    Punishment in environmental protection.Jürgen S. Poesche - 1996 - Journal of Business Ethics 15 (10):1071 - 1081.
The fundamental character of a punishment is the subject of this paper. Based on the assumed function of a punishment (deterrent), a punishment has to be perceived and experienced to be an adverse result by the punished and the public. The first factor in particular means that the courts have to have flexibility to sentence a person to such a punishment that is experienced as such. The legal question becomes how this customization of a punishment is acceptable from an equality (...)

  6. Analogy making in legal reasoning with neural networks and fuzzy logic.Jürgen Hollatz - 1999 - Artificial Intelligence and Law 7 (2-3):289-301.
Analogy making from examples is a central task in intelligent system behavior. A lot of real world problems involve analogy making and generalization. Research investigates these questions by building computer models of human thinking concepts. These concepts can be divided into high level approaches as used in cognitive science and low level models as used in neural networks. Applications range over the spectrum of recognition, categorization and analogy reasoning. A major part of legal reasoning could be formally interpreted as an (...)

Predictive Validity of Operationalized Criteria for the Assessment of Criminal Responsibility of Sexual Offenders With Paraphilic Disorders—A Randomized Control Trial With Mental Health and Legal Professionals.Sascha Dobbrunz, Anne Daubmann, Jürgen Leo Müller & Peer Briken - 2020 - Frontiers in Psychology 11.
The prevention of sexual violence is a major goal of sexual health. In cases of accused sexual offenders, the assessment of diminished criminal responsibility of the accused is one of the most important procedures undertaken by experts in the German legal system. This assessment follows a two-stage method assessing first the severity of a paraphilic disorder and then second criteria for or against diminished capacity. The present study examines the predictive validity of two different sets of criteria for the assessment (...)

The Existential and Semantic Truth of Religion in Jürgen Habermas's Political Philosophy and the Possibility of a Philosophy of Religion.Michael Schulz - 2017 - Journal of Speculative Philosophy 31 (3):457-467.
The former president of the German Constitutional Court, Ernst-Wolfgang Böckenförde, coined the formulation, "The liberal, secularised state is nourished by presuppositions that it cannot itself guarantee."1 In the first part of this article I would like to discuss the deliberations of one who is considered the chief philosopher of the Federal Republic of Germany, Jürgen Habermas, in particular his thinking regarding the epistemological and existential status and role of religion in a modern democracy. I investigate Habermas's concept of philosophy (...)

Human resource management’s perspective on ethics of allocation in a hospital.Jürgen Wallner - 2011 - Ethik in der Medizin 23 (4):283-289.
Hierbei geht (...)

“Hitting is not Manly”: Domestic Violence Court and the Re-Imagination of the Patriarchal State.Rekha Mirchandani - 2006 - Gender and Society 20 (6):781-804.
In this study, the author investigates how the battered women’s movement has transformed the treatment of domestic violence in Salt Lake City’s specialized domestic violence court. Using Lisa Brush’s account of how the state promotes the dominance of men and the disadvantage of women, the author shows that Salt Lake City’s domestic violence court transforms both its governance of gender and its gender of governance, lending support to optimistic theories of the state. The author argues that this (...) is an example of a state institution that has been transformed into a feminist regime committed to individual and social change. The author encourages feminist theorists to engage with the work of Jurgen Habermas to better conceptualize the potentially positive relations among the state, social movements, and social change. E-Capacities and the Ellsberg Paradox.Jürgen Eichberger & David Kelsey - 1999 - Theory and Decision 46 (2):107-138.
Ellsberg's (1961) famous paradox shows that decision-makers give events with ‘known’ probabilities a higher weight in their outcome evaluation. In the same article, Ellsberg suggests a preference representation which has intuitive appeal but lacks an axiomatic foundation. Schmeidler (1989) and Gilboa (1987) provide an axiomatisation for expected utility with non-additive probabilities. This paper introduces E-capacities as a representation of beliefs which incorporates objective information about the probability of events. It can be shown that the Choquet integral of an E-capacity is (...)

Healthcare Ethics Consultation in Austria: Joining the International Path of Professionalization.Jürgen Wallner - 2023 - Journal of Clinical Ethics 34 (1):69-78.
Healthcare ethics consultation has been developed, practiced, and analyzed internationally. However, only a few professional standards have evolved globally in this field that would be comparable to standards in other areas of healthcare. This article cannot compensate for this situation. It contributes to the ongoing debate on professionalization by presenting experiences with ethics consultation in Austria, though. After exploring its contexts and providing an overview of one of its primary ethics programs, the article analyzes the underlying assumptions of “ethics consultation” (...)

It is widely acknowledged that resource allocations are taking place at various levels of the health care system. On the macro level, resources are allocated according to societal and political considerations within the system as a whole. On the micro level, it is the health care organization where allocations have to be made. Ethical analyses of this micro level usually deal with decisions of health care professionals since they affect patients directly. Allocation decisions by management are of less interest to (...)

In this, the second of two articles outlining a theory of communicative competence, the author questions the ability of Chomsky's account of linguistic competence to fulfil the requirements of such a theory. ?Linguistic competence? for Chomsky means the mastery of an abstract system of rules, based on an innate language apparatus. The model by which communication is understood on this account contains three implicit assumptions, here called ?monologism?, ?a priorism?, and ?elementarism?. The author offers an outline of a theory of (...)

    Variety of Evidence.Jürgen Landes - 2020 - Erkenntnis 85 (1):183-223.
Varied evidence confirms more strongly than less varied evidence, ceteris paribus. This epistemological Variety of Evidence Thesis enjoys widespread intuitive support. We put forward a novel explication of one notion of varied evidence and the Variety of Evidence Thesis within Bayesian models of scientific inference by appealing to measures of entropy. Our explication of the Variety of Evidence Thesis holds in many of our models which also pronounce on disconfirmatory and discordant evidence. We argue that our models pronounce rightly. Against (...)

These three robust volumes make available in its entirety a collection of correspondence, held at the University of Leipzig library and comprising nearly five hundred letters, between Christian Wolff and Ernst Christoph, Graf von Manteuffel. At the time of the correspondence, Wolff was the most famous philosopher of the German Enlightenment, having taken a position in Marburg after his exile from Prussia in 1723. Manteuffel was a Saxon diplomat, advocate for the Wolffian philosophy at the Prussian court, and a (...)

The Principal Principle, admissibility, and normal informal standards of what is reasonable.Jürgen Landes, Christian Wallmann & Jon Williamson - 2021 - European Journal for Philosophy of Science 11 (2):1-15.
This paper highlights the role of Lewis’ Principal Principle and certain auxiliary conditions on admissibility as serving to explicate normal informal standards of what is reasonable. These considerations motivate the presuppositions of the argument that the Principal Principle implies the Principle of Indifference, put forward by Hawthorne et al.. They also suggest a line of response to recent criticisms of that argument, due to Pettigrew and Titelbaum and Hart, 621–632, 2020). The paper also shows that related concerns of Hart and (...)

  37. Objective Bayesianism and the maximum entropy principle.Jürgen Landes & Jon Williamson - 2013 - Entropy 15 (9):3528-3591.
Objective Bayesian epistemology invokes three norms: the strengths of our beliefs should be probabilities, they should be calibrated to our evidence of physical probabilities, and they should otherwise equivocate sufficiently between the basic propositions that we can express. The three norms are sometimes explicated by appealing to the maximum entropy principle, which says that a belief function should be a probability function, from all those that are calibrated to evidence, that has maximum entropy. However, the three norms of objective Bayesianism (...)

In this, the first of two articles outlining a theory of communicative competence, the author shows how the requirements of such a theory are to be found in an analysis not of the linguistic competence of a native speaker, but of systematic distortion of communication of the kind postulated by psychoanalytic theory. The psychoanalyst's hermeneutic understanding of initially incomprehensible acts and utterances depends on the explanatory power of this understanding, and therefore rests on theoretical assumptions. After a preliminary delineation of (...)

This paper explores Simon Stevin’s l’Arithmétique of 1585, where we find a novel understanding of the concept of number. I will discuss the dynamics between his practice and philosophy of mathematics, and put it in the context of his general epistemological attitude. Subsequently, I will take a close look at his justificational concerns, and at how these are reflected in his inductive, a postiori and structuralist approach to investigating the numerical field. I will argue that Stevin’s renewed conceptualisation of the (...)

How do subjects view multiple sources of ambiguity?Jürgen Eichberger, Jörg Oechssler & Wendelin Schnedler - 2015 - Theory and Decision 78 (3):339-356.
As illustrated by the famous Ellsberg paradox, many subjects prefer to bet on events with known rather than with unknown probabilities, i.e., they are ambiguity averse. In an experiment, we examine subjects’ choices when there is an additional source of ambiguity, namely, when they do not know how much money they can win. Using a standard assumption on the joint set of priors, we show that ambiguity-averse subjects should continue to strictly prefer the urn with known probabilities. In contrast, our (...)

The variety of evidence thesis and its independence of degrees of independence.Jürgen Landes - 2020 - Synthese 198 (11):1-31.
The intuitive Variety of Evidence Thesis states that, ceteris paribus, more varied evidence for a hypothesis confirms it more strongly than less varied evidence. Recent Bayesian analyses have raised serious doubts in its validity. Claveau suggests the existence of a novel type of counter-example to this thesis: a gradual increase in source independence can lead to a decrease in hypothesis confirmation. I show that Claveau’s measure of gradual source independence suffers from two unsuspected types of inconsistencies. I hence put forward (...)

Objective Bayesianism says that the strengths of one’s beliefs ought to be probabilities, calibrated to physical probabilities insofar as one has evidence of them, and otherwise sufficiently equivocal. These norms of belief are often explicated using the maximum entropy principle. In this paper we investigate the extent to which one can provide a unified justification of the objective Bayesian norms in the case in which the background language is a first-order predicate language, with a view to applying the resulting formalism (...)

This paper addresses a data integration problem: given several mutually consistent datasets each of which measures a subset of the variables of interest, how can one construct a probabilistic model that fits the data and gives reasonable answers to questions which are under-determined by the data? Here we show how to obtain a Bayesian network model which represents the unique probability function that agrees with the probability distributions measured by the datasets and otherwise has maximum entropy. This paper targets the constitutive basis of social cognition. It begins by describing the traditional and still dominant cognitivist view. Cognitivism assumes internalism about the realisers of social cognition; thus, the embodied and embedded elements of intersubjective engagement are ruled out from playing anything but a basic causal role in an account of social cognition. It then goes on to advance and clarify an alternative to the cognitivist view; namely, an enactive account of social cognition. It does so first by (...)
