Avrupa Fetva Meclisi, çoğu Batı’da ikame eden hem şerî delilleri hem de vâkıayı bilen kıymetli âlimleri bünyesinde toplamış ilmi bir müessesedir. 1997 yılında Yûsuf el-Karadâvî’nin (1926-2022) başkanlığında kurulmuştur. Bu tarihten itibaren özellikle de Batı’da yaşayan müslümanları ilgilendiren ve müslüman ülkelerde gözlemlenen problemlerden ciddi manada farklılaşan önemli fıkhî meseleleri gündemine taşımış, ürettiği çözümlerle hem oradan yaşayan hem de benzer problemlerle yüzleşen Müslümanlar için referans niteliğinde karar ve fetvalara imza atarak, kendisine başvurulan ilmi bir merci haline gelmiştir. Kuruluşundan günümüze Meclis’in yapısını konu (...) edinen ve genel ya da aile hukuku veya muamelat gibi, özel bazı meseleler bağlamında izlediği fetva yöntemine ilişkin farklı dillerde bazıları akademik tarzda pek çok çalışma yapılmıştır. Meclis, 2023 yılında İstanbul’da icra ettiği toplantısını bu tarihe kadar yaptığı çalışmalar ve kendisine yöneltilen tenkitlere hasretmiş, toplantıda Meclis’i farklı yönleriyle değerlendiren çok sayıda bildiri sunulmuştur. Bu çalışma da aynı gayeye hizmet etmek maksadıyla Meclis’in fetvalarını neşrederken izlediği metodu, fıkıh ve fetva usulü kuralları bağlamında eleştirel bir bakış açısıyla değerlendirmek üzere kaleme alınmıştır. Değerlendirme, fetvanın muteber sayılabilmesi için müftüde aranan ilmi ehliyet ve adalet şartlarıyla sınırlandırılmıştır. Bu bağlamda öncelikle fıkıh meclislerinin fıkıh ilmine yaptığı katkıdan bahseden bir giriş yapılmış, ardından Meclisle ilgili tanıtıcı kısa bir malumat verilerek, “ekalliyyât fıkhı” olarak da bilinen alanda doldurduğu boşluk başta olmak üzere, diğer fıkıh meclislerinden olumlu yönde ayrıldığı hususiyetlerine değinilmiştir. Fetvanın kabul edilmesi için gerekli şartlar meşhur usul kitaplarıyla iktifa edilerek tahlil edilerek aktarılmış, Meclis’in neşrettiği fetva ve kararların bu kurallara uygunluğu tartışılarak, diğer fıkıh meclisleriyle mukayese imkânı oluşturabilmek için onlar tarafından neşredilmiş karar ve fetvalara da yer verilmiştir. Çalışmanın sonucunda Meclisin, karar ve fetvaların kimler tarafından alındığını ilan etmemek suretiyle kriter olarak belirlenen fetva usulü kurallarına riâyet etmediği anlaşılmış, diğer fıkıh meclislerinin de çoğunlukla aynı problemle malul olduğu sonucuna varılmıştır. Çalışma, tespit edilen problemlerin çözümü için bazı tavsiyelerin de yer aldığı bir sonuçla tamamlanmıştır. Çalışmanın, ulaştığı sonuçlarla fetva müesseselerinin bu faaliyeti icra ederken fetva usulü çerçevesinde hareket etmelerine rehberlik edecek ölçüler ortaya koymak suretiyle alana katkı sağlaması umulmaktadır. Bunun yanında, hangi isimle anılırsa anılsın kurumsal olarak fetva neşreden müesseselerin, özelde ise Avrupa Fetva Meclisi’nin kararlarıyla amel eden ya da karar ve fetvalarını esas alarak fetva veren veya çalışmalarında istifade eden araştırmacı ve müftülerde farkındalık oluşturması ümit edilmektedir. In this study, the tahrîj method, which is used in answering contemporary Fiqh issues throughout the history of Fiqh, will be described and some sample fatwas given by the High Board of Religious Affairs based on this method will be analysed. Tahrîj is firstly to define the procedural and legal principles on which the singular views of a madhhab imam is based on, and then to determine the verdict of the issues in which an opinion from that imam is not (...) conveyed, according to the rules reached. Firstly the High Board of Religious Affairs will be introduced briefly highlighting issues such the effort put forward by the Board in the answering current fiqh issues, its contributions to the unity of fatwa and that it is a continuation of the Islamic Meşîhat-ı İslamiyye in the Ottoman Empire. Tahrîj, will be defined and its types, history, and its role in the development of fiqh and in solving current fiqh issues will be explained. Among the issues resolved by the High Board of Religious Affairs by applying the Tahrîj method or by making use of this method; commercial insurance, organ transplantation, gold-based lease certificate and the effect of injection/vaccine on fasting will be analysed. Given these exemplary fatwas, it will be tried to show that the method of Tahrîj is important today as it was in the past, both in terms of maintaining the consistency of fiqh and its contribution to the development of fiqh. Recent advances in research on iron metabolism have revealed the identity of a number of genes, signal transduction pathways, and proteins involved in iron regulation in mammals. The emerging paradigm is a coordination of homeostasis within a network of classical iron metabolic pathways and other cellular processes such as cell differentiation, growth, inflammation, immunity, and a host of physiologic and pathologic conditions. Iron, immunity, and infection are intricately linked and their regulation is fundamental to the survival of mammals. The mutual (...) dependence on iron by the host and invading pathogenic organisms elicits competition for the element during infection. While the host maintains mechanisms to utilize iron for its own metabolism exclusively, pathogenic organisms are armed with a myriad of strategies to circumvent these measures. The factors responsible for the return of fertility post-partum have not been very clearly defined. Several previous studies have reported apparently major differences between populations in the duration of infertility associated with lactation. However, these differences may be related to the differences in study designs.

Tradition has been disparaged as a conceptual category that should be jettisoned in the development process. It is thought to be capable of hindering the use of reason which is thought to be the primary mover of development. This thinking has its root in the Enlightenment rationalisations, especially as championed by the philosophes, Rene Descartes, and Immanuel Kant. Conservatives, such as Edmund Burke, contrarily, are of the opinion that tradition is a valuable resource for society because they regard tradition as (...) the accumulated wisdom of the past. This paper argues that, even though the Enlightenment and conservative thinkers differ in their conceptions of the value of tradition, they misconceived what tradition entails because they failed to pay attention to its dynamics and consequently could not put its values in proper focus. The paper considers tradition as a relevant imperative in development attempts and, therefore, suggests a conception of tradition that makes it a dynamic and useful phenomenon. (shrink)

Current literature suggests that the adversarial legal system may undergo some changes or may even be transformed by a recent influx of women lawyers into the profession. Such research indicates that women may approach ethical problems differently than men. This paper examines the responses of family law lawyers in Vancouver, British Columbia and the surrounding Lower Mainland to a hypothetical case which requires an assessment of professional responsibilities in light of potential conflicts in personal moral values.

Dada continues to attract a small following among scholars, but has perhaps not yet been recognized as providing invaluable insight into the underlying functions and potentials of culture generally. This article explores the nature and theoretical import of Dada, and two radically different visions of culture as they might try to accommodate and explain Dada. Models of culture taken from Bourdieu and Nietzsche are brought to bear, first on Dada, and then on each other, with the (...) aim of developing a theoretically informed understanding of Dada, and also demonstrating the practical, political and philosophical difficulties involved in choosing between a conflict model of culture and an `existential' model. Ultimately, both models are found to be helpful but insufficient at providing an adequate account of Dada, and it is suggested that present models of cultural analysis can benefit by revisiting both Dada and Nietzsche, trying to incorporate their insights and critically evaluate their visions of culture. ArgumentOne of the first high-altitude observatories was a hotel. Established in 1823, the chalet on Mount Faulhorn became a highpoint of nineteenth-century science. In this paper, I take this mountain as my entry point into the examination of the special attraction that mountains exerted on scientists. I argue that Mount Faulhorn stood for three different conceptions of the usefulness of the mountain in science: (1) in observation networks, stations were usually chosen for pragmatic rather than scientific reasons, but mountains (...) representedsingularspots in such networks, which deserved special attention; (2) the mountain also was amicrocosmwhere altitude differences were thought to capture essential features of latitude differences; (3) the mountain was sometimes no more than amacro-toolfor the pursuit of science, just a middle ground between the heaven and the earth. With the inception of Dada-Zurich - at the intersection between literary and art studies, comparative studies, image-text theory and philosophy - the relationship between modernity and avant-garde as well as between avant-garde and Dadaism was redefined. This redefinition was a consequence of the scandalous aesthetic theoretical insights of Dada Zurich, which (...) concretized in practical and poetic form an aesthetic theory that in itself is aesthetic, and developed an aesthetic-theoretical understanding in which aisthesis takes up a central position. Dada uses the avant-garde as material. The aesthetic theoretical potential of Dada Zurich in turn had an impact not only on the artefacts that were actually used and aesthetically reflected by Dada, but on all modern - including avant-garde - artefacts. The present study explores the discursive practice of the hospitality industry in addressing competence-based, benevolence-based, and integrity-based accusations of trust violation made by dissatisfied customers on TripAdvisor. Authentic negative online reviews written by dissatisfied customers and the corresponding responses by hotel management downloaded directly from TripAdvisor are analyzed qualitatively with Nvivo10. Results show that hotel management has the strongest preference for apology, followed by implicit denial and then explicit denial when dealing with the three different types of accusations (...) of trust violation. The findings will enhance our understanding of trust and its repair, and benefit hospitality practitioners responsible for handling online criticisms and complaints. (shrink)

The study examines the employment experience of workers with intellectual disability in the hotel sector in Australia. Through a qualitative case study, we interviewed managers and WWID, and held focus groups with supervisors and colleagues at three hotels. We have used the theoretical framework of corporate social responsibility to investigate HR practices that create an ethical climate which promote authentic work experiences for WWID. The study found that participative work practices provide evidence of how WWID fit in at the (...) workplace. When workers are confronted with work-related anxieties, the pragmatic nature of existential authenticity becomes a reality. Our findings reveal that managing workers ethically can lead to more authentic work experiences. In turn, this may promote social inclusion of WWID and improve their reported well-being. (shrink)

The study examines the ontological similarity between the concept of competitor orientation and questionable intelligence-gathering efforts. Respondents from the hotel industry were surveyed with self-administered questionnaires. Exploratory factor analysis was carried out to identify the structure underlying variables of market orientation and ethical judgment on questionable intelligence-gathering efforts. The results suggest that the surveyed hotel managers are unable to distinguish the legitimate tactics of competitor orientation from the questionable practice of industrial espionage.

Dada’s Subject and Structure argues that Dadaist praxis was far more theoretically incisive than previous scholarship has indicated. The book combines theoretical frameworks surrounding ideological subject formation with critical media and genre histories in order to more closely read Dadaist techniques (e.g. montage, irony, nonsense, etc.) across multiple works. These readings reveal both Dada’s preternatural focus on the discursive aspects of subject formation—linguistic sign, literary manifesto, photographic image, commodity form/aesthetics, which comprise the project’s chapters—and on Dada’s performative (...) sabotage and subversion of them. In addition to highlighting commonalities between Dadaist works, artists, and chapters previously imagined disparate, the book shows how Dada simultaneously prefigured structuralist theories of subject formation and pre-performed post-structuralist critiques of those theories. This essay is an exercise in the phenomenology – and post-phenomenology – of reading in relation to Elizabeth Bowen’s The Hotel (1927), a novel that thematizes and reflects on the uncanny status of reading and provokes in response an experimental critical ABC. Special attention is given to the work of French psychoanalyst Charles Baudouin in foregrounding the role and effects of suggestion in reading. Engaging with the concerns of writing and reading fiction in the ‘Anthropocene’ (especially in the form (...) of what is here called twi-fi) and drawing on notions of literary anachrony, cryptaesthetic resistance, queerness and deferred effect, the essay offers a new critical appreciation of the singularity of Bowen’s novel. The rise of non-fungible tokens (NFTs) has been astonishing, in particular for the arts and creative industries. The dominant discourse both in mainstream media and in academia today focuses predominantly on what this new technology can do for the art market rather than art itself. However, framing NFTs in art in the context of money and markets draws attention away from the more subtle and creative role of NFTs. Consequently, this article asks: What is the role of NFTs in art, (...) beyond the market? This research complements existing empirical work, by conducting a case study and interviews with members of DADA, a historic NFT art project which is particularly critical towards the role of the art market. The findings foregrounded five roles that NFTs play in art: as (1) a tool for systemic change, (2) a new way to community, (3) a ritual artefact, (4) a means for preservation and (5) a new medium. There is a striking contrast between the significance of Harold Hotelling’s contribution to industrial economics and the fact that his location model was invalid, unrealistic and non-robust. It is difficult to make sense of the explanatory value of Hotelling’s model based on philosophical accounts that emphasize logical validity, representational adequacy, and robustness as determinants of explanatory value. However, these accounts are misleading because they overlook the context within which the explanatory value added of a model is apprehensible. Pragmatism is ever more popular amongst those who study international relations. Its emphasis on practice is generally acknowledged as a defining characteristic. There is, however, a general tension within pragmatist thought concerning practice, for pragmatism may emphasize the theorizing of practice. It is, then, distinguished from other theories in International Relations (IR) such as neo-realism or constructivism as a contender in their midst. We delineate a pragmatist theory of IR in the first part of this article, but insist on going (...) beyond merely establishing the next paradigm, for pragmatism may also emphasize the practice of theorizing. Theories are, then, considered different tools useful for dealing with the social world. This will be corroborated in the second part by a close reading of William James. Finally, we submit that instead of a paradigm war, a metaphor such as that of the Papini hotel is needed in IR — a metaphor that accounts for theory competition without neglecting the limitations set by the practice of theorizing itself. This essay examines Meera Margaret Singh’s exhibition Nightingale in the time and place of the liminal space we call “hotel.” In intertexual dialogue with Wayne Koestenbaum’s Hotel Theory, the author not only reviews Singh’s intimate photographs of her mother, she reads the images with and against the architecture in which they are exhibited. The Gladstone as exhibition space redoubles Singh’s emphasis on the tense connectivity of apparent binaries: youth and age, public and private, artist and model, object and (...) spectator, living and dying. The quotidian activities of hotel living—guests’ arrivals, departures, and returns—become inextricable pieces of Singh’s site-specific installation. The author theorizes what Freud calls the “foretaste of mourning” in this work, grappling with what will be but is not yet the death of the mother. Singh’s Nightingale proposes that we do not “work through” mourning: mourning is a perpetual way of being in the present. (shrink)

I argue that there is a problem for a wide class of theories of art that arises from counterexamples drawn from everyday artistic activity, rather than high artworld artistic activity. I explore how the counterexample functions. Part of the point is to reflect on methodological issues concerning the use of examples when considering theories of art. We will also see why thinking about everyday cases is theoretically significant.
