Research that is initiated, designed or funded by sponsor agencies based in countries with relatively high social and economic development, and conducted in countries that are relatively less developed, gives rise to many important ethical challenges. Although clinical trials of HIV vaccines began ten years ago in the US and Europe, an increasing number of trials are now being conducted or planned in other countries, including several that are considered “developing” countries. Safeguarding the rights and welfare of individuals participating as (...) research subjects in developing countries is a priority. In September, 1997, the Joint United Nations Programme on HIV/AIDS embarked on a process of international consultation; its purpose was further to define the important ethical issues and to formulate guidance that might facilitate the ethical design and conduct of HIV vaccine trials in international contexts. Algorithmic predictions are promising for insurance companies to develop personalized risk models for determining premiums. In this context, issues of fairness, discrimination, and social injustice might arise: Algorithms for estimating the risk based on personal data may be biased towards specific social groups, leading to systematic disadvantages for those groups. Personalized premiums may thus lead to discrimination and social injustice. It is well known from many application fields that such biases occur frequently and naturally when prediction models are applied to (...) people unless special efforts are made to avoid them. Insurance is no exception. In this paper, we provide a thorough analysis of algorithmic fairness in the case of insurance premiums. We ask what “fairness” might mean in this context and how the fairness of a premium system can be measured. For this, we apply the established fairness frameworks of the fair machine learning literature to the case of insurance premiums and show which of the existing fairness criteria can be applied to assess the fairness of insurance premiums. We argue that two of the often-discussed group fairness criteria, independence (also called statistical parity or demographic parity) and separation (also known as equalized odds), are not normatively appropriate for insurance premiums. Instead, we propose the sufficiency criterion (also known as well-calibration) as a morally defensible alternative that allows us to test for systematic biases in premiums towards certain groups based on the risk they bring to the pool. In addition, we clarify the connection between group fairness and different degrees of personalization. Our findings enable insurers to assess the fairness properties of their risk models, helping them avoid reputation damage resulting from potentially unfair and discriminatory premium systems. The paper is a critical discussion of scholarship on the "Critique of Pure Reason" published during the past ten years. The emphasis is on Anglo-American authors. I identify and discuss three main trends in the field: a shift from the general discussion of transcendental arguments to the analysis and evaluation of particular proofs in Kant; a renewed interest in the doctrine of transcendental idealism and the distinction between things in themselves and appearances; and the emergence of an entire body of (...) literature on Kant's philosophy of mind, centered around the idea of a "transcendental psychology." The concept of human dignity has remained surprisingly absent from philosophical discussions about the ethics of childhood so far. Likewise, children as a group are mostly neglected in the ongoing discourse on human dignity. In this paper, we attempt to close this double gap by showing that there is, first, a meaningful way to speak of children’s dignity, and that, second, considering children as a group can be illuminating for dignity theorists in general. After an analysis of the reasons why (...) the debates on human dignity and the ethics of childhood have been conducted almost entirely separately, we develop a concept of respecting children as respecting their dignity. Drawing upon personhood accounts of human dignity, we suggest that respecting a child’s dignity means respecting her activity, which means essentially developing and maintaining a perspective of one’s own. Construed in that way, respecting children’s dignity is in some important respects different from concerns about their well-being and their autonomy. In the last section, we will take a step back from the debate about the ethics of childhood and point to some possible conclusions for the debate about human dignity in general. (shrink)

As Husserl already noticed, artworks themselves have a phenomenological character. This means, however, that to experience artworks as phenomena no “epoché” and no “phenomenological reduction” is necessary. The leading question of my essay is whether, and possibly how, this observation can be methodologically generalized for understanding phenomena. I discuss if, and possibly how, a phenomenological reflection on art allows and even demands a general conception of phenomenology that nevertheless does not confuse artworks with phenomena in general. My intention is to (...) show that and how phenomenality can be clarified with reference to its spatial character. Accordingly, works of architecture that are artworks will play a decisive role in my argument. (shrink)

Scientific exploration and thus our knowledge about the outside world is subject to the conditions of our experience.These conditions are condensed here into an interface model which,besides being physical,has an additional interface structure not reducible to physics. We suggest that this structure can dynamically be characterized by separate modes.Their selection and operation presupposes free will and a rudimentary concept of time and space. Based on some analogies with quantum networks it is argued that the 'observed' gets 'dressed'as a consequence of (...) the observing. Most contextualists agree that contexts differ with respect to relevant epistemic standards. In this paper, I discuss the idea that the difference between more modest and stricter standards should be explained in terms of the closeness or remoteness of relevant possible worlds. I argue that there are serious problems with this version of contextualism. In the second part of the paper, I argue for another form of contextualism that has little to do with standards and a lot with the well-known (...) problem of the reference class. This paper also illustrates the fact that contextualism comes in many varieties. (shrink)

There is a very plausible principle of the transitivity of justifying reasons. It says that if "p" is better justified than "q" (all things considered) and "q" better than "r", then "p" is better justified than "r" (all things considered). There is a corresponding principle of rational theory choice. Call one theory "a better theory than" another theory if all criteria of theory choice considered (explanatory power, simplicity, empirical adequacy, etc.), the first theory meets the criteria better than the second (...) theory. The corresponding transitivity principle says that if theory A is a better theory than theory B and if theory B is a better theory than theory C, then A is a better theory than theory C. I argue against this principle. It turns out that whenever there are 2 or more relevant and independent criteria of theory evaluation, and whenever at least of one the criteria is "non-linear" in a certain sense, there may be violations of transitivity which do not violate any standards of rationality (of theory choice). This shows, again, that theory choice cannot be seen as merely the application of given rules of rational theory choice. (shrink)

Introduction to and overview over my book "Epistemic Contextualism. A Defense" (OUP 2016).

In spite of the importance of point mutations for evolution and human diseases, their natural spectrum of incidence in different species is not known. Here I propose to determine these spectra by comparing consecutive sequence periods in stretches of repetitive DNA. The article presents the analysis of more than 51,000 such point mutations identified by this approach in the genomes of human, chimpanzee, rat, mouse, pufferfish, zebrafish, and sea squirt. I propose to explain the observed spectra by auto‐mutagenic mechanisms of (...) genome variation involving the inter‐conversions of nucleotides, single base‐pair inversions and their combinations. Fichte's System of Ethics, published in 1798, is at once the most accessible presentation of its author's comprehensive philosophical project, The Science of Knowledge or Wissenschaftslehre, and the most important work in moral philosophy written between Kant and Hegel. Fichte's ethics integrates the discussion of our moral duties into the systematic framework of a transcendental theory of the human subject. Its major philosophical themes include the practical nature of self-consciousness, the relation between reason and volition, the essential role of the (...) drives in human willing, the possibility of changing the natural world, the reality of one's own body, the reality of other human beings, and the practical necessity of social relations between human beings. Ricoeur has written about translation as an ethical paradigm. Translation from one language to another, and within one’s own language, provides both a metaphor and a real mechanism for explaining oneself to the other. Attempting and failing to achieve symmetry between two languages is a manifestation of the asymmetry inherent in human relationships. If actively pursued, translation can show us how to forgive other people for being different from us and thus serves as a paradigm for tolerance. In full acceptance (...) that this will be impossible, Ricoeur uses the model of translation as a way of understanding European integration, with three aspects: translation, shared narrative and shared forgiveness of Europe’s history. These models provide a strong statement about tolerance and become even more significant through their conversation with the negativity that suffuses them. He draws on his knowledge of psychoanalysis to explain that the translator suffers through remembering and through mourning the loss of perfection; there must be acknowledgement of deficiency. This acceptance of imperfection and of limits to success is a key element in Ricoeur’s philosophy and is explored from the 1950s onwards in his study of negativity; denied by phenomenology and explored by Hegel. Negation is vital for understanding the world, but it can preclude us from access to meaning when it becomes negativity. Translation can provide the bridge to span the tension between the pathology of denial and different interpretations, and projection of evil into others, which I believe is at the heart of the perceived incompatibilities between Islam and the West. There is a political urgency to this enterprise, given the ‘othering’ of the Muslim world that has replaced the Cold War dichotomies between Communist as ‘other’ and the capitalist world. References to the Muslim as the current ‘other’ will be part of my discussion. As well as seeking to understand Ricoeur’s model of translation, we will examine whether his model works in a world where many speak no Arabic, Urdu or Farsi, or indeed whether it has any relevance for people who do not translate from one language to another. This article compares Kant and Fichte from the double stand- point of identity and difference with regard to two thinkers who were at first united by a master-student relation but who later on drifted apart from each other due to mutual defamation. At the center of the present discussion stands the relationship between spirit of freedom and system’s form which binds Kant and Fichte beyond methodological divergences and doctrinal differ- ences. The critical comparison between Kant and Fichte will be developed (...) in four steps: it will start with the general positioning of Kant within German Idealism, and then move on to Kant’s double critical enterprise of grounding an aprioristic doctrine of principles of nature and freedom; it will later on address the conception championed by Fichte of having pre- sented the “first system of freedom”, and from there it will focus on the manifestations of freedom within Fichte’s philosophical system, with Kant’s position as contrast.
