    Présentation.Hélène Miard-Delacroix & Michel Senellart - 2006 - Astérion 4.

    Hart's and Kelsen's Concepts of Normativity Contrasted.Sylvie Delacroix - 2004 - Ratio Juris 17 (4):501-520.
Hart's and Kelsen's respective outlooks on the concept of normativity not only differ by the way they explain this concept but also, more importantly, in what they seek to achieve when endeavouring to account for the normative dimension of law. By examining Hart's and Kelsen's models in the light of Korsgaard's understanding of the “normativity problem,” my aim is to emphasise not only their contrasted perspectives, but also the common limit they impose on their theories by dismissing as inappropriate any (...)

On the Logical Structure of the Dream.H. Delacroix - 2018 - Russian Journal of Philosophical Sciences 9:28-43.
How can we explain that our dreams are often not a chaotic, incoherent pile of images, but a definite, perfectly organized sequence of images? How do the sensations and images fit in dreams, what kind of logic do they obey, what is the role of emotions and ideas? Henri Delacroix formulates these questions in his article and offers his answers, delineating and examining different types of dreams. Taking into account and critically evaluating the concepts of contemporary researchers who studied (...)

    Espaces Temps et l'histoire des femmes.Christian Delacroix - 2002 - Clio 16:111-118.

    Meta-Ethical Agnosticism in Legal Theory: Mapping a Way Out.Sylvie Delacroix - 2010 - Jurisprudence 1 (2):225-240.
In his review of Bernard Williams' Ethics and the Limits of Philosophy, Hart eloquently formulated an apprehension that still haunts much of contemporary jurisprudence: if the moral 'I must' has to be 'seen as coming not from outside, but from what is most deeply inside us? the fear is that this will not be enough'. I argue that this fear is the byproduct of the dualist outlook within which Hart—and a significant part of contemporary legal theory—is confined: because of his (...)

    Computing Machinery, Surprise and Originality.Sylvie Delacroix - 2021 - Philosophy and Technology 34 (4):1195-1211.
Lady Lovelace’s notes on Babbage’s Analytical Engine never refer to the concept of surprise. Having some pretension to ‘originate’ something—unlike the Analytical Engine—is neither necessary nor sufficient to being able to surprise someone. Turing nevertheless translates Lovelace’s ‘this machine is incapable of originating something’ in terms of a hypothetical ‘computers cannot take us by surprise’ objection to the idea that machines may be deemed capable of thinking. To understand the contemporary significance of what is missed in Turing’s ‘surprise’ translation of (...)

Fuzzy Trace Theory and Medical Decisions by Minors: Differences in Reasoning between Adolescents and Adults.E. A. Wilhelms & V. F. Reyna - 2013 - Journal of Medicine and Philosophy 38 (3):268-282.
Standard models of adolescent risk taking posit that the cognitive abilities of adolescents and adults are equivalent, and that increases in risk taking that occur during adolescence are the result of socio emotional differences in impulsivity, sensation seeking, and lack of self-control. Fuzzy-trace theory incorporates these socio emotional differences. However, it predicts that there are also cognitive differences between adolescents and adults, specifically that there are developmental increases in gist-based intuition that reflects understanding. Gist understanding, as opposed to verbatim-based analysis, (...)

Legal norms and normativity: an essay in genealogy.Sylvie Delacroix - 2006 - Portland, OR: Hart.
This book offers a 'genealogical' explanation of law's normativity. The term 'genealogical' conveys a commitment to a non-metaphysical type of enquiry. While it explains how law, as a normative phenomenon, comes about, it does not seek to ground law's normativity in anything but the context of social interaction giving rise to it. Legal normativity is brought about on a daily basis. Whether in revolutionary circumstances or in the quotidian need for judges, lawmakers or citizens to balance law's demands with those (...)

  29. The Emerging Concept of Responsible Innovation. Three Reasons why it is Questionable and Calls for a Radical Transformation of the Concept of Innovation.V. Blok & P. Lemmens - 2015 - In Bert-Jaap Koops, Ilse Oosterlaken, Henny Romijn, Tsjalling Swierstra & Jeroen van den Hoven (eds.), Responsible Innovation 2: Concepts, Approaches, and Applications. Cham: Springer International Publishing. pp. 19-35.
Abstract In this chapter, we challenge the presupposed concept of innovation in the responsible innovation literature. As a first step, we raise several questions with regard to the possibility of ‘responsible’ innovation and point at several difficulties which undermine the supposedly responsible character of innovation processes, based on an analysis of the input, throughput and output of innovation processes. It becomes clear that the practical applicability of the concept of responsible innovation is highly problematic and that a more thorough inquiry (...)

Computer systems fit for the legal profession?Sylvie Delacroix - 2018 - Legal Ethics 21 (2):119-135.
ABSTRACTThis essay aims to contribute robust grounds to question the Susskinds’ influential, consequentialist logic when it comes to the legitimacy of automation within the legal profession. It does so by questioning their minimalist understanding of the professions. If it is our commitment to moral equality that is at stake every time lawyers hail the specific vulnerability inherent in their professional relationship, the case for wholesale automation is turned on its head. One can no longer assume that, as a rule, wholesale (...)
