Objective: Ethical guidelines are designed to ensure benefits, protection and respect of participants in clinical research. Clinical trials must now be registered on open-access databases and provide details on ethical considerations. This systematic survey aimed to determine the extent to which recently registered clinical trials report the use of standard of care and post-trial obligations in trial registries, and whether trial characteristics vary according to setting. Methods: We selected global randomized trials registered on http://www.clinicaltrials.gov and http://www.controlled-trials.com. We searched for intervention (...) trials of HIV/AIDS, malaria, and tuberculosis from 9 October 2004, the date of the most recent version of the Helsinki Declaration, to 10 April 2007. Results: We collected data from 312 trials. Fifty-eight percent (58%, 95% CI = 53 to 64) of trial protocols report informed consent. Fifty-eight percent (58%, 95% CI = 53 to 64) of trials report active controls. Almost no trials (1%, 95% CI = 0.5 to 3) mention post-trial provisions. Most trials measure surrogate outcomes. Twenty percent (20%, 95% CI = 16 to 25) of trials measure patient-important outcomes, such as death; and the odds that these outcomes are in a low income country are five times greater than for a developed country (odds ratio (OR) 5.03, 95% CI = 2.70 to 9.35, p = < 0.001). Pharmaceutical companies are involved in 28% (CI = 23 to 33) of trials and measure surrogate outcomes more often than nonpharmaceutical companies (OR 2.45, 95% CI = 1.18 to 5.09, p = 0.31). Conclusion: We found a large discrepancy in the quality of reporting and approaches used in trials in developing settings compared to wealthier settings. (shrink)

This paper describes a tool for assisting lawyers and paralegal teams during document review in eDiscovery. The tool combines a machine learning technology (CategoriX) and advanced multi-touch interface capable of not only addressing the usual cost, time and accuracy issues in document review, but also of facilitating the work of the review teams by capitalizing on the intelligence of the reviewers and enabling collaborative work.

Many would argue that since Kant's day, the study of the starry heavens has advanced while ethics has stagnated, and in particular that Kant's ethics offers an empty formalism that tells us nothing about how we should live. In Acting on Principle Onora O'Neill shows that Kantian ethics has practical as well as philosophical importance. In 1690 a Latin translation of a philosophical treatise, originally written in English by Anne Conway , was published anonymously. The English manuscript did not survive, but in 1692 the Latin version of Conway's text was translated (...) into English as The Principles of the Most Ancient and Modern Philosophy. Conway was widely known by seventeenth-century philosophers and religious writers, including the Cambridge Platonist, Henry More; Descartes's correspondent, Princess Elisabeth of Bohemia; Robert Boyle; physician and vitalist philosopher, Francis Mercury van Helmont; as well as numerous Quaker leaders. And her Principles were read with critical approbation by such figures as Leibniz. Further, Conway's text is probably the most anthologized of the writings of seventeenth-century women philosophers. It is curious, then, to discover a dearth of critical literature on the Principles. When Peter Loptson produced the first modern edition of the Principles , he attempted to interest contemporary philosophers in Conway's essentialist metaphysics. People more frequently select norm-violating factors, relative to norm- conforming ones, as the cause of some outcome. Until recently, this abnormal-selection effect has been studied using retrospective vignette-based paradigms. We use a novel set of video stimuli to investigate this effect for prospective causal judgments—i.e., judgments about the cause of some future outcome. Four experiments show that people more frequently select norm- violating factors, relative to norm-conforming ones, as the cause of some future outcome. We show that the abnormal-selection effects (...) are not primarily explained by the perception of agency (Experiment 4). Legalisation of assisted suicide presents a dilemma for society. This arises because of a lack of consensus regarding the precedence to be accorded freedom of choice versus the inviolability of human life. A combination of factors has served to throw this dilemma into sharper focus in recent times. Inchoate crime consists of acts that are regarded as crimes despite the fact that they are only partial or incomplete in some respect. This includes acts that do not succeed in physically harming the victim or are only indirectly related to such a result. Examples include attempts (as in attempted murder that does not eventuate in the killing of anyone), conspiracy (in which case the crime has only been planned, not yet acted out) and incitement (where the inciter does not (...) himself commit the crime he is urging others to undertake). The present paper attempts to analyze these inchoate crimes from a libertarian perspective, based on the non-aggression principle. (shrink)

This article is the first in-depth analysis of the direct intellectual engagement between one of America's most important Founding Fathers, John Adams, and the work of the leading modern feminist, Mary Wollstonecraft. It draws on the first complete transcription of Adams's marginalia in his copy of Wollstonecraft's French Revolution to argue that these two thinkers disagreed profoundly in their respective assessments of the watershed event of political modernity due to their divergent interpretations of the relationship between human nature, history, and (...) ABSTRACT It is widely supposed by both its proponents and critics that communitarianism is committed to the defence of lies of nationhood: the nation forms a surviving communal attachment in a world in which the individual is otherwise denuded of ties of community. I argue in this paper that this assumption is mistaken. It depends on a romantic image of the nation which was constructed in the eighteenth and nineteenth centuries. That image hides the recent historical origins of the nation (...) and its foundation in the suppression of older allegiances or their later privatisation; it continues to disguise the illusory nature of the national community. The nation is not a surviving pre‐modern community to which individuals are attached as a bulwark against the impersonality of public life in modern society. Rather the nation is one of the main vehicles for the construction of the modern unencumbered self. Communitarians need not be committed to the defence of the specifically modem forms of public irrationality and immorality that nationalism embodies. (shrink)

ABSTRACT Is a scientific attitude to the natural world an obstacle to an appreciation of its value? This paper argues that it is not. Following Aristotle and Marx, it maintains that, properly pursued, science has value because it enables us to contemplate that which is wonderful and beautiful. However, the paper concedes that, as actually practised, science can foster a vice described by Augustine as ‘the lust of the eyes’: knowledge is sought not to open us to the world, but (...) merely to satisfy the itch of curiosity. If scientific knowledge is thus pursued, no limits to the means to it nor to its objects are recognised. Those who thus seek knowledge fail to understand its value. (shrink)

How does character information inform judgments of blame? Some argue that character information is indirectly relevant to blame because it enriches judgments about the mental states of a wrongdoer. Others argue that character information is directly relevant to blame, even when character traits are causally irrelevant to the wrongdoing. We propose an empirical synthesis of these views: a Two Channel Model of blame. The model predicts that character information directly affects blame when this information is relevant to the wrongdoing that (...) elicits blame. Further, the effect of character information on blame depends on judgments about the true self that are independent of judgments of intentionality. Across three pre-registered studies (N = 662), we found support for all three predictions of the Two Channel Model. We propose that this reflects two distinct functions of blame: a social regulatory function that encourages norm compliance and a pedagogical function that encourages personal improvement. (shrink)

ABSTRACT In a recent paper Alan Carter argues that the claim that workers’co‐operatives merely replace exploitation by employers with ‘self‐exploitation’is nonsense: the term ‘self‐exploitation’is self‐contradictory. He maintains that the only form of exploitation to which a workers’co‐operative may be said to be subject is ‘market‐exploitation’by dominant economic actors who are external to the co‐operative. I argue that these conclusions are mistaken. While the concept of ‘market‐exploitation’is not without value, it is difficult to operationalise. While the concept of ‘self‐exploitation’is, understood literally, (...) incoherent, the claims defended by some of the users of this term can be made conceptually respectable. (shrink)

In a recent article, ?Marxism and Radical Democracy?,1 Femia argues that Marxism is incompatible with radical democracy. In so doing he specifically reiterates2 a now common claim that the notion of scientific socialism defended by Marx and Engels and prevalent in the Second International is anti?democratic. This claim has not only been made by critics of Marxism.3 It has been a major criticism of classical Marxism within the Western Marxist tradition, in particular? in the work of the Frankfurt School.4 It (...) is one of the main reasons why the classical Marxism of Engels and the Second International has been rejected as positivist and vulgar: no modern sophisticated Marxist admits to either positivism or vulgarity. In this paper I examine and reject Femia's arguments for the claim that the notion of scientific socialism is undemocratic. I argue that the orthodox view of Marxism as a scientific theory is compatible with democracy, and indeed encourages a democratic understanding of socialism. A thoroughly vulgar Marxism is thoroughly democratic. (shrink)

The necessity for a government “lender of last resort” has been advanced as a justification for central banking. In this paper, I compare lending practices under central banking with those that would be likely to exist under a system of fractional-reserve free banking (FRFB). To do this I examine the underlying nature of banks as warehousing and credit-granting institutions and consider how redemption runs can arise as a consequence of fractional reserves in this system. Following the work of Thornton and (...) Bagehot, I describe principles of prudent lending that can be used to stem a redemption run when it arises. I examine the market incentives that apply under FRFB and how these incentives are perverted under a system of central banking. I find that a government central bank is not well-placed to lend according to prudent standards, and in fact is likely to use its power to pursue political goals that are at odds with prudent lending. I examine the US financial crisis and the actions of the Federal Reserve System to illustrate this view. (shrink)

In the last few decades, several philosophers have written on the topic of moral revolutions, distinguishing them from other kinds of society-level moral change. This article surveys recent accounts of moral revolutions in moral philosophy. Different authors use quite different criteria to pick out moral revolutions. Features treated as relevant include radicality, depth or fundamentality, pervasiveness, novelty and particular causes. We also characterize the factors that have been proposed to cause moral revolutions, including anomalies in existing moral codes, changing honour (...) codes, art, economic conditions and individuals or groups. Finally, we discuss what accounts of moral revolutions have in common, how they differ and how moral revolutions are distinguished from other kinds of moral change, such as drift and reform. When can one say that a new theory is truer than the old one it contradicts, even though neither is absolutely true? We are primarily concerned with the case in which the conflicting theories offer answers to the same questions, and so we do not introduce considerations of "logical width". We propose that part of the new theory is truer than part of the old one when the former part gets right whatever the latter-part got right while the former does (...) not make any new mistakes. Pragmatic considerations will determine the relative importance of whatever new mistakes the new theory does make as a whole. To avoid artificial counterexamples, we restrict the parts compared to those that are "convex". A "convex" theory is one that holds in all cases intermediate between any two cases in which it holds. Why has autonomy been a leading idea in philosophical writing on bioethics, and why has trust been marginal? In this important book, Onora O'Neill suggests that the conceptions of individual autonomy so widely relied on in bioethics are philosophically and ethically inadequate, and that they undermine rather than support relations of trust. She shows how Kant's non-individualistic view of autonomy provides a stronger basis for an approach to medicine, science and biotechnology, and does not marginalize untrustworthiness, while also explaining (...) why trustworthy individuals and institutions are often undeservingly mistrusted. Her arguments are illustrated with issues raised by practices such as the use of genetic information by the police or insurers, research using human tissues, uses of new reproductive technologies, and media practices for reporting on medicine, science and technology. Two centuries after they were published, Kant's ethical writings are as much admired and imitated as they have ever been, yet serious and long-standing accusations of internal incoherence remain unresolved. Onora O'Neill traces the alleged incoherences to attempts to assimilate Kant's ethical writings to modern conceptions of rationality, action and rights. When the temptation to assimilate is resisted, a strikingly different and more cohesive account of reason and morality emerges. Kant offers a "constructivist" vindication of reason and a moral (...) vision in which obligations are prior to rights and in which justice and virtue are linked. O'Neill begins by reconsidering Kant's conceptions of philosophical method, reason, freedom, autonomy and action. She then moves on to the more familiar terrain of interpretation of the Categorical Imperative, while in the last section she emphasizes differences between Kant's ethics and recent "Kantian" ethics, including the work of John Rawls and other contemporary liberal political philosophers. Wood] Kant's moral philosophy is grounded on the dignity of humanity as its sole fundamental value, and involves the claim that human beings are to be regarded as the ultimate end of nature. It might be thought that a theory of this kind would be incapable of grounding any conception of our relation to other living things or to the natural world which would value nonhuman creatures or respect humanity's natural environment. This paper criticizes Kant's argumentative strategy for (...) dealing with our duties in regard to animals, but defends both his theory and most of his conclusions on these topics. /// [Onora O'Neill] Kant's ethics, like others, has unavoidable anthropocentric starting points: only humans, or other 'rational natures', can hold obligations. Seemingly this should not make speciesist conclusions unavoidable: might not rational natures have obligations to the non-rational? However, Kant's argument for the unconditional value of rational natures cannot readily be extended to show that all non-human animals have unconditional value, or rights. Nevertheless Kant's speciesism is not thoroughgoing. He does not view non-rational animals as mere items for use. He allows for indirect duties 'with regard to' them which afford welfare but not rights, and can allow for indirect duties 'with regard to' abstract and dispersed aspects of nature, such as biodiversity, species and habitats. This edited collection presents the case for a research program (in Lakatos's sense) in the social sciences based on the theory of recognition developed by Axel Honneth and others in recent years. The cumulative argument of the book is that recognition theory provides both a plausible framework for explaining social conflict and a normative compass for reaching just resolutions.

Towards Justice and Virtue challenges the rivalry between those who advocate only abstract, universal principles of justice and those who commend only the particularities of virtuous lives. Onora O'Neill traces this impasse to defects in underlying conceptions of reasoning about action. She proposes and vindicates a modest account of ethical reasoning and a reasoned way of answering the question 'who counts?', then uses these to construct linked accounts of principles by which we can move towards just institutions and virtuous (...) lives. This article makes the case for a specific variety of what we call Collective Capital Institutions (CCIs), by returning to the idea of Wage-Earner Funds (WEFs) – a 1970s Swedish policy proposal designed gradually to shift ownership and control over parts of the economy to democratically controlled institutions. We identify two attractive rationales in favour of such a scheme and argue that both can fruitfully be transposed to the current worldwide economic situation. The egalitarian rationale is that WEFs could help (...) in the pursuit of equality by giving a wider set of people a stake in collectively owned companies and a right to their profits. The democratic rationale is that WEFs redistribute not only these profits, but also the power over economic decisions made within companies. We then contrast such schemes for collective capital ownership with the similar but much more privatised proposals set out in, for instance, John Rawls's idea of a ‘property-owning democracy’. We argue that CCIs ultimately are more likely to contribute to the development of the ‘sense of justice’ within society that is needed for a stable just society. We conclude that CCIs deserve a great deal more exploration in academic and political discussions of egalitarian economic systems. (shrink)
