In this paper, we analyze the legal situation regarding physician-assisted suicide in the world. Our hypothesis is that the prohibitive stance on physician-assisted suicide in most societies in the world today seems to be related to our moral attitudes toward suicide. This brings us to a discussion about life itself. We claim that the total lack of legal protection for physician-assisted suicide from international organizations and most countries in the world lies in a philosophical assumption that supports much of our (...) common beliefs about what life really is. This assumption states that life must be thought of as not belonging exclusively to the individual. We argue that this assumption is a misconception that can be heard in the debate on suicide. Consequently we endorse a different conception of life which tends to favor a pro-choice stance towards suicide and assisted death in general. This position takes the patient’s decision about when to die more seriously. We conclude that there is no reason why physician-assisted suicide does not deserve legal protection as an individual right to die under international law. (shrink)

Comme les autres branches de l'ethique appliquee, l'ethique des affaires (business ethics) suscite de nombreuses questions epistemologiques et pratiques. Les premieres ont trait notamment aux rapports qu'entretiennent ses dimensions normative et empirique. Les secondes concernent surtout sa supposee incapacite a apporter un reel progres moral dans les pratiques des acteurs et dans le fonctionnement du systeme economique. Cette inefficacite est souvent mise sur le compte d'une allegeance inconditionnelle de la discipline au liberalisme. L'ethique des affaires s'est constituee sur ce fond (...) de scepticisme, et elle s'est efforcee d'y repondre de facon imaginative et constructive. C'est ainsi que certaines de ses theories ont une ambition considerable. Car si elles etaient effectivement mises en pratique, elles conduiraient a un changement radical du systeme economique actuel. Les textes qui composent cet ouvrage temoignent non seulement de la richesse des contributions de l'ethique des affaires sur ces deux types de questions, mais aussi de sa pretention a modifier profondement les pratiques de la vie economique. La première partie examine les contours de l'éthique des affaires et du (...) management, à travers une étude du sens des mots utilisés (particulièrement une minutieuse analyse de l'éthique), une recherche de ses finalités (la dignité de l'homme, le bien commun) et de ses organes. La seconde partie porte sur les atours de l'éthique des affaires et du management. D'abord dans le microcosme, c'est-à-dire entre partenaires, en dépeignant successivement les outils juridiques (la bonne foi, la cause, la transparence, etc.), les sujets (avec notamment d'importantes considérations sur le management des entreprises dans la lumière de la dignité du salarié) et le moment (dont les pourparlers, conduisant à traiter de la corruption). Ensuite dans le macrocosme, en visant par là les rapports entre tous les intervenants du monde des affaires (non partenaires), que ce soit entre concurrents, envers les non-concurrents, ou enfin envers les pays en voie de développement (donnant lieu à une analyse et à une présentation de perspectives). Ce livre est un essai multidirectionnel, comportant des ouvertures dans des domaines les plus variés, aux vues personnelles bien qu'appuyées par d'innombrables travaux récents dans des disciplines diverses. S'il constitue une réflexion théorique sur un vaste secteur de l'activité humaine, il a aussi une visée pratique. Fondé sur des convictions, il s'achève par une note optimiste. When visual attention is directed away from a stimulus, neural processing is weak and strength and precision of sensory data decreases. From a computational perspective, in such situations observers should give more weight to prior expectations in order to behave optimally during a discrimination task. Here we test a signal detection theoretic model that counter-intuitively predicts subjects will do just the opposite in a discrimination task with two stimuli, one attended and one unattended: when subjects are probed to discriminate the (...) unattended stimulus, they rely less on prior information about the probed stimulus’ identity. The model is in part inspired by recent findings that attention reduces trial-by-trial variability of the neuronal population response and that they use a common criterion for attended and unattended trials. In five different visual discrimination experiments, when attention was directed away from the target stimulus, subjects did not adjust their response bias in reaction to a change in stimulus presentation frequency despite being fully informed and despite the presence of performance feedback and monetary and social incentives. This indicates that subjects did not rely more on the priors under conditions of inattention as would be predicted by a Bayes-optimal observer model. These results inform and constrain future models of Bayesian inference in the human brain. (shrink)

Barzykowski and Moulin suggest that déjà vu and involuntary autobiographical memories recruit similar retrieval processes. Here, we invite the authors to clarify three issues: (1) What mechanism prevents déjà vu to happen more frequently? (2) What is the role of semantic cues in involuntary autobiographical retrieval? and (3) How déjà vu relates to non-believed memories?

Positive Psychology has turned its attention to the study of emotions in a scientific and rigorous way. Particularly, to how emotions influence people’s health, performance, or their overall life satisfaction. Within this trend, Flow theory has established a theoretical framework that helps to promote the Flow experience. Flow state, or optimal experience, is a mental state of high concentration and enjoyment that, due to its characteristics, has been considered desirable for the development of the performing activity of performing musicians. Musicians (...) are a population prone to health problems, both psychological and physical, owing to different stressors of their training and professional activity. One of the most common problems is Musical Performance Anxiety. In this investigation, an electronic intervention program was carried out for the development of psychological self-regulation skills whose main objective was to trigger the Flow response in performing musicians and the coping mechanism for Musical Performance Anxiety. A quasi-experimental design was used with a control group in which pre- and post-measures of Flow State, Musical Performance Anxiety and, also, Social Skills were taken. Sixty-two performing musicians from different music colleges in Spain participated in the program. Results indicated that the intervention significantly improved Flow State, and Sense of Control, and decreased Music Performance Anxiety, and self-consciousness of the participants in the EG but not CG. The changes in the EG after the program showed the inverse relationship between Flow and Anxiety. Two important theoretical factors of both variables, such as worry and the feeling of lack of control, could be involved. The results are under discussion and future lines of research are proposed. Este estudio presenta las evidencias psicométricas de la Escala de Aprendizajes Percibidos, basada en los elementos didácticos y pedagógicos del proceso de enseñanza-aprendizaje de una Experiencia Curricular en formulación y ejecución de «Programas de Intervención en Psicología». Investigación instrumental-psicométrica, de enfoque cuantitativo-transversal, con recolección de datos post-EC, en 117 estudiantes universitarios. Su contraste estadístico se realizó en el entorno R para Análisis Factorial Confirmatorio y Análisis Factorial de Componentes Principales, entre otros. Los resultados indican un adecuado ajuste orientado a 5 (...) factores, ratificado en análisis paralelos. Se concluye en la conformación de un constructo robusto, fiable y válido, que explora la conciencia de los aprendizajes en materia de promoción prevención en salud, y susceptible de adaptación. L'ethique des affaires semble prise dans une tension entre deux ambitions: d'une part, la recherche d'un cadre normatif sur-mesure, adapte aux specificites de la vie des affaires et respectueux de principes ethiques fondamentaux; d'autre part la formulation d'une nouvelle maniere de penser le role de l'entreprise dans la societe qui, tout en restant coherente avec le liberalisme economique, depasserait l'hypothese sous-jacente d'individualisme et reconcilierait la morale des affaires et la morale ordinaire. Dans certaines de ses versions, comme celle (...) defendue dans l'un des textes commentes (Edward Freeman et alii), la theorie des parties prenantes pretend faire la synthese de ces ambitions. Si elle se heurte a des resistances theoriques et pratiques, comme celle, classique, exposee par Milton Friedman dans le premier texte, elle renforce le poids des considerations politiques dans l'ethique des affaires et contribue a rapprocher cette branche de l'ethique appliquee de l'ethique economique et sociale. A basic income is typically defined as an individual’s entitlement to receive a regular payment as a right, independent of other sources of income, employment or willingness to work, or living situation. In this article, we examine what it means for the state to institute a right to basic income. The normative literature on basic income has developed numerous arguments in support of basic income as an inextricable component of a just social order, but there exists little analysis about basic (...) income within a jurisprudential or philosophical rights perspective. In our view, strong reasons of either a principled or a pragmatic nature in support of instituting a basic income scheme nevertheless often fall short of ascribing to basic income a distinctive Hohfeldian rights status. This article aims to partially redress this gap by examining two sets of questions. First, what are the implications – ethical and practical – of adopting basic income as a legal right as opposed to a mere policy? Second, we also enquire whether there should be such a right: what, if anything, is the ethical foundation that warrants granting basic income a distinctive legal rights status? This article suggests that any such foundation must be grounded in comparative evaluation and discusses several comparative strategies available to basic income advocates. The aim of this article is not to offer a definite argument in favor of a legal right to basic income, but to chart several lines of argument that a rights perspective might add to the contemporary discussion. Risk taking is a component of the decision-making process in situations that involve uncertainty and in which the probability of each outcome – rewards and/or negative consequences – is already known. The influence of cognitive and emotional processes in decision making may affect how risky situations are addressed. First, inaccurate assessments of situations may constitute a perceptual bias in decision making, which might influence RT. Second, there seems to be consensus that a proneness bias exists, known as risk proneness, which (...) can be defined as the propensity to be attracted to potentially risky activities. In the present study, we take the approach that risk perception and risk proneness affect RT behaviours. The study hypothesises that locus of control, emotion regulation, and executive control act as perceptual biases in RT, and that personality, sensation seeking, and impulsivity traits act as proneness biases in RT. The results suggest that locus of control, emotion regulation and executive control influence certain domains of RT, while personality influences in all domains except the recreational, and sensation seeking and impulsivity are involved in all domains of RT. The results of the study constitute a foundation upon which to build in this research area and can contribute to the increased understanding of human behaviour in risky situations. (shrink)

The triumph of the Sandinista Revolution on July 19, 1979 marked the beginning of a period of intensification of the struggle of the insurgent movements in El Salvador and Guatemala that, encouraged by the victory of their Sandinista comrades, tried to emulate the defeat of the oligarchy in their respective countries. Nicaragua acquired a relevant role as it had not had in the region until then, becoming one of the actors that would mark the course of the isthmus during the (...) eighties of the last century. One of the effects of this new role was the strengthening of relations between the Sandinista National Liberation Front and the Nicaraguan government with the guerrillas of the Farabundo Martí National Liberation Front of El Salvador and the National Revolutionary Unity. of Guatemala. The climate of revolutionary optimism that very graphically expressed this Central American vision of the revolution was summed up in the motto of the time: "If Nicaragua won, El Salvador will win and Guatemala will follow." Ingarden). Luego, indagamos cómo ocurre esta constitución en el caso concreto de La Tierra Baldía con toda su riqueza poética y sus valores estéticos. Particularmente, investigamos cómo es dado concretamente a nuestra conciencia el fenómeno estético de esta obra de arte literaria.

Many physicians are involved in relationships that create tension between a physician's duty to work in her patients’ best interest at all times and her financial arrangement with a third party, most often a pharmaceutical manufacturer, whose primary goal is maximizing sales or profit. Despite the prevalence of this threat, in the United States and globally, the most common reaction to conflicts of interest in medicine is timid acceptance. There are few calls for conflicts of interest to be banned, and, (...) to our knowledge, no one calls for conflicted practitioners to be reprimanded. Contrast our attitudes in medicine with public attitudes toward financial conflicts among government employees. When enforcement of rules against conflict of interest slackens in the public sector, news organizations investigate and publish their criticism. Yet even when doctors are quoted in the media promoting specific drugs, their personal financial ties to the drug maker are rarely mentioned. Policies for governmental employees are strict, condemnation is strong, and criminal statutes exist (allowing for corruption charges). Yet the evidence that conflict is problematic is, if anything, stronger in medicine than in the public sector. Policies against conflicts of interest in medicine should be at least as strong as those already existing in the public sector. (shrink)

This paper focuses on an emergency basic income as a tool for avoiding financial insecurity during the time of pandemic. The authors argue that paying each resident a monthly cash amount for the duration of the crisis would serve to protect them from the economic fallout.They suggest three reasons why the EBI proposal is particularly well-suited to play an important role in a comprehensive public health response to COVID-19: it offers an immediate and agile response; it prioritizes the most vulnerable (...) in the affected population; and it promotes a solidaristic response to the pandemic crisis. To go beyond the need to shut down and restart an EBI assistance scheme each time a pandemic hits, the authors propose considering turning the program into a permanent feature. (shrink)

Organizational membership seems to be linked to a more participatory and informed political culture, to foster electoral participation, and to promote positive feelings toward democracy. More recently, the social capital and associative democracy debates have introduced new arguments about the positive effects of associational involvement. However, little attention has been paid to the problems of measuring associational involvement and to their consequences for our theories. This article discusses the various problems of validity and reliability of our measurements of associational membership. (...) It is shown that different questionnaire formats produce substantially different results. En este caso particular analizamos a Karol Wojtyla �y en un cierto sentido a Juan Pablo II, quien, no obstante, en cuanto pontífice habla desde otra sede, la de Pedro�. Sin embargo, pensamos que (...) no hay discontinuidad en su pensamiento y el método fenomenológico, en cuanto método, tampoco está ausente de las reflexiones del pontífice, aunque la primacía aquí sea teológica y no filosófica. Secondly, by means of the analysis of certain scenes in The Saga of Gísli Súrsson, i aim to demonstrate that the inclusion of magic-religious motifs in the Sagas of icelanders has a triple objective: to provide a model to help understand apparently inexplicable phenomena, to intensify the tragic tone of the plot (...) and finally to depict those involved in the performance of seiðr in a very negative light. L’État est le plus souvent représenté comme une entité abstraite et neutre. Or il est fondamentalement une réalité concrète et située, qui s’incarne dans le travail de ses agents. Ceux-ci ne se contentent pas d’appliquer des directives et des procédures ; les jugements qu’ils formulent et les émotions qu’ils ressentent sont partie prenante de leurs décisions, dont la somme constitue l’action publique. Autrement dit, l’État est également une entité morale. C’est ce que montre cet ouvrage qui, au fil d’une (...) enquête ethnographique de cinq années, s’attache à comprendre l’ordinaire du fonctionnement de l’État à travers un ensemble d’institutions : la police, la justice, la prison, les services sociaux et la santé mentale, qui ont en commun d’avoir affaire, en large part, aux mêmes publics, composés d’individus de milieux populaires et précaires ou d’origine immigrée. Défini dans cette tension entre les politiques telles qu’elles se décident au sommet et les pratiques des agents dont les valeurs et les affects sont eux-mêmes nourris par les débats autour des problèmes sociaux qui font leur quotidien, l’État apparaît simultanément dans ses fonctions contradictoires d’État social en recul, d’État pénal en expansion et d’État libéral qui attend toujours plus de ses sujets. The answer I offer regards all emotions as potentially relevant to ethics, rather than singling out a privileged set of moral emotions. It relies on taking a moderate position both on the question (...) of the naturalness of emotions and on that of their objectivity as revealers of value: emotions are neither simply natural nor socially constructed, and they apprehend objective values, but those values are multi-dimensional and relative to human realities. The "axiological" position I defend jettisons the usual foundations for ethical judgments, and grounds these judgments instead on a rationally informed reflective equilibrium of comprehensive emotional attitudes, tempered with a dose of irony. The axiological position I defend jettisons the usual foundations for ethical judgments, and grounds these judgments instead on a rationally informed reflective equilibrium of comprehensive emotional attitudes, tempered with a dose of irony. Este trabajo se ocupa de algunas ideas éticas del filósofo latinoamericano Andrés Bello (1781-1865), en especial de su “teoría de los sentimientos morales”. En la polémica del siglo XIX entre el llamado racionalismo ético (representado por Théodore Jouffroy) y el utilitarismo (Bentham), Bello adopta una postura intermedia, que pudiera calificarse de “hedonismo moderado” o de “eudemonismo”. Sus puntos de vista sobre la motivación moral o la manera en que la razón y el sentimiento se entrelazan para formar nuestras creencias morales, (...) se revelan como muy próximos a las doctrinas de Aristóteles y de algunos autores contemporáneos. This article discusses five propositions about managerial moral tractability -- that is, a morality that is amenable to the complexity of managers’ continual pressure to decide and act -- in their customer relations. The propositions come from the comparison of three case studies of different types of managers. To analyze the morality of managers, discursive practices of managers are studied. El objetivo de este artículo es realizar una revisión del estado de la cuestión sobre el concepto de estado de naturaleza en el pensamiento de Thomas Hobbes. Dicha revisión permite articular una comprensión de la naturaleza humana, puesto que a diferencia del realismo político el estado de naturaleza en Hobbes no tiene un rol meramente hipotético. Precisamente, la idea de naturaleza humana articula una proto-moralidad que permite comprender la transición hacia el estado civil. Las investigaciones Kavka, Gauthier y Hampton han (...) construido una compleja compresión de la naturaleza humana, la cual permite entender cierto sustrato de proto-moralidad en el pensamiento hobbesiano. This paper outlines and defends a notion of tragic-remorse. This moral emotion properly accompanies those actions that involve unavoidable moral wrongdoing in general and dirty hands scenarios in particular. Tragic-remorse differs both phenomenologically and conceptually from regret, agent-regret and remorse. By recognising the existence of tragic-remorse, we are better able to account for our complex moral reality which at times makes it necessary for good persons to act in ways that although justified leave the agent with a moral stain and (...) a particular emotional response.
