This article responds to Bell’s notion of an Interpretive Arc, by considering his reinterpretation of Babel in the light of rabbinic traditions of interpretation. It is suggested that Bell’s interpretation of Babel is not altogether different from some rabbinic interpretations. This is particularly true of the tradition which lays great emphasis on discovering the plain sense of the text. However, there is a difference between Bell’s hermeneutic method and the rabbinic tradition of interpretation. The latter insists on working with the (...) original text, not a translation of the text. By attending to the original Hebrew, one can see how translation can close down meanings. Moreover, the notion of a hermeneutic arc, especially its assumption of a final stage of appropriation, does not fit well with a tradition that has continuing rituals of reading and interpretation. This chapter evaluates the use of rabbinic literature in the study of the history of Christianity in Roman Palestine. It explains that this issue goes back to medieval Jewish-Christian controversy and intertwines with the whole history of the reception of the Talmud in Europe and the western world. It suggests that the view that Christians are most often envisaged in the rabbinic references to minim is consistent with the likelihood that Christianity is envisaged in a number of rabbinic and targumic (...) passages which do not mention minim. This article argues that the religious epistemology of the rabbinic tradition, which preserves and respects multiple perspectives in intellectual debate, is best understood in comparison to the definitions of truth proposed by philosophical pragmatists, in particular William James and W. V. Quine, and in contrast to those of philosophical liberals, in particular J. S. Mill. Both the rabbis and the pragmatists emphasize the harmony that innovation must maintain with extant webs of meaning. Conceptions of objectivity and subjectivity in Jewish medieval (...) rationalism and in early modern mysticism are considered and compared with those of latter-day European and American epistemology. This article makes a case for a fundamentally pluralistic conception of truth and argues that it is exemplified in the social interaction of the talmudic sages. (shrink)

Describing rabbinic reasoning as a rational response to experience. Hashkes combines insights from the analytic philosophy of Wittgenstein, Quine, and Davidson with the semiotics of Peirce to construe knowledge as systematic reasoning occurring within a community of inquiry. Her reading of the works of Emmanuel Levinas and Jean-Luc Marion allows her to create a philosophical bridge between a discourse of God and a discourse of reason. This synthesis of analytic philosophy and pragmatism, hermeneutics and theology provides Hashkes with a sophisticated (...) tool to understand Rabbinic Judaism. It also makes this study both unique and path breaking in contemporary Jewish philosophy and Rabbinic thought. (shrink)

What would a Jewish process theology look like if it also adopted the a priori principles of rabbinic Judaism - among them, the authority of Torah given on Sinai, an historically particular revelation of divine instruction for a particular people, and the authority of the Oral Torah, an historically evolving hermeneutic, according to which that revelation becomes normative practice for communities of observant Jews? I trust this would not be a naturalism, since it would be a theology that found its (...) grammar or regulative logic in a textual hermeneutic rather than in an account of the orders of perception and imagination. It would not, for the same token, be an anti-naturalism, but rather a theology for which the distinction between natural and super- or non-natural was not definitional. For such a theology, for example, the world out there would belong to the order of creation (maaseh bereshit), rather than to "nature." This would mean that, since God creates through words, language (at least some sort of language) and world would be intimately connected rather than extrinsic phenomena, It would mean, furthermore, that for language to "know" the world would not be surprising and that something like a form of realism would not be out of the question, While it would presuppose the authority of divine speech and even of some human interpretations of it, this other-than natural theology would not, as naturalists might suppose, present a heteronomous conception of divine law, If the distinction nature/not nature would not be definitive for this theology, neither would those of autonomy/heteronomy, body/spirit, this world/other world, This theology would present its own variety of neutral monism; in this case, however, the undifferentiated plenum would be termed a plenum of undifferentiated signification (or pure semiosis), of which undifferentiated feeling (or pure experience) was an instance; "prehension" would be another term for interpretation, Max Kadushin was the first and, as far as I know, the only Jewish thinker to articulate a process theology in the service of what he considered the behavioral or halakhic authority of classical rabbinic literature. In this paper, I examine Kadushin's work as the foundation of a rabbinic text process theology, I assume, from the outset, that such a theology may complement a Jewish natural process theology and that a Jewish process theology, in general, would appear as a process of dialogue between textual- andnatural-process theologies. This chapter examines the methodologies, new approaches, and challenges in the use of rabbinic literature to study the history of Judaism in late antiquity. It provides some examples that demonstrate some of the issues concerning the applicability of rabbinic literature to the study of Judaism in late-Roman Palestine. It concludes that rabbinic literature can serve as a historical source, especially when read indirectly and through the lens of well-defined theoretical frameworks, and when perceived as a rabbinic cultural product that reflects (...) delicate, sophisticated and hardly recoverable relationships between text and reality. I argue that “sampling” is at the heart of rabbinical hermeneutics. I argue further that anomalous monism—and specifically its arguments about token identity, of which sampling is one species—provides some insight into understanding the nature of rabbinical hermeneutics and religion, where truth is contingent on social judgment but is nevertheless objective. These points are illustrated through a close reading of the story of the oven of Aknai in the Bavli's Baba Metzia. I claim that rabbinic Judaism represents an early attempt (...) to integrate written texts into communicative processes, and thus frame the essay by comparing it to more recent computational technologies. In Berlin two rabbinical seminaries, a Reform and Conservative, have recently been established. The historical and intellectual roots of these institutions in the nineteenth century is sketched, and then contrasted with the present curriculum and the religious profile of the students. Some theological questions for the future of these projects conclude the article.

This book traces rabbinic thought on the near-universal phenomenon of legal circumventions, finding licit ways to achieve otherwise illegal outcomes. Rabbinic literature does not fully reject or accept loopholing, but instead determine acceptability based on whether their outcome and their process maintain the values and the integrity of the law.

The German Jewish philosophers Hermann Cohen, Martin Buber and Franz Rosenzweig introduced a critique and extension of Kant's transcendental philosophy that looks to us today like the foundations of a rabbinic semiotics. It is a theory about the semiotic character of our knowledge of the world, of other humans and of God. And it is a claim that such a theory is embedded in the classical literature of rabbinic Judaism. More recently, the American rabbinic thinker Max Kadushin presented a more (...) elaborate analysis of the logic of what he called the rabbis' "organic thinking." While influenced in some ways by Charles Peirce, Kadushin did not offer his analysis as a semiotic. In this paper, I suggest that Kadushin's analysis is better served if it is restated more precisely in the vocabulary of Peirce's semiotics. The resulting construction then serves as a complement to the work of the German Jewish philosophers. (shrink)

At a time when bioethical issues are at the top of public and political agendas, there is a renewed interest in representations of the embryo in various religious traditions. One of the major traditions that have contributed to Western representations of the embryo is the Jewish tradition. This tradition poses some difficulties that may deter scholars, but also presents some invaluable advantages. These derive from two components, the search for limits and narrativity, both of which are directly connected with the (...) manner in which Jewish tradition was constructed in Antiquity. The article accomplishes three goals: • To introduce some central elements in ancient Rabbinic literature on the subject of the embryo and its representation; • To present this body of literature as clearly as possible, noting some of the difficulties encountered by scholars who engage in its study; • To explain how the literature’s textuality came about, examining the particular sociopolitical circumstances of Judaism at that time, including the reasons for the delay in the production of scientific texts, transmitted as such, as compared to other philosophical or religious traditions. The claim is that these circumstances engendered a tradition peculiarly relevant for the study and teaching of medical ethics today. (shrink)

The current paper aims at merely charting a brief outline of Jewish philosophical attitudes toward idolatry. In its first part, I discuss some chief trends in Rabbinic approach toward idolatry. In the second part, I examine the role of idolatry in the philosophy of religion of Moses Maimonides and Benedict de Spinoza, two towering figures of medieval and early modern Jewish philosophy. In the third and last part, I address the relevance of the notion of idolatry to contemporary Jewish life, (...) and argue that the early rabbinic announcement on the perishing of the inclination toward idolatry might have been premature. Challenging earlier cognitivist approaches, recent theories of embodied cognition argue that the human mind and its functions are best understood as intimately bound up with the human body and its physiological dimensions. Some scholars have suggested that such theories, in departing from some core assumptions of the Western philosophical tradition, display significant similarities to certain non-Western traditions of thought, such as Buddhism. This essay extends such parallels to the Jewish tradition and argues that, in particular, classical rabbinic thought presents a (...) profoundly nondualistic account of the body–soul relation in its connection to cognition, action, and embodiment. Classical rabbinic texts therefore model the possibility of engaging with ‘Western’ conceptions such as God and the soul, while doing so in a manner that resonates strongly with many aspects of contemporary scientific theories. Thus, beyond their value as historical documents, insight into the texts and concepts of classical rabbinic Judaism can contribute to the further development of new theories of intellect and cognition. Do ubiquitous modes of thought (types of analysis, types of argumentation) pervade the entire corpus of the Rabbinic writings of late antiquity and impart coherence to those diverse documents? Here are the results of a systematic probe of representative Halakhic and Aggadic documents in search of the answer to that question. The result is limited but one-sided: the answer is yes, they do. The inquiry proves urgent, because the bases for supposing the Rabbinic documents coalesce have diminished, and the differences (...) between and among the respective documents have made their mark. The book asks whether, however diverse, all of the documents conform to a single, determinate program of [1] analysis and [2] argumentation. Do they raise in common a set of questions that are ubiquitous, and do they pursue a uniform inquiry, whatever the data subject to study? Further, does a single protocol of argumentation dictate the means by which analytical propositions are advanced and tested? If they do, then Rabbinic Judaism finds coherence in shared intellectual traits. These, then, would serve to define the foundations for the construction of all components into the Rabbinic system and structure. (shrink)

This lucid description of the Languedocian Jewish community's multigenerational cultivation of - and acculturation to - scientific and philosophic teachings into Judaism fulfils a major desideratum in Jewish cultural history. In the first detailed account of this long-forgotten Jewish community and its cultural ideal, the author gives an expansive reappraisal of the role of the philosophic (...) interpretation in rabbinic culture and medieval Judaism. Looking at how the cultural ideal of Languedocian Jewry continued to develop and flourish throughout the thirteenth and fourteenth centuries, with particular reference to the literary style and religious teaching of the great Talmudist, Menahem ha-Meiri, Stern explores issues such as Meiri’s theory of "civilized religions", including Christianity and Islam, controversy over philosophy and philosophic allegory in Languedoc and Catalonia, and the cultural significance of the medical use of astrological images. This book will be of great interest to scholars and students of Religion, of Judaism in particular, and of Philosophy, History and Medieval Europe, as well as those interested in Jewish-Christian relations. The late antique rabbis of Roman Palestine were seasoned jurists, experts on exegesis and legal interpretation. Yet rabbinic literature does not theorize. A positive account of rabbinic conceptions of language therefore remains a desideratum. I choose an alternative approach. Legal reasoning relies on language to ground the determinacy of the law. Jurists must thus confront language when it threatens to undermine the latter. Conversely, they may hold language to safeguard legal determinacy. Drawing on insights from legal theory, I turn to (...) an unusual rabbinic rule of inference. Its earliest attested version suggests a universal possibility of inference “from the category of yes that of no, from the category of no that of yes.” I show that the ever-evolving uses of this rule allow us to observe a shift in linguistic attitude, increasingly acknowledging linguistic uncertainty. My findings tie in with recent advances in the study of rabbinic exegesis. (shrink)

This chapter examines the rabbinic Judaism from the Palestinian context. It suggests that it is not possible to provide any unambiguous framework which will offer clues to the context, or contexts, in which the extraordinary corpus of rabbinic works was composed. It concludes that the composition of the rabbinic literature could only take place in a society marked by a complex interplay of beliefs, ethnic identities and languages and identifies the most common points of reference in Jewish religious writing.
