This article aims to read feminist new materialisms (Barad), together with ‘postulated’ linguistic or cultural primacy of Queer Theory (Butler), to show how both are engaged in similar critical-ethical endeavours. The central argument is that the criticism of Barad and new materialisms misses Butler’s materialistic insights due to a narrow interpretation of Butler's alleged social-constructivist position. There is, therefore, a specific focus on where they both make similar ethical appeals. Moreover, the article relies on Adorno's negative dialectic to highlight an (...) interpretation of Barad and Butler as being part of the same dialectical movement, in which materialism and idealism fluctuate in their mutual criticisms, thus continuing the procession towards 'new knowledge' and emancipation, or freedom, through their motions back and forth. Provability, Computability and Reflection.

This paper argues that proper functions are proximal functions. In other words, it rejects the notion that there are distal biological functions – strictly speaking, distal functions are not functions at all, but simply beneficial effects normally associated with a trait performing its function. Once we rule out distal functions, two further positions become available: dysfunctions are simply failures of proper function, and pathological conditions are dysfunctions. Although elegant and seemingly intuitive, this simple view has had surprisingly little uptake in (...) the literature. Indeed, our position departs from that of almost every theorist who has engaged with the issue at any depth. We start by presenting three arguments for the position that proper functions are proximal: one from the specificity of functions, one from their relation to intervention, and one from their relation to pathology. We then consider two case studies evidencing the trouble that accepting distal functions causes for philosophical reflection on the nature of pathological conditions. Finally, we anticipate and respond to three objections: that there can be failure of function without dysfunction; that our account is unacceptably revisionary in respect of normal function-talk; and that our thesis over-generalises from a narrow set of cases. Baumgarten war im Jahr seiner bei Franz v. Liszt verteidigten Dissertation nach Genf berufen worden und lehrte in Köln, Basel, Frankfurt/M. und Berlin. Von der dreiteiligen "Wissenschaft vom Recht" urteilte Albrecht Mendelssohn Bartholdy im "Archiv des öffentlichen Rechts", hier sei die Jurisprudenz auf Philosophie gegründet, und die Lehre Baumgartens werde neben Stammler und Nelson die stärkste Wirkung (...) aufs Rechtsdenken gewinnen. Mit seinen philosophischen Schriften wurde Baumgarten, beeinflusst von James und Dewey, in den zwanziger und dreißiger Jahren des vergangenen Jahrhunderts ein Vordenker des sozialliberalen Pragmatismus in der deutschen Philosophie und nahm deren Hinwendung zur angloamerikanischen philosophischen Tradition um Jahrzehnte vorweg. 1933 erklärte er, unterm NS-Regime nicht Rechtwissenschaft lehren zu können, und ging von Frankfurt in die Schweizer Emigration. Die Erfahrung von Faschismus und Krieg führte ihn in der Mitte der vierziger Jahre zu sozialistischen Überzeugungen und Erwartungen und zur Marxschen sozialwissenschaftlichen Methode, so dass er, nach Frankfurt nicht zurückberufen, gleich anderen antifaschistischen Intellektuellen in die Ostzone und spätere DDR zog. Gerd Irrlitz behandelt die Hauptwerke und die marxistisch orientierten Texte Baumgartens – wie überhaupt die sozialliberale und die späte sozialistische Periode – nicht als Gegensätze, sondern als aufeinander bezogene und einander bedingende Konzepte, überzeugt, dass das Werk des Rechtsphilosophen unterm Erfordernis der Erneuerung des sozialen Liberalismus in der hochindustriellen Zivilisation neue Aktualität gewinnen kann. At the time of the crisis culminating in the First World War, Bloch, a long time opponent of the authoritarian German state, was taking liberal, pacifist and finally even socialist positions. This criticism was also directed at German scholarly philosophy. In order to elaborate the fundamental idea of his theory – a metaphysics of inwardness – without being affected by current trends, Bloch refers back to the classical antique and neoplatonic gnostic metaphysics as well as to Manichaeism. These elements, which (...) constitute the very basis of his idea of the anticipating consciousness, are then related to a central problem facing the 19th century: the fate of subjectivity in the context of capitalist reification. The essay examines some core ideas in P. Sloterdijk′s more recent publications. Two issues are of concern here. Drawing on a Heideggerian terminology and position on the problem, Sloterdijk presents some critical descriptions of the expansive character of capitalist civilisation. But he doesn′t seem to acknowledge the real internal essence of modern society. Instead of this he presents a simplified anthropological interpretation of its social and cultural character. It is not, as he sees it, social structures nor moral or religious (...) values which produce the character of our modern times, but rather a duality of beastly impulses, which on the one hand are prevented or tamed whilst on the other being allowed free reign of expression. In this context the author aligns himself with the increasingly obsolete tradition of disdain for the masses. (shrink)

The article looks at Marxist theory under two separate aspects: the socialist perspective of teleological determination of actions and causal determination over the long duration of historical periods. The first aspect is historically very changeable; Marx was thinking within the conditions of 19th century. As for the second aspect, his assessment of economic development trends was generally accurate. However, nowadays new societal aspects also need to be taken into account and their potential to contribute to the free development of society (...) evaluated – albeit without one able to build on the traditional working class. Der Aufsatz stellt Leben und Werk des bedeutenden deutschen Rechtswissenschaftlers und Philosophen Arthur Baumgarten dar, der neben Gustav Radbruch einer der führenden sozialliberalen Juristen und Philosophen in der Weimarer Republik war und gegen die nationale Isolierung der deutschen Philosophie seit dem Ersten Weltkrieg früh die angloamerikanische Philosophie aufgenommen hatte. So zeichnete er intellektualistische und utilitaristische Theorielinien vor, die in der deutschen Philosophie erst seit den sechziger Jahren Einfluss gewannen. In engem kollegialem Kontakt war Baumgarten mit Hans Driesch und Helmuth Plessner (...) verbunden.Seine Philosophie verband Baumgarten gemäß empiristischer Tradition vor allem mit der Psychologie. Daraus ergab sich auf der Grundlage einer sich auf Schopenhauer beziehenden Antinomik die Konzentration der Philosophie in einer sensualistischen Moralphilosophie, deren empiristische Partikularität Baumgarten in einer erfahrungsgeleiteten Metaphysik zusammenfasste. In seiner Rechtsphilosophie bietet die Bestimmung des Verhältnisses von Geltung der Positivität des Rechts gegenüber der Geltung moralischer Normen besonderes Interesse. (shrink)

Catastrophic risk raises questions that are not only of practical importance, but also of great philosophical interest, such as how to define catastrophe and what distinguishes catastrophic outcomes from non-catastrophic ones. Catastrophic risk also raises questions about how to rationally respond to such risks. How to rationally respond arguably partly depends on the severity of the uncertainty, for instance, whether quantitative probabilistic information is available, or whether only comparative likelihood information is available, or neither type of information. A promise to do some action seems to create a binding obligation to do that action. And yet, paradoxically, an obligation seems not to be a fact that we can create or bring into existence; we can create an obligation only by creating or bringing into existence something else. The only way to avoid the paradox is to show that the act of promising creates something other than an obligation, which nonetheless binds us to perform the action in question. After (...) considering and rejecting various options such as the promisee's expectation and the promisor's resolve, Prichard locates the bindingness of a promise in a prior general promise, which allows the noises we make when promising to generate an obligation to perform the promised action.
