The main objective of this work is to understand the daily practices of user management in post-reformist devices in the Brazilian mental health field. Through Foucault's genealogical work on government practices, understood as forms of conducting the behavior of others, it is possible to open a possible field for the study of the practices of psi knowledge, considering them as forms of management that act by through the free and natural acts of individuals. More specifically, our goal is (...) to examine day-to-day practices on some reformist devices such as CAPS through user files. Basically, two driving models have been found in the new devices: 1) Cases with frank intervention of production of commitments and agreements with users, seeking the entry of this to varied activities and political leadership ; 2) Cases with little response from the user, in which the forms of conduction are implemented by policies of inclusion of family members and close reference characters in the management of the patient's life. Last year marks the first year of implementation for both the Patient Protection and Affordable Care Act and the Mental Health Parity and Addiction Equity Act in the United States. As a result, healthcare reform is moving in the direction of integrating care for physical and mental illness, nudging clinicians to consider medical and psychiatric comorbidity as the expectation rather than the exception. Understanding the intersections of physical and mental illness with autonomy and self-determination in a system realigning its (...) values so fundamentally therefore becomes a top priority for clinicians. Yet Bioethics has missed opportunities to help guide clinicians through one of medicine's most ethically rich and challenging fields. Bioethics' distancing from mental illness is perhaps best explained by two overarching themes: 1) An intrinsic opposition between approaches to personhood rooted in Bioethics' early efforts to protect the competent individual from abuses in the research setting; and 2) Structural forces, such as deinstitutionalization, the Patient Rights Movement, and managed care. These two themes help explain Bioethics' relationship to mental health ethics and may also guide opportunities for rapprochement. The potential role for Bioethics may have the greatest implications for international human rights if bioethicists can re-energize an understanding of autonomy as not only free from abusive intrusions but also with rights to treatment and other fundamental necessities for restoring freedom of choice and self-determination. Bioethics thus has a great opportunity amid healthcare reform to strengthen the important role of the virtuous and humanistic care provider. (shrink)

This article aims to expose the main governmental shifts in recent American history (1961-2000) by examining two programs: the Assistance to Families with Dependent Children (AFDC) and the Agency for International development (US-AID). Through the exploration of primary and secondary sources, we analyse the production, organisation and circulation of governmental practices in the realms of both domestic and foreign policy. In the American context, practices of government typically revolve around freedom, efficiency models and individual responsibility. Throughout the analysis, we find (...) that the general critiques which have guided reforms and experiments in both areas converge around the same elements. This testifies to the fact that the reflexions and technical models directed at the optimal management of populations are more far-reaching than they first appear. Moreover, the historical transformations in welfare and foreign aid practices bear out the increasingly disciplinary nature of the administration and objectification of the poor, both within the United States and internationally. The paper examines the roles of manager and therapist as formed by an emotivist culture, by a recognition of tragedy, and by a Christian narrative. The Christian story provides resources to resist an emotivist culture, to cope with tragedy, and to reform the roles of manager and therapist. The context for the examination is provided by reflection about the development of a mission statement for Pine Rest Christian Hospital.

What does it mean to develop psychiatric method in a colonial context? Specifically, if the aims of psychiatry have traditionally been couched in the language of ‘psychic integration’ and ‘healing’, then what does it mean to practice psychiatry within structures that organize and reinforce the exclusions of colonialism? With these questions, this article examines Frantz Fanon’s psychiatric practices in light of his radical political commitments. I argue that Fanon’s innovations with the institutional form of the psychiatric hospital (...) serve to intervene differently in psychic conflict. Notably, these changes offer different ways to diagnose and respond to patients, along with different strategies for managing psychic disintegration in colonial contexts. The result is a rethinking of the relation between material and imagined worlds, and so the emergence of the hospital as a waystation between a colonial context and a political freedom yet to come. Throughout the last decades, state and civil society actors in Germany have undertaken a number of initiatives in order to enter into a structured conversation with Muslim communities, and to find spokespersons who serve as partners for political authorities. This process has commonly been analysed in terms of its empowering effects for Muslims via the emerging ‘institutionalisation’ of Islam. The modes and techniques of power at stake in this process have yet often been undermined. Through the lens of Foucault's concept (...) of governmentality, the starting point of my article is one particular dialogue forum, initiated by the German state in 2006 – the ‘Deutsche Islam Konferenz’ (DIK) – whose primary goal is to institutionalise and regulate the communication between Muslims and state actors and thereby to regulate the conduct of Muslims. Focusing mainly on the way in which gender and Islam have been coupled and played out in this initiative, I argue that the DIK is less a dialogical encounter than a tool of a broader civilising liberal project. Through the inquiry into the modes of power operating in this state led dialogue initiative the article shows that while aiming to secure Muslim's ‘integration’ into German society and to liberate Muslim women from restrictive gender norms, the DIK operates as an enactment of a particular notion of freedom with normative and normalising implications. The approach to managing the involuntary detention of people suffering from psychiatric conditions can be divided into those with clinicians at the forefront of decision-making and those who rely heavily on the judiciary. The system in England and Wales takes a clinical approach where doctors have widespread powers to detain and treat patients involuntarily. A protection in this system is the right of the individual to challenge a decision to deprive them of their liberty or treat them against their (...) will. This protection is provided by the First-tier Tribunal; however, the number of successful appeals is low. In this paper, the system of appeal in England and Wales is outlined. This is followed by a discussion of why so few patients successfully appeal their detention with the conclusion that the current system is flawed. A number of recommendations about how the system might be reformed are offered. (shrink)

This article presents an overview of traditional legal and regulatory incentives directed at achieving lawful corporate behavior, together with examples of more recent governmental incentives aimed at encouraging self regulation activities by corporations. These incentives have been differentiated into positive incentives that benefit corporations for actions that encourage or assist lawful behavior, and punitive incentives that only punish corporations for violations of legal or regulatory standards. This analysis indicates that traditional legal and regulatory incentives for lawful corporate behavior are overwhelmingly (...) punitive in their intended effects, while more recent governmental incentives to encourage voluntary corporate self regulation are much more positive in their intended effects.A prototype private compliance system containing typical features specified in governmental incentives for corporate self regulation was then analyzed applying the same positive/punitive analysis that was performed with the governmental incentives. This analysis suggests that corporate compliance programs that are structured to comply with Department of Defense regulations for defense contractors or the new Federal Organizational Sentencing Guidelines will reflect the same overwhelmingly punitive balance of incentives for lawful and ethical employee conduct as do the traditional legal and regulatory incentive systems for lawful corporate behavior. In recent educational reforms in New Zealand, a central assumption has been the existence of a free and autonomous chooser acting as a consumer of education. The present paper examines and critiques this notion of autonomy, as developed within liberal theory. Both Foucault and Lyotard provide materials for this critique of such a self, a self independent of the laws and principles of a community.

While the ethical implications of corporate actions have received increasing attention, one important area overlooked by both researchers and corporate codes of ethics is the significant ethical implications of corporate records management practices. This article discusses the operational and strategic purposes of modern corporate records management programs—including scorched earth programs which seek to reduce exposure to potential liability by eliminating documentary evidence from corporate files that could be used to establish culpability in future governmental investigations or in litigation (...) by persons injured by corporate actions. As a first step toward developing relevant ethical guidelines and decision criteria for socially-responsible records management practices, the ethical values of freedom of choice and avoidance of harm are applied to various corporate decisions as to (1) which information should be retained as records and for how long, (2) subsequent disclosure or non-disclosure of that information and to whom, and (3) decisions as to when information in corporate records may properly be destroyed. To fill this void, the authors delineate two archetypes of freedom — quantitative and qualitative — and outline the consequences of the respective notions for organisational strategy, corporate governance, leadership and culture. This paper provides an interpretation, based on the social systems theory of German sociologist Niklas Luhmann, of the recent paradigmatic shift of mental health care from an asylum-based model to a community-oriented network of services. The observed shift is described as the development of psychiatry as a function system of modern society and whose operative goal has moved from the medical and social management of a lower and marginalized group to the specialized medical and psychological care of the whole (...) population. From this theoretical viewpoint, the wider deployment of the modern social order as a functionally differentiated system may be considered to be a consistent driving force for this process; it has made asylum psychiatry overly incompatible with prevailing social values (particularly with the normative and regulative principle of inclusion of all individuals in the different functional spheres of society and with the common patterns of participation in modern function systems) and has, in turn, required the availability of psychiatric care for a growing number of individuals. After presenting this account, some major challenges for the future of mental health care provision, such as the overburdening of services or the overt exclusion of a significant group of potential users, are identified and briefly discussed. Over a decade after publication of Thinking Again: Education After Postmodernism (1998) contention still emerges among Foucaultians over whether discursively made‐up things really exist, and whether removal of the constituent subject leaves room for agency within techniques of caring for the self. That these questions are kept alive shows that some readers have not rethought Foucault, finding what possibly comes after postmodernism. Using Wittgenstein to ‘reciprocally illuminate’ Foucault (after Tully and Marshall), I open teacher inspection and reforms to problematization, as (...) relations to bedrock rules governing games of truth. ‘How, upon entering classrooms, do inspectors know “teaching” is taking place and not crazy and fuzzy things in its name?’ Taking up Hirst's vexing question, I move beyond liberal‐analytic concept‐mapping and neo‐liberal individualism to more fully assay the political ground for judging teaching practices through genealogy. Epistemological, political and ethical concerns intersect as we approach the problem through Foucault's three axes of an historical‐ontology of the present: knowledge(s), power relations, and arts of the self. Drawing on recent Governmentality Studies in Education (Peters., 2009), we aver the impasses of postmodern relativism while finding limited ranges of agency along each axis, as teachers practice freedoms by critiquing and renegotiating rules. The paper describes the refusal of the liberal community to assert the right of persons accused of mental illness to be free of coercive psychiatric intrusion. It suggests that the penchant for benevolent governmental intrusion into other social problems may be at fault and recommends that intervention be abandoned in favor of a return to human autonomy as a basis of the concept of freedom.

Is it the clever author who offers a guide out of the goodness of his heart? Or more likely, is it the sharp publisher, who knows a good selling point when he or she sees one? One guesses it is the publisher. But as to the present volume, few will complain of the title’s ambiguity, for it entices readers into an compact, well written, and timely argument on political matters of the first importance. Conrad Russell was the author of Academic Freedom, a well regarded and similarly compressed discussion of academic freedom. Academic Freedom preceded the Guide to Liberalism by six years. It was as though Russell had first to taste and see the awful effects of neo-conservatism in his beloved University of  Conrad Russell has a world reputation as an historian of the English Civil War, of the whole seventeenth century, and of the social history of politics before . His several books and hundreds of articles and reviews show that he had an apparently effortless mastery of most world history since the Reformation. I have been unable to deal with Conrad’s historical output in this review, but have discussed it in a forthcoming biographical essay about Conrad Russell in the Bertrand Russell Society Quarterly, “Conrad Russell as Political Intellectual”, forthcoming in . _Russell_ journal (home office): E:CPBRRUSSJOURTYPE2502\REVIEWS.252 : 2006-02-27 11:52 Reviews  London and then, six years later—after due reflection upon the whole horrid mess—to provide a compelling political remedy to the evil apparatus of Mrs. Thatcher and Mr. Major. Academic Freedom, a sister volume to the Guide, dealt with the intellectual and administrative liberty that university teachers must have if their work is to be academically viable and socially valuable. Already in , Academic Freedom offered a sharp attack on the Thatcherite use of league tables and performance indicators, and on high civil servants, vice-chancellors, and government ministers who rely on the numbers. In effect, accountants and managers and long lists of numbers had overtaken much that universities did. Academic Freedom ended with a straightforward prescription: university teachers and (on occasion) responsible administrators should make the hard academic decisions to which they are called—not civil servants, not numbercrunchers, not politicians. This view did not mean elected politicians were released from the burden of honest choice and decision, particularly in regions of governance and public life for which they had direct responsibility and care. But Russell’s point remained: it would be madness if statistical tables replaced responsible and able human beings, or if those human beings accepted that they must become automatic “decision machines”. Conrad Russell died on  October , but must have had a form of prescience. For in , more than thirty academic units and fields were eliminated in United Kingdom universities on grounds of efficiency, ranking in league tables, and performance indication. Each time the administrator concerned threw up her hands, claiming she had no choice, as the league table or the last Research Assessment Exercise “made me do it”. Up the line, politicians have gone further, even rejoicing in the New Management of British higher education and the pleasant prospect of even greater “efficiencies” in the next decade. Conrad Russell well understood that freedom is not just academic. An Intelligent Person’s Guide to Liberalism relies, then, on recent political history to provide its main narrative thrust. By the mid-point of the book, one has the impression that current events have shaped his liberalism, and that his understanding of the history of liberalism is “presentist”. But Conrad Russell starts by saying that he doesn’t pretend to be writing history (or philosophy) in his Guide. To call Conrad Russell “presentist” is to underplay... (shrink)

This paper engages with one debate in the emerging field of neuroethics. It is sometimes claimed on the strength of neuroscientific research that our actions are causally determined and therefore not truly free, or more modestly that brain structures or processes constrain some choices and actions, raising questions about our moral responsibility for them. I argue that a Reformed account of providence, sin and grace offers an account of causation able to resist hard determinism, reframes concepts of freedom and responsibility, (...) and provides a theological perspective for evaluating medical interventions in brain activity. Thus the paper not only contributes to a neuroethical debate, but also illustrates the capacity of Reformed ethics to respond creatively to novel problems. (shrink)

The Dayton General Framework Agreement for Peace of late 1995 brought a ceasefire and an end to the killings in Bosnia. More than 11 years after its signing, some of Dayton’s outlined aims for Bosnia remain unfulfilled or realized with mixed results. Late in 2005, on the occasion of the 10th anniversary of Dayton, leading world political figures raved about the successes of Dayton, but the immediate calls for the reform of Constitution included in the Dayton agreement, which followed the (...) praise, are perhaps a better indicator of the Agreement’s shortfalls in transitioning the Bosnian society from war to peace and subsequently creating a functioning state since its signing. The outlined aims of Dayton were undoubtedly ambitious. This article will examine the successes and failures of Dayton, within the framework of its own aims and jurisdiction – which themselves, in the process, evolved and changed – to protect human rights with respect to the freedom of movement, the return of refugees, and the war crime indictments. New methods of brain analysis show that in remaining conscious after their necks are cut, animals suffer extreme agony. In the United States, the Humane Slaughter Act mandates that animals be stunned before being cut in order to avoid that suffering, yet Orthodox Judaism mandates that animals remain conscious throughout. The Netherlands requires that animals be stunned if they are still conscious 40 seconds after being cut, mediating religious and animal-rights interests. The United States should reexamine religious exemptions to humane (...) slaughter laws given new brain analysis capabilities, and the Dutch government’s compromise could serve as a model. (shrink)

This paper aims to examine some of the broader social consequences of enabling digital rights management. The authors suggest that the current, mainstream orientation of digital rights management systems could have the effect of shifting certain public powers into the invisible hands of private control. Focusing on two central features of digital rights management ‐ their surveillance function and their ability to unbundle copyrights into discrete and custom‐made products ‐ the authors conclude that a promulgation of the (...) current use of digital rights management has the potential to seriously undermine our fundamental public commitments to personal privacy and freedom of expression. Neuroethics to date has tended to focus on social and ethical implications of developments in brain science, especially in functional neuroimaging. Within clinical neuroethics, the emphasis has been on ethical issues in clinical neuroscience practice, including informed consent to neuroimaging; the development of ethical research protocols for functional magnetic resonance imaging especially, and especially in children; and the ethical clinical management of incidental findings. Within normative neuroethics, we have witnessed the more philosophical and/or social scientific study of the meanings (...) of developments in neuroscience, including concerns about the impact of neuroimaging on privacy, freedom of thought, moral culpability, and sense of self. In this piece, I argue for an expansion of neuroethical attention to the interface of neuroscience and psychiatry, where brain science meets the clinical sciences of the mind. One of the key challenges of social policy in Poland in the early 21st century is to adapt its management to the requirements of a service economy. Essential conditions for the mixed economy of welfare have been already created after adjustments of the subsystems of national social policy during the first years of membership in the European Union since 2004. Labour market policies already include the relationships between providers from the public sector, the commercial sector, and the non-governmental sector. (...) However, the tasks and services of individual entities and institutions still lack coordination and integration. This paper focus on the examples of possibilities for their development by combining the activation policy with concepts of the governance and welfare mix. The paper presents the results of the author’s research on the implementation of welfare mix solutions in the field of professional activation of the unemployed people in Poland. Two case studies are included the implementation of outplacement programs that are based on the cooperation between different entities; and the cooperation between the public employment services and non-governmental employment agencies in the activation of people with disabilities in the labour market. Moreover, basic concepts of ongoing reforms of active labour market policies in Poland were discussed. The summary contains the practical recommendations and possible directions for further research in the field of integration of employment services. (shrink)

The development of a human right to water and sanitation under international law has created an imperative to implement human rights in water and sanitation policy. Through forty-three interviews with informants in international institutions, national governments, and non-governmental organizations, this research examines interpretations of this new human right in global governance, national policy, and local practice. Exploring obstacles to the implementation of rights-based water and sanitation policy, the authors analyze the limitations of translating international human rights into local water and (...) sanitation practice, concluding that system operators, utilities, and management boards remain largely unaffected by the changing public policy landscape for human rights realization. To understand the relevance of human rights standards to water and sanitation practitioners, this article frames a research agenda to ensure that human rights aspirations lead to public policy reforms and public health outcomes. Spirituality, in the broad sense, provides a deeper foundation for principles of international business ethics than legalistic, command-based ethics programs. Spiritual-based principles and values are presupposed and endorsed by established legal and ethical principles for international business. Identifying such spiritual-based principles and values requires the exercise of moral imagination and an openness to values embraced by the world's religions. Once identified, a new realm of moral freedom is attained for multinational corporations which may help them move beyond an "ethics for (...) sale" orientation. (shrink)

The principle goal of school today is the formation ofcitizens. Laws enshrine this sacred purpose, and politicians repeat it in every conceivable declaration oftheir programs. Public schools are ofcourse (...) part and parcel ofthe State. It is the ideals ofthe State that govern the educational process, and this in a double sense: schools should train pupils in these values, and at the same time reproduce these values in their functional processes. A quick glance at the characteristics of any high school allows us to recognize the values in question: a)Freedom of expression for teachers and pupils; freedom ofprograms, or rather the multiplication of subjects to be taught, since schools should represent every facet of our complex reality; freedom also from etiquette, from formal rules of behavior regarding what to wear, the way to speak up, how to address teachers; freedom, finally, from parents, who abandon to schools the role of primary and fundamental educator. b)Equality, a benefit ofdemocratization, which bears with it the obligation ofschooling for all; boys and girls study the same contents, and there is no exclusion for economic or religious reasons, nor for intellectual ones. c)Fraternity nowadays cashes out as tolerance, a true fetish word in the contemporary world. I would like to bring out some arguments underlying it, as described from the position ofa teacher ofadolescents who loves and enjoys his profession. This malaise does not spring from resistance to the ideals of our era—liberty, equality, fraternity—but from the experience of a surprising fact: the more one exalts that slogan, the more the intellectual task of the school recedes into the background. This book investigates the struggles for hegemony, and a possible ‘crisis of crisis management’ at the core of Italy’s political economy. With a specific focus on the conflict over the 2012 labour market reform, the book also explores the country’s trajectory in the area of economic and social reproduction. This chapter aims to combine the general framework of social investment with organizational forms and possible organizational changes. This chapter underlines mixed specifics of the contributions of various entities of the public sector, the private sector, the non-governmental sector, the informal sector, and hybrid organizations to the implementation of the creative ageing policy. The chapter also includes recommendations for the management of the creative ageing programs.

Weight-gain in psychiatric populations is a common clinical challenge. Many patients suffering from mental disorders, when exposed to psychotropic medications, gain significant weight with or without other side-effects. In addition to reducing the patients' willingness to comply with treatment, this weight-gain may create added psychological or physiological problems that need to be addressed. Thus, it is critical that clinicians take precautions to monitor and control weight-gain and take into account and treat all problems facing an individual. In this review, (...) we examine some of the key issues surrounding weight-gain in individuals suffering from mental disorders for contemporary practitioners in community clinics. We describe some factors known to make certain patients more susceptible to treatment-induced weight-gain and mechanisms implicated in this process. We also highlight a few psychological and pharmacological interventions that have proven effective in weight management. Importantly, we provide critical steps for management and prevention of weight-gain and related issues in the clinical practice of psychopharmacology. (shrink)

My paper responds to certain themes of Professor John McMurtry's recent book, Unequal Freedoms: The Global Market as an Ethical System. Although I am in general sympathy with McMurtry's penetrating critique of conventional market theory and practice, I find Unequal Freedoms ambivalent on the critical question of whether endorsing and enacting the life-value code McMurtry proposes would require only a mitigation of the principles and definitive activities of the competitive market system or whether significant reforms within the system would have (...) to be deep structural ones. It is argued that the second alternative is inescapable. I defend my perspective from the point of view of a philosophical analysis of orthodox or neo-classical theory-construction about the competitive market order. In particular, I examine three fundamental principles of such modelling: the maximization of the satisfaction of self-interest, the unboundedness of consumer desire for material goods, and the distribution of monetized wealth. In order for McMurtry's "civil commons" to survive, the practice of each of these principles would need to be radically modified. However, in doing so, competitive capitalism would lose its essential identity as a socio-economic order. (shrink)

Current symptom-based DSM and ICD diagnostic criteria for mental disorders are prone to yielding false positives because they ignore the context of symptoms. This is often seen as a benign flaw because problems of living and emotional suffering, even if not true disorders, may benefit from support and treatment. However, diagnosis of a disorder in our society has many ramifications not only for treatment choice but for broader social reactions to the diagnosed individual. In particular, mental disorders impose a sick (...) role on individuals and place a burden upon them to change; thus, disorders decrease the level of respect and acceptance generally accorded to those with even annoying normal variations in traits and features. Thus, minimizing false positives is important to a pluralistic society. The harmful dysfunction analysis of disorder is used to diagnose the sources of likely false positives, and propose potential remedies to the current weaknesses in the validity of diagnostic criteria. This article pursues the question whether and inasmuch theories of corporate responsibility are dependent on conceptions of managerial freedom. I argue that neglect of the idea of freedom in economic theory has led to an inadequate conceptualization of the ethical responsibilities of corporations within management theory. In a critical review of the history of economic ideas, I investigate why and how the idea of freedom was gradually removed from the canon of economics. This reconstruction aims at a deconstruction of (...) certain axioms of neoclassical economics that hamper contemporary efforts in integrating ethics firmly into management education. I intend to show by these deconstructive endeavors that a constructive use of the idea of responsible freedom could correct and complement the current quantitative focus in business theory through qualitative orientations. I argue that with the help of qualitative success criteria, the strategic integration of the tenets of both business ethics and Corporate Social Responsibility into business practice can be advanced by further research. Forest tenure reforms are occurring in many developing countries around the world. These reforms typically include devolution of forest lands to local people and communities, which has attracted a great deal of attention and interest. While the nature and level of devolution vary by country, all have potentially important implications for resource allocation, local ecosystem services, livelihoods and climate change. This book helps students, researchers and professionals to understand the importance and implications of these reforms for local environmental quality, climate (...) change, and the livelihoods of villagers, who are often poor. It is shown that local forest management can often be more successful than top-down management of common pool forest resources. The relationship of local forest tenure reform to the important climate change initiative REDD+ is also considered. The work includes a number of generic chapters and also detailed case studies from China, Ethiopia, Kenya, Nepal, Tanzania and Uganda. Using specific examples and a wide variety of disciplinary perspectives, including quantitative and qualitative analytical methods, the book provides an authoritative and critical picture of local forest reforms in light of the key challenges humanity faces today. This paper takes the vigorous political debate unleashed in Germany by the results of the PISA study as a stimulus to take a closer look at the strategic aims and effects of the current education reforms, of which the PISA study is only one example. It shows that the reform measures underpin a powerful process of normalisation. In this context, the PISA study, along with other reform measures, can be seen as a ‘power stabiliser’. The paper indicates how techniques of (...) political domination are linked with ‘technologies of the self’ and how the ‘discourse of self organization’ can be seen as the core of a governmental strategy to assimilate education more thoroughly than ever before into a network of disciplinary procedures and ‘voluntary self‐control’. The current health care system is not operating with a properly functioning market. Health care costs are hidden and often shifted, consumers and providers are insulated from the economic consequences of their decisions, and costs therefore go up dramatically. Instead of attacking both the structural deficiencies and the consequent inequities of the current employer based insurance system, the Clinton Plan simply expands them, and adds a heavier level of government regulation. The ultimate choice for the public is between a health (...) care system based on consumer choice or a government controlled system. In pursuing a market based health care reform that enhances personal freedom and responsibility, two ethical principles are served. First, American consumers will be made aware of the true costs of health care services, and market forces will thus introduce incentives on the part of providers to control costs. Second, justice will be served; for not only will providers of medical services receive their due, but public policy makers can target relief more effectively to those who need it most. Animal welfare is a complex matter that includes scientific, ethical, economic and other dimensions. Despite the existence of more comprehensive approaches to animal welfare and the obvious shortcomings of the ‘Five Freedoms’, for zoological gardens the freedoms still constitute the general guidelines to be followed. These guidelines reflect both, an ethical view and a science based approach. Analysis reveals that the potential ineptitude of the ‘Five Freedoms’ lies in the manifold perceptions that people have of other animals. These perceptions are (...) biased by our own umwelt, which is intertwined with different cultural attitudes towards other species. Perceptions of animals may be held simultaneously by different interest groups and may often be incompatible, thus often making it difficult to follow the ‘Five Freedoms’ in practice. We aim to recognise and consider the multiplicity of factors that, besides animal subjectivity, are relevant in understanding this hybrid environment. The moral value and practical applicability of the ‘Five Freedoms’ are sometimes undermined by prioritising some freedoms over others and by species bias. Both are characteristic phenomena of the zoo as a hybrid environment where other species are managed by humans. Given deficiencies are further amplified by humanistic and moralistic attitudes that people hold. (shrink)

This comparative study of management reforms in the United Kingdom and in Belgium between 1982 and 1985, focuses on the incentives to these reforms, on the objectives pursued by the governments of both countries in undertaking them and on the results which have been already obtained.The need to reduce severely public expenditure by improving efficiency and effectiveness in government is recognized in both countries, but the governments diverse on the contents of the reforms and on the methods used to (...) realize them. : In its response to pressures to rationalize health care resource allocation, the American health care system has embraced managed care without concurrent comprehensive health care reform, either in the form of the centralized tax-based systems found in Europe and Canada or that of the Clinton reform plan. What survives is managed care without managed competition, employer mandates, or universal access. Two problems inherent in the incentive structure of managed care plans developed in the absence of comprehensive health care reform (...) work against the public interest. First, sacrifices in terms of medical innovation and quality of care may not be offset by greater equity in the distribution of health care. Power is one of the key ideas in management, and so is the concept of authority. However, most studies on power are rather instrumental, dealing with the place of power in management, and how to achieve it. Less attention has been paid to the essential concepts of power and authority themselves in management thought and how they have evolved. To clarify these concepts, and to better understand the notions of power and authority in management and their (...) proper use in organisations, this paper goes back to one of the pioneers in management thought: Mary Parker Follett (1868-1933). She had an original vision of power, holding that genuine power is not ‘power-over’, but ‘power-with’. At the same time, she defended an authority based on function and responsibility. Abstract:In providing an ethical guide for managers, the Clarkson Principles offer one part of a possible professional code, namely, that managers have a fiduciary duty—a duty of loyalty of the corporation’s stakeholders. However, the Clarkson Principles contain little advise for managers when they act politically to fashion the regulatory framework in which stakeholders negotiate. When managers participate in these arenas, I argue that they ought to assume a second fiduciary duty—a duty of loyalty to fair bargaining. Where the first duty (...) of loyalty pertains to the firm’s “constituents,” the second refers to the firm’s “constitution”—to the rules by which the firm’s stakeholders bargain and to the background conditions that distribute advantages. Together, these two fiduciary duties establish the large good—development as freedom—from which a managerial profession can mature. (shrink)

The Article traces recent trends in the management and distribution of citizenship within the Israeli context of the 1990s, as they have evolved in the wake of new modes of migration that are neither Jewish nor Palestinian and that stem from liberalized market policies. The Article focuses on administrative and policy initiatives taken since September 2003 that deal with the naturalization of the children of undocumented labor migrants. The vulnerable situation of these migrants in lacking resident status and being (...) eligible for deportation, as well as the predominant Jewish ethno-national character of the Israeli state, make these initiatives and policy measures particularly surprising. However, these measures also reveal the boundaries of liberalizing reforms, as they become part of general trends in the nation-state towards deeming membership manageable without upsetting its national politics of identity. Indeed, it will be argued that, though this liberalizing legal reform is part of a larger context of demystification of national citizenship taking place in Israel following the adoption of socioeconomic liberal policies, it is also indicative of the adaptability of the nation-state as it seeks to reprioritize ethno-national definitions of citizenship in the face of new challenges.
