On occasions, laws on consent are subject to modification, largely on account of being subject to common law rather than statute—for example, in the UK. Guideline publications such as the UK Department of Health Reference Guide to Consent for Examination or Treatment are intended to provide information for clinicians on when and how to apply current laws in everyday clinical situations. While the extent to which guidelines influence clinician behaviour depends on how much they are read and followed, what is (...) also relevant, and sometimes omitted from consideration, is discussion about underlying philosophical concepts.This paper analyses philosophical weaknesses relating to English laws on consent, the main focus of attention being applied ethics and the rights of adults with incapacity. It draws comparisons between the US and the UK, and advocates changes in English law in order to help rectify weaknesses in patient protection. Discussion includes references to Scottish law, and the use of advance directives, and it voices concerns about over-reliance on “best interests” determinations. The problem is partly one of logical analysis, and what can happen is that best interests determinations fail to show proper respect for adults lacking the capacity to consent to examination or treatment on their own behalf. This is fundamentally a matter of rights, and requires further investigation and appropriate legal remedies in order to respond to ethical deficiencies in English law as it now stands. (shrink)

Physician assistants (PAs), nurse practitioners (NPs), and medical residents constitute an increasingly significant part of the American health care workforce, yet patient assent to be seen by nonphysicians is only presumed and seldom sought. In order to assess the willingness of patients to receive medical care provided by nonphysicians, we administered provider preference surveys to a random sample of patients attending three emergency departments (EDs). Concurrently, a survey was sent to a random selection of ED residents and PAs. All respondents (...) were to assume the role of patient when presented with hypothetical clinical scenarios and standardized provider definitions. Despite presumptions to the contrary, ED patients are generally unwilling to be seen by PAs, NPs, and residents. While seldom asked in practice, 79.5% of patients fully expect to see a physician regardless of acuity or potential for cost savings by seeing another provider. Patients are more willing to see residents than nonphysicians. (shrink)

What are appropriate criteria for assessing a theory of morality? In Ideal Code, Real World, Brad Hooker begins by answering this question, and then argues for a rule-consequentialist theory. According to rule-consequentialism, acts should be assessed morally in terms of impartially justified rules, and rules are impartially justified if and only if the expected overall value of their general internalization is at least as great as for any alternative rules. In the course of developing his rule-consequentialism, Hooker discusses (...) impartiality, well-being, fairness, equality, the question of how the 'general internalization' of rules is to be interpreted by rule-consequentialism, and the main objections to rule-consequentialism. He also discusses the social contract theory of morality, act-consequentialism, and the question of which moral prohibitions and which duties to help others rule-consequentialism endorses. In exploring corporate perceptions of the business case for supplier diversity, this paper reports on a cross-national study of large purchasing organisations that had introduced, or were in the process of introducing, purchasing initiatives aimed at ethnic minority businesses. The research investigates how LPOs portray the benefits of this form of socially responsible purchasing and suggests a business case construct based on four component elements. It also highlights a number of contextual factors that appear to have shaped business case rationales. (...) There are inconsistencies in the treatment and attitudes of human beings to animals and much confusion in thinking about what are appropriate conditions for using and keeping animals. This article outlines some of these considerations and then proposes guidelines for designing animal management systems. In the first place, the global and local ecological effects of all animal management systems must be considered and an environment designed that will not rock the biospherical boat. The main points to consider are the interrelatedness (...) of living things with each other and the environment, the self-sustaining nature of ecosystems, and the importance of diversity in the stability and maintenance of ecosystems. These can and should be taken into account when assessing animal management. They are illustrated by examples of companion/urban dogs, as well as farm, zoo, and circus animals. The environment must also be considered from the point of view of the ethological needs of the animals. There are two possible approaches to this: (1) the reductionist approach, illustrated by the choice experimental tests; and (2) a holistic, evolutionist approach that concentrates on the degree of behavioral restriction and the identification of distress. The assessment of an animal's ethological needs, and thus the ethological soundness of an environment, must take into account the species needs (communication system, species-specific characteristics of the brain receptors and cognition) and the individual's needs (his past experience). The behavioral effects of domestication and how distress can be assessed are discussed. Different ethical positions toward animals and their treatment are briefly outlined, and it is argued that, provided animals are in ecologically and ethologically sound environments, their use by human beings is ethically acceptable. The animal-human association should be characterized by symbiosis—mutual benefit—rather than a parasitic or exploitative relationship—employer to employee, rather than master to slave. (shrink)

Virtue ethics is normally taken to be an alternative to consequentialist and Kantian moral theories. I shall discuss what I think is the most interesting version of virtue ethics – Rosalind Hursthouse's. I shall then argue that her version is inadequate in ways that suggest revision in the direction of a kind of rule-consequentialism.

It is widely believed that there must be a conflict between food production and conservation, and that development must be related to economics. Both these beliefs are questioned. It is suggested that ecological agriculture, which includes ethologically and ecologically sound animal management can reduce conflicts between conservation and food production. African elephants are taken as an example illustrating different attitudes to conservation. It is proposed that, rather than developing further the present common conservation attitude of ' wildlife apartheid', the future (...) of elephants in many parts of Africa may rest on bringing them closer to the voters where the welfare of neither the human nor elephant is compromised. Here, they can act as both as workers, and as ' wildlife ambassadors'. This approach needs further research and development, but preliminary results show significant possibilities for reducing these apparently conflicting land use interests in some geographical areas. Act-utilitarianism claims that one is required to do nothing less than what makes the largest contribution to overall utility. Critics of this moral theory commonly charge that it is unreasonably demanding. Shelly Kagan and David Brink, however, have recently defended act-utilitarianism against this charge. Kagan argues that act-utilitarianism is right, and its critics wrong, about how demanding morality is. In contrast, Brink argues that, once we have the correct objective account of welfare and once we accept that act-utilitarianism is a (...) criterion of moral rightness, not necessarily a good method for everyday moral thought, act-utilitarianism is not as demanding as its critics claim. I shall argue that Brink's arguments for thinking act-utilitarianism is not so demanding fail. I shall then argue against Kagan that, in comparison with act-utilitarianism, rule-utilitarianism is considerably less demanding and more plausible. (shrink)

On one day in 2009, in 38 countries around the world, 4,000 ordinary citizens gathered to discuss the future of climate policy. This project, 'WWViews', was the first-ever global democratic deliberation - an attempt to enable normal people to reach informed decisions on and impact the global policy process.This book, written by the international practitioners and scholars who facilitated the project, analyses the experiences and lessons from this ground-breaking event. Despite the apparent success of the individual deliberations, the recommendations had (...) little impact within the media or the policy process at Copenhagen. The authors examine these successes and failures, and the challenges and opportunities of such deliberative events. Through this they explore important themes for participatory approaches from the local to the global: the role of deliberation within global governance; methodology and practice; participant selection; policy impacts; engaging the media; how policy culture affects deliberation uptake; capacity building and knowledge transfer; process evaluation; content and argumentation analysis; and gender, race and class aspects.The global aims of the WWViews project, along with the opportunity to evaluate the same process in different national and cultural contexts, makes this a hugely valuable and informative study for all those interested in democratic deliberation and environmental governance from the small to the international scale. Katarzyna de Lazari-Radek and Peter Singer’s wonderful book, The Point of View of the Universe: Sidgwick and Contemporary Ethics, contains a wealth of intriguing arguments and compelling ideas. The present paper focuses on areas of continuing dispute. The paper first attacks LazariRadek’s and Singer’s evolutionary debunking arguments against both egoism and parts of common-sense morality. The paper then addresses their discussion of the role of rules in utilitarianism. De Lazari-Radek and Singer concede that rules should constitute our moral decision procedure (...) and our public morality. This paper argues that, if no one should be blamed for complying with the optimal decision procedure and optimal public rules, there are strong reasons to accept that these same rules determine what is morally permissible from what is morally wrong. This paper begins by celebrating Sidgwick's Methods of Ethics. It then discusses Sidgwick's moral epistemology and in particular the coherentist element introduced by his argument from common-sense morality to utilitarianism. The paper moves on to a discussion of how common-sense morality seems more appealing if its principles are formulated as picking out pro tanto considerations rather than all-things-considered demands. Thefinal section of the paper considers the question of which version of utilitarianism follows from Sidgwick's arguments.

Suicide has long been the subject of philosophical, literary, theological and cultural–historical inquiry. But despite the diversity of disciplinary and methodological approaches that have been brought to bear in the study of suicide, we argue that the formal study of suicide, that is, suicidology, is characterized by intellectual, organizational and professional values that distinguish it from other ways of thinking and knowing. Further, we suggest that considering suicidology as a “social practice” offers ways to usefully conceptualize its epistemological, philosophical and (...) practical norms. Tim van Gelder, following Brandom, Collins and others, uses the so‐called wide content of capacities which support social, norm governed activities, such as language, to argue for their anti‐natural, abstract, but socially instituted nature and thence for the failure of the entire traditional mind‐body discussion as ill‐posed. We argue that his former conclusion is wrong, that such properties are naturalisable, complicated organisational properties of the complexly organised, non‐linearly interactive systems that human beings are. This analysis also provides principled support, but (...) on other grounds, for van Gelder’s latter conclusion. We outline a new naturalist approach to the organisational capacities of such systems that is intended to ground their biological, cognitive and social characters. (shrink)
