Women’s entry into the legal academy in significant numbers—first as students, then as faculty—was a 1970s and 1980s phenomenon. During those decades, women in law schools struggled: first, for admission and inclusion as individual students on a formally equal footing with male students; then for parity in their numbers in classes and on faculties; and, eventually, for some measure of substantive equality across various parameters, including their performance and evaluation both in and in front of the classroom, as well as (...) in the quality of their experiences as students and faculty members and in the benefits to be reaped from their tenure. This part of the story of women’s entry into the legal academy in the 1970s and 1980s—a story of attempted admission, then inclusion, then integration and assimilation, and then, finally, equality—is now a familiar one, at least in broad outline. It is not, in its entirety, an uplifting story. According to a raft of articles produced by women law students in the 1980s, 1990s, and 2000s, women law students during those decades participated less in the classroom, were called on and responded to differently when they did participate, suffered from more law-school-induced anxiety disorders and other mental health issues, graduated with lower GPAs and less law review experience, published fewer notes and filled fewer editorial positions on those journals, held fewer leadership positions overall while in law school, and had far more difficulties connecting with mentors, teachers, and would-be recommenders among the faculty than male students. Women law professors during those decades were tenured at significantly lower rates than men and, particularly at high prestige schools and at schools with fewer female faculty among the tenured ranks, were hired at lower rates that did not reflect their number in the pool of qualified applicants, had trouble asserting or maintaining authority in the classroom or being perceived as having authority, taught lower-prestige courses and received low teaching evaluations, and, like their students, were published far less frequently in the major and most prestigious law reviews. Much of this, albeit not all, has not changed much for either students or faculty. As women in law schools enter the posttenure and midcareer phase, many of the old problems persist while new ones appear: women faculty are invited to participate on panels less often than men, and both women students and faculty are underrepresented as authors in law reviews. Although gender-neutral parental leave is now available to faculty at most law schools, many such policies are still ad hoc. There is considerable worry, although no hard evidence, over whether men disproportionately use the time off to write rather than care for children. Women are still disproportionately overrepresented in some fields and underrepresented or unrepresented in others, and those fields correlate in unsurprising ways with levels of prestige: the more women in a field, the less prestigious. As elsewhere in the workforce, women faculty in legal education suffer from sexual harassment, most of which is unremedied. Women still suffer a pay gap in law schools that remains unaddressed at most universities, as it does elsewhere in academia. There is a sizeable literature on these depressing phenomena that stubbornly do not seem to abate. In these comments, however, I want to focus on another, less appreciated, part of the story of women’s entry into the legal academy in the 1970s and 1980s: the emergence of a body of scholarship—sometimes called feminist legal theory—produced by some of these women legal scholars over the same time period. The story I want to focus on, in other words, is not that of second- or third-wave women’s struggles within the academy, either for admission, acceptance, assimilation, or equality in law schools. Rather, this Article focuses on the story of the scholarship some of those second-wave assimilated women produced once they got there. Feminist jurisprudence, understood largely as scholarship on issues pertaining to gender equality, was launched in the 1970s, endures today, and continues to shape debates. Feminist legal theory, however, was in effect a subfield within feminist jurisprudence and, as its name implies, was an attempt to fashion a broad- based theoretical account of the relationship of law in liberal legal regimes to women’s subordination, patriarchy, and gender and sexual inequality— particularly in a post–civil rights era, when women enjoyed broad access to rights of formal equality, reproductive liberty, and liberal antidiscrimination law. Feminist legal theory so understood—a body of scholarship in search of a theoretical understanding of the relation of law to women’s subordination or, more simply, of law and patriarchy—was birthed in the 1970s, nurtured in the 1980s, and matured in the 1990s. I suggest in this Article that it is now seemingly in decline, and may soon disappear altogether. The reasons for this trajectory, I believe, are to date unexplored. Some reasons are fairly self-evident. Feminist legal theory was a product of three time-specific factors peculiar to the 1970s and 1980s: it reflected the political and the legal struggles of second-wave feminism. The critical theory schools were, to varying degrees, present or thriving in the academy in the 1970s and 1980s, within which feminist legal theory was birthed, grew, and then coexisted with critical theory, albeit at times very uneasily; and this feminist theory reflected second-wave women faculty and students’ mixed experiences of assimilation, success, and alienation in law schools themselves, as briefly recited above. Those three factors—the background politics, the presence of critical theory in law schools, and the differences in women’s experience of those schools—are all themselves either disappearing or dissipating in felt urgency, albeit in different ways and at different speeds, and that dissipation clearly is a part of the story of feminist legal theory’s decline. There are other reasons for its decline as well, however. Some are internal to feminism and feminist theory, and some pertain to the changing nature of legal scholarship from the 1980s to the present. I explore these reasons in Part II below. The story of the development of a distinctively feminist legal theory during the 1970s through the 1990s, and the story of its decline in the 2000s, is of obvious relevance to the history of second- and third-wave feminism. It should also be of interest for what it reveals about the nature of legal scholarship as it was understood, received, and produced in those decades. Its decline likewise reveals something about the changing nature of legal scholarship and the legal academy today. Thus, one conclusion I draw is that the feminist legal theory of the 1970s through the 1990s—regardless of the truth or lasting power of its claims—stands as an example of a type of legal scholarship that was somewhat distinctive to those decades. That form of legal scholarship, furthermore, likely can only emanate from the legal academy. For a host of reasons, we are currently in danger of losing this entire genre of intellectual work, which would be the polity’s loss, not just feminism’s or the legal academy’s. (shrink)

Since the publication of The Sexual Politics of Meat in 1990, activist and writer Carol J. Adams (2000 [1990]) has put forth a feminist defence of veganism based on the argument that meat consumption and violence against animals are structurally related to violence against women, and especially to pornography and prostitution. Adams’ work has been influential in the growing fields of animal studies and posthumanism, where her research is frequently cited as the prime example of vegan feminism. However, her (...) particular radical feminist framework, including her anti-pornography and anti-prostitution arguments, are rarely acknowledged or critiqued. This article challenges the premises of Adams’ argument, demonstrating that her version of vegan feminism is based upon an unsubstantiated comparison between violence against women and violence against other-than-human animals, and on the silencing and exclusion of sex workers as subjects. The article contests the limited reading of Adams, and of feminism, offered in some key works in animal studies and posthumanism, at the same time that it recognises the need to challenge the anthropocentrism evident in much feminist theory. By way of alternative approaches to the sexual politics of veganism, the article highlights the interventions of artist and activist Mirha-Soleil Ross, proposing that her situated and embodied commitment to animal rights brings sex worker agency into the story, while resisting simple comparisons among different forms of violence. The concerns raised by Ross overlap in compelling ways with recent research in performance studies and labour history, bringing the question of work and workers, animal and human, to the fore. These studies point towards a potentially more useful framework than that of Adams for understanding the human violence suffered by different species, including those destined to be eaten by people. Nearly two hundred years ago, Mary Wollstonecraft wrote what is considered to be the first major work of feminist political theory: A Vindication of the Rights of Women . Much has been written about this work, and about Wollstonecraft as the intellectual pioneer of feminism, but the actual substance and coherence of her political thought have been virtually ignored. Virginia Sapiro here provides the first full-length treatment of Wollstonecraft's political theory. Drawing on all of (...) The death of Jean Baudrillard in 2007 brought about a resurgence of feminist scholarship on his work. But in all recent feminist scholarship on Baudrillard, save for Victoria Grace’s Baudrillard’s Challenge: A Feminist Reading (2000), feminists focus on Baudrillard’s later theory of simulation, forestalling any reconsideration of his earlier text Seduction (1979). In this article I argue that a theory of seduction facilitates the unveiling of a hitherto unnoticed strain of feminist writing that proposes (...) an ongoing challenge to masculine power and politics. Anna Doyle Wheeler was a nineteenth‐century, Irish‐born socialist and feminist. She and another Irish‐born socialist and feminist, William Thompson, produced a book‐length critique in 1825, Appeal of One Half the Human Race, Women: Against the Pretensions of the Other Half, Men, to Retain Them in Political, and Thence in Civil and Domestic, Slavery: In Reply to a Paragraph of Mr. Mill's Celebrated “Article on Government,” to refute the claims of liberal philosopher James Mill in 1820 that women (...) did not need to be enfranchised. In so doing the Appeal undermined the philosophical credibility of Mill's liberal utilitarianism. The Appeal exposed the hypocrisy of the language of contract (whether social, sexual, or marriage) by showing that men's freedom and claims to rights presupposed the unfreedom and sexual subjugation of women. The article argues that the Appeal was an original formulation of feminist political theory that still retains its relevance in the twenty‐first century. (shrink)

This article analyzes the innovations produced by the concept of experience, introduced from the feminist theory during the eighties. The experience was an epistemic invention to give account of what used to result exceeding, subsidiary, or invisible to the science legitimated as such. This theoretical-methodological tool led to redefinitions around the sense of objectivity and pointed out the political condition of a perspective that was declared as neutral. This work tries to throw some light over the critical (...) strength that this epistemic tool had during those years, for which it chooses the historical perspective. At the same time, this article advances towards a critical analysis around certain modelling of the tool. In this sense, the article aims to sharpen the epistemic surveillance and to review the commitments that this has been acquiring with the institutionalization of the feminist perspective during the last decades. El presente artículo analiza las innovaciones que produjo en el campo del conocimiento la herramienta de la experiencia, introducida desde la teoría feminista en los años ochenta. La experiencia fue una invención epistémica que tuvo como objetivo dar cuenta de aquello que resultaba excedente, subsidiario o invisible a la ciencia legitimada como tal. Este instrumental teórico-metodológico conllevó redefiniciones en torno al sentido de la objetividad y señaló la condición política de una perspectiva declarada neutral. El presente trabajo apunta a alumbrar la potencia crítica que dicha herramienta epistémica tuvo en aquellos años, para lo cual elige la perspectiva histórica. Pragmatism, Feminism, and Democracy is James Livingston's virtuoso reflection on the period between 1890 and 1930, a primal scene of American history during which a wave of intellectual currents came together--and fell apart--to reorient society. Tying in critical insights on corporate capitalism, consumer culture, populism, and the American Left, Livingston analyzes the intersections and similarities of pragmatism and feminism to yield an original, provocative blend of historiography, feminist theory, and American intellectual history.

In the sociology of science and sociology of scientific knowledge, the decline of functionalism during the 1970s opened the field to a wide range of theoretical possibilities. However, a Marxist-influenced alternative to functionalism, interests analysis, quickly disappeared, and feminist-multicultural frameworks failed to achieved a dominant position in the field. Instead, functionalism was replaced by a variety of agency-based frameworks that focused on constructive or performative processes. The shift in the sociology of science from Mertonian functionalism to the poststrong program, (...) agency-based sociology of scientific knowledge has parallels with the broader shift in political ideologies from social liberalism to neoliberalism. The argument is made in a way that is cognizant of the criticisms raised against interests analysis and avoids the ?short circuit? of class imputation. This article qualifies and supplements the interpretation of Astell's Reflections on Marriage as an attack on contract theories of politics. Astell was undoubtedly a conservative critic of Locke, but also deserves her reputation as a feminist critic of marriage, since the primary purpose of her Reflections was to get women to reflect on whether to marry, and seriously to consider not marrying. The essay supports this interpretation by locating Astell's Reflections in the context of the querelle des femmes. Viewed (...) as a response to misogynist anti-marital satire, it is clear why Astell's work on marriage should have been received by her contemporaries as blowing the 'trumpet of rebellion' to women. The fact that Astell was both deeply conservative and recognizably feminist suggests that feminist political thought is not simply an outgrowth of Enlightenment radicalism, and reminds us that feminism is in part a defensive response to the hatred of women. Sonia Kruks' latest book, Retrieving Experience, is a valuable contribution to ongoing debates about the relevance of feminist philosophy in a period of relative political quietism. It (...) also offers timely reminders of historical continuities between phenomenological and postmodern conceptions of subjectivity and political engagement. Drawing on Merleau-Ponty, Beauvoir, Fanon, and the later Sartre, Kruks proposes to "explore women's embodied experiences" and to "ask whether they might not offer some means to help build affective bonds among women who are in many ways radically different from one another" (6). The book approaches this task by means of two secondary issues. First, should feminist thought be oriented by phenomenological or postmodernist theoretical strategies? Second, can women's embodied experience be the conceptual basis for political and epistemological practices that avoid the pitfalls of "identity politics" or an "epistemology of provenance"? The answer to both questions comes through the notion of praxis developed in Sartre's Critique of Dialectical Reason. By thinking of embodiment as praxis or work, a strategy implicit in Beauvoir's idea that "one is not born, but rather becomes, a woman." Kruks seeks to resolve the ethical affront of finding one's individuality reduced to the "generality" of a collective—the ethical affront to which feminists of various generations and theoretical persuasions must respond.Retrieving Experience explores the significance of recognition as a political norm. Identifying Sartre's Anti-Semite and Jew as a pivotal work in the history of identitarian theorizing, she situates recent appeals for race- and gender-based political mobilization in the United States with respect to the dialectical relationship between the Look, shame, and recognition existentialists observed in situations of anti-Semitic and colonial domination during and immediately after the Second World War. Legitimating knowledge gained under oppressive conditions formed an important element of African, Southeast Asian, and ultimately African-American and feminist resistance to cultural imperialism. However, Kruks warns, discourses of "recognition" risk placing the blame for group domination on individuals' face-to-face interactions while concealing the role of state and economic institutions in enabling social disdain to systematically damage a group's quality of life. Moreover, they suggest that the experience of subjugation alone justifies knowledge claims or counts, without further elaboration, as an act of political engagement. Kruks argues that knowers and actors need to identify conceptual and practical mediations enabling individual interactions, experiences, and strategies to prompt the recognition and transformation of [End Page 73] group situations. Sartre's notion of praxis, she suggests, explains how an individual can participate in a collectivity while acting autonomously or acquiescing to subjection.The most important passages in Retrieving Experience examine the affective aspects of the decision to take up a political identity or engage in political action. Going beyond Sartre's account of mediations, Kruks suggests that the sensory and emotional qualities of embodiment are themselves mediators, the products of praxis as well as its vehicles. Since any act of social knowledge involves the emotions, affect plays an important role in the process whereby individuals from different cultural, economic, and bodily situations learn about and shape one another's' environment through the act of knowledge. Individuals, then, may have a moral responsibility to learn about others in a way that gives them "sympathetic bodies." Drawing on Maria Lugones' social epistemology, Kruks argues that "world-traveling" or existing simultaneously in several communities or sets of power relations is a bodily act, but also a fully cultural, ethical act rather than a natural way of being. The use of "theory" in feminist analysis has been said to threaten feminism as a political force. This collection of work by leading feminist scholars engages with the question of the political status of poststructuralism theory within feminism. Against the view that the use of post-structuralism necessarily weakens feminism, 'Feminists Theorize the Political' affirms the contemporary debate over theory as politically rich and consequential. Following in Joan Scott's anti-foundationalist footsteps, Linda Zerilli argues for a theory of feminist political judgement not framed in terms of epistemological certainty but assimilated to aesthetic judgement. Tani Barlow criticises Zerilli for not taking adequate account of history in her theory. I analyse the implications of Zerilli's ‘abyssal’ approach to political judgement and Barlow's critique of it. Despite their shared concerns, Zerilli's, Barlow's, and Scott's abyssal approaches struggle to effectively ground the validity of (...) historical analysis and political judgement within a context of plurality and historical difference. All three thinkers focus extensively on discursive and imaginative potential for change while marginalising the role of materiality in the creation of new horizons for women. Incorporating a dynamic account of the materiality of human life into their work would allow them to tie politics and history to an explanation of the role material life plays in constituting plurality, factuality, and historicity. Fox-Genovese, Kaminer, and Riley all write the history of feminism as a history of conflict between feminists who desire to deny difference in favor of equality and those who desire to celebrate difference. And they all ask what this contradiction lying at the heart of feminist theory implies for the practice of feminist politics. These works reveal the need for feminists who engage this debate to be self’-Conscious in their formulations.

Are women's movement and feminist theories still connected to radical politics and the interest in changing social inequalities, when feminism has been `institutionalized', for instance in the academia, and has become a mainstreaming issue in social policies? This main question was put to eminent feminist scholars, with the aim of investigating the renewed critical role of international feminism and women's/gender studies in society, science, information, education and research. A reconstruction of the main changes which have occurred to women's (...) movements and feminist theories in the last decades were the core of the interview, stressing differences and disagreement, also in relation to the new sociopolitical claims, supported by younger generations. The conclusion was that feminism has not lost its historical political mission, even though the world scenario and ideologies have dramatically changed. Indeed, feminism has become transcultural and `glocal', facing new socioeconomic inequities induced by globalization both in western societies and countries in development, confronting with the transformation of collective/gender identities and questioning the increasing importance of technologies. The theme of human biology recurs continually both in feminist and in anti-ferminist literature. Reflection on human biology has seemed to promise answers to the urgent questions of why women everywhere are subordinated and whether and how that subordination can be ended. Invariably, anti-feminists have justified women's subordination in terms of perceived biological differences between the sexes, and feminists have responded to their claims in a variety of ways. In this paper, I want to look critically at the ways (...) in which feminists in the liberal and Marxist traditions have responded to the biologically based challenges of anti-feminism, and to suggest an alternative way of conceptualising the relation between human biology and the social status of women.
