This article shows that the conspicuous and consistent idiosyncrasy of Grotius's Biblical interpretation is an important part of his revolutionary effort to secularize natural law. In De iure praedae and related works, Grotius systematically deployed a range of exegetical techniques in order to demonstrate that the Bible, like all texts, is open to multiple interpretations and susceptible to hijacking by rival agendas. This strategy aimed to render the Bible inadmissible as evidence in legal disputes and political legitimacy claims. The consistent (...) instrumentality of Grotius's use of the Bible in IPC cannot be dismissed as mere legalistic opportunism or described as an atheistic move. Rather, Grotius's exegetical strategy was motivated by pacifism and a desire to protect religion from politicization. The article positions this secularization strategy in the intellectual environment of the Leiden Circle, and shows how competing Catholic, Calvinist, and Mennonite political readings of the same key biblical passages during the Dutch-Iberian conflict provided the immediate occasion for writing IPC. In order to construct a natural law theory that was independent from, and therefore acceptable to, all religious sides, it was necessary to ensure that the Bible have no final word in law or politics, lest its invocation link disagreements to belief and thereby render them impossible to resolve. Kimberlé Williams Crenshaw ends her landmark essay “Mapping the Margins: Intersectionality, Identity Politics, and Violence against Women of Color” with a normative claim about coalitions. She suggests that we should reconceptualize identity groups as “in fact coalitions,” or at least as “potential coalitions waiting to be formed.” In this essay, I explore this largely overlooked claim by combining philosophical analysis with archival research I conducted at the Gay, Lesbian, Bisexual and Transgender Historical Society Archive in San Francisco about Somos (...) Hermanas, the solidarity project of the Alliance Against Women’s Oppression, based in the San Francisco Women’s Building (1984–90). I extend my analysis into the present by drawing on the oral history and published works of Carmen Vázquez, a key organizer in both Somos Hermanas and the Women’s Building. I argue that conceptualizing identities as in fact coalitions—as complex, internally heterogeneous unities constituted by their internal differences and dissonances and by internal as well as external relations of power—enables us to organize effective political coalitions that cross existing identity categories and to pursue a liberatory politics of interconnection. Ostensible contradictions between Augustine's account of the two cities are resolved by his concealed claim to the privileged epistemic status of a Christian prophet. Faith and grace provide the mobility between this quasi-divine and the fallen human position. Such mobility is impossible in a pluralist and secular system of thought. Wells's The New Machiavelli (1911) offers an excellent case study of the use of anti-Machiavellian Machiavellism as both a philosophical and a rhetorical strategy. In Remington, Wells creates a protagonist who follows Machiavellian rules of behaviour and denounces those who do likewise. The novel is structured to show Remington's progress from an idealist refutation of Machiavellism, through a recognition of its necessity, to the formulation of a private and political method for the necessary pursuit of Machiavellian principles under the disguise (...) of anti-Machiavellism, including trenchant criticisms of Fabians as anti-Machiavellian Machiavellians. These stages, culminating in complete personal and public failure, are reflected in Remington's party allegiances, and broadened by Wells into an account of British party ideologies around the turn of the twentieth century. Wells's rhetorical design for mapping and assessing anti-Machiavellian Machiavellism is paralleled by an exploration of that technique in himself, attested by the predominance of autobiographical elements in The New Machiavelli, and by similarities between Remington's and Wells's own deception of others and themselves. Far from incidental, anti-Machiavellian Machiavellism is the motif that unites the shifting party allegiances, political conceits and moral hypocrisies, and private and public failures of Wells, Remington, and of the period of British politics that they intend to encapsulate. In his De tragoediae constitutione (1611) Heinsius rearranged the text of Aristotle's Poetics, and built on it a new general theory of drama, literature and speech. The new system was designed to render Christian exemplars and Christian theories of internalisation, pedagogy and motivation impossible to maintain, and thereby sidestep one of the most divisive issues in the intellectual debates of the Reformation. The phrase, "state of nature", has been used over centuries to describe the uncultivated state of lands and animals, nudity, innocence, heaven and hell, interstate relations, and the locus of pre- and supra-political rights, such as the right to resistance, to property, to create and leave polities, and the freedom of religion, speech, and opinion, which may be reactivated or reprioritised when the polity and its laws fail. This research note announces and briefly describes a new five-year project to prepare a census bibliography of the first ten editions of Grotus’s De iure belli ac pacis. The resulting book will be published in 2025, the 400th anniversary of ibp’s first appearance. The project is sponsored by the Deutsche Forschungsgemeinschaft and hosted by the Max Planck Institute for Comparative Public Law and International Law in Heidelberg.

This article recovers James Brown Scott’s conviction in American exceptionalism, a belief that underlay both his institutional work as well as his understanding of the origins and trajectory of international law. In the first section, we discuss Scott’s interpretation of Hugo Grotius as part of his tactic to make US foreign affairs policies and perspectives more compelling by presenting them as universal. In the second section, we argue that Scott’s writings on the Spanish origins of international law were in fact (...) meant to protect Anglo-American hegemony and US influence in the Americas in the face of rapidly changing geopolitical pressures. In the final section we suggest that Scott’s US exceptionalism is reflected in his use of the United States Constitution and Supreme Court as a model for key international organizations. We conclude that Scott reframed Vitoria not to redress American bias but to enshrine it. (shrink)

Has there already been a Grotian Moment for corruption? If not, what would it take for new legal rules and doctrines on corruption to crystallise? This article seeks to answer these two questions by reviewing the relevant history of international legal scholarship, the current public international law framework for anticorruption, and recent developments in international legal practice. We conclude that a Grotian Moment may have been reached for a narrow concept of corruption, focused on petty corruption and bribery, with the (...) proliferation of international anticorruption law following the Cold War. However, a Grotian Moment for a broadened understanding of corruption, based on other forms such as institutional, political, and grand corruption, ought to emerge to comprehensively address all forms of corruption. Given the range of challenges, including resistance from political elites and the indeterminacy of criminal liability, a Grotian Moment for a broadened concept of corruption remains improbable. This note studies the 1650 edition of Hugo Grotius’s De iure belli ac pacis. Using online and card catalogues, we have located eighty-nine copies, thirty-seven of which we examined in person, with an additional six fully digitised copies online. We hope that this research note on the preliminary results will generate greater interest in this unduly neglected edition. The note shows how, despite the connection established in the history of seventeenth-century politics that emphasized the ties between Grotius and the Peace (...) of Westphalia, the reception of Grotius’s 1650 edition bore no relation to the debates at Osnabrück and Münster. However, this is an influential edition, cherished by collectors and authors. According to our findings, it would be reproduced in a number of later reprints. (shrink)

This research note is the eighth instalment in our series of preliminary findings on the census and study of the reception of De iure belli ac pacis. The note presents a bibliographical description of Laurentius’ 1647 re-issue of the 1631 edition by Blaeu, considers Laurentius’ motivation and methods of production, lists and maps the currently known twenty-three surviving copies, and briefly describes two notable exemplars.

This research note offers a contextual overview of the printing history of Johann Blaeu’s 1646 octavo edition of Hugo Grotius’s De iure belli ac pacis (ibp). The note examines the printing process of the last edition that was prepared while Grotius was still alive, though it was published after his death. The note also sheds light on the theological dimension of some readers’ annotations, and concludes by discussing the impact this edition had on the modern versions of the text.

This article provides new information on the publication history of the first edition of the text that, according to many scholars, laid the ground for the growth of international law: Hugo Grotius’s De iure belli ac pacis. Drawing on the preliminary findings of the Grotius Census Project at the Max Planck Institute for Comparative Public Law and International Law, funded by the German Research Foundation (Deutsche Forschungsgemeinschaft), the following pages shed light on the first three states of the typescript, the (...) sources that Grotius had access to in France while drafting the book, and the early circulation of the 1625 edition, published by Nicolas Buon in Paris. The goal of this publication is to disseminate updated information on the printing history of this key text in the history of legal and political thought, and to invite readers to come forward with more information about the location of the remaining copies of the text, in order to advance our understanding of the rise of international law around the world. The first edition of Hugo Grotius’s De iure belli ac pacis was published in Paris by Nicolas Buon in 1625. An unauthorised second edition appeared in Frankfurt a year later, from the reputable Wechel press. After Grotius made hundreds of changes to the first and second states of the first edition, and failed to convince the publisher Nicolas Buon of the merits of printing yet another edition of the book, the Wechels’s release of a new edition sought to capitalise on (...) the high demand for the text, as copies had sold out in Central Europe by the summer of 1625. In this preliminary report on the 1626 edition, using online and card catalogues, we have located 59 surviving copies. We examined thirteen copies in person, and another three fully digitised copies online, and on the basis of this small sample we have been able to draw a number of conclusions. We hope that this research note on preliminary results will generate interest in this unduly neglected edition, and that readers will kindly bring further copies to our attention. (shrink)

Hugo Grotius’s best-known work, De iure belli ac pacis, appeared in 1625 in Paris with the author’s approval. A second unauthorised version was published in 1626 in Frankfurt. In 1631 the Amsterdam publisher, Willem Janszoon Blaeu (1571–1638), issued the third edition, this one authorised by the author – and this edition featured nearly a thousand revisions by Grotius. The purpose of this report is to analyse the context behind the publication of this third edition and the copies’ provenance records. Using (...) online and card catalogues, we have located 154 copies. We examined 52 copies in person, and another three fully digitised copies online. This is the fourth instalment of our census and study of the reception of the first nine editions of De iure belli ac pacis. Here we focus on the two versions that Johannes Janssonius issued in 1632, one with a copy of Mare liberum attached to it. This report outlines the place of the 1632 Janssonius edition in the context of his long-running rivalry with the printer Willem Blaeu and his firm. It then explores the typographical differences between the two (...) issues, their causes, and their significance for our understanding of the reception of the text. Finally, it provides the preliminary results of the census concerning the circulation and provenance of the fifty-three copies of this edition that we have found. We hope that this research note on the preliminary results will attract interest in this edition and that readers will kindly inform us of further copies. (shrink)

This article provides new information on the printing and readership history of the fifth edition of De iure belli ac pacis. Building on our earlier research on the way that the dispute between Willem Janszoon Blaeu and Johannes Janssonius influenced the publication of the 1631 edition of the text, this article studies how Blaeu harnessed his position to make the 1632 edition more reputable than the earlier version published by his rival. The article considers how, over four centuries, readers have (...) appreciated the quality of the production and three engaged with the text for radically different ends: Remigius Faesch, Baron von Boineburg, and Wendell Phillips. The article draws attention to the changes and continuities in reading and annotation patterns and offers preliminary insights into the themes that these influential readers focused on. This article constitutes the sixth instalment in our series on the census and study of the reception of the first nine editions of De iure belli ac pacis. This edition has long held a prominent place in studies and editions of Grotius’s work since it was the last published during his lifetime. The report first outlines the genesis of the edition in the context of Grotius’s relationship with Johann Blaeu (1596–1673) and Cornelius Blaeu (1610–1642), who had recently inherited the Blaeu (...) print firm from their father Willem. It then elucidates a number of crucial ways in which the 1642 edition differed from the five previous editions, especially via the addition of an extensive new series of annotations to ibp and a separate set addressed to the Epistle of Philemon. Finally, it concludes by providing the preliminary results of the census concerning the one hundred and twenty-one copies we have found. (shrink)

This article contains a summary of selected theses of the theory of the state developed by Hermann Heller, who was one of the leading representatives of the so-called Weimar Theory of the State. State theorists of the Weimar era formed an independent, formally unrelated group of scientists who had often opposing views, but were united by a common effort to conduct even philosophical investigation of the nature of the state, the European, continental state, as well as its internal ratio and (...) mission. In addition to Hermann Heller, this group included Carl Schmitt, Rudolf Smend, Erich Kaufmann and Heinrich Triepel. They asked questions which are absent in today’s science, such as: “What is a state?”, “What kind of being is it and what is its nature?”. The answers determine many issues, including our perception of the durability and strength of the state, our understanding of its structure and development, the relation between the state and the individual and the relation between politics and history, etc. No settlement of this basic issue is not only simple negligence, but – as can be judged – it stems from today’s tacit assumption that the state is not a being, but only an artificial human construct, a combination of elements and a set of institutions. Heller perceives the state substantially: as particular organization of social affairs; organization of specific areas of public life: economy, law and public opinion. These were created in the modern era and have been specific to Europe from the sixteenth century to modern times. The matter of these areas is transformed into a state order by sovereign authorities. Therefore, their policies and their law have their concrete object whose reality they face, and they need to demonstrate that they are capable of organizing this reality. The ethos of the state and at the same time the legitimacy of its power require that elementary principles of justice are ensured, or at least injustice is eliminated from social life. (shrink)

Este estudo foi motivado, porque em tais documentos curriculares há uma imposição de uma nova postura teórico-prática que acaba forjando uma nova identidade a tais profissionais. O autor utilizou a abordagem discursivo-desconstrutiva apresentada por Coracini em reflexões que tratam da mesma temática. A obra gira em torno da questão kantiana “quem (...) class='Hi'>somos nós?”, tendo como preocupação principal a identidade do professor de Língua Portuguesa construída sob força de lei, num processo que envolve uma certa violência simbólica, em termos da teoria de Bourdieu e Passeron. The aim of this research is to carry out a comparative study of military interventionism in Spain, the United Kingdom, and the United States. The thesis I defend is that armies intervene when the conditions are created for them to do so. There is no such thing as a dichotomy between interventionist and non-interventionist armies in the political decision-making process.

El objetivo principal de este trabajo es plantear la controversia entre Descartes y Leibniz en torno a las verdades eternas como constituyente de diversos diálogos incluyendo los contralógicos: diálogos en los cuales Descartes y Leibniz representan perspectivas distintas en relación con las elecciones posibles para la determinación de normas de racionalidad. Cada uno de estos diálogos tiene un aspecto universal o monológico (determinado por la estrategia de ganancia), y un aspecto eminentemente contextual y dialógico determinado por el nivel de juego. Finalmente, afirmo que una noción de racionalidad que contenga tanto el aspecto contextual como el universal, no es una lógica específica en forma dialógica sino un cuadro de racionalidad normativa. Lo que, según creo, está relacionado con la idea de la construcción dinámica de una lengua universal perfectible, discutida por Olga Pombo. La idea general es que la noción misma de racionalidad de Leibniz es fondateur de discursivité, si usamos la expresión que Marcelo Dascal toma de la boca de Foucault. The main aim of the present paper is to understand the debate between Descartes and Leibniz about eternal truths as providing the structure of several possible dialogues involving counter-logicals conditionals. According to this analysis the positions of Descartes and Leibniz are understood as constituting dual and dynamic perspectives in relation to the availability of some specific choices that should provide norms of rationality. Each of these dialogues has both a universal, monological aspect (given by the winning strategy) and a contextual, dialogical one (given by the play level). I conclude with the suggestion that a notion of rationality that contains both the universal and the contextual aspects does not yield a specific logic, but rather a frame of normative rationality. The conception of such a frame seems to be closely linked to the notion of a universal perfectible language discussed by Olga Pombo. The central idea is that the Leibniz's notion of rationality is a fondateur de discursivité if we use Marcelo Dascal's quote of Foucault. (shrink)

En este artículo, siguiendo la metáfora de ir haciendo juntas un tejido de experiencias, elaboramos una autoetnografía dialógica. Entrelazamos nuestras historias mediante un ejercicio que consistió en escribir de manera individual y discutir los textos en reuniones semanales. Este ejercicio nos ha permitido articular tres historias como académicas de tiempo completo dedicadas principalmente a la investigación. Tomamos la decisión de hacer este proceso de indagación compartida porque sentimos la urgente necesidad de reflexionar sobre esa carrera profesional, que iniciamos por vocación (...) hace ya varias décadas, pero que, conforme nos acercamos a su posible conclusión por jubilación, ha dejado de tener el mismo sentido. Esto, consideramos, responde en gran medida a la relevancia que han tomado los criterios administrativos en detrimento de los académicos en un nuevo contexto, que algunos han caracterizado como la universidad neoliberal.Las tres autoras —dos de las cuales han trabajado más la metodología cualitativa, en este caso particular la autoetnografía, y una de ellas que durante años ha investigado las trayectorias laborales de las mujeres dentro de las universidades públicas— hemos hecho un ejercicio de introspección compartido con la intención de detectar cuestiones nodales y de explorar alternativas viables dentro del contexto actual. This essay elaborates on Rodolfo Corky Gonzales’s “Yo soy Joaquín” as an inter-American articulation of the critical commitments of Chicanismo, which is here identified as the sociopolitical philosophy and ideological/normative leanings of Mexican Americans who call themselves Chicanas/os. The purpose of this essay is to show both how syncretism frames Chicanismo as a philosophy of growth and identity beyond borders and that this worldview can be critically explained as seeking alliances to communities and contexts defined by struggle. It engages the (...) historical groundwork, philosophical influences on, and cultural ideals and values voiced through this poem by proponents of Chicanismo among its multiple forms and various representatives. This essay elaborates on Rodolfo Corky Gonzales’s “Yo soy Joaquín” as an inter-American articulation of the critical commitments of Chicanismo, which is here identified as the sociopolitical philosophy and ideological/normative leanings of Mexican Americans who call themselves Chicanas/os. The purpose of this essay is to show both how syncretism frames Chicanismo as a philosophy of growth and identity beyond borders and that this worldview can be critically explained as seeking alliances to communities and contexts defined by struggle.
