National <.lt> domain name disputes in Lithuania are the ones which courts must decide without having any specific legal regulation. In such cases courts shall apply analogy of law, customs and general principals of law. Last but not least, the courts must address international legal practice as regards the domain name disputes, i.e. take into account the famous ICANN Uniform Domain Name Dispute Resolution Policy adopted in 1999 and mostly applied by the panels of WIPO Arbitration and Mediation Centre (...) while dealing with disputes on generic top level domain names <.com>, <.net>, <.org>, also analyse the practice of ADR cases of Czech Arbitration Court which has the jurisdiction over <.eu> domain name disputes. This article deals with the case-law of Lithuanian courts in <.lt> domain name disputes and analysis the trends of Lithuanian internet law as regards the protection of the owners of intellectual property in Lithuania. The special attention is given to the phenomenon of cybersquatting in Lithuania and the lack of effective means to fight such unfair practices on the net. (shrink)

This paper argues that private property and rights assignment, especially as applied to communication infrastructure and information, should be informed by advances in both technology and our understanding of psychology. Current law in this area in the United States and many other jurisdictions is founded on assumptions about human behavior that have been shown not to hold empirically. A joint recognition of this fact, together with an understanding of what new technologies make possible, leads one to question basic assumptions about (...) how law is made and what laws we should have in a given area, if any. I begin by analyzing different aspects of U.S. law, from a high-level critique of law making to a critique of rights assignment for what I call 'simple nonrival goods.' I describe my understanding, as a non-lawyer with a background in psychology and computing, of the current conventions in U.S. law, consider the foundational assumptions that justify current conventions, describe advances in psychology and technology that call these conventions into question, and briefly note how the law might normatively change in this light. I then apply this general analysis to the question of domain name assignment by the Internet Corporation for Assigned Names and Numbers (ICANN). (shrink)

Built upon the foundations of the Internet, the World Wide Web has been the most significant technological development within recent history, sparking a reformulation of both capitalism and resistance. The Web is defined as a « universal information space » by its inventor Tim Berners-Lee of the W3C, reflecting the universal scope of politics and struggle today. Yet while its effects have been scrutinized, the Web itself has received little inquiry. The composition of the governing networks that control the infrastructure (...) of the Web have only recently been engaged with by activists with the ICANN affair and WSIS protests. The Web is governed by a network that is composed of an « immaterial aristocracy » of radical democratic « hackers », corporations such as Google and Microsoft, and non-governmental organizations such as the Internet Engineering Task Force and World Wide Web Consortium. These networks continually negotiate between the needs of global capitalism and the desires of immaterial labour on the Web. (shrink)

Ce texte entend montrer les enjeux en termes de protection des données personnelles de l'accès au service WHOIS. Avec la création massive de nouveaux noms de domaines rendue possible par la migration des serveurs racines vers IPv6, la question de l'accès au WHOIS devient critique. Une régulation tendant à mieux assurer la protection des données personnelles est à envisager dans un autre contexte, l'Icann ne souhaitant pas la mettre en place. Mieux vaut se replier sur les noms de domaines (...) contrôlés par les organismes respectant les directives européennes, à l'image de ce que pratique l'Afnic, assurant la protection des données personnelles des propriétaires des noms de domaine tout en permettant d'y avoir accès dans des conditions bien spécifiées.This paper aims to show what is at stake in terms of data protection with access to the WHOIS service. With the exponential growth ofTLDs offered by the migration of root servers to IPv6, access to WHOIS has become a critical issue. A regulation to ensure better protection of personal data needs to be envisaged in a different context, since ICANN does not wish to implement it. A better option would be to use TLDs under the control of organisations that abide by EU rules, as AFNIC is doing by protecting the personal data of domain name owners while allowing access to them under specified conditions. On n'a pas attendu le Net pour établir un commerce profitable des données personnelles. Depuis la vente par correspondance jusqu'aux cartes de fidélité, des milliers de fichiers sont venus grossir les bases de données des grandes marques qui stockent, nettoient et monnayent leurs informations clientèle. Dans le monde réel donc, il semble presque consensuel d'être fichés et démarchés par des enseignes. En revanche, sur le Net, les internautes semblent davantage inquiets du devenir des traces qu'ils laissent en ligne. Qu'est-ce que (...) l'arrivée du Net change à ces pratiques commerciales? Prenons-nous davantage de risque quand nous remplissons un questionnaire en ligne? Cette forme de profilage est pourtant indispensable à la survie d'un modèle économique qui a la gratuité comme principe et la publicité comme outil. Mais doit-on payer la gratuité au prix fort, c'est-à-dire celui de la perte de protection des données personnelles? D'autant plus que les internautes semblent aujourd'hui plus occupés à se rendre visibles sur les réseaux sociaux qu'à rester anonymes: un changement de comportement qui modifie le rapport du consommateur à la marque.This paper aims to show what is at stake in terms of data protection with access to the WHOIS service. The Ukrainian Democratic-Radical Party was formed as a result of the unification of the Ukrainian Democratic and Ukrainian radical party in 1905. Regarding religious affairs, the UDRP program required the separation of the Church from the state and the election of the clergy that was traditional for Ukraine. The party's foundations were local communities that existed autonomously and often raised and resolved on their own. In January, 1905, the Odessa community asked the Russian government to ensure the freedom to (...) use the Ukrainian language in the church. (shrink)

Частным аспектом предлагаемой реформы интернета является метаномические правила референцирования и адресации виртуальных объектов с целью приближения их к естественным языкам, и создания их логической системы. Однако реформа интернета и преобразование его в средство общения и служения обществу требует также других мер. К этим мерам относится передача определённых имён в неотчуждаемое владение, чтобы их собственники безусловно и беспрепятственно могли осуществлять их право публикации, т.е. публичного высказывания и выражения их мыслей, что также важно для документографии. Другой мерой должно стать упразднение всей сложившейся (...) системы управления интернетом, т.е. бюрократии, после чего техническим службам будут делегированы обязанности по обеспечению его функционирования с учётом высказанной критики.
