Using a sample of Chinese listed firms for the period of 2004–2010, this study examines the impact of religion on corporate philanthropic giving. Based on hand-collected data of religion and corporate philanthropic giving, we provide strong and robust evidence that religion is significantly positively associated with Chinese listed firms’ philanthropic giving. This finding is consistent with the view that religiosity has remarkable effects on individual thinking and behavior, and can serve as social norms to influence corporate philanthropy. Moreover, religion and (...) corporate philanthropic giving have a significantly weaker (less pronounced) positive association for state-owned enterprises than for non-state-owned enterprises. The results are robust to a variety of sensitivity tests. Our results highlight religious influence on corporate philanthropic giving in contemporary China, an old traditional country with a typical communist economy. (shrink)

The Occupy Central Movement was the biggest protest in Hong Kong in decades and caused an unprecedented division of opinion in society. Reports about the event in local Chinese media were remarkably different in stance and attitude. To understand the ideological dissonances and their linguistic construction, this article analyzes a corpus of 120 reports on the Occupy Central Movement from four major Chinese newspapers in Hong Kong, namely, Apple Daily, Ming Pao, Oriental Daily News and Ta Kung Pao, which cover (...) the political spectrum from anti-Beijing to pro-Beijing. In total, 856 concordance lines of the two selected words ‘佔中’ and ‘佔領’ were annotated using the Attitude framework. Analysis shows that their attitudes toward the event form a continuum from supportive, through neutral, to antipathic. The attitudes do not simply reflect the stances of the newspapers, but are strategically selected and designed to legitimize or delegitimize the event. The pattern of attitudes reflects the ideological divergence in Hong Kong society, and at the same time, the news reports also exacerbate the divergence by reinforcing the attitudes of their readers. Nearly thirty years ago, Robert Alexy in his book The Concept and Validity of Law as well as in other early articles raised non-positivistic arguments in the Continental European tradition against legal positivism in general, which was assumed to be held by, among others, John Austin, Hans Kelsen and H.L.A. Hart. The core thesis of legal positivism that was being discussed among contemporary German jurists, just as with their Anglo- American counterparts, is the claim that there is no necessary connection (...) between law and morality. Robert Alexy has argued, however, that the law, besides consisting conceptually of elements of authoritative issuance and social efficacy, necessarily lays a claim to substantial correctness, which is derived from analytical arguments. Furthermore, if this claim to substantial correctness necessarily requires the incorporation of moral elements into law, then the ‘necessary connection thesis’, as defended by non-positivism, can be justified. Some of the most significant objections to this sort of claim, stemming from the Anglo-American world, are those introduced by Joseph Raz. In his ‘Reply’ to Robert Alexy, Raz raises at least three interesting criticisms, including, first, the ambiguity of ‘legal theory in the positivistic tradition’, second, the indeterminate formulations of the ‘separation thesis’, and, third, the necessary claim of law to legitimate authority as a moral claim. As a point of departure, I will argue that Raz’s three criticisms are misleading. For they do not enhance our understanding of the genuine compatibility or incompatibility between legal positivism and non-positivism. Despite the frequently reformulated theses of legal positivism and the various kinds of opponents responding thereto, the essential divergence between legal positivism and non-positivism was and remains the answer to the question of the relation between law and morality. Furthermore, I will clarify that in the strictest sense there can be three and only three logically possible positions concerning the relation between law and morality: the connection between them is either necessary, or impossible (i. e. they are necessarily separate), or contingent (i. e. they are neither necessarily connected nor necessarily separate). The first position is non-positivistic, while the latter two positions are, indeed, both positivistic, but in different forms: one may be called ‘exclusive’ legal positivism, the other ‘inclusive’ legal positivism. I will continue by showing that these three positions stand to one another in the relation of contraries, not contradictories, and that, taken together, they exhaust the logically possible positions concerning the relation between law and morality, never mind the tradition or authority from which these positions are derived. Raz mentions, however, many changeable formulations of the separation thesis, which even leads him to acknowledge ‘necessary connections between law and morality’. One who is trying to understand legal positivism would no doubt be puzzled by this claim. Nevertheless, I will argue that this is an alternative strategy of legal positivism, and it points to naturalistically oriented view. Although this necessary separation between law and morality, understood naturalistically, strikes one as strengthening the separation, in the end it leads to a weakened notion of necessity. This weakened necessary separation thesis, however, cannot be justified through the so-called claim of the law to legitimate authority, defended by Raz, for it is difficult to answer the question of whether a normally justified but factual authority can gain legitimate authority. Finally, the necessary connection between law and morality in a strong sense can still be justified by the claim of law to correctness, as per Alexy’s argument. (shrink)

The concept of human dignity has been criticized as either too thick or too thin. However, according to the non-positivistic standpoint, the legal normativity of human dignity can be justified and thus strengthened by means of its moral correctness. From the individual perspective, Mencius’ understanding of human dignity as an intrinsic value and Kant’s formula of ‘man as an end in itself’ can be adequately understood based on the differentiation of, as well as the connection between, principium diiudicationis and principium (...) executionis, between will and choice, and between homo phaenomenon and homo noumenon (that is, ‘humanity in the personality’). From the social perspective, since the dual dimensions of the individual and the social person are both fictive constructions, even Radbruch, once as a supporter of social law, has not replaced the concept of ‘legal person’ and, in the post-War period, acknowledges individualistic human dignity as the criterion for applying the famous ‘disavowal formula’. On the one hand, human dignity shows at least a weak normative character, which requires, firstly, balancing between the exercise of state powers and the constitutional review under the guidance of the dual dimensions of man and, secondly, optimization of the principle of human dignity in individual cases. On the other hand, through the necessary connection between the concept of dignity and that of personality, human dignity can exhibit a strong normative character, which unavoidably requires a metaphysical justification. Die Disziplin, die als „Juristische Methodenlehre“ bezeichnet wird, ist gegenwärtig chinesischen Juristen nicht fremd, sie stammt aber ursprünglich aus dem deutschen Sprachraum. In der Literatur finden sich auch verwandte Ausdrücke wie „Juristische Methodologie“, „Juristische Methodik“ bzw.„Methodenlehre der Rechtswissenschaft“. Seit Anfang des 21. Jahrhunderts wurde ihre Rezeption in China durch zwei Übersetzungen gekennzeichnet, nämlich die „rechtswissenschaftliche Methodenlehre“ (faxue fangfalun) und die „rechtliche Methodenlehre“ (falü fangfalun). Neben der herkömmlichen Methodenlehre entwickelte sich auch eine jüngere Theorie der juristischen Argumentation, die die weltweite Aufmerksamkeit (...) sogar außerhalb Deutschlands auf sich lenken konnte und deren Bestand in China einen ganz selbständigen Abschnitt verdient. Als Hintergrund dafür soll von vornherein ein Blick auf die Entwicklungen der chinesischen Rechtstheorie und Rechtsphilosophie nach 1978 und demzufolge auf die Entstehung der Methodenfrage in der chinesischen Rechtswissenschaft geworfen werden. The paper attends to the increasingly heated debate on the local, the global versus the glocal approaches in transcultural brand communication with an examination of how Disneyland performs emotional branding on social media across US to Hong Kong and Shanghai. Integrating insights from brand communication with linguistics, the present study develops a framework to examine how Disneyland builds emotional attachment of the public to the brand via brand personality appeals and use of interactional features. It is found that on a (...) global-local continuum, brand personality traits exhibit strong globalization propensity whereas interactional features demonstrate strong localization tendency in Hong Kong and Shanghai. Variations also exist in the means of emotional branding between Hong Kong and Shanghai. Finally, the paper provides an account for the differences between Hong Kong and Shanghai and concludes that neither the local approach nor the global approach but the glocal approach can tackle the challenge of transcultural brand communication and that future studies in this area should be oriented further to uncovering the global-local nexus in the process. As the largest labour flow in human history, the recent rise in migration in China has opened up unprecedented opportunities for millions of Chinese to rearrange their lives. At the same time, this process has also posed great challenges to Chinese migrants, especially female migrants, who not only face a bias against ‘outsiders’ but also have a greater need for reproductive health-related services in their migratory destinations. Based on data collected via multiple sources in Shanghai, China’s largest metropolis, this study (...) profiles the changing characteristics of female migrants, presents data on self-reported symptoms of reproductive health-related problems and knowledge on reproductive health issues, compares maternal and child health measures between migrants and local residents, and examines factors related to reproductive health knowledge and migrants’ access to health care in urban china. Results of this study show a relatively low level of self-reported reproductive health problems among female migrants, coupled with a relatively high level of ignorance in knowledge related to STD. both self-reported health status and knowledge of reproductive health are related to migrants’ educational attainment and length of stay in the urban destination. This study also finds ample evidence that female migrants’ access to urban health care is limited by a number of institutional barriers. (shrink)

There has been no consensus on the neural dissociation between emotion-label and emotion-laden words, which remains one of the major concerns in affective neurolinguistics. The current study adopted dot-probe tasks to investigate the valence effect on attentional bias toward Chinese emotion-label and emotion-laden words. Behavioral data showed that emotional word type and valence interacted in attentional bias scores with an attentional bias toward positive emotion-laden words rather than positive emotion-label words and that this bias was derived from the disengagement difficulty (...) in positive emotion-laden words. In addition, an attentional bias toward negative emotion-label words relative to positive emotion-label words was observed. The event-related potential data demonstrated an interaction between emotional word type, valence, and hemisphere. A significant hemisphere effect was observed during the processing of positive emotion-laden word pairs rather than positive emotion-label, negative emotion-label, and negative emotion-laden word pairs, with positive emotion-laden word pairs eliciting an enhanced P1 in the right hemisphere as compared to the left hemisphere. Our results found a dynamic attentional bias toward positive emotion-laden words; individuals allocated more attention to positive emotion-laden words in the early processing stage and had difficulty disengaging attention from them in the late processing stage. This study conducted in-depth interviews with 20 students from a university in Wuhan so as to obtain data regarding their collective memory at the early stage of the COVID-19 outbreak and their social imaginaries in the longitudinal dimension of time. Compared with those in other regions, interviewees from Wuhan show more fear and dissatisfaction and think that others find it difficult to empathize with their first-hand experiences. Interviewees from Wuhan are more dependent on the media. However, media use can cause (...) problems related to redundant information and emotional impact. While one is confined to home, he/she is forced to participate in communication with family members and the topic of the body is discussed again from a new angle. Trauma leads to self-reconciliation, as facilitated by the re-examination of and reflection on one’ nomination of and reflection on n family members and the months in the wake of the COVID-19 outbreak. However, having received a collectivist education since childhood and having been guided by the discourse system created by the state media, they have since been able to shape their sense of identity and strengthen their sense of national honor. As one of the basic manufacturing industries in China, injection molding industry is faced with the problems of low degree of informatization and intelligence, resulting in low production efficiency and high costs. It is urgent to integrate deeply with new generation of information technology to achieve transformation and upgrade. In this paper, an integrative industrial Internet architecture of “integration of intelligent equipment, intelligent production lines, intelligent workshops, intelligent factories, and intelligent formats” was described. The injection molding intelligent control system, the (...) production management, control platform based on the MES system, and other key technologies were researched. Also, the smart factory architecture based on digital twin was established, and the implementation method of the smart factory digital twin system was elaborated. The feasibility and effectiveness of the method had been verified through the industrial application, which provided the technical supports for the injection molding industrial Internet system. Finally, the intelligent manufacturing industrial Internet cloud platform for injection molding industry was prospected. (shrink)

Based on social information processing theory, we provide a novel theoretical account of how and when leader humor influences subordinate boundary-spanning behavior. We develop a moderated mediation model explicating the mechanism of psychological safety and the boundary condition of subordinate interpersonal influence. Using multiwave data, we tested our research hypotheses with a sample of 452 members from 140 teams in a Chinese information technology company. Results showed that leader humor positively affects subordinate boundary-spanning behavior via increased psychological safety. Moreover, this (...) mediated effect is stronger when subordinates have high interpersonal influence. These findings offer theoretical and practical insights into boundary-spanning activities and leader humor, which we discuss. (shrink)

Cranial electrical stimulation has been applied at various current levels in both adults and children with neurological conditions with seemingly promising but somewhat inconsistent results. Stimulation-induced spatial electric fields within a specific brain region are likely a significant contributing factor for the biological effects. Although several simulation models have been used to predict EF distributions in the brain, these models actually have not been validated by in vivo CES-induced EF measurements in the live human brain. This study directly measured the (...) CES-induced voltage changes with implanted stereotactic-electroencephalographic electrodes in twenty-one epilepsy participants and then compared these measured values with the simulated ones obtained from the personalized models. In addition, we further investigated the influence of stimulation frequency, intensity, electrode montage and age on EFs in parts of participants. We found both measured voltages and EFs obtained in vivo are highly correlated with the predicted ones in our cohort. In white matter and gray matter, the measured voltages linearly increased when the stimulation intensity increased from 5 to 500 μA but showed no significant changes with changing stimulation frequency from 0.5 to 200 Hz. Electrode montage, but not age, significantly affects the distribution of the EFs. Our in vivo measurements demonstrate that the individualized simulation model can reliably predict the CES-induced EFs in both adults and children. It also confirms that the CES-induced EFs highly depend on the electrode montages and individual anatomical features. (shrink)

The emerging digital twin technology is an intelligent technology that makes full use of multimodels, big data, and interdisciplinary knowledge, which provides some new approaches for the field of the intelligent manufacturing industry. The job shop scheduling problem has been an important research field in the discrete manufacturing industry. Digital twin technology is adopted to solve the problem of job shop scheduling, which provides (...) the possibility for the intelligent development of workshops. Based on digital twin technology and combined with the actual problem of production line scheduling, we propose a new intelligent scheduling platform to solve the shop scheduling problems above. Meanwhile, based on the prediction and diagnosis of multisource dynamic interference in the workshop production process by big data analysis technology, the corresponding interference strategy is formulated in advance by the scheduling cloud platform. The model simulation experiment of intelligent dispatching cloud platform was carried out, and some enterprises in intelligent manufacturing workshop were taken as examples to verify the superiority of the dispatching cloud platform. Finally, we look forward to the future research direction of intelligent manufacturing based on digital twin technology. (shrink)

Battery energy storage is the pivotal project of renewable energy systems reform and an effective regulator of energy flow. Parallel battery packs can effectively increase the capacity of battery modules. However, the power loss caused by the uncertainty of parallel battery branch current poses severe challenge to the economy and safety of electric vehicles. Accuracy of battery branch current prediction is needed to improve the parallel connection. This paper proposes a radial basis function neural network model based on the pigeon-inspired (...) optimization method and successfully applies the algorithm to predict the parallel branch current of the battery pack. Numerical results demonstrate the high accuracy of the proposed pigeon-inspired optimized RBF model for parallel battery branch forecasting and provide a useful tool for the prediction of parallel branch currents of battery packs. Porosity is considered as one of the most important indicators for the characterization of the comprehensive performance of thermal barrier coatings. In this study, the ultrasonic technique and the artificial neural network optimized with the genetic algorithm are combined to develop an intelligent method for automatic detection and accurate prediction of TBCs’s porosity. A series of physical models of plasma-sprayed ZrO2 coating are established with a thickness of 288 μm and porosity varying from 5.71% to 26.59%, and the ultrasonic reflection (...) coefficient amplitude spectrum is constructed based on the time-domain numerical simulation signal. The characteristic features f 1, f 2, A max, Δ A of the URCAS, which are highly dependent on porosity, are extracted as input data to train the GA_BPNN model for predicting the unknown porosity. The average error of the prediction results is 1.45%, which suggests that the proposed method can achieve accurate detection and quantitative characterization of the porosity of TBCs with complex pore morphology.
