Michel Foucault embora não tenha sistematizado uma Teoria ou Filosofia do Direito em sentido estrito e, mesmo não sendo da área jurídica,construiu suas propostas em diversas obras, as quais acabam tecendo críticas e considerações acerca do Direito Penal e do Sistema de Justiça Criminal, a partir do modelo panóptico e das novas formas de punição no ambito do cárcere, envolvendo a transição do modelo feudal para o sistema capitalista de produção. Nesse sentido que se pode perguntar: qual a concepção foucaultiana (...) em relação às ilegalidades nesse novo modelo punitivo? Na hipótese a ser desenvolvida, Foucault parte de uma crítica ao formato das ilegalidades de bens e as ilegalidades de direitos, repensando o aparato judicial e seu estatuto jurídico o qual tem por finalidade “não a igualdade de todos perante a lei”, mas proteção da propriedade dos bens e, por consequência, a repressão ao ilegalismo popular; por outro lado, a permissão para a prática de ilícitos pelos detentores dos meios produtivos. _Palavras chave: Ilegalidade, bens, direito, capitalismo_. The aim of this study is to explore the role and the importance of the notary service in the process of dejudicialization of the judicial-civil protection. In this context, this paper first of all attempts to examine the extent to which the issues from the traditional competence of the court have been transferred to notary publics and the possibilities of further extension of this transfer. The judicial framework for the transfer of these issues from the court competences to (...) that of notary publics has been decided by the Law on Non-Litigious Procedure. In supporting this law, the notary publics undertook the realization of a series of activities in this field, namely in the field of inheritance. In this respect, the idea of this paper was to try to identify other judicial issues that could perhaps be entrusted to the notary publics in the future, by carrying out a judicial-political assessment of the public interest to transfer the resolution of certain issues to notary publics′ competences with the aim of facilitating the judicial circulation and increasing judicial security. The article considers the notary as a subject of active influence on the formation of postmodern democratic legal society, mediation of law in postmodern society. The constitutional definition of the state in this status does not mean that the civil law consciousness prevails in all spheres of its life. Since no person in society does not need this type of legal service, it is quite objective to consider this community as a subject whose activities should be considered as a (...) subject of formation not only of legal consciousness of society but also a leading subject of civil society. This primarily applies to private notaries, who, unlike public notaries, are fully responsible for the results of their activities. After all, a legal duty is organically combined with the responsibility from which the public notary is released. The study of the manifestations of the phenomenon of postmodernism is relevant to many disciplines, including - the philosophy of law. Modern research shows that classical types of legal understanding do not satisfy the understanding of postmodern law, which indicates the need to find a fundamentally new concept of law. The author concludes that the solution to this problem should be sought in the field of theories that offer new approaches to the interpretation of legal texts; this area is considered the most promising. Between the world wars, Lithuanian notary practice was based on the legal acts adopted from Russia, the Kingdom of Poland, and Germany. The most important was the Russian Notary Law of 1866, which was valid in the largest part of the Lithuanian territory. This law established the so-called approval system, in which the most important acts of the notary as indicated by civil law had to be approved by the senior notary, who worked under the supervision (...) of the county court. In 1919, upon transferring this outdated system into the Lithuanian law practice, only a few provisions were corrected. In addition to the right to collect fees from customers, the notaries had a fixed state remuneration established for them. The provisions for material liability of the notaries were abolished. This withdrawal from the so-called Latin model of notary practice was corrected by the changes to the Notary Law of 1932, which declared notaries as “civil servants without wages”. Thus, starting 1932, payments from the state have been discontinued while more regulation was enforced regarding the daily activities of notaries (e.g. notaries were required to work at least six office hours). Furthermore, the provisions on material liability were revived. (shrink)

Obiettivo del contributo è delineare l’attività editoriale di Umberto Notari, poco studiata dalla critica, analizzando alcune riviste fondate a Milano tra 1903 e 1917: il «Verde e Azzurro», «La Giovane Italia», «Gli Avvenimenti» e «Le Industrie Italiane Illustrate». Oltre a rintracciare le collaborazioni con i membri del Futurismo e del gruppo di Novecento, l’analisi di questi periodici mostra in che misura Notari si sia servito delle sue riviste per elaborare pionieristiche strategie pubblicitarie, di comunicazione di massa e di organizzazione del (...) consenso, che hanno avuto molti riflessi nella cultura visiva a lui contemporanea. One day in the year 1274, Giuntino Jacobi appeared at the church of Santo Stefano in Quarrata. According to the notarial contract in the register of Ildebrandino d'Accatto, Giuntino was already seething with rage when he arrived at the sanctuary. When he then tried to force his way into the church, the presbyter Donato refused him access by slamming the door in his face. There is little doubt that Donato felt threatened, as he very quickly set about raising the hue (...) and cry by sounding the church bell and calling out for help. Meanwhile Giuntino, in a gesture portending Khrushchev's more famous one, took off his shoe and began pounding on the church door until a group of local men arrived and carted him away. Donato lost no time in denouncing the shoe-thumping Giuntino to the court of the podestà. When Giuntino absented himself from court, he was fined 200 fiorini piccoli, declared contumacious, and by order of the General Council banished from the commune of Florence and its territories. Thanks to the institution of the peace agreement, this story has an unexpected ending. Six months later, Donato and Giuntino stood before a notary and three witnesses in the church of Sant'Angelo di Quarrata and reconciled their differences. Their dispute was settled with the kiss of peace. The written witness—the peace agreement—was duly registered in the notarial protocol of Ildebrandino d'Accatto. (shrink)

The fundamental rules which should be followed by Notary Public are: honesty, reliability, detachment and impartiality, as well as keeping the professional secret. As a crucial participant in creating and carrying into effect legal structures of free market, Notary Public performs public functions. Therefore, he or she is authorized to give an official character to declarations of persons being their clients. In view of the foregoing, the notary should secure such documents in trading abiding by the rules (...) and regulations of the governing law and ethics. With a view to a special role of the profession in question in economic trade, The National Notary Board passed a Notary Public Code of Professional Ethics, by virtue whereof a Notary shall with their attitude and actions give a good character to their profession and mind its dignity and honor. Any breach of the above – mentioned rules results in the Notary’s liability. Notary Public, as a person whose functions play a crucial role in legal trade and who is trusted by the parties, is responsible for correctness and precision of their activities. Smithson, Notari, Le Corbusier, Einstein…Renée Green’s work sketches genealogies through reconstructions and inquiries based on displacements through times and spaces, between the present and the past, the subject of narration and the subject of the story, here and elsewhere. In these back-and-forth movements between archive and fiction, historical figures emerge as ghosts which literally haunt her films, occupying a spatial borderline between imagination, history and the desires invested in the process of remembrance.

Freedom was, quite naturally, a dream cherished by every Brazilian slave. The desire for manumission - a more reliable route to freedom than the path of flight or revolt - was based on the experiences of other slaves in Brazil, a country open to all sorts of social adaptation practices. Consequently, the charters of liberty granted by masters and registered in notarial records have proved a rich source for the study of certain aspects of slavery itself. The similarity between the (...) title of the present article and that of the 1979 work To Be a Slave in Brazil reflects the fact that since the publication of that book, other authors have added to the bibliography on the subject of manumitted Brazilians, thus confirming the important role of this social group whose close connections with the slaves themselves were described in my previous study. In their experience of life, the manumitted slaves regularly encountered pitfalls that served as constant reminders of their skin color. Moreover, the daily lives of African blacks on the market, who at the time were merely African captives shipped to Brazil in various stages of youth and various degrees of adaptation to their slave status - along with the experiences of creole slaves (that is, those born in Brazil), of free-able slaves in the process of attaining freedom, of freed slaves, of children and grandchildren of manumitted slaves (who were therefore born free) - must all be understood not only in the context of their legal status but also and especially in the light of their subtly nuanced lives. We deal with themes like social and geographic representativity of this document and its character of a source for the study of mentalities, c1asping all the century and applying an aleatory sounding of a homogeneous type of notariate record.

The Disputation or Cathechesis of Tortosa with its sixty-nine sessions (February 7, 1413-November 12, 1413) was the longest of the Jewish Christian encounters in the Middle Age. Stirred by the Avignonesian Pope Benedict XIII, Geronimo de Sancta Fide, olim Yehoshua ha-Lorki, summoned a group of Catalan and Aragonese rabbis to inform them that the Messiah was already came. Not only the Papal notaries recorded the excruciating debates, but also two Hebrew sources: the anonymous and fragmentary letter published by Halberstam in (...) 1868 and the chapter 40 of the Shebet Yehuda. They encompass the first nine sessions carried out orally, before the Pope requested for written texts to be debated lately. Since these sources disagree on many details, this paper aims at examining them anew. That examination has shown that the anonymous account is more accurate than the fictional report of the Shebet Yehuda as far as the internal chronology of the sessions, the speeches of the Jewish delegates and their identities are concerned. The internal evidence leads us to subscribe with Riera i Sans in ascribing its authorship to Bonastruc Desmestre from Girona, who was at Tortosa on request of the Pope. He probably knew other Jewish chronicle and added some new materials from the Vikkuach Ramban, Salomon Ibn Verga, the author of Shebet Yehuda, built upon this chronicle and created a fictional account around Vidal Benveniste or the ‘ideal’ portrait of the Pope and added some materials from the Latin Protocols or from unknown Jewish sources. This paper analyses the details that characterized the negotiation and collection of the servicio de los naturales from the year 1603 onwards, the last time of those three in which moriscos of Granada paid to the Hispanic Monarchy after the Alpujarras War, when they were settled in Castile. The author has analysed documents coming from the Archivo General de Simancas, but also those included in notary’s protocols and in local archives. Its main contributions are three: to publish the content (...) of the actual contract signed by the moriscos and the Crown; to contribute to set up a precise spatial distribution of the communities that paid the tax and, finally, to show the amounts delivered by them. Irregularities, problems, and conflicts lived while the precedent servicios were being paid, are analysed too. There are aspects that we know thanks to other previous works. Nevertheless, if they are considered in relation with the situation of the year 1603, they allow observing that all those difficulties were used in order to improve the servicio itself and the agreement between the minority and the King. L’article explore l’acte notarié établi par Catalina de los Santos à Garachico (Tenerife) en 1593. Elle s’identifie comme mulâtresse, veuve, vecina de Santo Domingo sur l’île d’Española, et propriétaire du navire sur lequel elle voyage. Elle s’était rendue à Séville où elle avait fait affaire avec divers marchands et avait acheté une cédule royale (dont le nom du bénéficiaire a été laissé en blanc), lui permettant de voyager. Durant son voyage de retour, elle séjourne à Garachico dans la maison d’un (...) marchand qui héberge également ses « serviteurs et esclaves ». Elle signe de son nom à la fin. Le statut social et les activités commerciales de Catalina de los Santos la distinguent de la grande majorité des Africains et des personnes d’ascendance africaine qui résidaient dans la région à la fin du xvie siècle, nous obligeant à envisager un champ d’actions plus large pour les femmes d’ascendance africaine dans les ports maritimes des Caraïbes espagnoles. The Vida de Santa Oria is the most problematic of Gonzalo de Berceo's works. There is disagreement about its textual integrity, and important elements of its structure are imperfectly understood. The intent of this article is to demonstrate Berceo's use of literary and iconographic material prominent in the thirteenth-century monastic culture of San Millán de la Cogolla to construct a moral and eschatological definition of the contemplative life. The Vida de Santa Oria renders Christian eschatology through an elaborate symbolic structure, (...) circumscribed physically and spiritually by the cloister walls of San Millán, where Berceo, a secular priest, served as notary of one of the abbots. The economy of Berceo's communicative method is no small part of the excellence of his poem; his artistic self-cloistering mirrors the existential condition of his hagiographic subject. It derives from a conscious and complex choice, rather than from any limitation of his intellectual horizons. (shrink)

Cet article analyse les premiers exemples de testaments, actes de cession et autres documents notariés par lesquels des femmes réduites en esclavage puis libérées ont reçu des biens fonciers et des biens matériels à la fin du xviie et au début du xviiie siècle à la Barbade. Comme cette première période a été marquée par le développement de la société esclavagiste barbadienne et la croissance de la communauté des libres de couleur, ces documents donnent un aperçu des relations établies avec (...) les propriétaires d’esclaves et l’administration coloniale. L’une de ces séries documentaires concerne « Free Jenny » ou Jane Hallett qui résidait vers 1690-1740 dans la région connue sous le nom de « The Cameroons » ainsi que Sarah Hallett qui résidait à proximité de Halletts à Saint Michael. On y voit de quelle façon la terre se transmettait des élites blanches masculines à leurs familles blanches et non-blanches. On y voit aussi combien ces legs de terre étaient ténus. Mais ce type de document transmet également la voix des femmes libres ainsi que celle de certaines esclaves à travers les temps. (shrink)

Merchants in late medieval Antwerp worked with a number of different representatives: They appointed proxies to trade on their behalf, to collect debts in their name or to represent them in court. If a merchant wanted to authorize another person to act on his behalf, he went to a notary who issued a letter of procuration. The article discusses the role of Roman law in these procurations. It contrasts the procurations issued by the notaries with other models for procurations (...) found in a form book for notaries in Antwerp. The analysis comes to the conclusion that the basic idea of installing a proxy did not rely on Roman law. However, knowledge of Roman law was crucial if someone wanted to be represented in a Roman law court. Furthermore, concepts derived from Roman law were applied when complicated problems or phenomena had to be shortened to a few words. In sum, the practice of including phrases and concepts of Roman law wherever they proved useful can be regarded as a part of the lex mercatoria, the customary law of merchants. (shrink)

À partir des riches registres de la justice pénale de Bologne de la fin du Moyen Âge (les libri maleficiorum), l’article s’intéresse aux violences sexuelles faites aux jeunes filles et aux femmes par des hommes en replaçant le viol dans un ensemble d’atteintes sexistes et sexuelles. Après un essai d’identifier socialement les coupables et les victimes et une analyse du langage notarial stéréotypé utilisé dans ce type de crime, il s’agira de traiter de l’acte de viol lui-même, « connaître charnellement (...) une femme contre sa volonté et avec violence » mais aussi, en amont et en aval du coït imposé et violent, de toutes les atteintes psychologiques, physiques et sexuelles portées à l’encontre des femmes. Avant : pénétration dans la maison de la victime, injures à caractère sexuel et sexiste, menaces, violences physiques (jeter à terre, traîner par les cheveux, frapper, déplacement du lieu d’habitation au lieu du viol, etc.). Après : humiliation, opprobre, vexation de la victime et de sa parenté, nécessité pour la victime de prouver le non-consentement et difficultés de dénoncer. On terminera sur les parties lésées par le crime et les peines infligées au coupable, somme toute relativement légères. L’intégration du viol dans une longue chaîne de violence et d’humiliation subie par les femmes oblige à repenser, pour une période donnée, ce que nous entendons par « violence sexuelle ». (shrink)

This article contains an implicit comparison of the institutions and thought of the Italian city republics in the period from about 1150 to 1350 with medieval and early-modern monarchies and oligarchical republics, the latter being exemplified here by a passage from Bartolo of Sassoferrato. The grammarians, notaries, and jurists treated here are representative of the secular or lay professionalism that first emerged on a large scale in these republics. To these have been added occasional clerks who show the influence of (...) these legal and secular traditions, including Ptolemy of Lucca , whose On Princely Government continued a work by the far more famous Dominican Thomas Aquinas and hence enjoyed wide circulation and great influence. His work shows evidence of the influence of the translation of Aristotle's Politics done c. 1260; the only other author treated here who absorbed part of that tradition is the civilian jurist Bartolo of Sassoferrato. Most of the lawyers and other professionals derived their ideas from Roman law and, to a lesser extent, from Seneca and even Cicero. Readers may be surprised to observe that Marsiglio of Padua, surely Italy's premier political thinker, is not seen here at all or, rather, only once mentioned in passing. A reason for this is that he is much discussed in today's scholarly literature of political theory. A main intention of this author, however, has to do with him. It is to help explain the world he came from. If exaggerated, A. J. Carlyle's observation remains sound. Marsiglio, he said, “is not … setting out some new and revolutionary democratic doctrine, but is rather expressing, even if in rather drastic and unqualified terms, the normal judgement and practice of the [Italian] Middle Ages. This paper aims to analyse the enslavement of Moriscos from the Alpujarras during the initial months of the war of Grenade. This research is based on unknown historical records of the Archivo General de Simancas, which include a rich information about this issue. Other local and notarial sources treasured in several andalussian archives are also used in order to study the kingdom of Granada as a slave market during 1569-1571. These historical sources let to study the exports of Morisco slaves (...) to the main cities of the Guadalquivir valley during these years. (shrink)

In his book Byzantine Art in the Making; Main Lines of Stylistic Development in Mediterranean Art 3 rd–7 th Century, Ernst Kitzinger describes three types of subjects represented in a group of ivory plaques most likely executed in the same Roman workshop c. 400. He begins with the famous pair of ivory panels inscribed with the names Nicomachi (Paris, Musée Cluny) and Symmachi (London, Victoria and Albert Museum), two of the old Roman senatorial families known for their efforts and actions (...) to preserve and protect pagan rites during the final decades of the fourth century in Rome [fig. 1]. Each of the two panels shows a priestess performing a rite before an altar. Kitzinger's main interest was in the classicistic style of the settings and figures, recruited to emphasize the patrons' purposes. He compares the priestess diptych with the official ivory diptych of Rufius Probianus. There in each part Probianus, vicarius of the city of Rome, is seen seated on a throne flanked by two notaries [fig. 2]. Below, two patricians stand in acclamation pose. The devotional pair of ivories and the official one, says Kitzinger, are closely related. The borders of the first diptych, made of “delicately wrought palmette ornament” are identical with the frames of the second one, including the borders dividing the Probianus panels into upper and lower zones. This text The Apostolic Church: from the “Tent of God for Salvation and Healing” to the “Church of the Santa Vó Rosa” - Religious Mutations aims to describe the emergence and mutations experienced by an initially Pentecostal Church, founded in São Paulo, in 1954, in the wake of the divine healing movement. We try to answer the question: Given these changes experienced over the course of six decades, what of Pentecostal features remained at the end of this trajectory marked by (...) doctrinal, liturgical and administrative transformations? In the research, were examined: primary documentation; minutes of assemblies registered at notary offices; Church websites and bulletins; television documentaries and other documents posted on Youtube; newspapers; and electronic files produced by former members and pastors some years ago against the leadership of this Church. The data obtained lead us to the conclusion that the changes implemented are sufficient to classify this Church as a sect-type institution because of the closure in itself, the rigor of its discipline, of its eschatological emphasis and of its anticultural position. The Apostolic Church today maintains only a few remnants of its Pentecostal origins. (shrink)

In this paper we argue that hermeneutics acquires additional relevance in the era of technology. In particular legal hermeneutics offers examples of how the use of specific instruments aimed at constituting legal objects (like the digital instruments used by notaries) demonstrate that legal professions will never be entirely delegated to machines. The capacity to use the instruments and the very functioning of those instruments can never be detached from comprehension, and from legal savoir.

The current issue of the journal includes eleven articles. It opens with an argument by Jerzy Brzozowski on the question of the theoretical and practical legitimacy of the use of modern, and, in fact, colloquial language in the translation of the Holy Scriptures. Referring to the example of the Paulian Bible, which was intended to be characterized by language understandable to the modern reader, the author notes that only ostensibly “modern language” was used. Moreover, full phrases from the Millennium Bible (...) were borrowed in many places. Then follows a discussion by Nicholas Coureas based on Venetian and Genoese notarial deeds drawn up in Cyprus between 1362 and 1458, on the relationships between household slaves or servants and their owners. It turns out that they were very often supported by wills containing bequests for the benefit of slave women and illegitimate children born of these relationships. (shrink)

Presentamos un análisis de los protocolos de escribanos de la ciudad de Córdoba en el último cuarto del siglo XVI para reconocer las posibilidades y límites que presentan para el estudio de las movilidades de personas y bienes desde y hacia la jurisdicción en cuestión. El desarrollo de la presente investigación se sustenta en los argumentos legales y constitucionales que permiten impulsar la modernización del Estado ecuatoriano, considerando la desmaterialización de las actuaciones notariales y la manera como esta se vincula al principio de seguridad jurídica. La metodología empleada se basó en el enfoque cualitativo, de tipo descriptivo, utilizando como instrumento de recolección de datos la entrevista estructurada dirigida a notarios y abogados. Los principales resultados indican que en efecto la desmaterialización de documentos es percibida (...) como parte del proceso de modernización del Estado, y se ciñe al principio de seguridad jurídica, en virtud de los procedimientos establecidos, sin embargo, es preciso que se mantenga actualizado el sistema de información informático conforme a los adelantos tecnológicos, con el fin de lograr afianzar la confianza del usuario en el sistema, así como la constante capacitación de los servidores notariales y la simplificación de trámites para la obtención de la información.
