Definition of the problem Death and suicide wishes of older people represent a relevant and morally challenging issue for nurses. Especially in the context of wishes for assisted suicide, the risk for the development of moral uncertainty or even moral distress grows. As suicide rates and requests for assisted suicide are particularly high among people 65 years of age or older, the topic proves to be particularly relevant to the settings of long-term community and nursing home care. At (...) the same time, this fact underlines the importance of suicide prevention, which has recently been strengthened by the federal government, with the intention of launching a national strategy and a corresponding law. Arguments According to our hypothesis, the situational confrontation of nursing professionals with death and suicide wishes may cause an ethical field of tension between an unprejudiced, open, empathetic and respectful acceptance of death and suicide wishes on the one hand and the goal of suicide prevention on the other. The legal uncertainties in regards to the practice of assisted suicide, which currently prevails in practice, may intensify this risk. International studies point to the potential of moral distress of nurses when confronted with death and suicide wishes. Conclusion These findings and the reference to the current legal uncertainties and framework conditions in the national (German) context underpin the importance of the professional discussion about the topic, the need to sensitise (future) nursing professionals to potential ethical tensions and to enable them to deal with the accompanying moral uncertainty in a professional and competent manner. During combat, soldiers make critical split-second choices about matters of life and death dozens of times a day. These individual decisions accumulate to determine the outcome of wars. In this book, Marcus Schulzke examines the theory and practice of how military ethics can guide conduct in counterinsurgency, which are particularly difficult operations because the opponent operates outside of the laws of war. Schulzke surveys the ethical traditions that militaries borrow from; compares ethics in practice in the US Army, British (...) Army and Royal Marines Commandos, and Israel Defense Forces; and draws conclusions that may help militaries refine their approaches in future conflicts. The work is based on interviews with American, British, and Israeli soldiers who were deployed between 2000 and 2012, review of training materials and other official publications, published accounts from combat veterans, and observation of US Army focus groups with active duty soldiers. Examining three distinct national militaries illuminates positives and negatives is different approaches to military ethics. Schulzke makes a convincing argument that while moral warfare is an illusive goal, it is possible to make incremental improvements that can reduce war's destructiveness while improving the success of counterinsurgency operations. In the article, we analyse ethical and moral issues of public administration in region of Eastern Slovakia through some cases of the last years. We focused on self-governing regions, namely the Košice and Prešov self-governing regions. We identified two fundamental situations where failures on the side of public administrators occur: selection processes for vacant positions, be it directly in public administration or institutions that fall under its domain, and public procurement with regard to the (...) acquisition of goods and services. The year 2009 was the year of elections to self-governing regions which is why a great number of negative cases dealt with the election campaign. Further, we stated that negative cases dealt with failures of bodies of self-governing regions from both the legal (breaking the law) and moral viewpoint. By claiming that public administrators failed morally, we meant breaking moral norms and rules. Contradictions, which were identified (from the ethical viewpoint), predominantly result from the conflict between public and private interests. In many cases, private interests of public administrators are preferred at the expense of public interests. And it is exactly this preference (a conflict of interests) that is sensitively perceived by the public. (shrink)

Nanotechnology is an important platform technology which will add new features like improved biocompatibility, smaller size, and more sophisticated electronics to neuro-implants improving their therapeutic potential. Especially in view of possible advantages for patients, research and development of nanotechnologically improved neuro implants is a moral obligation. However, the development of brain implants by itself touches many ethical, social and legal issues, which also apply in a specific way to devices enabled or improved by nanotechnology. For researchers developing nanotechnology (...) such issues are rather distant from their daily work in the lab, but as soon as they use their materials or devices in medical applications such as therapy of brain diseases they have to be aware of and deal with them. This paper is intended to raise sensitivity for the ethical, legal and social aspects (ELSA) involved in applying nanotechnology in brain implants or other devices by highlighting the short term problems of testing and clinical trials within the existing regulatory frameworks (A), the short and medium-term questions of risks in the application of the devices (B) and the long-term perspectives related to problems of enhancement (C). To identify and address such issues properly nanotechnologists should involve ethical, legal and social experts and regulatory bodies in their research as early as possible. This will help to remove pressure from regulatory bodies, to settle public concern and to prevent non-acceptable developments for the benefit of the patients. (shrink)

Do doctors fix patients? Or do they heal them? For all of modern medicine’s many successes, discontent with the quality of patient care has combined with a host of new developments, from aging populations to the resurgence of infectious diseases, which challenge medicine’s overreliance on narrowly mechanistic and technical methods of explanation and intervention, or “fixing’ patients. The need for a better balance, for more humane “healing” rationales and practices that attend to the social and environmental aspects of health (...) and illness and the experiencing person, is more urgent than ever. Yet, in public health and bioethics, the fields best positioned to offer countervailing values and orientations, the dominant approaches largely extend and reinforce the reductionism and individualism of biomedicine. The collected essays in To Fix or To Heal do more than document the persistence of reductionist approaches and the attendant extension of medicalization to more and more aspects of our lives. The contributors also shed valuable light on why reductionism has persisted and why more holistic models, incorporating social and environmental factors, have gained so little traction. The contributors examine the moral appeal of reductionism, the larger rationalist dream of technological mastery, the growing valuation of health, and the enshrining of individual responsibility as the seemingly non-coercive means of intervention and control. This paradigm-challenging volume advances new lines of criticism of our dominant medical regime, even while proposing ways of bringing medical practice, bioethics, and public health more closely into line with their original goals. As one of the most massive and successful business sectors, the pharmaceutical industry is a potent force for good in the community, yet its behaviour is frequently questioned: could it serve society at large better than it has done in the recent past? Its own internal ethics, both in business and science, may need a careful reappraisal, as may the extent to which the law - administrative, civil and criminal - succeeds in guiding (and where neccessary contraining) it. The psychosocial morbidity associated with HIV infection and responses to such infection may exceed morbidity associated with medical sequelae of such infection. This paper argues that negative judgements on those with HIV infection or in groups associated with such infection will cause avoidable psychological and social distress. Moral judgements made regarding HIV infection may also harm the common good by promoting conditions which may increase the spread of HIV infection. This paper examines these two lines of argument with regard (...) to the ethical aspects of psychological bases of health care, clinical contact, public perceptions of AIDS and the comparative perspective. The UK Chief Medical Officer’s 2016 Annual Report, Generation Genome, focused on a vision to fully integrate genomics into all aspects of the UK’s National Health Service. This process of integration, which has now already begun, raises a wide range of social and ethical concerns, many of which were discussed in the final Chapter of the report. This paper explores how the UK’s 100,000 Genomes Project —the catalyst for Generation Genome, and for bringing genomics into the NHS—is negotiating (...) these ethical concerns. The UK’s 100 kGP, promoted and delivered by Genomics England Limited, is an innovative venture aiming to sequence 100,000 genomes from NHS patients who have a rare disease, cancer, or an infectious disease. GEL has emphasised the importance of ethical governance and decision-making. However, some sociological critique argues that biomedical/technological organisations presenting themselves as ‘ethical’ entities do not necessarily reflect a space within which moral thinking occurs. Rather, the ‘ethical work’ conducted by organisations is more strategic, relating to the politics of the organisation and the need to build public confidence. We set out to explore whether GEL’s ethical framework was reflective of this critique, and what this tells us more broadly about how genomics is being integrated into the NHS in response to the ethical and social concerns raised in Generation Genome. This book is therefore intended to cover some ground in both types of topic and it is to be hoped that its contents will stimulate further reflection and writing on the deep controversies that recent events in world politics have stoked. However misguided much of the debate has been, many have contended that the present era is witnessing a "clash of civilisations", in which fundamentally different value-systems confront each other with their mutually opposed and antagonistic views of the world. This position often undergirds a moral relativism, which denies that there are any universal values: all we have, according to this outlook, are the different values of different cultures seeking (insofar as they "clash") to impose themselves on others. In the first essay, James Beard counters this argument with a case for what he calls a "thin universalism", a relatively sparse but powerful set of fundamental values which can credibly be demonstrated to have universal application.Many who supported the 2003 invasion of Iraq now oppose it, not on the grounds that they were wrong at the outset but that hindsight and subsequent events have given them new reasons to revise their judgements. This has led some to think that arguments about whether a war is just, and justified, can very often only be satisfactorily made "down the line", thus excusing initial support for a conflict which thereafter goes badly wrong. In her article, Christine Stender reminds us of many of the considerations that were available in 2003 itself which readily led to just-war arguments against launching the invasion at the time. It may be easy for the passage of time to cause us to forget those factors. But, given that we can only become more adept at making just-war judgements by reflecting on past experience, it is crucial not to let them disappear in the morass of subsequent experience. Arguably, the Abu Ghraib scandal did more than any other single event to undermine what moral credibility the American occupation of Iraq ever had. It certainly raised acute questions about the conception of "virtue" that the role of combatant in war ought to necessitate and, in his essay, J. Joseph Miller subjects this issue to close philosophical scrutiny, with particular focus on the ethics of torture. Traditional just war theory has been composed of two elements: jus ad bellum, which sets out moral criteria which may sanction the resort to war, and jus in bello, which provides moral rules for its actual conduct. Recent events, and in particular the tragically chaotic situation of post-invasion Iraq, have helped to make the case for a third element: jus post bellum, which deals with the rights and responsibilities of just combatants with respect to the pursuit of a just peace once conflict has ended. This remains an under-researched area and, in their article, Mark Evans and Christine Stender introduce a wide-ranging set of considerations towards the construction of an adequate account of jus post bellum. A concept that has surged to the fore in recent times has been that of a "failed state", which has been invoked as part of arguments for "humanitarian intervention." (Afghanistan is perhaps the most obvious and pertinent example.) It is, however, a highly contentious concept and many think it has nothing other than ideological, polemical value. Whilst admitting that it is prone to such (mis)use, Mark Evans argues, in his essay, that it can be given a determinate and useful normative content, even if it does not necessarily sanction the kind of foreign policies which certain Western leaders have thought it does. Most liberal democracies have responded to the "terror threat" by introducing emergency legislation, or by otherwise suspending in some way what they would "ordinarily" have regarded as inviolable basic liberties and legal safeguards. Nazeer Patel argues that this dangerously undercuts the moral authority that these states claim for themselves and urges that we rethink how liberal democracy should appropriately respond to terrorism; it may take courage not to "overreact" against it, but he plausibly suggests a more measured and morally preferable attitude for it to take. Finally, in her essay, Claire Delisle focuses on one of the more bitter conflicts within a liberal democracy of recent times which has, it seems, been resolved in favour of peaceful accommodation: that between the Nationalist and Unionist communities in the north of Ireland/Ulster. The full story of how this peace became possible has yet to be fully told, and she adds a vital element to the tale, of how incarcerated combatants developed attitudes, strategies and a culture which built the foundations for a process that eventually brought "The Troubles" to what, it is to be hoped, is a permanent end. With the exception of the editor's contributions, the research which is published here is the product of the intellectual labours of scholars who are in the early stages of their careers. This volume is, therefore, a compendium of work in progress and the authors hope that this publication will help to further their reflections; certainly, the issues with which they engage are a long way indeed from being exhausted in terms of the scholarly attention they demand. Obviously, their appearance together in the same volume should not be taken to imply that any of the contributors endorse anything of what any of the others argue. (shrink)

What is health policy for? In Health and the Good Society, Alan Cribb addresses this question in a way that cuts across disciplinary boundaries. A significant effect of China’s rejection of a planned economy for a free market is the stimulus this has given to discussion of therelationship between morality and the market. Some Chinese believe that the introduction of a market economy has had a negative effect on public morality. Others disagree and maintain that it has had only a positive effect. Besides this particular debate there are two others. In the first of these debates, it is maintained on the one side (...) that conduct in the market is amoral and essentially contractual or transactional in nature: a boundary must be drawn between economic conduct and conduct in other spheres of social life. Against this it is argued that ethical norms apply equally to all aspects of social life including the economy. In the second debate one side holds that the market engenders its own “ethical” norms. In opposition it is argued that the moral categories articulated in moral philosophy are applicable to behaviour in the market. (shrink)

Whether the law should permit voluntary euthanasia or physician-assisted suicide is one of the most vital questions facing all modern societies. Internationally, the main obstacle to legalisation has proved to be the objection that, even if they were morally acceptable in certain 'hard cases', voluntary euthanasia and physician-assisted suicide could not be effectively controlled; society would slide down a 'slippery slope' to the killing of patients who did not make a free and informed request, or for whom palliative care would (...) have offered an alternative. How cogent is this objection? This book provides the general reader with a lucid introduction to this central question in the debate, not least by reviewing the Dutch euthanasia experience. Morality is not declining in the modern world. Instead, a new morality is replacing the previous one. Technology shapes every aspect of human experience and it is the primary driver of social and ecological change. Given this, it is surprising that we spend so little time studying, analyzing, and evaluating new technologies. Occasionally, an issue grabs public attention--for example, the use of human embryonic stem cells in medical research or online file sharing of music and movies. However, these are the exceptions. For the most part, we enthusiastically embrace each new technology and application with little critical (...) reflection on how it will impact our lives and our world. What is more, when an issue raised by an emerging technology is attended to, we often lack the language, concepts, and critical perspectives to thoroughly address it.
