Feminist opposition to the use of cohabitationcontracts for the private regulation of personalrelations has been predicated on the classical readingof contract as commerce. On this reading,cohabitation contracts construct cohabitants'obligations as commercial and typically detrimental towomen because of their weaker bargaining power. Butthe premisses of classical contract theory are beingundermined by radical critiques which emphasize theimportance of relationality in the reading ofcontract. On such critiques, the obligationsconstructed by cohabitation contracts need no longerexclude considerations of the parties' differentfinancial status and (...) social circumstances. Theconstruction of cohabitants' obligations canaccordingly foreground fairness and equality, both indrafting and in enforcing cohabitation contracts. Inthis way, the conceptualization of contract asrelationality encourages the use of cohabitationcontracts as progressive mechanisms for thedemocratization of personal relations. (shrink)

In 2004, the U.K. parliament passed the Civil Partnership Act which provides a scheme to enable same-sex couples to obtain formal recognition of their relationships through the registration of a civil partnership. When the Civil Partnership Bill was making its way through parliament, attempts were made in the House of Lords to derail the Bill through amendments seeking to extend the Bill to certain familial relationships of care and support. In order to counter these attempts and to facilitate the removal (...) of the amendments, the government gave the assurance that the matter of the economically vulnerable cohabitant would be referred back to the Law Commission for England and Wales for review. Consequently, in July 2005, the Law Commission commenced its project on cohabitation. This paper seeks to examine models of reform (such as the one proposed by the Law Society of England and Wales in its 2002 Cohabitation report) as well as those introduced in other Commonwealth countries. The aim is to identify some of the crucial questions that the Law Commission will need to give careful consideration to if they are to make recommendations that will provide a more radical approach to this area of the law, rather than adopt the more conservative approach of including cohabitation in ‘piggy back’ mode on the marriage model. The cohabitation theory is a popular solution to the problem of personal fission. It affirms that all the people who result from fission were there cohabiting the pre-fission body all along. Adopting this solution is an uncontroversial move for four-dimensionalists, but is it open to three-dimensionalists too? The present paper will summarise the methodology, the scientific outcomes, and the potential for generalisation of the model of a project that studied cohabitation between human inhabitants and liminal species (in the present case, corvids) in Tartu, Estonia, from October 2021 to July 2023, with a comparative field study in Paris, France. It will present the context and goals of using a semiotic model to map interspecific cohabitation, expose what kind of data can be used to feed the (...) model in a relevant way and how it was done in the case of this project. This paper will present how the model diagnosed issues in cohabitation, both from material nuisances and cultural aspects, insisting on the concept of “hostile minority” that emerged from the study. It will discuss the importance of problem-solving in interspecific cohabitation, what the model suggested regarding this aspect, how this tool can be generalised to a large variety of cases and why it should be used this way. Understanding risk factors for relationship dissolution and poor relationship adjustment among couples has been an active area of research in relationship science. One risk factor, non-marital cohabitation, has shown to predict higher rates of relationship dissolution and relationship instability in some samples, but the associations among German parents with children over time are less clear. In this study, we examined the links between non-marital cohabitation and 10-year outcomes in 220 German families with preschool-aged children at the initial assessment (...) followed into adolescence. Families were assessed 7 times over the 10 years and retention at the 10-year follow-up was over 92%. After accounting for multiple testing, only mother’s report of better initial interparental communication predicted whether parents were likely to stay together over the course of the 10 years. Adolescents of parents who cohabited were at higher risk for externalizing symptoms 10 years later compared to children of married parents. In addition, although there were no differences between cohabiting couples and married couples at the initial assessment in relationship adjustment, cohabiting mothers who stayed with their partner over the 10 years showed significantly greater declines in relationship adjustment over the 10 years compared to married mothers. Findings indicate the need for further research that explores family structure and dynamics over time to inform refinement of prevention programs targeting relationships and children’s mental health. Empirical research in this field has underlined the diversity of the cohabitation population, the existence of the common law marriage myth and the lack of consensus on the best way forward for reform of the law in England and Wales. Against the backdrop of the English Law Commission’s on-going project on cohabitation law, this article will explore the reasons found by recent research for people’s choice of cohabitation over marriage, the interrelationship between commitment and economic vulnerability and (...) the tension in feminist debates as to whether an extension of rights for opposite-sex cohabitants that are analogous to married spouses (either by an opt-in model or opt-out model) might be an appropriate solution or a reinforcement of patriarchal marriage values. It will also consider, given recent research findings and other initiatives aimed at raising awareness about the legal differences between different styles of cohabitation relationship, law’s dual and conflicting role in shaping regulated family structures whilst both protecting vulnerable family members inside and outside such structures and at the same time also offering socially acceptable standards of dispute resolution in this most personal of spheres. This article is based on interviews with a small number of cohabitants who are critical of conventional marriage. It examines some of the ways in which the distinction between heterosexual cohabitation and marriage is rendered in the New Zealand context. Culturally available distinctions, like that between cohabitation and marriage, are used in the production of resistant counterdiscourses. However, difference can be rewritten as deviance and in this form is central to the exercise of disciplinary power. Contextual shifts in (...) the assertion of a cohabitational self and a marital self contribute to the blurring of the distinction, further exposing the dilemmas of resistance based on difference. I aim to show that there are cases in which an ordinary material object exists intermittently. Afterwards there are a few words about the consequences of acknowledging such cases, but what is of more interest is the route by which the conclusion is reached. When deciding among competing descriptions of the cases considered, I have tried to reduce to a minimum the role of intuitive judgment, and I have based several arguments on "metaphysical principles," two of which I have defended.

Starting from a specific case, the spontaneous return of wolves to France and the intense conflicts that event has triggered, the French philosopher Baptiste Morizot invites us to think about what he calls "diplomacy with living beings." How can we conceive of cohabitation with the most recalcitrant wildlife, large predators in particular, and what concrete solutions need to be invented to make this happen? Drawing on knowledge gleaned from history and philosophy as well as from ethology, scientific ecology, and (...) biology, Wild Diplomacy prompts us to ask what relations we want to reinvent with living beings today and how we might fundamentally reimagine our status as living beings among other life forms. Cohabiting has been associated with a number of problems including sexually transmitted diseases and HIV and AIDS, abortions, sexual abuse and violence, low academic performance, increased cost of medical care and unwanted pregnancies. However, there is little documented information on the extent and the factors influencing cohabitation among the youth and especially among tertiary education students. This study therefore sought to fill this gap by investigating factors that lead to the prevalence and practice of cohabitation by tertiary education (...) students. The research adopted the interpretivist philosophy. The qualitative research methodology was employed in order to understand in greater detail the behaviors, attitudes, opinions, and beliefs of the respondents on cohabitation among tertiary education students. The study used the survey research design. Primary research was conducted using questionnaire surveys that were administered to tertiary education students who participated at the Tertiary Education Sports Association of Zimbabwe in July 2016. There were 100 questionnaires distributed and 78 questionnaires were returned making 78% response rate. The respondents were randomly sampled to participate in the study. The study reflects that cohabitation among the Tertiary education students is quite common. The study noted that it is mostly caused by lack of accommodation, problems with roommates, lack of privacy and the need to be close and intimate with one's lover. In results cohabitation exposes students to premarital sex and other consequences such as unwanted pregnancies, abortion, complications and sexually transmitted infections. The study recommends that tertiary education students should be enlightened during orientations about the dangers of cohabitation. Parents should be encouraged to visit their children and find where and whom they live with while in school. (shrink)

David Lewis's cohabitation theory suffered damaging criticism from Derek Parfit. Though many have defended versions of Lewis's theory Parfit's criticism has not been answered. This paper shows how to defend the cohabitation theory against Parfit's criticism.

This Article argues that U.S. law should give protection to relationships between cohabitants and their partners’ children when necessary to avoid the economic and emotional trauma that may be caused by separation of the child from a member of his or her household if the cohabitation ends. After examining the social science literature about the welfare of both stepchildren and children of cohabitants and the inadequate legal treatment of custody, visitation, and child support issues under current law, the author (...) recommends that cohabiting stepparents be given standing to seek custody if they have acted as de facto parents, with a presumption in favor of custody by the stepparent when the cohabitant who is the child’s biological parent has died and the possibility of joint custody in other cases; be awarded visitation if both the ex-cohabitant and child desire it; and be obligated to pay child support for the child if the cohabitation dissolves after a period of two years or more. This study investigates how individuals’ life satisfaction and depression are affected by the dissolution of a steady non-cohabiting intimate relationship. Previous studies have focused more on the consequences of divorce and less on the influence of non-cohabiting relationships on the well-being of the individual. The data for this study were taken from pairfam, a large-scale German panel survey, and were used to estimate fixed-effects panel regression models and impact functions to identify the overall effect of dissolution and trajectories after separation. (...) The study sample comprised 2,631 individuals who were observed over the course of 11,219 partnership years. Based on the results of this study, three main findings were reported. First, the dissolution of a non-cohabiting relationship led to a significant decline in mental health and life satisfaction. Second, the trajectories after dissolution suggest that the decline was only temporary, showing readjustment after 1 year. Third, gender differences were identified, suggesting worse consequences for men who experienced a significant decline in both dimensions and did not readjust in life satisfaction until several years after the dissolution. For women, decreases were only found for life satisfaction, but quick readjustments were observed. (shrink)

Rebecca Roache’s recent critique of David Lewis’s cohabitation view assumes that a person cannot be properly concerned about something that rules out that she ever exists. In this brief response, I argue against this assumption.

Under the Second Demographic Transition, alternative forms of living arrangement are on the rise. The aim of this article is to compare quality of life in children living in married and cohabiting families. We present the results of representative research conducted in Slovakia in 2018 (N = 1,010 respondents). We tested whether children brought up in traditional married families had better material resources and healthcare, fewer behavioural problems, better peer relations and spent more leisure time with their parents than children (...) brought up by cohabiting parents. We also investigated whether number of children in the family and net monthly household income affected the children’s quality of life. The results show that there were almost no differences in quality of life between children brought up by married and by cohabiting parents and that number of children in the family and level of net monthly household income affected only the child’s material resources. La traduction est inséparable de l’histoire d’un peuple, de sa culture passée et présente, de la dimension politique qui, en définitive, délimite les cadres juridiques et sociaux où se déploie l’activité des personnes, mais aussi marque l’opinion et le débat idéologique dans une démocratie. Alors que la planète s’achemine vers le plurilinguisme d’une mondialisation économique et culturelle, en Catalogne, la politique se trouve en partie prise dans un combat visant à faire du catalan une langue majoritaire, voire, pour les nationalistes (...) radicaux et indépendantistes, la seule langue officielle. Dans un tel contexte, la traduction depuis et vers le catalan constitue le moyen culturel stratégique d’une revendication identitaire face à la langue de Cervantès. La question de la traduction et, plus précisément, celle de la langue catalane est inévitablement perçue comme politique, ce qui, d’une certaine manière, tend à laisser la réalité linguistique occultée derrière le contexte historique que la Catalogne a connu.Translation is inseparable from the history of a people, its culture past and present, and its political dimension which, ultimately, frames the legal and social context in which individuals act, but also sets its stamp on public opinion and ideological debate in a democracy. As multilingualism marches onward in an economically and culturally globalised world, politics in Catalonia have been caught up in a struggle to make Catalan the majority language – or, for radical nationalists and independence activists, even the only official language. In this context, translation from and into Catalan has become a strategic cultural vehicle for claims opposing Catalan identity to the language of Cervantes. The question of translation and, more specifically, translation of the Catalan language is inevitably perceived as political, so that the linguistic realities tend to be overshadowed by the historical context as experienced in Catalonia. The present article will introduce a proposition of semiotic methodology that can be used to diagnose cohabitation issues in cities between human inhabitants and non-human liminals. This methodology is built on a few sets of data that should be easy to obtain in any important city, and can therefore be utilised in a variety of situations. The different sets of data allow us to map the cohabitation semiosphere (following Hoffmeyer’s meaning of the term) of the situation along three (...) axes: the materiality of the situation, the symbolic significance of the relationship, and the emotional significance of the interaction. These three aspects allow us to see gaps, paradoxes and points of consistency, enabling complex and multi-level understanding of the situation. (shrink)

In this article, I examine the legal position of those who perform caregiving work within the context of a cohabiting relationship through a novel relational vulnerability lens. I argue that the state, through privatising and devaluing caregiving labour, situates carers within an unequal and imbalanced relational framework, exposing them economic, emotional, and spatial harms. Unlike universal vulnerability, which is inherent and unavoidable, relational vulnerability can be avoided and reduced if the state were to acknowledge that humans are embodied and relational (...) rather than self-sufficient and rational. Law’s treatment of cohabiting carers reflects the state’s broader tendency to value economic self-sufficiency, while confining caregiving to the private family. I argue that the state has a duty to respond directly to relational vulnerability and should aim to make cohabiting carers resilient. Resilience must involve the provision of material resources but should also have a normative commitment to achieving autonomy and equality for those marginalised by law and state policies. (shrink)

La globalisation qui devait ouvrir le monde conduit à un défi inverse: gérer le retour des identités et la diversité culturelle. Il s'agit maintenant de créer une autre mondialisation associant humanisme universaliste et respect des identités. Or, il apparaît que le cadre politique traditionnel est le plus apte à permettre de respecter cette diversité culturelle. Il doit donc être préservé pour assurer la protection non seulement sociale mais aussi culturelle. Si les pouvoirs européens sous-évaluent la question des identités et ne (...) prennent pas en charge la gestion de la diversité culturelle, on risque de déboucher sur les pires des communautarismes, comme on l'a vu en Bosnie et ailleurs. La prise en compte des identités concerne aussi l'ensemble des populations migrantes, dont on doit valoriser les apports culturels au lieu de les ignorer. Par ailleurs, afin de faciliter la cohabitation culturelle, il faut promouvoir une « laïcité de tolérance » dans laquelle la gestion politique serait totalement autonome par rapport aux croyances religieuses. Dans tous les cas, le respect de la diversité culturelle exige donc une revalorisation et une indépendance de la sphère politique.Globalization which would open up the world leads to challenge reverse handle the return of identities and cultural diversity. It is now creating another globalization combining universalist humanism and respect for identities. However, it appears that the traditional political framework is the most suitable to meet this cultural diversity. It must be preserved to protect not only social but also cultural. If the European powers undervalue the question of identities and do not take responsibility for managing cultural diversity, is likely to lead to the worst of communitarianism, as we have seen in Bosnia and elsewhere. Taking into account the identities also concerns all migrant populations that must develop cultural contributions instead of ignoring them. In addition, to facilitate the cultural coexistence, we must promote a "secular tolerance" policy in which management would be totally independent of religious beliefs. From a gender perspective, female immigrant domestic caregivers have been particularly impacted during the COVID-19 pandemic: first, as female immigrants, and second, due to their work within the domestic care sector, which has been so badly affected in this pandemic. This study investigates the emotions and experiences of 15 female Latin American immigrant domestic workers, caregivers in five Andalusian cities who were cohabiting with their employees/patients during the COVID-19 pandemic lockdown, using qualitative research through in-depth interviews and life stories. The (...) results show the moral debt accrued by the caregivers with the family who employ them, while worsening the physical and psychological health of many of the caregivers, due to both work overload and fear of the global pandemic.
