Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

Based on a comparison of various sources, such as different editions, correspondence, reviews, and lecture transcripts, it is shown that Ludwig Heinrich Jakob’s Outline of the General Logic and Critical Elements of Metaphysics in General uses one or more transcripts of Kant’s Logic Lectures as a source. In addition to the thus far known texts by Kiesewetter and Hippel, Jakob’s textbook should therefore also be added to the list of secondary transmissions of Kant’s Logic Lectures.

This book explores in detail the relation between ontology and ethics in the early work of Ludwig Wittgenstein, notably the _Tractatus Logico-Philosophicus_ and, to a lesser extent, the _Notebooks 1914-1916_. Self-contained and requiring no prior knowledge of Wittgenstein's thought, it is the first book-length argument that his views on ethics decisively shaped his ontological and semantic thought. The book's main thesis is twofold. It argues that the ontological theory of the _Tractatus_ is fundamentally dependent on its logical and linguistic (...) doctrines: the tractarian world is the world as it appears in language and thought. It also maintains that this interpretation of the ontology of the _Tractatus_ can be argued for not only on systematic grounds, but also via the contents of the ethical theory that it offers. Wittgenstein's views on ethics presuppose that language and thought are but one way in which we interact with reality. Although detailed studies of Wittgenstein's ontology and ethics exist, this book is the first thorough investigation of the relationship between them. As an introduction to Wittgenstein, it sheds new light on an important aspect of his early thought. (shrink)

Martine Nida-Rümelin has argued recently for subject-body dualism on the basis of reflections on the possibility of survival in fission cases from the literature on personal identity. The argument focuses on the claim that there is a factual difference between the claims that one or the other of two equally good continuers of a person in a fission case is identical with her. I consider three interpretations of the notion of a factual difference that the argument employs, and I argue (...) that on each of them the argument either begs the question or is unsound. (shrink)

In “The Argument for Subject Body Dualism from Transtemporal Identity Defended” (PPR 2013), Martine Nida-Rümelin (NR) responded to my (PPR 2013) criticism of her (2010) argument for subject-body dualism. The crucial premise of her (2010) argument was that there is a factual difference between the claims that in a fission case the original person is identical with one, or the other, of the successors. I argued that, on the three most plausible interpretations of ‘factual difference’, the argument fails. NR responds (...) that I missed the intended, fourth interpretation, and that, in any case, with an additional assumption, the argument on the third interpretation goes through. I argue that the fourth interpretation, while insufficient as stated, reveals an assumption that provides an independent argument, namely, that in first person thought about future properties we have a positive conception of the self that rules out having empirical criteria of transtemporal identity. I argue that the considerations offered for this thesis fail to establish it, and that we do not bring ourselves under any positive conception in first person thought. I argue also that on the third interpretation, the first premise of the argument is inconsistent with the necessity of identity. (shrink)

Syst. 31 215–229] and K. Tadaki [A generalisation of Chaitin’s halting probability Ω and halting self-similar sets, Hokkaido Math. J. 31 219–253] have studied the degree of randomness of sequences or reals by measuring their “degree (...) of compression”. This line of study leads to various definitions of partial randomness. In this paper we explore some relations between these definitions. Among other results we obtain a characterisation of Σ1-dimension in terms of strong Martin-Löf ε-tests , and we show that ε-randomness for ε is different than the classical 1-randomness. (shrink)

So-called "transparency theories" of self-knowledge, inspired by a remark of Gareth Evans, claim that we can obtain knowledge of our own beliefs by directing out attention towards the world, rather than introspecting the contents of our own minds. Most recent transparency theories concentrate on the case of self-knowledge concerning belief and desires. But can a transparency account be generalised to knowledge of one's own perceptions? In a recent paper, Alex Byrne (2012) argues that we can know what we see by (...) inferring from visual facts about our environment because such facts can exclusively be known by us through vision. I discuss his proposal and object that visual facts, as conceived of by Byrne, are odd: they cannot be remembered and we cannot, as yet, write them down. More needs to be said about them to make his account plausible. (shrink)

Self-knowledge presents a challenge for naturalistic theories of mind. Peter Carruthers’s (2011) approach to this challenge is Rylean: He argues that we know our own propositional attitudes because we (unconsciously) interpret ourselves, just as we have to interpret others in order to know theirs’. An alternative approach, opposed by Carruthers, is to argue that we do have a special access to our own beliefs, but that this is a natural consequence of our reasoning capacity. This is the approach of transparency (...) theories of self-knowledge, neatly encapsulated in Byrne’s epistemic rule (BEL): If p, believe that you believe that p (Byrne 2005). In this paper, I examine an objection to Carruthers’s theory in order to see whether it opens up space for a transparency theory of self-knowledge: Is it not the case that in order to interpret someone I have to have some direct access to what I believe (cf. L'objectif de cette these est d'etudier les fondements empiriques de notions semantiques telles que la signification, l'analyticite et la reference. J'essaie entre autres choses de defendre l'idee qu'il n'existe pas de critere permettant de definir strictement ces notions. Dans un premier temps, j'examine les critiques formulees par W. V. Quine contre la distinction analytique-synthetique. Il n'existe pas d'argument general pour rejeter cette distinction. Pour critiquer celle-ci, on doit examiner individuellement les diverses tentatives visant a l'etablir. ;Tout d'abord, j'examine les objections (...) de Quine contre le point de vue selon lequel la distinction analytique-synthetique aurait un caractere fondationnel. Ces objections sont rapprochees du paradoxe sceptique de Ludwig Wittgenstein, qui concerne le concept normatif de signification, selon lequel la signification d'un enonce justifierait son usage. ;J'aborde ensuite la question de savoir s'il est possible de tracer la distinction analytique-synthetique dans le cadre d'une theorie verificationniste de la signification, qui est fondee sur la maniere dont les locuteurs s'y prennent pour etablir la verite de leurs enonces. Une telle approche ne permet pas d'assigner aux enonces theoriques une signification determinee a cause du holisme, qui affirme que les enonces theoriques ne sont pas liees individuellement aux experiences qui les confirment , mais seulement en tant que fragments plus ou moins importants de theorie. Je tente de clarifier la these du holisme, et en etudie la source. ;Je presente ensuite le compte rendu de la signification propose par Quine, qui est fonde sur l'experience de pensee de la traduction radicale. Un manuel de traduction radicale doit organiser les donnees empiriques a partir desquelles il est construit, i.e. les dispositions verbales des locuteurs, conformement a certaines contraintes comme la contrainte de la communaute et le principe de charite. J'explique comment ces contraintes doivent etre comprises et appliquees. Le compte rendu de Quine est compare et contraste a celui de Donald Davidson, qui presente plusieurs points en commun. J'examine les principales differences qui les separent et essaie d'en decouvrir les motivations. Je montre par exemple pourquoi la theorie distale de Davidson est preferable a la theorie proximale de Quine. ;Enfin, la these de l'indetermination de la traduction est presentee. Je propose une formulation de cette these, selon laquelle l'indetermination de la traduction est directement liee a l'absence de critere empirique permettant de tracer la distinction analytique-synthetique. J'illustre ensuite cette these au moyen d'exemples et examine certaines de ses consequences, qui n'ont pas toutes ete envisagees par Quine, notamment celles qui concernent la notion de contenu empirique. Although Hawthorne has always had his admirers and defenders among literary critics, this novel has sometimes been selected for unfavorable comparison"; this 1941 assessment by Dorothy Waples (224) still aptly describes the critical terrain (...) and the challenge of reading Hawthorne's last complete novel. In recent scholarship, Nancy Bentley's The Ethnography of Manners (1995) has been influential in marking The Marble Faun for continued unfavorable comparison. Geoffrey Sanborn (1998), in building a case for the postcolonial intelligence of Herman Melville, uses Bentley's argument about the novel's disregard for the "lower orders of creation" to set up Hawthorne as a representative of the typically blinkered "white male writers" against whose limitations Melville shines (18, 214n33). Hawthorne, especially in The Marble Faun, has become a kind of whipping boy for American literary history.Be that as it may, my concern is not to establish Hawthorne's status as a victim of criticism, but rather to seek a recovery of what may be sacrificed in hasty dismissals of The Marble Faun. The present article proposes that this novel arrives at its greatest insights by a consideration of the dynamics of exclusionary violence as such. Henry James lamented the absence of "real psychology" in the novel, and Ludwig Lewisohn complained about its lack of "acceptable intellectual or moral content" (cited in Waples 1941, 224). Yet the novel's achievement may be seen to meet both these criteria, in part because it delivers an analysis of intellectual history as a history of mimetic sacrifice. In response to Waples's terms of challenge—the need for a certain light that reveals—I suggest that mimetic theory's reading of the Enlightenment allows the novel to disclose more critical historical intelligence than has generally been attributed to it. [End Page 133]This reading will focus on the interaction of three characters: the mysterious Miriam, the mysterious Donatello, and the even more mysterious figure known as the Model. In setting up the action of the narrative, the novel divulges little about the backgrounds of any of these characters but places them in a situation with a readily discernible structure: the relationships between the figures may be defined by the element of pursuit. Donatello follows Miriam wherever she goes. But he is not the only one who does so. The hazy figure of the Model likewise shadows Miriam. The Model's pursuit of Miriam may precede Donatello's, or the two pursuits may be somehow coeval; the novel refuses to specify either pursuit as original, focusing instead on the late-stage escalation of resentment between Donatello and the Model.This mimetic pursuit culminates in the central violent event of the novel: Donatello, claiming authorization from Miriam's glance, hurls the Model from a precipice. I have argued elsewhere that when the protagonists thus decisively act to exclude the shadowy character known as the Model, they enact the foundational move of Enlightenment discourse and the ideal of Platonic dialogue upon which that discourse is based.1 Michel Serres summarizes the Platonic-Enlightenment strategy of communicational purity and clarity:To hold a dialogue is to suppose a third man and to seek to exclude him; a successful communication is the exclusion of the third man. In "Individuals", Peter Strawson talks about identifying, discriminating and picking out particular objects, regarding discriminating and picking out as ways of identifying. I object that, strictly speaking, identification means to say of two things that they are the same. In contrast, discriminating an object from all others can be done by just ascribing some predicate to it that does not apply to the others. Picking out an object does not even seem to require to distinguish it from all others. The (...) object picked is distinct in that it is the picked one, but it is not clear - even in the context of sensorily picking out - that I have to be aware of this in order to do the picking. In the first essay, Stokhof discusses the nature and presuppositions of the formal semantic project as such. He shows that considerations of so-called radical interpretation and the normativity of meaning force us to rethink the relationship between the meaning of a linguistic utterance and its interpretation in a way that is hardly compatible with this project. In the second essay, the author introduces the early Ludwig Wittgenstein as an obvious, if completely neglected, precursor of formal semantics. He discusses the (...) systematic and, to a lesser extent, historical connections between the Tractatus and later formal semantics. From the similarities and differences found, it then draws conclusions regarding the contemporary status of this discipline at the interface of philosophy and the empirical sciences. Finally, the third study looks at formal semantics in terms of its contrast with Wittgenstein's later thinking about language. To date philosophical reflections on the Holocaust and Holocaust survivor testimony have come almost exclusively from authors in the so-called “Continental tradition”. This paper is an attempt to contribute to the scholarship on Holocaust survivor testimony using some of the concepts and conceptions of “analytic philosophy”, more precisely, some of Ludwig Wittgenstein’s remarks in On Certainty. The paper uses these remarks to analyse the “linguistic despair” expressed by many Holocaust survivors when trying to put their horrendous experiences into words.

First published in 1999, this engaging interdisciplinary study of romantic science focuses on the work of five influential figures in twentieth-century transatlantic intellectual history. In this book, Martin Halliwell constructs an innovative tradition of romantic science by indicating points of theoretical and historical intersection in the thought of William James ; Otto Rank ; Ludwig Binswanger ; Erik Erikson ; and Oliver Sacks. Beginning with the ferment of intellectual activity in late eighteenth-century German Romanticism, Halliwell argues that only (...) with William James’ theory of pragmatism early in the twentieth century did romantic science become a viable counter-tradition to strictly empirical science. The influence of Heinrich Hertz's The Principles of Mechanics on Ludwig Wittgenstein's Tractatus Logico‐Philosophicus has been studied for decades, but it has never become a mainstream topic in the Wittgensteinian literature. This paper focusses on Tractarian notions of objects, elementary facts and elementary sentences and discusses their similarities with Hertz's concepts of mass, its constituents and their mechanistic images. As the paper demonstrates, the Hertzian context provides some fruitful interpretational leads concerning several controversial ideas endorsed by early Wittgenstein, namely (...) propositional analysis, logical independence of elementary facts, logical independence of elementary sentences, and modalities. ABSTRACTTime-consciousness has long been a focus of research in phenomenology and phenomenological psychology. We advance and extend this tradition of research by focusing on the character of temporal experience under conditions of mania. Symptom scales and diagnostic criteria for mania are peppered with temporally inflected language: increased rate of speech, racing thoughts, flight-of-ideas, hyperactivity. But what is the underlying structure of temporal experience in manic episodes? We tackle this question using a strategically hybrid approach. We recover and reconstruct three hypotheses (...) regarding manic temporality that were advanced and modeled by two pioneers of clinical phenomenology: Eugène Minkowski and Ludwig Binswanger. We then test, critique, and refine these hypotheses using heterophenomenological methods in an interview-based study of persons with a history of bipolar and a current diagnosis of acute mania. And so begins one of the most controversial philosophical texts available today. Heidegger, a German Nationalist and proud Nazi, thoroughly examines the history, the philosophy, and the rise to power of the Nazi movement in Germany. Martin Heidegger s distinguished Italian colleague, Professor Benedetto Croce, said of his (...) German contemporary, This man dishonors philosophy and that is an evil for politics too. Croce s severe rebuke was not singular at the time when Hitlerism was rampant over Europe. It is true that among the almost one thousand professional philosophers of Germany and Austria only very few actively opposed National Socialism. On the other hand, no one degraded his historic profession in the manner Heidegger did, by becoming a spokesman for National Socialism and attempting to mold his theories into one pattern with Hitlerism. Heidegger s contribution to the growth and development of National Socialism was immense. In this small anthology Dr. Runes endeavors to point to the utter confusion Heidegger created by drawing, for political and social application of his own existentialism metaphysics, upon the decadent and repulsive brutalization of Hitlerism. Martin Heidegger was a philosopher most known for his contributions to German phenomenological and existential thought. Heidegger was born in rural Messkirch in 1889 to Catholic parents. While studying philosophy and mathematics at Albert-Ludwig University in Freiburg, Heidegger became the assistant for philosopher Edmund Husserl. Influenced by Husserl, Kierkegaard, and Nietzsche, Heidegger wrote extensively on the quality of Being, including his opus Being and Time. He served as professor of philosophy at Albert-Ludwig University and taught there during the war. In 1933, Heidegger joined the National Socialist German Worker s (or Nazi) Party and expressed his support for Hitler in several articles and speeches. After the war, his support for the Nazi party came under attack, and he was tried as a sympathizer. He was able to return to Albert-Ludwig University, however, and taught there until he retired. Neste sentido, pretende-se estabelecer relações convergentes entre o conceito de jogos de linguagem e os aspectos relativos ao documento como instrumento de veiculação de informação, ordenação e prática social. Após uma introdução do tema, serão apresentados os conceitos e configurações (...) do Neodocumentalismo no âmbito da Ciência da Informação. Em seguida, será feita uma apresentação do sistema de Wittgenstein, sobretudo o sistema de sua segunda fase e, logo após, serão abordados aspectos convergentes e considerações entre Neodocumentalismo e jogos de linguagem. In my argument for subject body dualism criticized by Ludwig I use the locution of a genuine and factual difference between two possibilities. Ludwig distinguishes three interpretations of this locution. According to his analysis the argument does not go through on any of these interpretations. In my response I agree that the argument is unsuccessful if ‘factual difference’ is understood in the first way. The second reading—according to a plausible understanding—cannot be used for the argument either. The discussion (...) of this reading raises fundamental issues about different notions of propositional content. I disagree with Ludwig's diagnosis with respect to the third reading. Contrary to Ludwig's claim, there is no modal error involved if ‘factual difference’ is understood in the third way. Ludwig's objection to the argument according to its third reading can be answered by pointing out that every individual has its identity conditions necessarily. At this point fundamental and general metaphysical issues (concerning the link between identity conditions and the nature of ontological categories and between transworld and transtemporal identity) prove relevant. Finally, I make more explicit how ‘factual difference’ should be understood in the context of the argument (this is a fourth reading not considered by Ludwig) and explain how this reading strengthens the argument (compared to the third reading) by weakening its central premise.
