This paper investigates the scope and limits of parents' and physicians' obligations to anencephalic newborns. Special attention is paid to the permissibility of harvesting anencephalic organs for transplant. My starting point is to identify the general justification for treating patients in order to benefit third parties. This analysis reveals that the presence of a close relationship between patients and beneficiaries is often crucial to justifying treating in these cases. In particular, the proper interpretation of the Kantian injunction against (...) treating persons as means only takes on a different light in the context of special relationships. The implications of this analysis for our responsibilities to anencephalic infants is clarified. (shrink)

Proposals to use organs from anencephalic infants to meet the growing need for transplantable ogans are well‐meaning but misguided. It would be unwise to amend the Uniform Determination of Death Act to classify anencephalics as “dead.” They are in the same situation as other patients (such as the permanently comatose). Likewise, amending the Anatomical Gin Act to permit organs to be removed from anencephalics would be unjust would set a bad precedent and would likely reduce overall success in (...) this field. In recent years, the need for infant organs for transplantation has increased. There is a growing recognition of the potential use of anencephalics as sources of organs. Prevalent arguments defending the use of live anencephalics for organ sources are identified and criticized. I argue that attempts to deny the applicability of the dead-donor rule are either question-begging or based on false premises and that attempts to skirt the Kantian dictum against treating others as a means only are not successful. I (...) contend that the apparent utilitarian justification for live anencephalics as organ sources is unsatisfactory for two reasons: first, because it ignores the undermining effect the policy would have on parental values and sentiments central to social welfare; and second, because attempts to respond adequately to the slippery slope argument against live anencephalic use are unconvincing. This paper reviews objections to the proposal to allow parents of anencephalics to donate their infant's organs for transplantation and finds them unpersuasive. Instead, interpretations of ‘Baby Doe’ legislation, a ‘higher-brain’ functional conception of death, the idea of ‘viability’ in many abortion statutes, and the wishes of many patients, give strong support for the proposal for organ transplantation using anencephalics. On May 24, 1995, the American Medical Association Council on Ethical and Judicial Affairs issued a rather controversial opinion that it is ethically permissible to use anencephalic infants as living organ donors. Approximately 1,000 to 2,000 infants are born each year in the United States with anencephaly, a congenital birth defect whereby the infant has no forebrain and cerebrum. Without higher brain functions, the infants can never experience consciousness, thoughts, emotions, or pain. Fewer than half survive (...) more than a day, and more than 90 percent die within one week. However, by the time brain death occurs in anencephalic infants, their organs are no longer suitable for donor purposes because they have deteriorated beyond use.In 1988, the AMA Council declared that it is ethical to use the infants as organ donors only after they have died. Now the Council has revised that opinion, and it proposes to allow removal of organs before death, as long as the parents consent and two doctors concur in the diagnosis of anencephaly. (shrink)

James Walsh and Moira McQueen accurately conclude that the early delivery of anencephalic fetuses is morally acceptable, but the reasoning they use to reach that conclusion is flawed. First, the principle of double effect does not require a weighing of good and evil, but rather seeks a sufficient reason for tolerating the physical evil indirectly intended. Second, the principle of double effect requires a clear distinction between physical and moral causality. Third, the Catholic moral tradition will not admit direct (...) and intended killing of the innocent. Rather, early delivery of anencephalic fetuses is permissible because of the pathology associated with delivery of anencephalic fetuses at full term. Thus, the early delivery of an anencephalic infant is acceptable if the purpose of the moral act is avoiding a pathological condition on the part of the mother. (shrink)

A comprehensive study of the ethics of killing in cases in which the metaphysical or moral status of the individual killed is uncertain or controversial. Among those beings whose status is questionable or marginal in this way are human embryos and fetuses, newborn infants, animals, anencephalic infants, human beings with severe congenital and cognitive impairments, and human beings who have become severely demented or irreversibly comatose. In an effort to understand the moral status of these beings, this (...) book develops and defends distinctive accounts of the nature of personal identity, the evaluation of death, and the wrongness of killing. The central metaphysical claim of the book is that we are neither nonmaterial souls nor human organisms but are instead embodied minds. In ethical theory, one of the central claims is that the morality of killing is not unitary; rather, the principles that determine the morality of killing in marginal cases are different from those that govern the killing of persons who are self‐conscious and rational. Another important theme is that killing in marginal cases should be evaluated in terms of the impact it would have on the victim at the time rather than on the value of the victim's life as a whole. What primarily matters is how killing would affect that which would be rational for the victim to care about at the time of death. By appealing to various foundational claims about identity, death, and the morality of killing, this book yields novel conclusions about such issues as abortion, prenatal injury, infanticide, the killing of animals, the significance of brain death, the termination of life support in cases of persistent vegetative state, the use of anencephalic infants as sources of organs for transplantation, euthanasia, assisted suicide, and advance directives in cases of dementia. In particular, the book defends the moral permissibility of abortion, infanticide, and euthanasia in certain cases and argues that brain death is not the appropriate criterion of death either for a person or a human organism. El presente trabajo aborda el concepto de Transmodernidad bajo dos puntos de vista diferentes. Por un lado, la mirada de Rosa María Rodríguez Magda, la cual nos plantea la Transmodernidad como una tríada dialéctica entre Modernidad-Postmodernidad-Transmodernidad, siendo esta última tanto una continuación como una superación de la Postmodernidad. El otro punto de vista corresponde a Enrique Dussel, el cual nos plantea la Transmodernidad como un proyecto utópico que es transversal a la Modernidad/Postmodernidad; está antes de la Modernidad y a la (...) vez la trasciende, siendo una categoría de exterioridad que pretende sacar la voz propia de las culturas no europeo-norteamericanas, para así poder establecer diálogos interculturales simétricos que llevan consigo características de la propia cultura inconmensurables al proyecto moderno europeo. Así enfrentamos ambas concepciones de la Transmodernidad para destacar sus diferencias y contraposiciones. (shrink)

Neoclassical economics assumes that individuals have stable and context-independent preferences, and uses preference satisfaction as a normative criterion. By calling this assumption into question, behavioural findings cause fundamental problems for normative economics. A common response to these problems is to treat deviations from conventional rational choice theory as mistakes, and to try to reconstruct the preferences that individuals would have acted on, had they reasoned correctly. We argue that this preference purification approach implicitly uses a dualistic model of the human (...) being, in which an inner rational agent is trapped in an outer psychological shell. This note replies to a comment by Daniel Hausman on our paper ‘Preference purification and the inner rational agent: a critique of the conventional wisdom of behavioural welfare economics’. We clarify our characterisation of behavioural welfare economics and acknowledge that Hausman does fully endorse this approach. However, we argue that Hausman’s response to our critique, like behavioural welfare economics itself, implicitly uses a model of an inner rational agent.

After viral entry into the cell, the nuclear envelope poses a major cellular barrier that needs to be overcome upon adaptation of highly pathogenic avian influenza viruses (HPAIV) to the new host. To ensure efficient viral transcription and replication in the nucleus of the host cell, the viral polymerase complex of avian influenza viruses needs to switch from recognition of avian to mammalian components of the nuclear import machinery. Abstract:This essay performs an anticolonial and poetic methodology of combining Black and Native feminists' deconstruction of metaphor and metaphysics in order to argue for the centrality of colonial metaphor to colonial metaphysics. I combine their analyses of the separate gendered metaphors of Blackness and Indianness and the centrality of these metaphors to the development of a global metaphysics as well as the transference of the terms of metaphysics to whiteness. I then apply this method of combined terms and readings to (...) white colonial writing that compares Black and Native America, which transforms both communities not only into individually potent, gendered metaphors but into an essential poetic pairing, a poetic couplet. Drawing on the work of Black and Native feminists, I further argue that when we take this paired model to evaluate the political concerns of Black and Native America, we come to a more complete and global understanding and refutation of whiteness. The creation, connection, and comparison of the gendered metaphors and archetypical figures of the "African Slave" and "Indian Savage" are important to each other and to the creation of a Western conception of the globe. Colonialism uses gender to compound metaphor's ability to create, by combining metaphors of gender with metaphors of race and colonialism to develop new symbolic amalgamations. This gestalt of metaphors comes together in order to create a fictive European metaphysics used to ameliorate white fears of the diversity of life on planet Earth and to satisfy white desires to control it. In this coupled metaphoric form, Blackness and Indianness are not connected by analogy but by the open-ended cut, the caesura, of poetry and the violence of slavery and conquest. I offer this anticolonial and poetic pairing as a model for political imagining between Black and Native theory. (shrink)

We examine the expressive power of probabilistic context free grammars (PCFGs), with a special focus on the use of probabilities as a mechanism for reducing ambiguity by filtering out unwanted parses. Probabilities in PCFGs induce an ordering relation among the set of trees that yield a given input sentence. PCFG parsers return the trees bearing the maximum probability for a given sentence, discarding all other possible trees. This mechanism is naturally viewed as a way of defining a new class of (...) tree languages. We formalize the tree language thus defined, study its expressive power, and show that the latter is beyond context freeness. While the increased expressive power offered by PCFGs helps to reduce ambiguity, we show that, in general, it cannot be decided whether a PCFG removes all ambiguities. (shrink)

The CRISPR-Cas9 system is a genetic editing technology that, in addition to expanding the possibilities for scientific research, promotes reflections associated with human dignity, biological control, therapy, and genetic improvement. Bioethical discussions on the challenges and repercussions of the CRISPR-Cas9 system are reviewed. As a result, bioethical questions tend to problematize the application to non-human organisms, primary research, and the human somatic and germline. In brief, it is necessary to increase the levels of safety and effectiveness so that the benefits (...) outweigh the risks, while reducing bioethical concerns and increasing the credibility of the technique. En un tiempo de profundas transformaciones, conflictos y resistencias, desde una aproximación filosófico-política, pondremos el foco en la emergencia de la Naturaleza como sujeto de derechos, de los pueblos indígenas y de las mujeres indígenas en los procesos de lucha, negociación y representación, como nuevos sujetos políticos en los distintos niveles de la esfera pública. Desde esta perspectiva, examinaremos la incorporación de la Naturaleza como sujeto de derechos en la Constitución de Ecuador en 2008 y las luchas y métodos del (...) Pueblo Originario Kichwa de Sarayaku (Ecuador), a nivel nacional e internacional, frente al extractivismo petrolífero, atendiendo al papel que desempeñan las mujeres, a su interpretación del Sumak Kawsay (Buen Vivir) y del Kawsak Sacha (Selva Viva), y a sus aportaciones para la resolución de los conflictos ecológicos y políticos. Además de dar a conocer y presentar Sarayaku como un caso ejemplar, se concluye afirmando que la irrupción de estos «nuevos sujetos» nos sitúan ante un nuevo y complejo escenario, interpelándonos desde el Sur Global. En este artículo pretendo argumentar de qué manera el lenguaje es conformador de la experiencia estética y, en especial, cómo el argot involucrado en las vivencias estéticas es indisociable de estas, al operar como uno de sus factores constituyentes. A través del análisis de ejemplos de jerga estética popular, procedentes en su mayor parte del lenguaje juvenil, señalo algunos de los modos en que el argot conforma experiencias estéticas que no existirían sin su intervención. El coraje de la ternura es una aproximación a la obra poética de Julia Valiente que, partiendo de dos poemas de su primer libro, hasta llegar a su producción actual aún inédita, pretende dar cuenta de cómo ha construido una voz propia desde la honestidad de una mirada cuya desnudez nos muestra quienes somos.

En un análisis fenomenológico, la pose aparece como un evento que establece una relación especial entre el cuerpo y la imagen; en dicho evento la intencionalidad se dirige a la resolución del propio cuerpo como imagen. Las distinciones tradicionales entre imagen y esquema corporales, y entre apercepción y apresentación sirven a este estudio para señalar algunos aspectos característicos del acto de posar, pero es el análisis fenomenológico de la recepción y la empatía el que aporta las claves fundamentales.In a phenomenological (...) analysis, the pose appears as an event that establishes a special relationship between body and image; in that event, the intentionality is directed to the resolution of the body itself as an image. The traditional distinctions between body image and body scheme, and between apperception and presentification, serve to point out some characteristic aspects of the act of posing, but it is the phenomenological analysis of reception and empathy that provides the fundamental insights. RESUMEN En su primera investigación, Edith Stein se propuso definir la esencia de la Einfühlung (empatía) como experiencia de la conciencia ajena; pretendía así fundamentar que, como había indicado Husserl, ese acto abría la posibilidad de una intersubjetividad trascendental como solución al solipsismo de la conciencia. Stein halló la clave de esa esencia en la idea de originariedad, pero intentó evitar el problema de la empatía estética, sirviéndose de Los ídolos del autoconocimiento de Scheler. ABSTRACT In her first research project, (...) Edith Stein set out to define the essence of Einfühlung (empathy) as an experience of another's consciousness. Her objective was to justify the fact that such an act opened up the possibility of a transcendental subjectivity as a solution to the solipsism of consciousness, as Husserl had indicated. Stein found the key to that essence in the idea of originariety, but she tried to avoid the problem of aesthetic empathy by resorting to Scheler's Idols of Self-Knowledge. Presentamos las dificultades relatadas por estudiantes de pedagogía de dos universidades latinoamericanas, en el contexto de la pandemia COVID-19. Los datos fueron obtenidos a partir de registros escritos y encuestas respondidas por los estudiantes y analizados a partir de una visión freireana de educación. Los problemas junto con el sufrimiento emocional de los jóvenes revelaron el distanciamiento entre docentes y estudiantes y entre sus pares, lo que impactó su proceso formativo. Una práctica educativa que valore el diálogo y los contextos (...) de intereses y motivaciones de los estudiantes se torna fundamental para su formación académica más humana, integrada y transdisciplinar. El término nuestroamericano —utilizado por Horacio Cerutti— tiene sus fundamentos en el concepto "Nuestra América". Este hilo conductor de pensamiento tiene como hecho ineludible el hacerse cargo de la realidad en que se vive y del lugar en donde se está, hecho expresado en un permanente interés en la identidad cultural y nacional, como también por una lectura crítica y explicativa del desarrollo de las ideas. En el caso de Chile, a nuestro juicio, la memoria filosófica nuestroamericana ha tendido a (...) ser borrada, olvidada, siendo obnubilada por un fuerte eurocentrismo, lo que ha dado como resultado un escaso número de filósofos preocupados por "lo latinoamericano". Así, este trabajo indaga sobre los orígenes de la vertiente latinoamericanista en la filosofía chilena en la segunda mitad del siglo XX. A modo de conclusión, proponemos que no es sino hasta los años ochenta cuando, desde el Círculo de Filosofía de la Academia de Humanismo Cristiano, se genera un punto de inflexión con la tradición filosófica chilena, dando origen de forma más nítida a la vertiente nuestroamericana que, antes de esto, solo habría tenido pequeñas huellas dispersas. Este trabajo se enmarca dentro del análisis de las acciones alternativas a la privación de libertad en adolescentes infractores a la ley penal. Intenta buscar soluciones que eviten la cárcel para quienes cometan pequeños delitos, opción que puede disminuir el índice de reincidencias. El objetivo es promover, desde el Trabajo Social, una doble reflexión: primero, analizando críticamente el concepto de delito, su definición en las diversas corrientes ideológicas y su aplicación en la legislación argentina; y segundo, la importancia de que (...) los jóvenes se responsabilicen de sus actos y experimenten caminos alternativos al delito.This work places inside the analysis of the alternative actions to the privation of freedom in inobservant teenagers to the penal law. It tries to look for solutions that avoid the jail for those who commit small crimes, option that can diminish the index of repetitions. The aim is to promote, from the Social Work, a double reflection: first, analyzing critically the concept of crime, his definition in the diverse ideological currents and his application in the argentine legislation; and second, the importance of which the young men take responsibility of his acts and experience alternative ways to the crime. Objective: The aim of this research was to study the mediation of body dissatisfaction, physical self-concept, and body mass index (BMI) on the relationship between physical activity and self-concept in adolescents. Materials and Methods: A sample of 652 Spanish students between 12 and 17 years participated in a cross-sectional study. Physical self-concept and general self-concept were assessed with the Physical Self-Concept Questionnaire (CAF), body dissatisfaction with the Body Shape Questionnaire (BSQ), and physical activity was estimated with the International Physical Activity (...) Questionnaire (IPAQ-SF). BMI was utilized as a measurement of body composition. Structural equation modeling was used to assess the results. Results: The resulting models showed good fit indexes. Physical activity had a positive and indirect effect on self-concept (β = 0.29, p < 0.01) and direct effects on dissatisfaction (β = -0.26, p < 0.01) and physical self-concept (β = 0.20, p < 0.01). BMI had a direct effect on dissatisfaction (β = 0.31, p < 0.01) and on physical self-concept (β = -0.10, p < 0.01) and an indirect effect on general self-concept (β = -0.24, p < 0.01). However, it was only associated with physical activity in males, playing a mediating role between physical activity and body dissatisfaction. Conclusion: Physical activity can help individuals to achieve a positive self-concept and promote psychological well-being in adolescents through the improvement of physical perceptions and body satisfaction. The importance of BMI, body dissatisfaction, and physical self-concept on the configuration of the self-concept are also emphasized. Educational policymakers and Physical Education teachers should implement strategies to promote physical activity in the schools and provide a Quality Physical Education programs to increase physical activity during adolescence.
