The fundamental character of a punishment is the subject of this paper. Based on the assumed function of a punishment (deterrent), a punishment has to be perceived and experienced to be an adverse result by the punished and the public. The first factor in particular means that the courts have to have flexibility to sentence a person to such a punishment that is experienced as such. The legal question becomes how this customization of a punishment is acceptable from an equality (...) standpoint. In the field of environmental protection, the administrative process poses serious problems. There may be administrative proceedings that result in substantial economic losses for individuals and groups alike. (shrink)

Analogy making from examples is a central task in intelligent system behavior. A lot of real world problems involve analogy making and generalization. Research investigates these questions by building computer models of human thinking concepts. These concepts can be divided into high level approaches as used in cognitive science and low level models as used in neural networks. Applications range over the spectrum of recognition, categorization and analogy reasoning. A major part of legal reasoning could be formally interpreted as an (...) analogy making process. Because it is not the same as reasoning in mathematics or the physical sciences, it is necessary to use a method, which incorporates first the ability to specify likelihood and second the opportunity of including known court decisions. We use for modelling the analogy making process in legal reasoning neural networks and fuzzy systems. In the first part of the paper a neural network is described to identify precedents of immaterial damages. The second application presents a fuzzy system for determining the required waiting period after traffic accidents. Both examples demonstrate how to model reasoning in legal applications analogous to recent decisions: first, by learning a system with court decisions, and second, by analyzing, modelling and testing the decision making with a fuzzy system. The prevention of sexual violence is a major goal of sexual health. In cases of accused sexual offenders, the assessment of diminished criminal responsibility of the accused is one of the most important procedures undertaken by experts in the German legal system. This assessment follows a two-stage method assessing first the severity of a paraphilic disorder and then second criteria for or against diminished capacity. The present study examines the predictive validity of two different sets of criteria for the assessment (...) of criminal responsibility in the context of paraphilic disorders combined with sexual offending. Two exemplary case vignettes of two suspected sexual offenders were developed to assess the criteria. For each participant, one of the two exemplary case vignettes was randomly presented. The presentation of the two different sets of criteria was also randomized, so that each participant was assigned only one of the two criteria sets to rate one of the presented cases. N = 349 participants from different professional backgrounds completed their assessments and were included in the data analysis. The data were evaluated using logistic regression. Results show that the more recently published criteria set predicts both the severity of the disorder as well as the diminished capacity twice as good as the older criteria set of Boetticher et al. currently used regularly for forensic court reports. In preliminary conclusion, the new criteria of Briken and Müller form an empirically based assessment of criminal responsibility. However, the proposed criteria cannot replace an extensive exploration of the accused person and a careful file analysis. Validity and reliability of the results are also limited due to the methodical choice of a vignette study. (shrink)

Observar-se-á para tanto a Teoria do Discurso enquanto arcabouço procedimental capaz de potencializar a observância na prática de uma justiça mais célere, simples, informal, econômica e baseada na oralidade. Para tanto aplicar-se-á a interpretação do pensamento de Jürgen Habermas (...) e de Robert Alexy em conjunto a autores tradicionais do Direito com o objetivo de se avaliar se o pensamento dogmático se encontra superado ou ainda se apresenta como um entrave para que os princípios, que a Lei atribui a condição de Critérios Orientadores dos Juizados Especial Cíveis, sejam observados na realidade fática. ZusammenfassungEs ist in der Literatur weithin bekannt, dass im Gesundheitswesen auf unterschiedlichen Ebenen Allokationsentscheidungen getroffen werden. Während es auf der Makroebene um gesellschaftlich-politische Strukturfragen geht, stehen die Akteure der Mikroebene vor der Aufgabe, begrenzte Ressourcen in einer Organisation sinnvoll einzusetzen. In den ethischen Analysen der Mikro-Allokationsebene werden zumeist Entscheidungen der Healthcare Professionals thematisiert, weil sie eine unmittelbare Auswirkung auf die konkreten Patienten haben. Weniger in den Blick geraten Allokationen des Managements, welche die Rahmenbedingungen für Ressourcenzuteilungen beim Patienten betreffen. Hierbei geht (...) es nicht bloß um den Einsatz von Sachmitteln, sondern auch um den Personaleinsatz. Das Personalmanagement ist damit in wichtige Allokationsentscheidungen eingebunden und trägt eine dreifache Verantwortung: für die Gesundheit der Patienten, der Mitarbeiter und der Organisation. Der vorliegende Beitrag geht der Frage nach, welche Aspekte der Allokationsethik aus der Sicht des Personalmanagements in einem Krankenhaus zu bedenken sind, um der dreifachen Verantwortung gerecht zu werden. Dadurch zeigt sich, dass Allokationsethik in einem Krankenhaus nicht adäquat erfasst werden kann, ohne sich mit dem Personalmanagement zu beschäftigen, da das Personal die wertvollste Ressource ist, die es in einem Krankenhaus zu allozieren gilt. In this study, the author investigates how the battered women’s movement has transformed the treatment of domestic violence in Salt Lake City’s specialized domestic violence court. Using Lisa Brush’s account of how the state promotes the dominance of men and the disadvantage of women, the author shows that Salt Lake City’s domestic violence court transforms both its governance of gender and its gender of governance, lending support to optimistic theories of the state. The author argues that this (...) class='Hi'>court is an example of a state institution that has been transformed into a feminist regime committed to individual and social change. The author encourages feminist theorists to engage with the work of Jurgen Habermas to better conceptualize the potentially positive relations among the state, social movements, and social change. Ellsberg's (1961) famous paradox shows that decision-makers give events with ‘known’ probabilities a higher weight in their outcome evaluation. In the same article, Ellsberg suggests a preference representation which has intuitive appeal but lacks an axiomatic foundation. Schmeidler (1989) and Gilboa (1987) provide an axiomatisation for expected utility with non-additive probabilities. This paper introduces E-capacities as a representation of beliefs which incorporates objective information about the probability of events. It can be shown that the Choquet integral of an E-capacity is (...) the Ellsberg representation. The paper further explores properties of this representation of beliefs and provides an axiomatisation for them. (shrink)

ZusammenfassungIn den letzten Jahren wird intensiv darüber diskutiert, ob und in welcher Weise das Gewissen im Kontext der Apotheke zu schützen ist. Der Status quo in Deutschland und Österreich sieht keine gesetzliche Regelung für dieses Problem vor. Der ethische Rahmen für eine Bewältigungsstrategie im Umgang mit dem Problem der Gewissensfreiheit in der Apotheke wird deutlich gemacht. Unter Anwendung des rechtsethischen Verhältnismäßigkeitsprinzips wird das Problem mit Berücksichtigung des deutschen und österreichischen Verfassungsrechts sowie der Europäischen Menschenrechtskonvention auf individueller, korporativer und gesellschaftlicher Ebene (...) analysiert. Auf individueller Ebene sind die berechtigten Interessen und Güter des Apothekers einerseits und der Patientin andererseits durch eine grundrechtliche Verhältnismäßigkeitsprüfung zu einem schonenden Ausgleich zu bringen. Auf korporativer Ebene legitimiert das auf der Religions- und Weltanschauungsfreiheit basierende Selbstbestimmungsrecht die ideologisch profilierte Apotheke als Organisation und kann in der Binnenbeziehung der Apotheke einen Loyalitätskonflikt verursachen. Auf gesellschaftlicher Ebene stehen vier Optionen der proaktiven rechtspolitischen Gestaltung der Gewissensproblematik zur Verfügung: sozialstaatlich, libertär, professionsbezogen und kommunitär. Wie Konflikte auf individueller oder korporativer Ebene gelöst werden können, hängt von den Optionen ab, die auf gesellschaftlicher Ebene gewählt werden. Für den Fall einer Änderung des Status quo wird für zwei Lösungsansätze argumentiert: a) die Einführung einer qualifizierten Gewissensklausel für Apotheker (mit Beratungs-, Verweis-, Notfall- und Verständigungspflicht); b) die auf einen Kompromiss zwischen ideologisch profilierter pharmazeutischer Korporation (Apotheke oder Apothekervereinigung) und Sozialstaat abzielende „weiche“ kommunitäre Option. Healthcare ethics consultation has been developed, practiced, and analyzed internationally. However, only a few professional standards have evolved globally in this field that would be comparable to standards in other areas of healthcare. This article cannot compensate for this situation. It contributes to the ongoing debate on professionalization by presenting experiences with ethics consultation in Austria, though. After exploring its contexts and providing an overview of one of its primary ethics programs, the article analyzes the underlying assumptions of “ethics consultation” (...) as an essential effort on the path to professionalize ethics consultation. It is widely acknowledged that resource allocations are taking place at various levels of the health care system. On the macro level, resources are allocated according to societal and political considerations within the system as a whole. On the micro level, it is the health care organization where allocations have to be made. Ethical analyses of this micro level usually deal with decisions of health care professionals since they affect patients directly. Allocation decisions by management are of less interest to (...) the ethical literature, although they define the framework for patient care. In this respect, this concerns not only the use of drugs or infrastructure but also of human resources. Human resource management, therefore, is deeply involved in allocation decisions and, thereby, must shoulder a threefold responsibility: towards the health of the patient, the employees, and the organization. The objective of this article is to analyze the ethics of allocation that derives from this threefold responsibility from the perspective of human resource management in a hospital. For an adequate ethical analysis of allocation in a hospital, human resource management has to be considered, since personnel is the most precious resource to allocate in a hospital. (shrink)

In this, the second of two articles outlining a theory of communicative competence, the author questions the ability of Chomsky's account of linguistic competence to fulfil the requirements of such a theory. ?Linguistic competence? for Chomsky means the mastery of an abstract system of rules, based on an innate language apparatus. The model by which communication is understood on this account contains three implicit assumptions, here called ?monologism?, ?a priorism?, and ?elementarism?. The author offers an outline of a theory of (...) communicative competence that is based on the negations of these assumptions. In opposing the first two assumptions he introduces distinctions, respectively, between semantic universals which process experiences and those that make such processing possible, and between semantic universals which precede all socialization and those that are linked to the conditions of potential socialization. Against elementarism, he argues that the semantic content of all possible natural languages does not consist of combinations of a finite number of meaning components. Differences in systems of classification preclude this, and such differences can be seen to infect all respects of intercultural comparison. Using the notion of ?performative utterance?, the author elucidates the role of dialogue?constitutive universals as part of the formal apparatus required of a?; speaker's capacity to communicate. He then notes what would be required of a general semantics based on a theory of communicative competence; and finally points out how this theory might be used for social analysis. (shrink)

Varied evidence confirms more strongly than less varied evidence, ceteris paribus. This epistemological Variety of Evidence Thesis enjoys widespread intuitive support. We put forward a novel explication of one notion of varied evidence and the Variety of Evidence Thesis within Bayesian models of scientific inference by appealing to measures of entropy. Our explication of the Variety of Evidence Thesis holds in many of our models which also pronounce on disconfirmatory and discordant evidence. We argue that our models pronounce rightly. Against (...) a backdrop of failures of the Variety of Evidence Thesis, the intuitive case for the Variety of Evidence Thesis emerges strengthened. Our models do however not support the general case for the thesis since our explication of it fails to hold in certain cases. The parameter space of this failure is explored and an explanation for the failure is offered. (shrink)

These three robust volumes make available in its entirety a collection of correspondence, held at the University of Leipzig library and comprising nearly five hundred letters, between Christian Wolff and Ernst Christoph, Graf von Manteuffel. At the time of the correspondence, Wolff was the most famous philosopher of the German Enlightenment, having taken a position in Marburg after his exile from Prussia in 1723. This paper highlights the role of Lewis’ Principal Principle and certain auxiliary conditions on admissibility as serving to explicate normal informal standards of what is reasonable. These considerations motivate the presuppositions of the argument that the Principal Principle implies the Principle of Indifference, put forward by Hawthorne et al.. They also suggest a line of response to recent criticisms of that argument, due to Pettigrew and Titelbaum and Hart, 621–632, 2020). The paper also shows that related concerns of Hart and (...) Objective Bayesian epistemology invokes three norms: the strengths of our beliefs should be probabilities, they should be calibrated to our evidence of physical probabilities, and they should otherwise equivocate sufficiently between the basic propositions that we can express. The three norms are sometimes explicated by appealing to the maximum entropy principle, which says that a belief function should be a probability function, from all those that are calibrated to evidence, that has maximum entropy. However, the three norms of objective Bayesianism (...) are usually justified in different ways. In this paper we show that the three norms can all be subsumed under a single justification in terms of minimising worst-case expected loss. This, in turn, is equivalent to maximising a generalised notion of entropy. We suggest that requiring language invariance, in addition to minimising worst-case expected loss, motivates maximisation of standard entropy as opposed to maximisation of other instances of generalised entropy. Our argument also provides a qualified justification for updating degrees of belief by Bayesian conditionalisation. However, conditional probabilities play a less central part in the objective Bayesian account than they do under the subjective view of Bayesianism, leading to a reduced role for Bayes’ Theorem. In this, the first of two articles outlining a theory of communicative competence, the author shows how the requirements of such a theory are to be found in an analysis not of the linguistic competence of a native speaker, but of systematic distortion of communication of the kind postulated by psychoanalytic theory. The psychoanalyst's hermeneutic understanding of initially incomprehensible acts and utterances depends on the explanatory power of this understanding, and therefore rests on theoretical assumptions. After a preliminary delineation of (...) the range of incomprehensible acts and utterances dealt with in psychoanalysis, the author presents an account of psychoanalysis as linguistic analysis. He then explicates the key theoretical assumptions underlying the analytical procedure, in particular those relating to the notion of ?scenic understanding?, and concludes by indicating the place of explanatory understanding in a theory of communicative competence. This paper explores Simon Stevin’s l’Arithmétique of 1585, where we find a novel understanding of the concept of number. I will discuss the dynamics between his practice and philosophy of mathematics, and put it in the context of his general epistemological attitude. Subsequently, I will take a close look at his justificational concerns, and at how these are reflected in his inductive, a postiori and structuralist approach to investigating the numerical field. I will argue that Stevin’s renewed conceptualisation of the (...) notion of number is a sort of “existential closure” of the numerical domain, founded upon the practice of his predecessors and contemporaries. Accordingly, I want to make clear that l’Aritmetique have to be read not as an ontological analysis or exploration of the numerical field, but as an explication of a mathematical ethos. In this sense, this article also intends to make a specific contribution to the broader issue of the “ethics of geometry.”. (shrink)

As illustrated by the famous Ellsberg paradox, many subjects prefer to bet on events with known rather than with unknown probabilities, i.e., they are ambiguity averse. In an experiment, we examine subjects’ choices when there is an additional source of ambiguity, namely, when they do not know how much money they can win. Using a standard assumption on the joint set of priors, we show that ambiguity-averse subjects should continue to strictly prefer the urn with known probabilities. In contrast, our (...) results show that many subjects no longer exhibit such a strict preference. (shrink)

The intuitive Variety of Evidence Thesis states that, ceteris paribus, more varied evidence for a hypothesis confirms it more strongly than less varied evidence. Recent Bayesian analyses have raised serious doubts in its validity. Claveau suggests the existence of a novel type of counter-example to this thesis: a gradual increase in source independence can lead to a decrease in hypothesis confirmation. I show that Claveau’s measure of gradual source independence suffers from two unsuspected types of inconsistencies. I hence put forward (...) a more natural measure of gradual source independence which is not plagued by inconsistencies. Claveau’s counter-examples to the variety of evidence thesis disappear with the measure I suggest. I hence argue that my measure is preferable and that this thesis does at least not seem to be troubled by Claveau’s arguments. (shrink)

Objective Bayesianism says that the strengths of one’s beliefs ought to be probabilities, calibrated to physical probabilities insofar as one has evidence of them, and otherwise sufficiently equivocal. These norms of belief are often explicated using the maximum entropy principle. In this paper we investigate the extent to which one can provide a unified justification of the objective Bayesian norms in the case in which the background language is a first-order predicate language, with a view to applying the resulting formalism (...) to inductive logic. This paper addresses a data integration problem: given several mutually consistent datasets each of which measures a subset of the variables of interest, how can one construct a probabilistic model that fits the data and gives reasonable answers to questions which are under-determined by the data? Here we show how to obtain a Bayesian network model which represents the unique probability function that agrees with the probability distributions measured by the datasets and otherwise has maximum entropy. We provide a general (...) algorithm, OBN-cDS, which offers substantial efficiency savings over the standard brute-force approach to determining the maximum entropy probability function. Furthermore, we develop modifications to the general algorithm which enable further efficiency savings but which are only applicable in particular situations. We show that there are circumstances in which one can obtain the model directly from the data; by solving algebraic problems; and by solving relatively simple independent optimisation problems. This paper targets the constitutive basis of social cognition. It begins by describing the traditional and still dominant cognitivist view. Cognitivism assumes internalism about the realisers of social cognition; thus, the embodied and embedded elements of intersubjective engagement are ruled out from playing anything but a basic causal role in an account of social cognition. It then goes on to advance and clarify an alternative to the cognitivist view; namely, an enactive account of social cognition. It does so first by (...) articulating a diachronic constitutive account for how embodied engagement can play a constitutive role in social cognition. It then proceeds to consider an objection; the causal-constitutive fallacy (Adams & Aizawa 2001, 2008; Block 2005) against enactive social cognition. The paper proceeds to deflate this objection by establishing that the distinction between constitution and causation is not co-extensive with the distinction between internal constitutive elements and external causal elements. It is then shown that there is a different reason for thinking that an enactive account of social cognition is problematic. We call this objection the ‘poverty of the interactional stimulus argument’. This objection turns on the role and characteristics of anticipation in enactive social cognition. It argues that anticipatory processes are mediated by an internally realised model or tacit theory (Carruthers 2015; Seth 2015). The final part of this paper dissolves this objection by arguing that it is possible to cast anticipatory processes as orchestrated as well as maintained by sensorimotor couplings between individuals in face-to-face interaction.
