Companies that are serious about corporate governance and business ethics are turning their attention to gender diversity at the most senior levels of business . Board gender diversity has been the subject of several studies carried out by international organizations such as Catalyst , the World Economic Forum , and the European Board Diversity Analysis . They all lead to reports confirming the overall relatively low proportion of women on boards and the slow pace at which more women are being (...) appointed. Furthermore, the proportion of women on corporate boards varies much across countries. Based on institutional theory, this study hypothesizes and tests whether this variation can be attributed to differences in cultural settings across countries. Our analysis of the representation of women on boards for 32 countries during 2010 reveals that two cultural characteristics are indeed associated with the observed differences. We use the cultural dimensions proposed by Hofstede to measure this construct. Results show that countries which have the greatest tolerance for inequalities in the distribution of power and those that tend to value the role of men generally exhibit lower representations of women on boards. The paper aims to explore the relationships that exist between party structure, party system, patronage, and the appointments of the political elites. It is focused on the extent to which political parties can control the allocation of jobs as well as find out which are the institutions over whom the political parties can exercise power; the extent to which historical legacies influence patronage patterns; the extent to which party patronage is exercised in a ‘majoritarian’ as opposed to a more (...) ‘consensual’ manner across the spectrum of political parties; and the relationship that exist between the structure of the party, the appointment of political elites and patronage. The conclusion is that the party in public office and its allies in the coalition cabinet control the post of ministers and vice-ministers. While these last ones control the posts of their subordinates, it is hard to understand whether they select the employees from the party pool or from their personal networks. The other finding is that the structure of the party creates strong links between patronage and appointment, these last ones done with the scope of having control over government resources and distribution of resources. Objective—To determine the prevalence of, and attitudes towards, observed and personal research misconduct among newly appointed medical consultants. Design—Questionnaire study.Setting—Mersey region, United Kingdom.Participants—Medical consultants appointed between Jan 1995 and Jan 2000 in seven different hospital trusts (from lists provided by each hospital's personnel department). Main outcome measures—Reported observed misconduct, reported past personal misconduct and reported possible future misconduct.Results—One hundred and ninety-four replies were received (a response rate of 63.6%); 55.7% of respondents had observed some form of research misconduct; 5.7% of (...) respondents admitted to past personal misconduct; 18% of respondents were either willing to commit or unsure about possible future research misconduct. Only 17% of the respondents reported having received any training in research ethics. Anaesthetists reported a lower incidence of observed research misconduct (33.3%) than the rest of the respondents (61.5%) (p<0.05). Conclusion—There is a higher prevalence of observed and possible future misconduct among newly appointed consultants in the UK than in the comparable study of biomedical trainees in California. Although there is a need for more extensive studies, this survey suggests that there is a real and potential problem of research misconduct in the UK. (shrink)

While the final outcome is uncertain what is most probable is that a new barbarian capitalism will prevail: many old and weak will be sacrificed and let to die, workers will have to accept much lower standards of living, digital control of our lives will remain a permanent feature, and class distinctions will become much more than now a matter of life and death. For decades historians of science and science writers in general have maintained that Charles Darwin was not the ‘naturalist’ or ‘official naturalist’ during the 1831–1836 surveying voyage of HMS Beagle but instead Captain Robert FitzRoy’s ‘companion’, ‘gentleman companion’ or ‘dining companion’. That is, Darwin was primarily the captain’s social companion and only secondarily and unofficially naturalist. Instead, it is usually maintained, the ship’s surgeon Robert McCormick was the official naturalist because this was the default or official practice at the time. (...) The power to appoint judges and the formal procedure for judicial appointments in Nigeria have been examined by writers, particularly in the context of separation of powers. Shortcomings in the conduct of some judicial officers and the poor performance of some courts continue to generate questions about the suitability of the current appointments process in the quest for a sound judiciary founded on integrity and competence. The article argues that what is missing is due regard for ethics in (...) the appointments process. This point, often overlooked or down played by writers, should be considered by the key players in the appointments process. Abstract:This article uses a large corpus of previously understudied documents—i.e., appointment edicts of medieval China—to reveal how real-time negotiation between the imperial court and its provincial officials gave rise to two sophisticated theories of political reciprocity that impose limits on the sovereign. The first, well-studied in existent scholarship, claimed that the ruler was obliged to appoint worthy officials to promote the well-being of the commoners. Clinicians are often called upon to assess the capacity of a patient to appoint a healthcare agent. Although a consensus has emerged that the standard for such assessment should differ from that for capacity to render specific healthcare decisions, exactly what standard should be employed remains unsettled and differs by jurisdiction. The current models in use draw heavily upon analogous methods used in clinical assessment, such as the “four skills” approach. This essay proposes an alternative model that relies upon categorization (...) and sliding scale risk assessment that can be used to determine to how much scrutiny the proxy appointment should be subjected and how much certainty of accuracy should be required in order to maximize the patient’s autonomy and ensure that her underlying wishes are met. How should we respond to patients who do not wish to take on the responsibility and burdens of making decisions about their own care? In this paper, we argue that existing models of decision-making in modern healthcare are ill-equipped to cope with such patients and should be supplemented by an “appointed fiduciary” model where decision-making authority is formally transferred to a medical professional. Healthcare decisions are often complex and for patients can come at time of vulnerability. While this does not (...) undermine their capacity, it can be excessively burdensome. Most existing models of decision-making mandate that patients with capacity must retain ultimate responsibility for decisions. An appointed fiduciary model provides a formalized mechanism through which those few patients who wish to defer responsibility can hand over decision-making authority. By providing a formal structure for deferring to an appointed fiduciary, the confusions and risks of the informal transfers that can occur in practice are avoided. Finally, we note how appropriate governance and law can provide safeguards against risks to the welfare of patients and medical professionals. -/- . (shrink)

Increasing the participation of women in top-level corporate boards is high on the agenda of policy-makers. Yet, we know little about director appointment dynamics and the drivers and impediments of women appointments. This study builds on organizational and group-level behavior theories and empirically investigates how ex-ante board structures and gender-specific board dynamics impact the representation of women on corporate boards. We study boards of listed firms in Europe between 2002 and 2019 and find a declining appointment probability for every (...) additional woman, i.e., the share of women already on the board negatively predicts the likelihood of additional women appointments. Further, we find evidence of a replacement effect, i.e., the likelihood of a woman being appointed as director is significantly larger when a woman, compared to when a man, leaves the board. We do not find spillover effects from non-executive to executive boards. These results are robust to econometric model specifications that address potential endogeneity concerns using matching and instrumental variables. Our results confirm that board director appointments are gender specific and suggest that demand-side factors such as explicit and implicit norms drive women appointments up to a certain threshold. This article examines state-church relations in Sweden by analysing clerical appointment processes in the latter part of the 16th century. The aim is to ascertain whether the king of Sweden could appoint pastors independently, and if not, with whom he was compelled to share the power. Earlier studies argue that the power of the king grew due to the reformation. First, this article examines the number of clerical appointments that were made in the period 1560-1611. The results reveal a (...) remarkable annual variation in the number of clerical appointments. Second, the timing and share of clerical appointments made by the king are studied. The number of appointments made by the king is viewed against the total number of clerical appointments so as to reveal the importance of appointments made by the crown. Third, the article examines the proportion of appointments made by other authorities. The results suggest that the crown’s role in clerical appointment processes varied, but more interestingly, it was not as ubiquitous as earlier researchers suggest. Thus article concludes that crown’s power over the church in 16th century Sweden was not as vast as it has previously been claimed. (shrink)

Recent years have seen a significant increase in stakeholder pressure on firms to be not only economically sustainable but also from an environmental and social perspective. Besides operational changes in practices and products companies have reacted toward this increased pressure from a strategic perspective through structural changes of their top management team. A recent addition to the TMT has been the appointment of the chief officer of corporate social responsibility. In this paper, we take a behavioral perspective and investigate how (...) the employment of a chief officer of CSR to the TMT impact on firm performance. Specifically, we explore how certain characteristics of the newly appointed chief executive of CSR impact on a firm’s financial performance. We collected secondary, longitudinal data of listed companies in the United States. Results indicate that appointing a chief executive of CSR does under certain conditions and characteristics result in financial performance benefits. Furthermore, the greatest financial performance benefits can be achieved if the appointee is female and has a CSR functional background. (shrink)

In this paper, I will characterize a phenomenon I call ‘self-appointed speaking-for’, and show how it constitutes a counter-example to Miranda Fricker’s definition of testimonial injustice (TI), expanding our understanding of the category. Self-appointed speaking-for occurs when one speaks on behalf of or in place of another individual or group without their authorization. It is the sort of phenomenon that occasions complaints like, ‘You put words in my mouth’; that happens when someone else answers a question directed at you; or (...) when someone purports to represent the perspective of a group they are not affiliated with or entitled to represent. I argue that this is a central case of Fricker’s testimonial injustice, on the grounds that it inflicts the same harms as other kinds of TI — particularly demeaning someone in their capacity as a giver of knowledge — in a way that is both epistemically and ethically culpable. TI is wrong not only for the harms it generates but also because its cause — prejudice — is ethically wrong and bad epistemic practice. As I show, self-appointed speaking-for is wrong for the same reasons as prejudice is, no matter what motivates it. (shrink)

Theorists such as Jussi Parikka, Jakob von Uexküll, Eugene Thacker, Sadie Plant, and others have utilized the figure of the insect as a particularly salient way of reading the materialization of information. Certain affinities of insect anatomy and behavior with technology aesthetically collude with technologies of communication. But is such use of the insect figure merely metaphorical, or does it drag with it other aspects of the insect body and its bearing on the physicality of information? In either case, the (...) notion of the insect body proves an interesting point for recognizing a tension between communication and language in contemporary posthuman discourse. As Lacanian psychoanalysis is invested in this difference, and in unfolding the post-, in-, or non-human human the human, a guiding question issued to Lacan in the name of the insect body could be: Did he have a vested interest in the non-discursive or “primordial” materiality of the world other than as an instructive disruption of language? In other words, does materiality have a role in his theories other than that of the speaking of/as the symptom, thereby cutting through, but ultimately mutating, communication? (shrink)

The judicial appointments regime in England and Wales is unbalanced. The pre-2005 appointments regime conferred excessive discretion on the Lord Chancellor, but the post-2005 regime has gone much too far in the opposite direction. Today, the Lord Chancellor is almost entirely excluded from the process of selecting lower level judges and enjoys only limited say over the selection of senior judges. In this article I argue that the current regime places too little weight on the sound reasons for (...) involving the minister in individual selection decisions, including the scope for ministerial input to enhance judicial independence, to supply political leadership on judicial diversity and to render more effective the discharge of the Lord Chancellor’s systemic responsibility for the justice system as a whole. I argue that shortlists reconcile the need to more fully involve the Lord Chancellor whilst at the same time ensuring that candidates satisfy a merit threshold. (shrink)

It demonstrates that essential to Confucianism is the concept of three contracts: the contract of mind with oneself, the cultural contract with society and community; and the moral contract with humanity and the universe at large. Confucianism may not be labelled as contractualism. Nonetheless one would not have an adequate understanding of Confucianism without a view of the contractual dimension of Confucianism. Confucianism may not be labelled as realism. However, essential to Confucianism (...) is the idea of the total unity of the self, society, and the world, and the total harmony of heaven, earth, and humankind. (shrink)

No law in any jurisdiction that permits physician assisted dying offers individuals a medically assisted death without the need to comply with certain criteria. The Netherlands is no exception. There is evidence to suggest that physicians are averse to providing an assisted death even when the Dutch ‘due care criteria’ have been met and the unbearable pain and suffering requirement is especially difficult to satisfy. Some individuals with an enduring desire to die who do not meet the ‘due care’ criteria (...) under the Dutch legislation turn to other means of achieving a self-appointed death. This paper explores two alternative methods of securing a self-determined death (an assisted death involving lay assistors or a self-hastened death by stopping eating and drinking), and raises the question of how far the law should recognise autonomy in the context of physician assisted death. There is considerable disagreement as to whether any gender differences on the bench are symbolic, substantive, or both. This paper, based on never-before published surveys and personal interviews conducted in the early 1980s, contributes to that discussion by describing what women appointed to the federal bench by President Carter between 1976 and 1980 had to say about gender differences in their first years in office. I conclude that these early experiences and comments by women on the bench are still relevant (...) today and presage much of the research on judicial gender which has followed. (shrink)
