At the centre of the metaethical debate that took off from G.E. Moore's Principia Ethica (1903) was his critique of ethical naturalism. While Moore's own arguments against ethical naturalism find little acceptance these days, an alternative ground for thinking that ethical properties and facts could not be natural has gained prominence: No natural account can be given of normativity. This collection contains original essays from both sides of the debate. The paper deals with the question of whether poverty as such violates the dignity of persons. It is argued that it does. This is, it is argued, not due to a lack of basic goods, nor to the fact that poverty prevents persons from enjoying the rights they have, particularly the right to bodily integrity. Poverty does violate dignity, so it is argued, insofar as poor people are dependent on others in a degrading way.

How do we change the normative landscape by making requests? It will be argued that by making requests we create reasons for action if and only if certain conditions are met. We are able to create reasons if and only if doing so is valuable for the requester, and if they respect the requestee. Respectful requests have a normative force – it will be argued – because it is of instrumental value to us that we all have the normative power (...) of creating reasons by making requests. The normative power has the potential for creating and shaping valuable interactions and relationships for the requester and the requestee. This potential could not be realized if we did not have the normative power of making requests. It will also be shown why this account of the normative force of requests should be preferred to the two alternative accounts of the reason-giving force of requests that have been put forward by James H.P. This paper discusses the volenti non fit injuria maxim. The volenti maxim states that a person is not wronged by that to which she consents, provided her consent is valid. I will argue, however, that the volenti maxim does not apply to all instances of valid consent. In some cases the consenter is wronged even if his consent is valid. Valid consent can only release others from consent-sensitive duties, not from consent-insensitive duties. If the consentee flouts a consent-insensitive duty the (...) consentee wrongs the consenter and thereby commits a wrong. (shrink)

When making decisions, humans can observe many kinds of information about others' activities, but their effects on performance are not well understood. We investigated social learning strategies using a simple problem-solving task in which participants search a complex space, and each can view and imitate others' solutions. Results showed that participants combined multiple sources of information to guide learning, including payoffs of peers' solutions, popularity of solution elements among peers, similarity of peers' solutions to their own, and relative payoffs from (...) individual exploration. Furthermore, performance was positively associated with imitation rates at both the individual and group levels. When peers' payoffs were hidden, popularity and similarity biases reversed, participants searched more broadly and randomly, and both quality and equity of exploration suffered. We conclude that when peers' solutions can be effectively compared, imitation does not simply permit scrounging, but it can also facilitate propagation of good solutions for further cumulative exploration. Das Instrumentalisierungsverbot spielt nicht nur in unserer Alltagsmoral, sondern auch in moraltheoretischen Diskussionen eine wichtige Rolle. Verschiedenste Praktiken werden mit der Begründung als unzulässig kritisiert, dass mit ihnen Menschen instrumentalisiert würden. Doch was heit es, die anderen blo als Mittel zu behandeln? Es besteht, so wird in diesem (...) Buch argumentiert, ein Zusammenhang zwischen unzulässiger Instrumentalisierung und Verletzung der Würde von Personen. In der Explikation des Würdebegriffs wird dieser Zusammenhang entfaltet. Die unzulässige Instrumentalisierung von Personen verletzt in bestimmten Fällen deren Würde, in anderen Fällen Ansprüche, die in der Würde von Personen begründet sind. Die Würde von Personen wird dabei als Anspruch auf Selbstachtung gefasst. Selbstachtung wird nicht im Sinne der Selbstwertschätzung verstanden. Im Blick steht vielmehr ein normatives Verständnis von Selbstachtung, wonach Personen ein Leben in Selbstachtung führen, sofern ihr Selbstverfügungsrecht von anderen und ihnen selbst geachtet wird. Der Anspruch auf Selbstachtung wird als Anspruch darauf begriffen, über wesentliche Bereiche des eigenen Lebens verfügen zu können. Diese Überlegungen zu Würde und Selbstachtung werden moraltheoretisch eingeordnet und abschlieend auf paradigmatische Fälle der praktischen Ethik angewendet, bei denen es um die Instrumentalisierung von Menschen geht. Der vorliegende Artikel versucht deutlich zu machen, dass das, worum es in dieser Diskussion um den selbstbestimmten Suizid geht, die Frage ist, was Entscheidungen von Menschen achtungswürdig macht. Der Artikel plädiert für eine Idee von Achtungswürdigkeit, für welche die selbstbestimmte Ausübung von Rechten über sich selbst leitend ist, eine Idee, die (...) auch in unserer Rechtspraxis wirksam ist. Mit dem Begriff ›Instrumentalisierung‹ steht eine Praxis im Blick, die dadurch charakterisiert ist, dass andere jeweils als Mittel behandelt werden. Das tun wir, wenn wir uns von einem Taxifahrer zum Bahnhof fahren lassen, wenn wir uns im Supermarkt vom Verkäufer beraten lassen und vom Kollegen einen Aufsatz lesen und kommentieren lassen. Wenn wir andere als Mittel benutzen, dienen sie bestimmten Zwecken, die wir verfolgen. Diese Zwecke müssen nicht notwendigerweise die eigenen sein. Ich kann jemanden fragen, wo die Stadtbibliothek sei, weil (...) ich damit einem Kollegen einen Gefallen erweisen möchte. Der Kollege möchte das wissen. Die Zwecke, die dabei verfolgt werden, sind nicht Zwecke, welche die als Mittel benutzte Person verfolgt. Es sind ihr fremde Zwecke. Wenn wir jemanden als Mittel behandeln, dann tun wir etwas mit der betroffenen Person. Sie ist nicht Mittel zu ihr fremden Zwecken, wenn sie keinen Beitrag zur Realisierung des Zwecks leistet. Dabei muss sie selbst nicht wissen, dass sie das tut. Fraglich ist, ob man bloß dann davon reden kann, dass ich eine andere Person als Mittel behandelt habe, wenn ich das absichtlich tue. Nehmen wir an, jemand würde mir im obigen Beispiel sagen, wo sich die Stadtbibliothek befindet, ohne dass ich sie vorgängig gefragt habe. Diese Person leistet ohne Zweifel einen Beitrag zur Realisierung meines Zwecks, aber habe ich sie auch als Mittel behandelt? Samuel Kerstein meint, dass man einen anderen dann als Mittel behandelt, wenn die Weise, wie man ihn behandelt, von der Absicht getragen wird, dass er oder sie etwas tut, was zur Realisierung meines Zwecks beiträgt: »Sie muss beabsichtigen [...], dass die Anwesenheit oder Mitwirkung des Anderen auf die eine oder andere Weise zur Realisierung des Zwecks beiträgt«. Jemand wird danach als Mittel behandelt, wenn eine andere Person beabsichtigt, seine Anwesenheit oder sein Tun zur Realisierung eines ihm fremden Zwecks zu benutzen. (shrink)

To respect the autonomous choices of persons is an important moral principle. There is, however, little agreement about its nature and its normative importance. This is due to the fact that the concept of autonomy as well as the moral relevance of autonomy are contested. It is argued in this paper that the debate about autonomy is at its core a debate about the reasons for respecting decisions. Decisions of persons are to be respected as their decisions, and they have (...) to be respected as determining the deontic properties of situations. This, however, can only be understood against the background of persons having rights over themselves. Their decisions determine the deontic properties as exercises of their rights. Thus, respect for the autonomous choice of persons turns out to be respect for their rights. (shrink)

In seinem Werk "Philosophie als Lebensform" vertritt Pierre Hadot (1922-2010) die These, dass die Philosophie bis zu Beginn der hochmittelalterlichen Scholastik nicht primar Wissenschaft mit Anspruch auf systematische Stimmigkeit und Objektivitat sei, sondern auf einen psychologisch-padagogischen Effekt fur die Lebenspraxis abziele: Die Philosophie der hellenistischen und romischen Epoche stellt sich als eine Lebensweise, eine Lebenskunst und eine Seinsweise dar. Es geht darum, das Sein des Menschen zu verwandeln und ihm zum Gluck zu verhelfen. Das fruhe Christentum sowie das mittelalterliche Monchtum (...) knupften daran an und verstanden das spirituelle Leben als philosophia, die durch die Praxis geistiger Ubungen in Christus den alten Menschen ablegt und den neuen anzieht (vgl. Eph 4,22-24). In der Mystik, die seit Dionysius Areopagita (ca. 500 n. Chr.) zu einem expliziten Inhalt des Denkens wird, spitzt sich dieses Spannungsverhaltnis zwischen Theorie und Praxis zu. Per definitionem ist Mystik eine uberwaltigende Erfahrung, die alle Affekte involviert. Aber genau diese Erfahrung wird schon in der vorchristlichen griechischen Philosophie zum Inhalt einer rationalen Reflexion. It has been argued that environmental decision-making can be improved be introducing citizen panels. The authors argue that citizen panels and other models of citizen participation should only be used as a consulting forum in exceptional cases at the local level, not as a real decision-making procedure. But many problems in the field of environmental policy need nonlocal, at least regional or national, regulation due to the fact that they are of national impor-tance. The authors argue that there are good (...) reasons not to institutionalise national citizen panels. They advocate the view that more reasonable and more competent solutions can be found by introducing forms of direct democracy. (shrink)

David Ekdahl (2023), in a constructive and thoughtful commentary, outlines both points of agreement with and suggestions for further research arising from our paper ‘Crossing the Fictional Line: Moral Graveness, the Gamer’s Dilemma, and the Paradox of Fictionally Going Too Far’ (Montefiore & Formosa, 2023).

This paper deals with the wrongness of having sex with someone without her valid consent. There are good reasons to think that deception about deal-breakers invalidate consent to sex and that acting without valid consent wrongs the consenter. Tom Dougherty argues that it is always seriously wrong to deceive another person into sex by deceiving her. We should on his view therefore reject the view that doing so is in certain cases only a minor wrong. It will be argued here (...) that we should accept this view. I will argue against Dougherty that the lenient view does not presuppose an unacceptably moralistic view of sexuality. In addition, the lenient view can be defended by what I call the harm view of the wrongness of having sex without valid consent. If no or only mild harm is caused deceiving someone into sex is only a minor wrong. (shrink)

According to a widely held view, a Kantian intuition functions like a singular term. I argue that this view is false. Its apparent plausibility, both textual and philosophical, rests on attributing to Kant a Fregean conception of judgment. I show that Kant does not hold a Fregean conception of judgment and argue that, as a consequence, intuition cannot be understood on analogy with singular terms.

Consent that is voluntary, informed and given by a competent person sometimes transforms a wrong into a right act. How does consent that meets these requirements change the moral property of an act, namely that of being a wronging of a person? This is the question this paper will deal with. Some authors argue that valid consent changes the moral property of an act by changing the reasons which speak against the act. This account of the normative force of consent (...) will be critically examined and rejected. An alternative model will then be put forward and defended according to which consent changes the moral property of an act if and only if the wrong‐making property of the act is that it is not consented to. The upshot will be that consent does not eliminate the wrong‐making property if the unconsented act is wrong for other reasons than not being consented to. (shrink)

Nach der klassischen Auffassung stellen paternalistische Handlungen Eingriffe in die Freiheit eines Menschen dar, die in dessen Interesse sind. Den Eingriffen in die Freiheit liegt die Absicht zugrunde, jemanden daran zu hindern, etwas zu tun, das für ihn schlecht ist.

The so-called resource curse raises moral issues. Who, if anyone, is morally responsible for it? This article argues that this question amounts to: who is blameworthy for the violations of people's property rights? The international oil companies are blameworthy for the violations of property rights only in the case of complicity, not in the normal purchase case. Yet the international community has to take action against massive violations of property rights. The article discusses different measures, and criticizes voluntary initiatives such (...) as the Extractive Industries Transparency Initiative for not making the states accountable to their people. In this line of thought, it argues for an extension of the mandate of the International Criminal Court: massive violations of property rights should be prosecuted at the international level. Are the values of different options and goods, as cost-benefit analysis assumes, commensurable? Not always. The incommensurability of certain options is based on the fact that preferences are sometimes not rankable, even if the agent is fully informed about the options in question. In addition, even if all values were commensurable they could not be compared in monetary terms. If this is the case, cost-benefit analysis should not be seen as a decision procedure.
