A basic income is typically defined as an individual’s entitlement to receive a regular payment as a right, independent of other sources of income, employment or willingness to work, or living situation. In this article, we examine what it means for the state to institute a right to basic income. The normative literature on basic income has developed numerous arguments in support of basic income as an inextricable component of a just social order, but there exists little analysis about basic (...) income within a jurisprudential or philosophical rights perspective. In our view, strong reasons of either a principled or a pragmatic nature in support of instituting a basic income scheme nevertheless often fall short of ascribing to basic income a distinctive Hohfeldian rights status. This article aims to partially redress this gap by examining two sets of questions. First, what are the implications – ethical and practical – of adopting basic income as a legal right as opposed to a mere policy? Second, we also enquire whether there should be such a right: what, if anything, is the ethical foundation that warrants granting basic income a distinctive legal rights status? This article suggests that any such foundation must be grounded in comparative evaluation and discusses several comparative strategies available to basic income advocates. The aim of this article is not to offer a definite argument in favor of a legal right to basic income, but to chart several lines of argument that a rights perspective might add to the contemporary discussion. I point out an odd consequence of the role that broadly pragmatic considerations regularly play in determining moral demands. As a result of the way in which moral demands are formed, it turns out that people will frequently become morally good in a strange and rather dubious way. Because human beings are not very good, we will lower our moral demands and, as a result, most people will turn out, in an important sense, to be morally good. (...) This is an invited commentary on Richard Rorty's Dewey Lecture, given last year at the University of Chicago Law School. “Pragmatism,” says Rorty, “puts natural science on all fours with politics and art. It is one more source of suggestions about what to do with our lives.” I argue that the truth in pragmatism - that the epistemic norms that help us cope are the ones on which we rely - is obscured by Rorty's promiscuous version of the doctrine, which (...) confuses the criteria for relying on particular epistemic norms (namely, that they work for human purposes) with the content of the norms themselves (most of which make no reference to human purposes, but rather criteria like causal or explanatory power). We need presuppose no Archmiedean standpoint to conclude, as Richard Posner does, that moral inquiry is feeble in a way physics is not; we need only take seriously our best current understanding of the world, how it works, and the epistemic norms that have proven most effective in making sense of it. This book examines the issue of moral realism from a pragmatist point of view, drawing attention to our human practices of ethical evaluation and deliberation. It defends the essentially ungrounded and humanly fundamental place of ethics in our thought and action. Ethics must remain beyond justification and ubiquitous in our human form(s) of life.

Moral Perfectionism: Ethical Theory from a Pragmatic Approach This article tries to rescue the perfectionist approach to moral theory from the pragmatic tradition and inspiration. Based on the philosophy of Dewey and taking into account authors like H. Putnam or S. Cavell, it tries to defend the idea that pragmatism allows us to understand moral perfectionism in a new way. In that way, perfectionism is bound to a certain interpretation of practical rationality, and a new understanding of (...) moral objectivity and human subjectivity. To solve the problems of factory farming and animal experimentation, what we need is not new philosophical knowledge but a systematic exploration of how to put what we know into practice. This book argues for combining pragmatism and vision, reason and emotions, and morality and politics to foster significantly better human-animal relations.

Subject-sensitive invariantism posits surprising connections between a person’s knowledge and features of her environment that are not paradigmatically epistemic features. But which features of a person’s environment have this distinctive connection to knowledge? Traditional defenses of subject-sensitive invariantism emphasize features that matter to the subject of the knowledge-attribution. Call this pragmatic encroachment. A more radical thesis usually goes ignored: knowledge is sensitive to moral facts, whether or not those moral facts matter to the subject. Call this moral (...) encroachment. This paper argues that, insofar as there are good arguments for pragmatic encroachment, there are also good arguments for moral encroachment. (shrink)

One of the most prevalent and influential assumptions in metaethics is that our conception of the relation between moral language and motivation provides strong support to internalism about moral judgments. In the present paper, I argue that this supposition is unfounded. Our responses to the type of thought experiments that internalists employ do not lend confirmation to this view to the extent they are assumed to do. In particular, they are as readily explained by an externalist view according (...) to which there is a pragmatic and standardized connection between moral utterances and motivation. The pragmatic account I propose states that a person’s utterance of a sentence according to which she ought to ϕ conveys two things: the sentence expresses, in virtue of its conventional meaning, the belief that she ought to ϕ, and her utterance carries a generalized conversational implicature to the effect that she is motivated to ϕ. This view also makes it possible to defend cognitivism against a well-known internalist argument. (shrink)

Abstract:In this article, we present a pragmatic approach to neuroethics, referring back to John Dewey and his articulation of the “common good” and its discovery through systematic methods. Pragmatic neuroethics bridges philosophy and social sciences and, at a very basic level, considers that ethics is not dissociable from lived experiences and everyday moral choices. We reflect on the integration between empirical methods and normative questions, using as our platform recent bioethical and neuropsychological research into moral cognition, action, and (...) experience. Finally, we present the protocol of a study concerning teenagers’ morality in everyday life, discussing our epistemological choices as an example of a pragmatic approach in empirical ethics. We hope that this article conveys that even though the scope of neuroethics is broad, it is important not to move too far from the real life encounters that give rise to moral questions in the first place. Debates about the moral status of social robots (SRs) currently face a second-order, or metatheoretical impasse. On the one hand, moral individualists argue that the moral status of SRs depends on their possession of morally relevant properties. On the other hand, moral relationalists deny that we ought to attribute moral status on the basis of the properties that SRs instantiate, opting instead for other modes of reflection and critique. This paper develops and defends a pragmatic (...) approach which aims to reconcile these two positions. The core of this proposal is that moral individualism and moral relationalism are best understood as distinct deliberative strategies for attributing moral status to SRs, and that both are worth preserving insofar as they answer to different kinds of practical problems that we face as moral agents. Roboethics is a recently developed field of applied ethics which deals with the ethical aspects of technologies such as robots, ambient intelligence, direct neural interfaces and invasive nano-devices and intelligent soft bots. In this article we look specifically at the issue of (moral) responsibility in artificial intelligent systems. We argue for a pragmatic approach, where responsibility is seen as a social regulatory mechanism. We claim that having a system which takes care of certain tasks intelligently, learning from experience and (...) making autonomous decisions gives us reasons to talk about a system (an artifact) as being “responsible” for a task. No doubt, technology is morally significant for humans, so the “responsibility for a task” with moral consequences could be seen as moral responsibility. Intelligent systems can be seen as parts of socio-technological systems with distributed responsibilities, where responsible (moral) agency is a matter of degree. Knowing that all possible abnormal conditions of a system operation can never be predicted, and no system can ever be tested for all possible situations of its use, the responsibility of a producer is to assure proper functioning of a system under reasonably foreseeable circumstances. Additional safety measures must however be in place in order to mitigate the consequences of an accident. The socio-technological system aimed at assuring a beneficial deployment of intelligent systems has several functional responsibility feedback loops which must function properly: the awareness and procedures for handling of risks and responsibilities on the side of designers, producers, implementers and maintenance personnel as well as the understanding of society at large of the values and dangers of intelligent technology. The basic precondition for developing of this socio-technological control system is education of engineers in ethics and keeping alive the democratic debate on the preferences about future society. In Kitcher’s ‘pragmatic naturalism’ moral evolution consists in pragmatically motivated moral changes in response to practical difficulties in social life. No moral truths or facts exist that could serve as an ‘external’ measure for moral progress. We propose a psychologically realistic conception of moral objectivity consistent with this pragmatic naturalism yet alive to the familiar sense that moral progress has an objective basis that transcends convention and consensus in moral opinion, even when these (...) are products of serious, extended and collaborative reflection. A good chunk of the recent discussion of hypocrisy concerned the hypocritical “moral address” where, in the simplest case, a person criticises another for $$\phi $$ -ing having engaged in $$\phi $$ -ing himself, and where the critic’s reasons are overtly moral. The debate has conceptual and normative sides to it. We ask both what hypocrisy is, and why it is wrong. In this paper I focus on the conceptual explication of hypocrisy by examining the pragmatic features of (...) the situation where accusations of hypocrisy are made. After rejecting several extant views, I defend the idea that moral criticisms are best understood as moves in an agonistic or hostile conversation, and that charges of hypocrisy are attempts to prevent the hypocrite from gaining an upper hand in a situation of conflict. I finish by linking this idea to frame-theoretic analysis and evolutionary psychology. (shrink)

Political judgments usually combine a normative principle or intuition with an appreciation of empirical facts regarding the achievability of different options and their potential consequences. The interesting question dividing partisans of political idealism and realism is whether these kinds of considerations should be integrated into the normative principles themselves or considered apart. At first sight, if a theorist is concerned with guiding political judgments, non-ideal or realist theorizing can seem more attractive. In this article, however, I argue that ideal theorizing (...) might be considered valuable even by theorists moved by a pragmatic concern because it is less exposed to conservatism. I nonetheless contend that the aim to guide action in the world as it is should not be abandoned. Therefore, I outline a four-step method for proceeding from abstract moral principles to concrete political judgments and apply it to a test case. (shrink)

The question of responsibility plays a critical role not only in our attempts to resolve social and political problems, but in our very conceptions of what those problems are. Who, for example, is to blame for apartheid in South Africa? Is the South African government responsible? What about multinational corporations that do business there? Will uncovering the "true facts of the matter" lead us to the right answer? In an argument both compelling and provocative, Marion Smiley demonstrates how attributions of (...) blame—far from being based on an objective process of factual discovery—are instead judgments that we ourselves make on the basis of our own political and social points of view. She argues that our conception of responsibility is a singularly modern one that locates the source of blameworthiness in an individual's free will. After exploring the flaws inherent in this conception, she shows how our judgments of blame evolve out of our configuration of social roles, our conception of communal boundaries, and the distribution of power upon which both are based. The great strength of Smiley's study lies in the way in which it brings together both rigorous philosophical analysis and an appreciation of the dynamics of social and political practice. By developing a pragmatic conception of moral responsibility, this work illustrates both how moral philosophy can enhance our understanding of social and political practices and why reflection on these practices is necessary to the reconstruction of our moral concepts. By articulating a Peircean strain of bioethical inquiry, Elizabeth Cooke admirably attempts to avert the anti-realism, subjectivism and focus on consensus that afflict much so-called “pragmatic” bioethics. Yet, like many of her Deweyan colleagues, she falls prey to the egalitarian conviction that inquiry should be undertaken by huge numbers of like-minded individuals, proceeding in accordance with an authoritative canon of rules of discourse. In this essay, I argue that Cooke's egalitarianism is inconsistent with her apparent commitment to Peirce, and that (...) an alternative, libertarian account of inquiry is better and truer to Peirce. In his The Ethical Project, Philip Kitcher offers a pragmatic naturalistic account of moral progress, rejecting a moral realist one. I suggest a moral realist account of moral progress that embraces Kitcher’s pragmatic naturalism and calls on moral realism to show how the pragmatic account is successful. To do so I invoke a hypothesis about moral affordances and make use of a cognitive account of emotions.

In this paper, I offer a novel defense of moderate pessimism about moral deference, i.e., the view that we have pro tanto reason to avoid moral deference. I argue that moral deference fails to give us the epistemic credentials to satisfy plausible norms of moral assertion. I then argue that moral assertions made solely on the basis of deferential moral beliefs violate a plausible epistemic and moral norm against withholding information that one knows, (...) has evidence, or ought to believe will importantly affect another person’s deliberation. Finally, I argue that not only does moral deference fail to put the audience in a good epistemic position it also puts the audience in a bad epistemic and moral position. First, there is a tight connection between outright believing something and being disposed to assert it and so deferential moral beliefs often motivate people to assert something that they don’t have the epistemic credentials to properly assertion. Second, there will often be moral reasons to make assertions—even based on deferential moral beliefs. These assertions, while all-things-considered permissible, will be epistemic impermissible and involve violating a moral norm. (shrink)

In pluralistic modern societies, moral dissent will, to an increasing extent, be an inescapable fact in our lives. Moral dissent, however, involves various serious dangers: escalation of conflicts, the use of violence, flourishing of radical extremism and even civil war. There are basically two ways in which these threats can be addressed: coercive enforcement of consensus or tolerance. First, we could try to eliminate moral dissent by using more dictatorial forms of consensus formation, like propaganda, indoctrination and (...) terror. This, however, would endanger or even destroy the open society. Therefore, from a moral point of view, tolerance appears to be the more desirable antidote to the unwanted effects of moral dissent. This paper aims to contribute to the discussions about the regulation of moral dissent and the formation of moral consensus by analyzing one of the most important and idiosyncratic elements of the Dutch way of handling these issues: pragmatic tolerance. First, some general thoughts are developed about moral consensus, moral dissent and tolerance as a means of regulating dissent. In addition, the characteristic Dutch policy of pragmatic tolerance is described. Finally, some of the pros and cons of pragmatic tolerance are analyzed from an ethical perspective. (shrink)

The theory of human moral evolution elaborated in the later work of Jürgen Habermas represents one of the most challenging and provocative of recent, linguistically inspired attempts to reinterpret our understanding of Western history. In critically examining this theory, the present article identifies some major problems with Habermas's reinterpretation of the history of the formation of Western civilization as the universal pragmatic process of the evolution of human moral communicative competences. Drawing on the works of Norbert Elias and (...) Michel Foucault, the article seeks to show how the formal grounding of Habermas's evolutionary theory in the categories of his universal pragmatic conception of communicative action ultimately prevents him from grasping the radically embodied nature of human discursive practice and its implications for the historical process of the formation of human moral will. Biologically, pain is neither intrinsically good nor bad, but is a communication mechanism designed to serve organismal ends. Pain for any given person at any given time should be evaluated on the basis of “success” (or not) in serving those purposes. Yet, the physiological, psychological, and cultural complexity of the experience makes moral consideration of pain complicated. This is especially the case with infants in pain. The competence of the infant as a “decision maker” cannot, of course, be assumed. (...) Even if the child “thinks” about pain, an epistemological barrier exists in that the child cannot clearly communicate about the pain experience. Furthermore, any expressions of pain from the child may be necessary for diagnosis. Just coercion criteria provide a means of evaluating when and to what extent pain in infants should be controlled under the authority of surrogate decision makers. (shrink)

In the following pages we discuss three historical cases of moral economies in science: Drosophila genetics, late twentieth century American astronomy, and collaborations between American drug companies and medical scientists in the interwar years. An examination of the most striking differences and similarities between these examples, and the conflicts internal to them, reveals constitutive features of moral economies, and the ways in which they are formed, negotiated, and altered. We critically evaluate these three examples through the filters of (...) rational choice, utility, and American pragmatism, using the latter to support the conclusion that there is no single vision of moral economies in science and no single theory—moral, political, social—that will explain them. These filters may not be the only means through which to evaluate the moral economies examined, but aspects of each appear prominent in all three cases. In addition, explanations for decisions are often given in the language of these theories, both at the macro (policy) level and at the local level of the moral economies we discuss. In light of such factors, the use of these frameworks seems justified. We begin with an attempt to define the nature of moral economies, then move to a consideration of scientific communities as moral communities operating within material and other constraints which we relate to wider questions of political economy and societal accountabilities. In this article we will address the issue of obtaining insight into the way in which teachers deal with the normative side of their profession. We outline the problem that forms the context of our question (the difference in the meaning of good teaching in the process–product model and in ethical models) and we discuss Oser's discourse approach as a solution for that problem. His discourse approach appears to be a step forward, but at the same time leaves questions unanswered. (...) As a contribution we introduce the concepts of pragmatic, ethical and moral. Although moral case deliberation (MCD) is evaluated positively as a form of clinical ethics support (CES), it has limitations. To address these limitations our research objective was to develop a thematic CES tool. In order to assess the philosophical characteristics of a CES tool based on MCDs, we drew on hermeneutic ethics and pragmatism. We distinguished four core characteristics of a CES tool: (a) focusing on an actual situation that is experienced as morally challenging by the user; (b) stimulating (...) moral inquiry into the moral concepts, questions and routines in the lived experience of the CES tool user; (c) stimulating moral learning by exploring other perspectives; and (d) incorporating contextual details. We provide an example of a CES tool developed for moral dilemmas over client autonomy. Our article ends with some reflections on the normativity of the CES tool, other application areas and the importance of evaluation studies of CES tools. (shrink)

This article defends a pragmatic conception of objectivity for the moral domain. I begin by contextualizing pragmatic approaches to objectivity and discuss at some length one of the most interesting proposals in this area, Cheryl Misak's conception of pragmatic objectivity. My general argument is that in order to defend a pragmatic approach to objectivity, the pragmatic stance should be interpreted in more radical terms than most contemporary proposals do. I suggest in particular that we should disentangle objectivity from truth, (...) and I claim that moral inquiry is in most cases responsive to a normative standard that is closer to warranted assertibility than to truth. Using an argument that relies partly on Huw Price's account of forms of normative assertion, I will show that a practice-based account of warranted assertibility does the epistemic work required to defend objectivity while avoiding exposure to the criticisms that are usually addressed against this notion. Kant's critical philosophy is often regarded as standing in a problematic relation to his works in “anthropology”, or the study of human nature. In the Preface to the second edition of the Critique of Pure Reason Kant describes his critical project as a “Copernican” turn toward the cognitive subject, which might seem to signal a reorientation of philosophy around anthropology.1 However, both in the first Critique and in his subsequent works he relegates “empirical anthropology” and “practical” or “moral anthropology” (...) to the sidelines of his critical projects in cognitive and practical philosophy. Yet Kant's formulation of his critical philosophy coincided almost exactly with the development of his interest in anthropology. During the 1770s, the “silent decade” in which he formulated his critical philosophy, Kant initiated a course on anthropology at the University of Königsberg. This course was among the most popular in his regular schedule, and he offered it annually for twenty-five years until his retirement. He then published a revised version of his lectures as the Anthropology from a Pragmatic Point of View, a text that is one of his most accessible publications, and might even seem uncharacteristically loose and anecdotal to readers of his other works. Kant also published a number of shorter works on anthropological topics during this period, and even suggested, in several scattered remarks, that anthropology in some way encompasses all of the philosophical disciplines. Hegel’s treatment of ‘Moralität’ in both the Phenomenology of Spirit and the Philosophy of Right provides important clues as to how he conceives the recognitive dynamics of modern moral life. As ‘spirit that is certain of itself’, morality as comprehended in the Phenomenology is the final form of spirit [Geist], which, in Hegel’s exposition, follows ‘reason’ which itself had followed ‘consciousness’ and ‘self-consciousness’. Spirit had first been considered in its objective form as an ‘in itself’. This was the ‘true (...) spirit’ of the ethical world of antiquity. As something ‘for itself’, spirit had then been considered in its self-alienated form as ‘culture’ which had culminated in an analysis of modern politics—specifically the political project of ‘absolute freedom’, the French Revolution, and the terroristic consequences that had been so acutely linked to the modern rationalist political project by Schiller. But, as many have pointed out, if Rousseau was the theorist of the modern political struggle for autonomy, Kant had an equally revolutionary conception of moral autonomy, which, like Rousseau, put the idea of a self-legislating will at the centre of thought. Such an internalization of the self-legislating will, however, now reveals the proper object for judgment in terms of the evaluative polarity of good and bad—the will itself. This evaluation becomes the task of conscience. In this paper I examine Hegel’s treatment of the role of conscience in moral judgment in the light of his relationship to Fichte, and interpret it in terms of a broadly conceived pragmatics of reason-giving in moral life implicit in his concept of intersubjective recognition [Anerkennung]. This article makes both a more general and a more specific argument, and while the latter relies upon the former, the inverse does not apply. The more general argument proposes that empirical disciplines such as sociology are better suited to the production of ethical knowledge than more characteristically abstract and legalistic disciplines such as philosophy and theology. The more specific argument, which is made through a critique of Bauman’s Levinasian articulation of ethics, proposes what it calls ‘pragmatic humanism’ as a (...) viable alternative model for sociological ethics to follow. This model rejects the abstract notion of some innate and universally distributed moral impulse, and instead turns to acknowledgement of the precariousness of life as a strategic resource in the construction, rather than revelation, of ethical solidarity. There are many cases of conduct for which responsibility can plausibly be ascribed to a group, in addition to any responsibility ascribable to the group's constituent members. It is important to be able to make such ascriptions because without them we are unable to assign responsibilities for many sorts of humanly-caused harms for which responsibility cannot reasonably be ascribed to individuals alone. Two recent theories of collective responsibility advance our understanding of why it is important to be able to hold (...) groups accountable, but they apply only to a limited spectrum of groups, and rely on the plausibility of importing unnecessary individualistic assumptions into discussions of collective responsibility. ;I argue that we can justify ascription of collective responsibility without engaging in difficult metaphysical or ontological disputes. In particular, in order legitimately to ascribe collective responsibility we need not demonstrate that groups are capable of exhibiting intentions, or that groups can be considered 'moral persons'. We may reasonably consider organized groups to take action, and we may justly blame or praise them, when their members engage in what I call 'joint purposive behavior', as when an automobile manufacturer knowingly markets faulty vehicles. I argue, further, that certain unorganized groups, or 'random collectivities', can justly be blamed for promoting values and attitudes conducive to harmful behavior, as when a hate group advocates violent actions against minorities, or praised as groups for promoting values that encourage laudable behavior. ;I argue that most objections to collective responsibility rely on various misunderstandings of what it means for a group to be collectively responsible, notably, the belief that if a group is responsible its members cannot also be individually responsible, and the belief that collective responsibility 'distributes' among the individuals in the responsible group. In addition, I argue that large-scale environmental problems such as global warming lend themselves to a collectivist analysis, and that a view of collective responsibility that balances the harm-prevention and fault-finding purposes of responsibility ascription may help us to resolve such problems.
