ETHICS IS ABUNDANT IN POPULAR CULTURE—IN RADIO TALK SHOWS, television, films, moral advice columns, books and workshops on popular psychology and spirituality, and other venues. This essay explores the ways in which ethics is presented in three select popular settings; the ethical questions addressed in those settings; the moral theories, perspectives, and values that are privileged in opinions offered; and the judgments that are proffered. Of special interest to professional ethicists are the ways in which ethics in popular culture participates (...) in the ways ethics is done in the academy and the ways in which popular media frame and foster ethics differently from the ways the academy does. Does law matter regarding public health outcomes? Regardless of what one may think about the answer to this age-old question, in recent years the public health community has increasingly demonstrated and recognized the roles that public health laws and policies play in effectuating long-lasting and broad-based population-wide changes. Public health laws and policies have been instrumental in the following ways: reducing smoking prevalence; reducing underage alcohol-related drinking, driving, crashes, and fatalities; reducing exposure to second-hand smoke; eliminating vaccine–associated paralytic poliomyelitis ; (...) increasing seat-belt use and reducing traffic fatalities; reducing dental carries; and reducing access to and consumption of unhealthy foods and beverages sold in schools and to reductions in caloric intake and overweight. In fact, in a review of the ten greatest public health achievements in the 20th century, all were influenced by policy change. (shrink)

Walter Conn's theory of Christian Conversion (1986) provides an illuminating lens for understanding Dorothy Day's conversion experience. Day's story, conversely, offers an opportunity to test selected features of Conn's theory, specifically the affective, cognitive, moral, and religious categories of analysis. The dialectic is a fruitful one, yielding insight into both Day's story and Conn's theory, while at the same time raising provocative questions about and contributing to the current debate regarding an "ethic of care" as distinct from an "ethic of (...) justice.". It has been proposed in South Africa and other sites that forgiveness is a political necessity if social reconstruction is to be effective following regimes of terror and torture. By placing the spotlight on forgiveness, these claims raise questions about the realism and relevance of forgiveness to public life. This paper interrogates the moral realism of forgiveness in public life by identifying some of its defining features, by comparing it to forgiveness in therapeutic and interpersonal settings, and by examining proposed (...) reasons and motivations for forgiveness in the face of moral atrocities inflicted, tolerated, or ignored by an apartheid governance in South Africa. The author argues that the South African experience displays forgiveness as a realistic, though difficult moral choice, when forgiveness in the public square is construed as a feature of the common good. Reflecting on a career that temporally coincides with that of the JRE and discloses a like commitment to approaching ethics through attention to multiple religious traditions, the author traces the evolution of her abiding interest in socio-historical expressions of religious convictions and the processes of ethical reflection and analysis that accompany and challenge these. As her research has increasingly focused on a North-South axis, the compelling voices of the poor have provided moral insight and have reformed the author's questions about (...) the interplay of circumstance and moral sensibility, awakening new appreciation both of indomitable moral integrity and of the fragility of virtue. To study and to do religious ethics is to be engaged in a three-tieres task which is likened to the process of climbing a three-step ladder. The climber is free to move both up and down depending on the need at hand, depending upon what it is that is to be reached for. The first step refers to the concrete-experiential level where we address conflicting value claims and engage in decision-making procedures; the second refers to the theological-philosophical level where we (...) examine the interpretive framework brought to bear at level one, and the third calls for examination and justification of the epistemological roots of that interpretive framework. The paper argues that concern with reason and the rational processes of justifying actions dominates ethical discussion today, and that although this concern is appropriate, it is also insufficient. The author thus lingers over the often-neglected role of feeling in ethical analysis and argues that feeling as well as reason has epistemological value in the search for ethical insight. (shrink)

The question I want to discuss is “How can I say ‘No’ to a fund-raising appeal?” Since many people apparently find it easy to say “No,” it is not clear what the problem is. Put briefly, the problem is this: I do not want to think of myself as uncaring, unfeeling, and insensitive to the needs of others. And yet, within the last year I have not responded to appeals for funds from a wide variety of causes: medical research, famine (...) relief, freedom of speech, environmental protection. I have turned down requests for support of scholarly magazines, research institutes, and other good causes. My only moderate-sized contribution during that time has been to the capital campaign of an organization of which I am a member. I have enough to have made small contributions to all of the organizations from which I received appeals, but not enough so that my contributions to any single cause would be of major significance. How can I justify not giving? The problem arises because these appeals apparently put moral claims upon me: they say that people are suffering and have needs, and you can help to meet them. Or they say that the intellectual and cultural life of our society will be enriched if you help. One traditional philosophic view holds that moral claims have a special status. They override political, economic, social, and other claims. The only thing, according to this view, that can free one from a moral claim is another moral claim. (shrink)

Elimination of state laws that preempt local antismoking ordinances is a national health objective. However, the tobacco industry and its supporters have continued to pursue statelevel preemption of local tobacco control ordinances as part of an apparent strategy to avoid the difusion of grassroots antismoking initiatives. And, an increasing number of challenges to local ordinances by the tobacco industry and persons supported by the tobacco industry are being decided in state supreme courts and courts of appeals. The outcomes of seemingly (...) similar cases about the validity of local smoke-free air ordinances vary signifcantly by state. This paper examines the common and unique aspects of the decisions and the potential implications of court rulings on preemption for future state tobacco control eforts and achievement of national health objectives around the elimination of preemption. Using a search strategy developed for the Centers for Disease Control and Prevention's State Tobacco Activities Tracking and Evaluation System, cases where a state or federal appellate level court made a fnding on the validity of a local smoke-free air ordinance or regulation were identifed in 19 states. In contrast to previous studies, we found that cases in approximately half of states were decided for local governments. We also found that across the states, courts were considering similar factors in their decisions including the extent to which: the local government possessed the authority to pass the ordinance, the ordinance conficted with the state constitution, and state statutes preempt the ordinance. Despite governmental and private antismoking initiatives, tobacco smoking remains a significant public health and economic challenge. The Centers for Disease Control and Prevention estimates that for each year between 1997 and 2001, cigarette smoking and exposure to secondhand smoke caused approximately 438,000 U.S. residents to die prematurely, resulting in 5.5 million years of potential life lost, and in $92 billion dollars of lost productivity. Also, despite convincing scientific data that laws against indoor smoking protect people from the negative health effects (...) of cigarette smoke, not all states have afforded their residents this protection. As of July 2007, 16 states neither restricted nor banned indoor smoking in restaurants, private worksites, or government worksites, and many state statutes only required separate rooms for smokers rather than eliminating all smoking inside buildings. In several states, local governments have attempted to fill this gap by adopting their own antismoking measures. (shrink)
