This is the first book-length project to examine the relationship between blackness, queerness, and hip hop. Using aesthetics as its organizing lens, Hip Hop Heresies attends to the ways that hip hop cultural production in New York City from the 1970s through the first fifteen years of the 21st century produced hip hop cultural products (film, visual art, and music) that offer "queer articulations" of race, gender, and sexuality that are contrary to hegemonic ideas and representations of those categories in (...) hip hop production, as well as in writing about hip hop culture. Why would philosophers interested in the points or functions of our conceptual practices bother with genealogical explanations if they can focus directly on paradigmatic examples of the practices we now have?? To answer this question, I compare the method of pragmatic genealogy advocated by Edward Craig, Bernard Williams, and Miranda Fricker—a method whose singular combination of fictionalising and historicising has met with suspicion—with the simpler method of paradigm-based explanation. Fricker herself has recently moved towards paradigm-based explanation, arguing that it is (...) a more perspicuous way of reaping the same explanatory pay-off as pragmatic genealogy while dispensing with its fictionalising and historicising. My aim is to determine when and why the reverse movement from paradigm-based explanation to pragmatic genealogy remains warranted. I argue that the fictionalising and historicising of pragmatic genealogy is well motivated, and I outline three ways in which the method earns its keep: by successfully handling historically inflected practices which paradigm-based explanation cannot handle; by revealing and arguing for connections to generic needs we might otherwise miss; and by providing comprehensive views of practices that place and relate the respects in which they serve both generic and local needs. Sudden enlightenment is awakening to be attained all at once. Hyun-Eung, a Korean Buddhist monastic, has proposed a new interpretation that sudden enlightenment is the revolutionary awakening of the dynamical and indivisible structure of cognitive subject and objects. I argue that Hyun-Eung’s ‘revolutionary enlightenment’ is achieved through a ‘paradigm shift’ in Thomas Kuhn’s sense as presented in his The Structure of Scientific Revolutions. Enlightenment is obtained when one’s essentialist and realist worldview is replaced, through a revolutionary change of paradigm shift, (...) by a new perspective based on the Buddhist teaching of dependent arising and emptiness. Prior to enlightenment, each person views oneself as a separate and independent individual who has her own essence. However, when our perspective on self and the world changes with the understanding of dependent arising and emptiness, it becomes clear that no one and nothing can exist independently of conditions. Everything comes into existence, abides, and passes out of existence only in dependence on conditions. Sudden enlightenment requires a revolutionary change in one’s perspective of self and the world. I conclude that this concept of revolutionary enlightenment aptly explains the features of sudden enlightenment. (shrink)

The Anthropocene is a radical reconceptualisation of the relationship between humanity and nature. It posits that we have entered a new geological epoch in which the human species is now the dominant Earth-shaping force, and it is rapidly gaining traction in both the natural and social sciences. This article critically explores the scientific representation of the concept and argues that the Anthropocene is less a scientific concept than the ideational underpinning for a particular worldview. It is paradigm dressed as epoch. (...) In particular, it normalises a certain portion of humanity as the ‘human’ of the Anthropocene, reinserting ‘man’ into nature only to re-elevate ‘him’ above it. This move promotes instrumental reason. It implies that humanity and its planet are in an exceptional state, explicitly invoking the idea of planetary management and legitimising major interventions into the workings of the earth, such as geoengineering. I conclude that the scientific origins of the term have diminished its radical potential, and ask whether the concept’s radical core can be retrieved. (shrink)

This article offers a functionalist account of trust. It argues that a particular form of trust—Communicated Interpersonal Trust—is paradigmatic and lays out how trust as a social practice in this form helps to satisfy fundamental practical, deliberative, and relational human needs in mutually reinforcing ways. We then argue that derivative (non-paradigmatic) forms of trust connect to the paradigm by generating a positive dynamic between trustor and trustee that is geared towards the realization of these functions. We call this trust’s proleptic (...) potential. Our functionalist approach does not only provide important insights into the practice of trust and its place in the broader web of social life, but also illuminates existing philosophical debates. First, pointing out how opposing theoretical accounts of trust each capitalise on only one of its functions, our paradigm-based approach reveals why they each contain a kernel of truth but are also deficient: the optimal realization of each function is tied to the existence of the other functions as well. Second, we show how a functionalist re-orientation can illuminate two recent disputes regarding (i) the question whether trust is explanatorily two- or three-place and (ii) whether (and to what extent) we can decide to trust others. A standard view would suggest that research is a neutral apolitical activity. It neutralizes external pressures by its fidelity to robust scientific methods. However, politics is an inevitable part of human knowledge. Our knowledge of the world is always mediated by human priorities. What matters is therefore a contested and political debate rather a neutral accumulation of factual data. How researchers manage this varies. Research paradigms are one way in which research engages with knowledge. They frame knowledge within epistemological and (...) ontological philosophies. In this paper, I will explore this view in relation to neo‐positivism, qualitative research, Foucault and critical realism. I will argue that if nursing knowledge is to be effective it needs to acknowledge the political, particularly in the context of neoliberalism. Healthcare systems are having to cope with a social world increasingly dominated by market fundamentalism, extreme levels of inequality and a rise in xenophobia. These forces are undermining the provision of ethically sound health care, misdirecting research practice and contributing to a discourse of dehumanization. These forces need to be challenged politically and I will argue that epistemologically diverse approaches, alongside a realist ontology can provide a way forward for nursing research. (shrink)

There are many calls for a definitions personhood, but also many logical and Wittgensteinian reasons to think fulfilling this is unimportant or impossible. I argue that we can consider many contexts as language-games and consider the person as the key player in each. We can then examine the attributes, presuppositions and implications of personhood in those contexts. I use law and therapeutic psychology as two examples of such contexts or language-games. Each correlates with one of the classic “theories” of ethics-deontology (...) and consequentialism. But each is a large enough cluster to consider them as paradigms in a sense related to Thomas Kuhn's notion in The Structure of Scientific Revolutions. Showing the presuppositions about and “takes” on personhood together with the connections involved in the paradigms deepens the dilemmas we already know to be present. (shrink)

In his recent bookThe Idea of Justice, Amartya Sen suggests that political philosophy should move beyond the dominant, Rawls-inspired, methodological paradigm – what Sen calls ‘transcendental institutionalism’ – towards a more practically oriented approach to justice: ‘realization-focused comparison’. In this article, I argue that Sen's call for a paradigm shift in thinking about justice is unwarranted. I show that his criticisms of the Rawlsian approach are either based on misunderstandings, or correct but of little consequence, and conclude that the Rawlsian (...) approach already delivers much of what Sen himself wants from a theory of justice. In Paradigms and Barriers Howard Margolis offers an innovative interpretation of Thomas S. Kuhn's landmark idea of "paradigm shifts," applying insights from cognitive psychology to the history and philosophy of science. Building upon the arguments in his acclaimed Patterns, Thinking, and Cognition, Margolis suggests that the breaking down of particular habits of mind—of critical "barriers"—is key to understanding the processes through which one model or concept is supplanted by another. Margolis focuses on those revolutionary paradigm shifts— such as the switch (...) from a Ptolemaic to a Copernican worldview—where challenges to entrenched habits of mind are marked by incomprehension or indifference to a new paradigm. Margolis argues that the critical problem for a revolutionary shift in thinking lies in the robustness of the habits of mind that reject the new ideas, relative to the habits of mind that accept the new ideas. Margolis applies his theory to famous cases in the history of science, offering detailed explanations for the transition from Ptolemaic to cosmological astronomy, the emergence of probability, the overthrow of phlogiston, and the emergence of the central role of experiment in the seventeenth century. He in turn uses these historical examples to address larger issues, especially the nature of belief formation and contemporary debates about the nature of science and the evolution of scientific ideas. Howard Margolis is a professor in the Harris Graduate School of Public Policy Studies and in the College at the University of Chicago. Following the publication of Thomas Kuhn’s Structure of Scientific Revolutions the term paradigm became ubiquitous. It is now commonplace in academic writing across the disciplines. Though much has been written about Kuhn’s use of the term and its impact on other fields, there has not yet been a systematic study of how frequently Kuhn used the term in Structure. My aim in this paper is to provide such an analysis. I aim to answer the following questions: (1) How many times (...) does Kuhn actually use the term in the book?; (2) What is the most number of times that he uses the term on a single page?; and (3) Is the term used evenly throughout the book or is it mentioned more often in some chapters than in others? We examine the philosophical disputes among computer scientists concerning methodological, ontological, and epistemological questions: Is computer science a branch of mathematics, an engineering discipline, or a natural science? Should knowledge about the behaviour of programs proceed deductively or empirically? Are computer programs on a par with mathematical objects, with mere data, or with mental processes? We conclude that distinct positions taken in regard to these questions emanate from distinct sets of received beliefs or paradigms within the discipline: – The rationalist (...) paradigm, which was common among theoretical computer scientists, defines computer science as a branch of mathematics, treats programs on a par with mathematical objects, and seeks certain, a priori knowledge about their ‘correctness’ by means of deductive reasoning. – The technocratic paradigm, promulgated mainly by software engineers and has come to dominate much of the discipline, defines computer science as an engineering discipline, treats programs as mere data, and seeks probable, a posteriori knowledge about their reliability empirically using testing suites. – The scientific paradigm, prevalent in the branches of artificial intelligence, defines computer science as a natural (empirical) science, takes programs to be entities on a par with mental processes, and seeks a priori and a posteriori knowledge about them by combining formal deduction and scientific experimentation. We demonstrate evidence corroborating the tenets of the scientific paradigm, in particular the claim that program-processes are on a par with mental processes. Quality of work life is generally associated with a series of objective organizational conditions and practices that enables employees of an organization to perceive that they are virtually safe, satisfied and have better chances of growth and development as individual human beings. QWL is nowadays drawing more attention globally as in modern society people spend about more than one-third of their lives at their workplace. Hence, the eminence and importance of QWL is unparalleled and unquestionable. This article first focuses on (...) the definitions of QWL, followed by various paradigms of QWL, which form the basic element of QWL in any organization: health and safety, employment security, job satisfaction, occupational stress, work environment, work–life balance and human relations. Finally, the article proposes some strategies to improve QWL in organizations that focus on different areas of organizational functions: employee participation, job design and work organization, workforce awareness and career guidance, inter-group relationships, role of HR managers, self-managing work teams, rewards, alternative work schedules and supportive organizational culture. A famous argument against Resemblance Nominalism is Russell's regress of resemblances, according to which the resemblance nominalist falls into a vicious infinite regress. Aristocratic Resemblance Nominalism, as opposed to Egalitarian Resemblance Nominalism, is the version of Resemblance Nominalism that claims that what makes F-things F is that they resemble the F-paradigms. I offer a new diagnosis as to why this modal consequence ensues. Central to my diagnosis is the concept of a paradigm term. I argue that modal and epistemic peculiarities that are commonly considered as distinctive of natural kind expressions are in fact traits that are shared by paradigm terms in general. The dominant technocratic philosophy which now guides policy and technological power is mechanistic. It conceptualizes nature as a resource to be controlled fully for human ends and it threatens drastically to alter the integrity of the planet’s ecosystems. Incontrast, the organic, person-planetary paradigm conceptualizes intrinsic value in all beings. Deep ecology gives priority to community and ecosystem integrity and seeks (...) to guide the design and applications of technology according to principles which follow from ecological understanding. Dr. Strange sees Dr. Stephen Strange abandon his once-promising medical career to become a superhero with the ability to warp time and space, and to travel through various dimensions. In order to make this transition, he is required to abandon many of his previous assumptions about the way the world works and learn to see things in a new way. Importantly, this is not merely a matter of learning a few facts, or of mastering new techniques. Instead, Dr. Strange is (...) required to alter his conception of the basic nature of the world and of how he relates to it. In time, this change extends to his values as well, as Strange comes to embrace his role in safeguarding the human world from interdimensional threats. -/- It is tempting to interpret Dr. Strange’s experience as one that shows the limits of rational, scientific inquiry, or even of human knowledge more generally. However, in this essay, I’d like to explore a different interpretation: that Strange’s experience can most fruitfully be thought of as a scientific revolution, in which Strange moves from one way of carrying out scientific inquiry to a different, incompatible way of doing it. In order to do this, I’ll be exploring the work of philosopher and historian of science Thomas Kuhn, who wrote a book—The Structure of Scientific Revolutions--about just this topic. Among other things, Kuhn’s work introduced the highly useful (though commonly misunderstood) notion of a paradigm shift. -/- We’ll begin by exploring what Kuhn describes as normal science, which consists of applying a set of well-understood concepts and methods to problems of interest. This “puzzle-solving” aspect of science is exemplified by Strange’s early successes in medicine. During this stage, scientists have good reasons to avoid questioning the basic validity of their paradigm, and to instead blame any problems that arise on other factors, such as human error. (As fans will know, Strange is quite good at assigning blame in just this way.) A crisis only occurs when significant, serious anomalies have accrued, such as those that Strange encounters in the aftermath of his accident. Even then, however, the old paradigm will only be abandoned only if a new paradigm can be found. Again, Strange’s experience bears this out, as he is able to move on only when the Sorcerer Supreme introduces him to the Mystic Arts. -/- Along the way, we’ll consider what it means for a practice to count as a scientific paradigm, and why it’s not just “anything goes.” Among other things, a paradigm requires that practitioners agree on which problems are most important, which techniques are appropriate to which problems, and what exemplary models of successful work look like. Scientists’ identities and social locations influence their work, but the content of scientific work can also influence scientists. Theory from feminist science studies, autoethnographic accounts, interviews, and experiments indicate that the substance of scientific research can have profound effects on how scientists are treated by colleagues and their sense of belonging in science. I bring together these disparate literatures under the framework of professional cultures. Drawing on the Survey of Earned Doctorates and the Web of Science, I use computational social (...) science tools to argue that the way scientists write about sex in their research influences the future gender ratio of PhDs awarded across 53 subfields of the life sciences over a span of 47 years. Specifically, I show that a critical paradigm of “feminist biology” that seeks to de-essentialize sex and gender corresponds to increases in women’s graduation rates, whereas “sex difference” research—sometimes called “neurosexism” because of its emphasis on essential, categorical differences—corresponds to decreases in women’s graduation rates in most fields. This paper investigates the nature of scientific realism. I begin by considering the anomalous fact that Bas van Fraassen’s account of scientific realism is strikingly similar to Arthur Fine’s account of scientific non-realism. To resolve this puzzle, I demonstrate how the two theorists understand the nature of truth and its connection to ontology, and how that informs their conception of the realism debate. I then argue that the debate is much better captured by the theory of truthmaking, and not by (...) any particular theory of truth. To be a scientific realist is to adopt a realism-relevant account of what makes true the scientific theories one accepts. The truthmaking approach restores realism’s metaphysical core—distancing itself from linguistic conceptions of the debate—and thereby offers a better characterization of what is at stake in the question of scientific realism. This article is primarily a defense of the Paradigm Case Argument (PCA). It is secondarily a comment on a recent controversy over the validity of its use in philosophy. I argue that the controversy rests on a misinterpretation. By extending the analysis of the objections (and here I invoke Descartes' famous method of possible doubt) I show that the occurrence of a paradigm and the fact that a concept is normally used to describe that paradigm logically entails not that the (...) paradigm is instantiated, but only that it is correct to apply that concept to that paradigm. In this manner the ontological fallacy is avoided, and further, this enforces the important separation between saying something about the correct application of a concept and saying something about its meaning. I explore moving from technocratic paradigms to the emerging ecological paradigms of planetary person ecosophies. The dominant technocratic philosophy's guiding policy and technological power is mechanistic. It conceptualizes nature as a resource to be controlled for human ends. Its global practices are drastically altering the integrity of the planet's ecosystems. In contrast, the organic, planetary person approaches respect the intrinsic values of all (...) beings. Deep ecology movement principles give priority to community and ecosystem integrity. These deep ecology movement principles guide the design and applications of technology by principles following from ecological understanding. The heart of philosophy is metaphysics, and at the heart of the heart lie two questions about existence. What is it for any contingent thing to exist? Why does any contingent thing exist? Call these the nature question and the ground question, respectively. The first concerns the nature of the existence of the contingent existent; the second concerns the ground of the contingent existent. Both questions are ancient, and yet perennial in their appeal; both have presided over the burial of (...) so many of their would-be undertakers that it is a good induction that they will continue to do so. For some time now, the preferred style in addressing such questions has been deflationary when it has not been eliminativist. Ask Willard Quine what existence is, and you will hear that "Existence is what existential quantification expresses. "! Ask Bertrand Russell what it is for an individual to exist, and he will tell you that an individual can no more exist than it can be numerous: there 2 just is no such thing as the existence of individuals. And of course Russell's eliminativist answer implies that one cannot even ask, on pain of succumbing to the fallacy of complex question, why any contingent individual exists: if no individual exists, there can be no question why any individual exists. Not to mention Russell's modal corollary: 'contingent' and 'necessary' can only be said de dicto (of propositions) and not de re (of things). (shrink)

In “Risk Based Passenger Screening in Aviation Security: Implications and Variants of a New Paradigm”, Sebastian Weydner-Volkmann describes the current paradigm shift from ‘traditional’ forms of screening to ‘risk based passenger screening’ (RBS) in aviation security. This paradigm shift is put in the context of the wider historical development of risk management approaches. Through a discussion of Michel Foucault, Herfried Münkler and Ulrich Beck, Weydner-Volkmann analyses the shortcomings of such approaches in public security policies, which become especially evident in the (...) aviation security context. As he shows, the turn towards methods of RBS can be seen as an attempt to address a trade-off ‘trilemma’ between the effective provision of security, the implied costs for industry and passengers, and the ethical, legal and societal implications of the screening procedures. In order to analyse foreseeable outcomes of embracing RBS, he differentiates three prototypical variants of the new paradigm on the basis of their main referent and rationale. For each variant, he then subsequently assesses the implications for the ‘trilemma’, after having unveiled the criteria of analysis that will necessarily have to be followed within a serious appraisal of RBS methods. In a forthcoming study I give an account of paradigm shifts as shifts in habits of mind. This paper summarizes the argument. Habits of mind, on this view, are what constitute a paradigm. Further, some particular habit of mind is ordinarily critical for a Kuhnian revolution. A contrast is drawn between this view and the "gap" view that is ordinarily implicit in analysis of the nature of of paradigm shifts.

This paper presents an account of the biological populations that can undergo paradigmatic natural selection. I argue for, and develop Peter Godfrey-Smith’s claim that reproductive competition is a core attribute of such populations. However, as Godfrey-Smith notes, it is not the only important attribute. I suggest what the missing element is, co-opting elements of Alan Templeton’s notion of exchangeability. The final framework is then compared to two recent discussions regarding biological populations proposed by Roberta Millstein and Jacob Stegenga.

When stripped to the bare bone, there are only 11 foundational paradigms in social sciences. These foundational paradigms are like flashlights that can be utilized to shed light on different aspects of human society, but each of them can only shed light on a limited area of human society. Different schools in social science result from different but often incomplete combinations of these foundational paradigms. To adequately understand human society and its history, we need to deploy all 11 foundational paradigms, (...) although more limited combinations of them may be adequate for understanding more specific social facts. This paper argues that commitment to the Dominant Social Paradigm (DSP) in Western societies, which includes support for such ideologies as free enterprise, private property rights, economic individualism, and unlimited economic growth, poses a threat to progress in imposing greater standards of corporate environmental accountability. It is hypothesized that commitment to the DSP will be negatively correlated with support for the New Ecological Paradigm (NEP) and support for corporate environmental accountability, and that belief in the NEP will be positively correlated (...) with support for corporate environmental accountability. This study provides data for a behavioral paradigm to resolve the free will issue in psychological terms. As predicted, college students selecting among many alternative responses consistently selected according to experimental set, environmental conditions, past experiences and other unknown factors. These explained and unexplained causal factors supplement one another and make varying relative contributions to different behaviors - the Principle of Behavioral Supplementarity. The more psychologically remote the causal factors, the greater proportion of unexplained ones relative to explained ones - (...) the Principle of Remote Antecedence. Both the causal categories can be conceptualized in the incompatible terms of reductionism or intentionality, depending upon the dissociated belief state of the observer - the Principle of Behavioral Complementarity. Ordinarily, on utilitarian grounds, behaviors with psychologically contiguous antecedents are best conceptualized in a reductionistic belief state, and behaviors with remote antecedents are best conceptualized in an intentional belief state. The Beiträge zur Philosophie mandates a paradigm shift in Heidegger scholarship. In the face of (1) widespread disarray in the current model, the new paradigm (2) abandons Sein as a name for die Sache selbst, (3) understands Welt/Lichtung/Da as that which gives being, (4) interprets Dasein as apriori openedness rather than as being-there, (5) understands the Kehre as the interface of Geworfenheit and Entwurf, not as a shift in Heidegger's thinking, (6) interprets Ereignis as the opening of the Da rather (...) than as appropriation, and (7) understands human finitude as what gives all forms of being and all epochs in the history of being. The conclusion alludes to the function of Mitdasein (co-openness) as die Sache selbst. (shrink)

This paper develops a new feminist paradigm for global justice that includes several components. I deploy a non-ideal ethics approach based on an argumentabout what principle of justice is possible to act on, given a historical and intersectional feminist analysis of what kind of feminist coalitions are possible in the present period. I claim that the time is ripe for a new progressive feminist Solidarity paradigm of justice that supersedes the classical liberal debates between Libertarian Freedom paradigm and the Social (...) Democrat Equality paradigm of Justice. I outline the antiglobalization economic and political networks coming into existence, as evidenced by networks of worker-owned cooperatives, labor unions, fair trade commitments, squatter and other land reform movements. Such movements are creating the material conditions in which North-South women’s coalition movements, based not on essentialist but on transformational identities, can unite around various issues of global gender justice, including reproductive rights, environmental justice, and the feminization of poverty. After a wave of breakthroughs in image‐based medical diagnostics and risk prediction models, machine learning (ML) has turned into a normal science. However, prominent researchers are claiming that another paradigm shift in medical ML is imminent—due to most recent staggering successes of large language models—from single‐purpose applications toward generalist models, driven by natural language. This article investigates the implications of this paradigm shift for the ethical debate. Focusing on issues like trust, transparency, threats of patient autonomy, responsibility issues in the (...) collaboration of clinicians and ML models, fairness, and privacy, it will be argued that the main problems will be continuous with the current debate. However, due to functioning of large language models, the complexity of all these problems increases. In addition, the article discusses some profound challenges for the clinical evaluation of large language models and threats to the reproducibility and replicability of studies about large language models in medicine due to corporate interests. Clinical bioethics is big business. There are now hundreds of people who bioethics in community and university hospitals, nursing homes, rehabilitation and home care settings, and some who play the role of clinical ethics consultant to transplant teams, managed care companies, and genetic testing firms. Still, there is as much speculation about what clinically active bioethicists actually do as there was ten years ago. Various commentators have pondered the need for training standards, credentials, exams, and malpractice insurance for ethicists engaged (...) in clinical consultation. Much of the discussion seems to accept an implicit presumption that all clinical ethics consultation practices look pretty much alike. But is this accurate? What do clinical ethicists do, how and where do they do it, and what kind of clinical ethics is useful in the hospital and in other settings? (shrink)

Special Relativity and the Early Quantum Theory were created within the same programme of statistical mechanics, thermodynamics and maxwellian electrodynamics reconciliation. I shall try to explain why classical mechanics and classical electrodynamics were “refuted” almost simultaneously or, in more suitable for the present congress terms, why did quantum revolution and the relativistic one both took place at the beginning of the 20-th century. I shall argue that quantum and relativistic revolutions were simultaneous since they had common origin - the clash (...) between the fundamental theories of the second half of the 19-th century that constituted the “body” of Classical Physics. The revolution’ s most dramatic point was Einstein’s 1905 photon paper that laid the foundations of both Special Relativity and Old Quantum Theory. Hence the dialectic of the old theories is crucial for theory change. Modern physics began with Einstein’s reconciliation of electrodynamics, mechanics and thermodynamics in 1905 and his unification of Special Relativity and Newtonian Theory of Gravity. Or, in more general social context: progressive scientific change can be described not in Weberian terms of zweckrational action forcing out all the other forms of action only but in terms of Habermas’s communicative rationality encouraging the establishment of mutual understanding between the various scientific communities also. Einstein’s programme constituted a progressive step in respect to its rivals not because it could explain more “facts” or was more “mathematical”. It was high than its rivals because it constituted a basis of communication and interpenetration between three main paradigms of 19-th century physics. Paradigms of International Human Rights Law explores the legal, ethical, and other policy consequences of three core structural features of international human rights law: the focus on individual rights instead of duties; the division of rights into substantive and nondiscrimination categories; and the use of positive and negative right paradigms. Part I explains the types of individual, corporate, and state duties available, and analyzes the advantages and disadvantages of incorporating each type of duty into the world public order, with special (...) attention to supplementing individual rights with explicit individual and state duties. Part II evaluates how substantive rights and nondiscrimination rights are used to protect similar values through different channels; summarizes the nondiscrimination right in international practice; proposes refinements; and explains how the paradigms synergize. Part III discusses negative and positive paradigms by dispelling a common misconception about positive rights, and then justifies and defines the concept of negative rights, justifies positive rights, and concludes with a discussion of the ethical consequences of structuring the human rights system on a purely negative paradigm. For each set of alternatives, the author analyzes how human rights law incorporates the paradigms, the technical legal implications of the various alternatives, and the ethical and other policy consequences of using each alternative while dispelling common misconceptions about the paradigms and considering the arguments justifying or opposing one or the other. Tensions between idealism and scientific realism have been resolved by an appeal to the theory/observation distinction. but many who support incommensurability reject the distinction in favor of a version of idealism, e.g., thomas kuhn who supports a version of relativist idealism in which the terms of a theory do refer, but only to a paradigm--relative world of entities. it is argued that the three kinds of idealism depend on a cluster theory of meaning for fixing the reference of scientific terms, (...) and that a realist interpretation of the growth of science must eschew such a theory of meaning. the kripke-putnam theory for reference fixing of theoretical terms is employed to show how one term, 'mass', is referentially invariant despite change in the theory of motion from newton to einstein.
