critical thinking requires system 2 processing. In particular, this assumption can provide interesting insights and benchmarks for critical thinking education. On the other hand, I show that system 2 processing can result in a range of outcomes which are either contradictory with critical thinking, or of debatable social desirability—which suggests that there is more to critical thinking than mere system 2 processing, and more to system 2 processing than just critical thinking. The article discusses principles that form part of evolutionary systems thinking in social sciences and humanities. It is argued that introducing the concept of self-organization relates agency and structures in a way that makes it possible to take up certain features of Critical Theory by which it can meet the demands for a critical social science. These principles are applied to the question of whether there is convergence or divergence in and by means of the Internet. (...) Irfan Ahmad makes the far-reaching argument that potent systems and modes for self-critique as well as critique of others are inherent in Islam--indeed, critique is integral to its fundamental tenets and practices. Challenging common views of Islam as hostile to critical thinking, Ahmad delineates thriving traditions of critique in Islamic culture, focusing in large part on South Asian traditions. Ahmad contemplates and interrogates Greek and Enlightenment notions of reason and critique, and he notes how they are invoked (...) in relation to "others," including Muslims. The cross-cultural critique rests on the idea that contemporary critical thinking textbooks completely ignore contributions from non-western sources, such as those found in the African, Arabic, Buddhist, Jain, Mohist and Nyāya philosophical traditions. The exclusion (...) of these traditions leads to the conclusion that critical thinking educators, by using standard textbooks are implicitly sending the message to their students that there are no important contributions to the study of logic and argumentation that derive from non-western sources. As a case study I offer a sustained analysis of the so-called Hindu Syllogism that derives from the Nyāya School of classical Indian philosophy. I close with a discussion of why contributions from non-western sources, such as the Hindu Syllogism, belong in a Critical Thinking course as opposed to an area studies course, such as Asian Philosophy. This essay is an attempt to address some concerns raised in rejoinders to my theory. I summarise the main concerns in the question, “What is this thing called the System of Conversational Thinking?” Three respectable colleagues, Chad Harris, Bruce Janz and Bernard Matolino have articulated some critical questions, which they hope that in addressing them, I would come to improve the System of Conversational Thinking considerably. In this essay, I would reply to their criticisms, but more specifically, (...) I would clarify my position, counter some of their objections and deepen my thought in some places. As machines have become increasingly smart and have entangled human thinking with artificial intelligences, it seems no longer possible to distinguish among levels of decision-making that occur in the newly formed space between critical reasoning, logical inference and sheer calculation. Since the 1980s, computational systems of information processing have evolved to include not only deductive methods of decision, whereby results are already implicated in their premises, but have crucially shifted towards an adaptive practice of learning from data, (...) an inductive method of retrieving information from the environment and establishing general premises. This shift in logical methods of decision-making does not simply concern technical apparatuses, but is a symptom of a transformation in logical thinking activated with and through machines. This article discusses the pioneering work of Katherine Hayles, whose study of the cybernetic and computational infrastructures of our culture particularly clarifies this epistemological transformation of thinking in relation to machines. Today’s educational system is in a quandary. On the one hand, colleges produce deep thinkers who possess skills necessary to adapt to an ever-changing world, but are less committed to the cause of resisting inequalities. On the other, there are students who have the passion for social reform, but are less concerned with higher order thinking skills. This investigation proposes a compromise by connecting the problem-posing method of Paolo Freire and the philosophy of education of John Dewey. This study (...) uses the neo-pragmatic approach of Richard Rorty to open a space that seeks to overturn elitist school systems. It is argued that there is no necessary tension since critical pedagogy and liberal education are actually against institutional oppression and the authoritarian ways of elitist or dominant educational paradigms that emphasize the instrumental rather than the humanist purpose of learning. The right approach can be found in the belief that each person has a transcendental value. The freedom of every man makes manifest the vital role of liberal education in emancipating society from unjust and unequal systems through inclusivity and pluralism. (shrink)

The philosophical framework of justice proposed by Nancy Fraser during the 1990s establishes two equally crucial dimensions of justice: redistribution, linked to the allocation of economic goods, and recognition, linked to the assignment of social status. This division makes it possible to distinguish between transformative strategies that intervene in the causes of social injustices and affirmative strategies that focus on their effects. However, the author’s treatment of her notion of “two-dimensional category”, which combines inequalities of redistribution and recognition, has limits (...) for thinking about the functioning of certain systems of social subordination and the situation of certain social groups. In this paper, I will use a queer-crip perspective to argue that both heterocissexism and ableism are two-dimensional categories, since they structure an unequal status system, but also sustain, define, and naturalize the capitalist mode of production and are functional to its distribution of economic goods. This critical review allows us to adapt the Fraserian framework to the current socio-political context. (shrink)

Critical realism, especially as developed by Roy Bhaskar, embodies at its heart systemic and holistic concepts such as totality, emergence, open systems, stratification, autopoiesis and holistic causality. These concepts have their own long history of development in disciplines such as systems thinking and cybernetics, but there is an absence in Bhaskar’s writings, and that absence is a lack of any reference to the corresponding systems literature. There is growing acceptance among language evolution researchers that an increase in our ancestors’ theory of mind capacities was critical to the origins of language. However, little attention has been paid to the question of how those capacities were in fact upgraded. This article develops a novel hypothesis, grounded in contemporary cognitive neuroscience, on which our theory of mind capacities improved as a result of an increase in our System-2 thinking capacities, in turn based in an increase in (...) our working memory capacities. I contrast this hypothesis with what would appear to be the default position among language evolution researchers, namely, that our theory of mind became more powerful as a result of genetic change to a domain-specific mindreading system which we share with other great apes. While the latter hypothesis is not implausible, it arguably enjoys less empirical support at present than does the alternative hypothesis I develop. (shrink)

Mirror neuron activation (MNA) has been applied to number of business ethics contexts including marketing, charitable giving, organizational connectedness, and leadership. Unfortunately, the business literature has often ignored research in philosophy and psychology which can provide insight into the application of mirror neurons to business contexts and other disciplines. I will argue that the use of mirror neurons to support business decisions cannot be established solely on the existence of neural activation as it requires higher level cognitive functions that go (...) beyond biological reductionism. But research into MNA does support their use in basic motor action understanding which is below the level of mental and psychological attributions. The corollary supports a dual-process model. On the one hand, mirror neurons are an automatic and unconscious process by which we understand human movement and, on the other hand, there is a cognitive system by which we understand action in terms of situational specifics and mental states. In this classic work, now appearing in English for the first time, Claudia Moatti analyses the intellectual transformation that occurred at the end of the Roman Republic in response both to the political crisis and to the city's expansion across the Mediterranean. This was a period of great cultural dynamism and creativity when Roman intellectuals, most notably Cicero and Varro, began to explore all areas of life and knowledge and to apply critical thinking to the reassessment of tradition (...) and the development of a systematic new understanding of the Roman past and present. This movement, linked to the development of writing, challenged old forms of authority and adhesion, belief and behaviour, without destroying tradition; and for this reason this rational trend can be described not as a cultural but as an epistemological revolution whose greatest achievement, Professor Moatti argues, was the development of the system of Roman law. Over the last 20 years or so, countries have faced international pressure to conform to human rights standards in order to enjoy legitimacy. However, there is a huge gap between what is legalized as “human rights” in domestic laws and what is set forth as “human rights” in international human rights instruments. Based on this presupposition that a proper incorporation of human rights on (...) the books is a prerequisite for putting them into practice, this study by adopting a Systems Thinking approach seeks to show that law as a soft system on the books is more than the name and number of rights. It is a complex whole whose function depends on not only the name and number of rights but also different features of rights and the relationships between them. To this end, law is conceived as a system of rights that has five major features including the “frame of reference,” “scope of rights,” “orientation of rights,” “enforceability of rights,” and “realizability of rights.” The way of codification of human rights with respect to each of these features makes a big difference in implementing human rights in practice. To develop a heuristic devise for evaluating the situation of human rights in current legal systems, the conceptual space of law as a system of rights is depicted in a matrix called a “Rights Fabric Matrix.”. The ambiguous development trend of cultural globalization brings both opportunities and challenges to China’s cultural development. English major in colleges and universities, a discipline of cross-cultural education, should look at the cultural communication of the target country dialectically based on the national consciousness of the home country. Since the end of the 20th century, administrators and scholars have paid attention to critical thinking, critical cultural awareness, and critical skills in cross-cultural communication, which are important components of (...) the cross-cultural meaning system. Therefore, all these are collectively referred to as critical cross-cultural literacy. On the basis of the research paradigm of systemic functional linguistics, a language is a semiotic system that creates meaning. Thus, to help students construct and improve their individual CCCL repertoire, teachers need to guide them to critically study and analyze the discourse purpose of the textbook author as well as their language methods and strategies to enrich their meaning potential. In this paper we investigate ignorance in relation to our capacity to justify our beliefs. To achieve this aim we specifically address scientific misconceptions, i.e. beliefs that are considered to be false in light of accepted scientific knowledge. The hypothesis we put forward is that misconceptions are not isolated false beliefs, but rather form part of a system of inferences—an explanation—which does not match current scientific theory. We further argue that, because misconceptions are embedded in a system, they cannot be (...) rectified simply by replacing false beliefs with true ones. To address our misconceptions, we must rather act on the system of beliefs that supports them. In the first step of our analysis, we distinguish between misconceptions that are easy to dispel because they represent simple errors that occur against the background of a correct explanatory apparatus and misconceptions that are, on the contrary, very difficult to dispel because they are the product of pseudo explanations. We show that, in the latter case, misconceptions constitute an integral part of an incorrect explanation and the reasons that support such misconceptions are deeply misleading. In the second step, we discuss various approaches that have been adopted to address the problem of misconceptions. Challenging the notion that directly addressing and criticizing specific misconceptions is an effective approach, we propose that critical thinking is the most fruitful means to deal with misconceptions. We define the core competences and knowledge relevant for the practice of critical thinking and discuss how they help us avoid misconceptions that arise from accepting beliefs that form part of a mistaken explanation. In this classic work, now appearing in English for the first time, Claudia Moatti analyses the intellectual transformation that occurred at the end of the Roman Republic in response both to the political crisis and to the city's expansion across the Mediterranean. This was a period of great cultural dynamism and creativity when Roman intellectuals, most notably Cicero and Varro, began to explore all areas of life and knowledge and to apply critical thinking to the reassessment of tradition (...) and the development of a systematic new understanding of the Roman past and present. This movement, linked to the development of writing, challenged old forms of authority and adhesion, belief and behaviour, without destroying tradition; and for this reason this rational trend can be described not as a cultural but as an epistemological revolution whose greatest achievement, Professor Moatti argues, was the development of the system of Roman law. Encouraging students to apply classroom knowledge in their personal, everyday life is a major problem confronting many teachers of critical thinking. For example, while a student might recognize an ad hominem argument in a classroom exercise, it is quite another thing for him or her to avoid the same in interpersonal relations, say with parents, siblings, and peers. One approach to this problem is the creation of interaction software to which students can turn for input on the rationality (...) of their own thinking. Students can then speak to computers rather than instructors about their private lives without having to share confidential information with any other human being, yet still receive relevant feedback. I discuss software technology that actually performs this function. The software in question is an interactive, artificial intelligence program that checks beliefs for faulty thinking, including inductive and deductive errors. The system "scans" student essays for possible fallacies; asks questions at relevant junctions; provides individualized feedback on fallacies committed; provides summaries of fallacies found; diagnoses thinking problems; issues recommendations; and provides other pertinent information. Considerations arising in the context of burgeoning concerns about the environment can provoke an exploration of issues that have significance both for environmental education in particular and education more generally. Notions of the ‘greater whole’ and ‘systemic wisdom’ that feature in some strands of environmental discourse are a case in point. It is argued that interpretations of these notions arising in currently influential scientific and systems thinking understandings of nature that attempt to overcome a corrosive separation of humankind (...) and nature through a dilution or dismissal of the distinction between the human and non-human, self and other, require critical evaluation if they are not to bring their own dangers. Merleau-Pontian understandings of object constitution in a subjectively informed life-world and ideas of the ‘selving’ of natural things are drawn upon in developing a non-discursively grounded interpretation of systemic wisdom. The latter is taken to raise questions that have considerable transformative potential for conventional views of knowledge and its curriculum organisation. (shrink)

To develop students’ critical thinking is one of the primary goals of a modern democratic school system. However, what is to be developed has been the matter of long-standing debate. One particular area of conflict has been what role is played by the knowledge concerning the object to be critically thought about. The ‘specifists’ have asserted that knowledge about the object is the core. The ‘generalists’ have claimed that there is no need for any actual profound knowledge. Typically, (...) this debate has been held at a theoretical and philosophical level. In this paper, I will make an empirically based contribution to the debate. In a unique approach, I will use a number of student essay responses to argue in favour of a specifist view, and at the same time to question some of the generalists’ basic assumptions. The paper ends with an appeal to the generalists to provide us with proper clarification regarding the questions I raise. This is important as they hold the dominant position in the field. If they are to continue to do so, we need to be clear about the accuracy of their basic assumptions. This becomes even more essential as the generalist research has been severely criticised for producing inconclusive results, as well as the fact that the generalist view on critical thinking has been adopted by major policymakers both in Europe and the United States. After outlining arguments for the general epistemological presumption in favour of taking into consideration alternative perspectives from other cultures, the article details several examples in which such an examination yields epistemic benefits and challenges. First, our example of alternative conceptions of art demonstrates that a western conception of art as disinterested contemplation cannot be accepted as a general characterization in that it does not adequately characterize the practice of many traditional societies. Second, the case of aboriginal justice reveals assumptions embedded (...) in the North American criminal justice system regarding justice as fairness, and suggests an alternative based on restorative justice. The third example is from Traditional Chinese medicine. While alternative herbal remedies can be tested according to shared standards of health improvement, practices such as acupuncture are more epistemologically challenging in that they cannot readily be explained by current scientific theories. The final example deals with the failed attempts to replace the traditional Balinese agricultural methods with modern farming practices, and shows how the traditional methods yielded practical insights which were ignored by western experts because of their spiritual origins. Finally, the article attempts to extract some general considerations from the above examination. (shrink)

We need to start to converse about Africa's problems and challenges with the inclusion of hope as an ontological need for change. Withoug hope, there will be no possibility to struggle on. Hope is an important variable in the way we wish to think, talk, reason, debate and mount intellectual reflection about Africa Re-thinking African development through innovation, social-invention, systems mental images and the logocentric imagination of the productive Africa-nation, and not through market exchange, Smithian or Ricardian comparative advantage can generate a hopeful departure from received approaches to theorising about Africa. The making of African productive power, building the capital of the mind, organising institutions within the progressive imagination of the Africa-nation is a critical launching pad for a new intellectual and research orientation hihgly needed when Africans want to make their history with the revival of the Pan-African ideal and the African renaissance. The article proposes that the national system of innovation provides the metaphor of hope, the heuristics of what is significant data to investigate, and the criticism of conventional and pessimistic theorising and finally the emancipatory knowledge resources for a post-pessimist turn to bring about the cognitive praxis of a post-colonial liberation of Africa as a whole. After more than 15 years of study, the 1/f noise or complex-systems approach to cognitive science has delivered promises of progress, colorful verbiage, and statistical analyses of phenomena whose relevance for cognition remains unclear. What the complex-systems approach has arguably failed to deliver are concrete insights about how people perceive, think, decide, and act. Without formal models that implement the proposed abstract concepts, the complex-systems approach to cognitive science runs the danger of becoming a philosophical exercise in (...) futility. The complex-systems approach can be informative and innovative, but only if it is implemented as a formal model that allows concrete prediction, falsification, and comparison against more traditional approaches. This paper discusses the role of Law and Legal Thinking in Critical Theory with specific reference to the arguments that Michael Hardt and Antonio Negri offer in their book Commonwealth. The core idea is that Critical Theory is no less radical, but much more concrete, when it is performing not only an external, but also an internal critique of the Law. It shows that the role of the law in critical theory emerges as a problem when (...) the latter claims that ‘there is no outside’ and that ‘the legal base of the system structures our lives.’ It then discusses optimistic and pessimistic strategies to overcome the problem, and argue for a demanding strategy which consist in articulating the external and the internal critique of the law. To make this point, the paper goes back to the epistemic context in which critical attitudes are deployed (the ‘Conflict of the Faculties’), describes the four theoretical moves constitutive of the historical moment in which, at the end of the 18th Century, modern law as we know it was conceived of and founded; and sketches the key moments of the history of the internal critique of the law. It then illustrates the demanding strategy with examples taken from the field of Intellectual Property, and concludes that the Law is malleable and open enough to allow the thinking and practicing of radical alternatives from within the legal system and also that alternatives spoken in the language of the law are no less radical, but certainly, more concrete than others. The purpose. Critical social philosophy of education strives to provide a radical critique of existing models of education in the so-called Western models of democracy, creating progressive alternative models. In this context, the proposed integrative metatheory, which is based on classical and modern sources, concepts, aims for a comprehensive understanding and reconstruction of the phenomenon of education. One of the main tasks in the sphere of education’s democratization today, therefore, is to bring to education the results of restructuring and (...) democratization of the society, to reflect changes in conditions of life and thinking, experience and transformation of subjectivity in the context of the technological revolution and globalization. Methodology. The critical social theory, which developed in the framework of contemporary neo-Marxism, indicates the need for a thorough analysis of society, however, unlike other theoretical concepts and research programs in order to analyze not a fixation and a statement of the existing social givens. On the contrary, critical analysis of society involves the identification of existing antagonistic, alienating factors that distort public communication.The subject of social analysis is the whole sphere of human and non-human nature, which interacts a person depend on it, the whole system of relations between society and nature, society and man, which is covered by the historical practice of conscious – "praxis". The representative of "pure science" isn't the learning, research subject. He is a public a person, which is the totality of all social definitions included in society and its constituent individuals. For such a "total subject" Object of interest is not something external; on the contrary, the latter appears as a product of his own activity. The scientific novelty examines trends in educational institutions and models of globalizing society in the context of our particular relationship of education and society, man and the state, and processes. The research and systematic analysis of neoliberal reforms at the level of society in general and education in particular are conducted. It examines substantive, structural and functional characteristics of the concept of «critical social philosophy of education» in the context of institutional tendencies of social life, as well as forms and possibilities of its methodological application. It consider a model of «critical social philosophy of education», as embodied in the programs of social development and learning, which are primarily designed to teach people how to lead an independent and original research themselves, society and knowledge systems. However, it is proved that the models and programs should not be cut off from any individual and the collective system of moral and social values, theoretical and applied training, nor from further use of the acquired values, norms and skills in everyday life, science, or in production, sphere of all social institutions. Conclusions. Critical philosophical, educational, pedagogical-psychological surprisingly theory, its models and concepts seek to redefine public and private and the public mind. Based on these grounds, in the future, it allows philosophy of education to develop a more inclusive philosophical vision of education, to apply directly to the problems of democratization and changes in social relations in the direction of equality and social justice in the field of education. The point of view of socio-philosophical and philosophical-еducational, pedagogical-psychological, normative understanding and social critics also requires the use of active efforts in the reconstruuction of education and society, the social vision of what education and human life can be and what their specific limitations in existing societies.
