Physicians generally recommend that patients resuscitated with naloxone after opioid overdose stay in the emergency department for a period of observation in order to prevent harm from delayed sequelae of opioid toxicity. Patients frequently refuse this period of observation despiteenefit to risk. Healthcare providers are thus confronted with the challenge of how best to protect the patient’s interests while also respecting autonomy, including assessing whether the patient is making an autonomous choice to refuse care. Previous studies have shown that physicians (...) have widely divergent approaches to navigating these conflicts. This paper reviews what is known about the effects of opioid use disorder on decision-making, and argues that some subset of these refusals are non-autonomous choices, even when patients appear to have decision making capacity. This conclusion has several implications for how physicians assess and respond to patients refusing medical recommendations after naloxone resuscitation. (shrink)

This study examines factors impacting ethical behavior of 103 hospital nurses. The level of emotional intelligence and ethical behavior of peers had a significant impact on ethical behavior of nurses. Independence climate had a significant impact on ethical behavior of nurses. Other ethical climate types such as professional, caring, rules, instrumental, and efficiency did not impact ethical behavior of respondents. Implications of this study for researchers and practitioners are discussed.

This paper investigates the effect of the countervailing forces within organizations of formal systems that direct employees toward ethical acts and informal systems that direct employees toward fraudulent behavior. We study the effect of these forces on deception, a key component of fraud. The results provide support for an interactive effect of these formal and informal systems. The effectiveness of formal systems is greater when there is a strong informal “push” to do wrong; conversely, in the absence of a strong (...) push to do wrong, the strength of formal systems has little impact on fraudulent behavior. These results help to explain why the implementation of formal systems within organizations has been met with mixed results and identifies when formal systems designed to promote ethical behavior will be most efficacious. This study examines factors impacting ethical behavior of 203 hospital employees in Midwestern and Northwestern United States. Ethical behavior of peers had the most significant impact on ethical behavior. Ethical behavior of successful managers, professional education in ethics and sex of the respondents also significantly impacted ethical behavior. Nurses were significantly more ethical than other employees. Race of the respondent did not impact ethical behavior. Management of organizational tensions can facilitate the simultaneous advancement of economic, social, and environmental priorities. The approach is based on managers identifying and managing tensions between the three priorities, by employing one of the three strategic responses. Although recent work has provided a theoretical basis for such tension acknowledgment and management, there is a dearth of empirical studies. We interviewed 32 corporate sustainability managers across 25 forestry and wood-products organizations in Australia. Study participants were divided into two groups: those considered (...) effective at corporate sustainability and a status-quo group. Contrary to current theory, our findings showed that acknowledgment of organizational tensions was widespread in the Australian forestry and wood-products industry and not limited to those managers who are effective at managing corporate sustainability. What differed was the degree to which managers did something about the perceived tensions—with the effective group more consistently acting to manage and resolve paradoxical scenarios. Our findings suggest that existing theoretical constructs of tension management may not adequately capture the individual-level complexity involved with managing tensions in practice. (shrink)

This study examined the impact of gender on perceptions of various business practices by male and female Russian managers. Female managers considered various activities such as doing personal business on company time, falsifying time/quality/quantity reports, padding an expense account more than 10 percent, calling in sick to take a day off, and pilfering organization materials and supplies more unethical than male managers. Female managers also perceived the acceptance of gifts and favors in exchange for preferential treatment more unethical than male (...) managers. (shrink)

This study investigated employee perceptions of ethical climates in a sample of Russian organizations and the relationship between ethical climate and behaviors believed to characterize successful managers. A survey of managerial employees in Russia (n = 136) indicates that "rules" was the most reported and "independence" was the least reported ethical climate type. Those who perceived a strong link between success and ethical behavior report high levels of a "caring" climate and low levels of an "instrumental" climate. The field of “business for peace” recognizes the role that businesses can play in peacebuilding. However, like much of the discussion concerning business in conflict zones, it has prioritized the view of multinationals, often overlooking the role of indigenous local firms. The economic, social, and intergroup dynamics experienced by local businesses in conflict zones are understudied, with the current paper beginning by positioning micro- and small enterprises in the peacebuilding debate, then engaging with multidisciplinary works to understand how they foster (...) peace. Through a case study set in north Lebanon, we conducted semi-structured interviews with twenty-three MSE owners in one industry who operate across sectarian divisions and with recently displaced Syrian refugees. Our findings indicate that local business activity can simultaneously promote peace and foster conflict, with peacebuilding improved when intergroup differences are reduced within the operating environment. Furthermore, the importance of economic development was elevated for local businesses, suggesting that peace through mechanisms such as social development, the rule of law, and training, is only achieved if economic needs are alleviated through these measures. We conclude by citing how contextual factors in conflict zones can enhance intergroup differences, and how resolving such factors can promote peacebuilding, with further empirical work needed in this area. Conflict zone entrepreneurs—local entrepreneurs running small businesses in conflict settings—have paradoxical impacts on stability: holding the ability both to foster peace but also to enhance conflict. Prior scholarly work has been unable to explain this divergence, as existing entrepreneurial indicators do not account for fundamental peacebuilding elements. In response, the article consolidates divergent fields of study, applies paradox theory to analyze underlying tensions in the field, and reframes entrepreneurship through a peacebuilding lens based on intergroup inclusivity and value-creating business practices. Using several cases, this article shows how entrepreneurial activity in conflict zones can foster sustainable peace, limited peace, or conflict, arguing that entrepreneurship based on value-creating and inclusive practices can result in pro-peace outcomes. This study investigates factors impacting perceptions of ethical conduct of peers of 293 students in four US universities. Self-reported ethical behavior and recognition of emotions in others (a dimension of emotional intelligence) impacted perception of ethical behavior of peers. None of the other dimensions of emotional intelligence were significant. Age, Race, Sex, GPA, or type of major (business versus nonbusiness) did not impact perception of ethical behavior of peers. This study examines perceptions of ethical climate and ethical practices of 118 successful Chinese managers among business students and managen in the Zhejiang province of China. The impact of different ethical climate types on perceived ethical practices of successful managers was also investigated. The "rules'* was the most reported, and '' independence'' was the least reported, among the various climate types. A majority of the respondents perceive successful managers as ethical. In addition, those who believed that their organization had a (...) "rules" climate perceived a strong positive link between success and ethical behavior. Suppose A is wrongfully attempting to kill you, thereby forfeiting his right not to be harmed proportionately in self-defense. Even if it were proportionate to blow off A's arms and legs to stop his attack, this would be impermissible if you could stop his attack by blowing off just one of his arms. Blowing off his arms and legs violates the necessity condition on imposing harm. Jonathan Quong argues that violating the necessity condition consists in violating a right to be (...) rescued: blowing off four of A’s limbs in proportionate self-defense rather than blowing off one of A’s limbs in proportionate self-defense fails to costlessly rescue three of A's limbs. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

This study explores if managerial dependencies and organizational independence impact ethical behavior of employees. Survey data was collected from 203 employees working for three hospitals in Midwestern and Northwestern United States. Managerial dependencies like specialized expertise, political connections, and performance visibility significantly impacted ethical behavior. Organizational independence and ethical behavior of peers also had a significant impact on ethical behavior. Implications of this study for researchers and practitioners are discussed.

This article seeks to develop the Marxist conception of social structure by incorporating developments within critical realist philosophy. It rejects forms of economic determinism such as the base-superstructure model and those reconstructions—like Cohen’s—that attribute primacy to productive forces in explaining history and society. It argues instead that society is the product of complex, often contradictory combinations of many different structures and mechanisms. They form a structural ensemble, hierarchically arranged, but where each element has its own dynamics and emergent powers. The paper presents the notion of “Spirit of Nature” in Henry More and describes its position within More’s philosophical system. Through a thorough analysis, it tries to show in what respects it can be considered a scientific object and in what respects it cannot. In the second part of this paper, More’s “Spirit of Nature” is compared to Newton’s various attempts at presenting a metaphysical cause of the force of gravity, using the similarities between the two to see this notorious (...) problem of Newton scholarship in a new light. One thus sees that if Newton drew from Stoic and Neo-Platonic theories of aether or soul of the world, we need to fully acknowledge the fact that these substances were traditionally of a non-dualistic, half-corporeal, half-spiritual nature. Both More’s “Spirit of Nature” and Newton’s aether can thus be understood as different attempts at incorporating such a pneumatic theory into the framework of modern physics, as it was then being formed. Entrepreneurship is the dominant form of enterprise in conflict-affected settings, yet little is known about the role of entrepreneurship in peacebuilding. In response, this article undertakes a review of entrepreneurship in conflict-affected regions to integrate research from business and management with research from political science, international relations, and parallel domains. Three views of entrepreneurship emerge—the destructive view, economic view, and social cohesion view—showing how entrepreneurship can concurrently create conflict but also potentially generate peace. The article identifies new avenues for pro-peace (...) entrepreneurship: namely, through personal transformation, social contributions, inclusive interactions, conflict trigger removal, intergroup policy persuasion, and acting as legal champions. This article also discusses several pathways forward for business-for-peace research alongside additional implications for the deployment of business-based support programs in conflict settings. In my paper, I dispute Christian Hengstermann’s analysis of More’s philosophical system as a form of panentheistic panpsychism in which matter is alive by virtue of being the last emanation from God. I show that, in his mature period, More explicitly rejected such an emanationist doctrine and attributed the non-mechanical powers of matter to an outside immaterial principle, the Spirit of Nature. Ultimately, this leads to a system in which divine space, the Spirit of Nature and the spirit of God (...) are representations of various aspects of the divine essence, as it is at work in the world. On the other hand, matter is not part of this triadic structure and can only be said to be alive at the cost of a rather counterintuitive redefinition of the notion of “life”. (shrink)

This paper performs a critical review of twin and adoption studies looking at possible genetic factors in criminal and antisocial behavior. While most modern researchers acknowledge that family studies are unable to separate possible genetic and environmental influences, it is argued here that twin studies are similarly unable to disentangle these influences. The twin method of monozygotic–dizygotic comparison is predicated on the assumption that both types of twins share equal environments, and it is argued here that this assumption is false. (...) Adoption studies have been promoted as a better way of separating genetic and environmental influences. However, there is good reason to believe that adoption studies of criminal and antisocial behavior were confounded by selective placement factors. In addition, these studies suffered from bias and serious methodological errors. In spite of these problems, no adoption researcher claimed to have found evidence of a genetic predisposition for violent crime. It is concluded that the weight of the evidence from family, twin, and adoption studies does not support a genetic basis for any type of criminal or antisocial behavior. Guidelines advise that x-rays do not contribute to the clinical management of simple nasal fractures. However, in cases of simple nasal fracture secondary to assault, a facial x-ray may provide additional legal evidence should the victim wish to press charges, though there is no published guidance. We examine the ethical and medico-legal issues surrounding this controversial area.

These are difficult times for the Marxist Left and many tough questions are being asked. Unfortunately two extremes often come to the fore. One position takes an ultra-revisionist course, questioning the very foundations of Marxism. Another takes a profoundly dogmatic approach, defending orthodoxy in knee-jerk fashion.

This paper evaluates the ongoing Finnish Adoptive Family Study of Schizophrenia. The Tienari, Lahti et al. study is the most recent attempt to use adoptees as a way of testing the hypothesis that schizophrenia carries a genetic component, and the purpose here is to present what is probably the first in-depth critical analysis of its findings. The published reports of Tienari and associates are the primary focus of analysis, while problems with other schizophrenia adoption studies using similar research designs are (...) also discussed. Because of factors including the selective placement of adoptees, the low variance explained by the two major hypothesized predictor variables for schizophrenia, the invalidity of the schizophrenia spectrum concept, and the failure to find an index schizophrenia rate greater than general population expectations, it is concluded that the Finnish study cannot be regarded as having produced evidence in favor of the genetic theory of schizophrenia. Human genetics research appears to be approaching a period of re-examination due to the decades-long failure of molecular genetic research to uncover the genes presumed to underlie psychiatric disorders, psychological traits, and some common medical conditions. As currently dominant theories of genetic causation come more into question, we will see a renewed interest in reassessing the potential roles of genes and environment in these areas. To illustrate the potentially harmful and diversionary impact of emphasizing genetics over the environment, the author (...) tells a story in the form of a parable. In this parable, the citizens of a medium-size city are confronted with the task of dealing with a group of arsonists who are systematically burning down several houses each week. The Mayor argues that the best way to prevent arson is to analyze the types of wood used to build the city’s houses, with an accompanying lack of interest in arresting the arsonists. Her opponents argue that regardless of the type of wood used, the city and its citizens should prevent arson attacks by focusing attention on identifying and arresting the arsonists. The Mayor’s position prevails, and the arson attacks continue for years to come at the same time as researchers continue to study and analyze the wood used to construct the houses. Informed readers will recognize the analogous ideas, research strategies, interest groups, publications, and historical controversies related to “nature–nurture” issues, which encompass every aspect of the parable. A new approach to understanding hegemony is developed based on the method of critical realism. Breaking from the traditional interpretations that emphasise inter-subjective, superstructural and cultural aspects of hegemony, this article looks at hegemony's structural context and the conditions for its possibility. A realist conception of hegemony relates hegemonic projects to structural reproduction and transformation via Bhaskar’s transformational model of social activity. In doing so this model is itself modified to incorporate hegemony as the political moment of social reproduction. But it is as a mystic that Eckhart is generally known. So any serious study of mysticism, in our times, cannot overlook this Dominican whose birth, childhood, and death remain obscure to this day.3 About the (...) age of eighteen, he probably entered the Dominican order. He was trained at the universities of Cologne and Paris. After completing his higher studies in theology at Paris, twice he was appointed as Paris magister (i.e., lesemeister or master)—in 1302 and in 1311—a rare honor, until then given only to Thomas Aquinas, whose teaching influenced him.After completing his second term as Paris magister, in 1313, he was called to function as the special vicar for the Dominican master general. From 1314 to 1326 Eckhart lived and worked first in Strasburg and then in Cologne, where he served as a spiritual guide for many Dominican nuns, also for Beguines. It was there Eckhart plunged into a life of a preacher and spiritual guide (lebemeister). His academic accomplishments, the positions he held, and the sermons he preached bear witness to his influence on Christian theology, philosophy, and mysticism.During the nineteenth and twentieth centuries, as the Occident came in contact with Oriental religious traditions, Eckhart’s theology and mysticism were suddenly seen in a new light. His daring insistence on the transcendence of the Godhead, his central theme of the union of God and the soul, his genius for apophatic theology, and so on were considered as the European parallel to the metaphysics of Asian religious traditions, especially Vedanta and Mahāyāna Buddhism.Of all the Christian mystics, Eckhart perhaps comes closest to Asian religions such as Hinduism and Buddhism, especially the Mahāyāna tradition. The text is divided into two parts. In the first part, the author describes the eternalists’ and presentists’ positions as the two basic possible statements of the ontology of time . The eternalist position and the emphasis it puts on the actual existence of past and future events are thoroughlly analysed in order to show that in fact, they end up making strings of symbols that are not correct statements. It is therefore necessary to step beyond these clumsy statements and (...) try to understand more exactly the eternalist intuitions on a deeper, metaphysical level. That is the main concern of the second part of the text, in which the metaphysical implications of both positions are compared. At the end of the linguistical analysis in the first part, we got to a point where it may seem that presentism and eternalism are only different attempts at expressing what is in fact the same understanding of the nature of time, but in the metaphysical analysis that follows, it will turn out that they are not. Presentism and eternalism are shown to be two different ontological approaches of time in relation to space . The author then focuses on the consequences these two positions have especially on the concept of the present and of its flow through time. In the end, presentism and eternalism turn out to be completely different positions that – in parallel with the famous McTaggart’s argument – claim a very strong reality of time on the one hand or, on the other hand, its utter unreality.
