Background The COVID-19 pandemic has influenced the approach to the health-disease system, raising the question about the principles of bioethics present in physician–patient relations. The principles while widely accepted may not be sufficient for a comprehensive ethical analysis. Therefore, the aim of this study was to explore the perception of these principles and the physician–patient relationship during a hospital stay through a qualitative approach. Method Sixteen semi-structured interviews took place to know the patients’ perception during their 2020 hospitalization for COVID-19. (...) The data was analyzed through the constant comparison method, creating categories and comparing them. In the end, seven categories were established and were grouped in three: bioethical principles (dignity, charity, vulnerability, autonomy), doctor-patient relationship (participant commitment, informed consent, health staff-patient relationship) and the experience of the disease (illness, the role of the family). Results The research found that most patients described a positive experience, with the feeling of having been well cared for with no sense of discrimination or injustice done. The majority also reported that their autonomy was respected in the treatment decisions. The evaluation of these attitudes is an area of opportunity, especially when the patients' vulnerability is at risk. Conclusions The ethics of virtue offers a better reflection of how human beings manifest themselves by emphasizing the development of virtuous character and behaviors that allow them to realize their values in life. Este artículo propone una alternativa a la discusión entre las visiones objetivistas y construccionistas sobre la ciencia. Para alcanzar tal objetivo, partimos de una esquemática presentación de lo que se ha denominado las Guerras de la Ciencia; en seguida expondremos en detalle la propuesta de Knor-Cetina, mostrando cómo conduce a actitudes anticientíficas. Posteriormente, confrontaremos las tesis construccionistas extraídas de Knor-Cetina con las propuestas realistas de Giere, Kitcher y Hacking, con el fin de morigerar las posturas anticientíficas, depurando las tradicionales polaridades. Finalmente, esbozamos las tesis del Sensismo Común Crítico propuestas por Susan Haack, las que plantearemos como una salida a la confrontación entre objetivistas y construccionistas, así como una forma moderada de comprender la ciencia en la época actual.This article proposes an alternative to the discussion between the objectivist and constructionist vision on science. In order to reach such objective, we start from a schematic presentation about what it is called Science Wars; then, we are going to talk in detail about Knor-Cetina’s proposal, showing how it leads to antiscientific attitudes. Later, we will confront the constructionist thesis taken from Knor-Cetina with the realistic ones, proposed by Giere, Kitcher and Hacking, in order to moderate the antiscientific positions, cleansing the traditional polarities. Finally, the Critical Common-Sensism proposed by Susan Haack will be outlined and stated as an option to the confrontation between objectivists and constructionists and also, as a moderate way to understand science in the present-day. In this paper we analyse the role of description in qualitative research. Our point is this: the description itself has a necessary role in qualitative research; though that role is necessary, it is not enough, interpretation is also necessary, but this interpretation must be supported on a realist epistemology setting up clearly what is observation. In order to defend this point we show some problems in the relationship description-interpretation; then, we choose two proposals that defend the role of description in (...) qualitative research; finally, we respond what is the role of description in qualitative research. En este artículo analizamos cuál es el papel de la descripción en la investigación cualitativa. Afirmamos que la descripción en sí misma tiene un papel necesario en la investigación cualitativa; aunque este papel es necesario, no es suficiente, también se necesita la interpretación, pero esta interpretación debe respaldarse en una epistemología realista que tenga claro qué cuenta como observación. Para defender esta afirmación, mostramos algunos problemas en la relación descripción-interpretación; luego, elegimos dos propuestas que defienden el papel de la descripción en la investigación cualitativa y, finalmente, respondemos cuál es el papel de la descripción en la investigación cualitativa. The Thesis of Theory-Laden [TTL] holds that is not possible a neutral observation. From this thesis, some philosophers have inferred that the facts, i.e., the subject’s independent reality, do not exist or that they are social constructions only. The aim of this paper is assess if TTL necessarily implies a constructivist point of view or if, conversely, we can still speak about the reality. In order to do this, we will clarify these terms: "the theory-ladenness of observation" and "constructivism". Then, (...) we will argue that although TTL is possible, we are not committed to constructivism, and on the contrary, TTL can be an interesting frame to the realistic thesis. Finally, we will point out the impact this had has when evaluating many epistemological proposals. La tesis de la carga teórica de la observación [CTO] sostiene que no es posible una observación neutral. A partir de esta tesis, algunos filósofos han derivado que los hechos, o mejor, la realidad independiente del sujeto, no existen o que son solo construcciones sociales. El objetivo de este artículo es evaluar si CTO implica necesariamente una visión constructivista o si, por el contrario, permite seguir hablando de realidad. Para ello, se aclararán los conceptos de "carga teórica de la observación" y de "constructivismo". Posteriormente, se defenderá que pese a la plausibilidad de CTO, no estamos comprometidos a adoptar el constructivismo, antes bien, CTO puede ser un interesante marco para las tesis realistas. Finalmente, se señalarán algunas repercusiones que esto tiene a la hora de evaluar propuestas epistemológicas. (shrink)

Resumen: Este artículo trata del método y su relación con la investigación educativa. El objetivo es analizar la relevancia del método en ciencias humanas y sociales, en especial, en educación. Para ello, dividimos este artículo en tres secciones: 1. ¿Hay método? 2. ¿Hay uno o varios métodos? 3. La discusión sobre el método en la investigación educativa. A la primera pregunta, respondemos que hay método. Respondemos a la segunda señalando la necesidad de adoptar un pluralismo metodológico. La tercera sección defiende (...) que las discusiones sobre el método de investigación educativa implican dimensiones ontológicas, epistemológicas y éticas que se han tornado críticas, y se hace una revisión de cada una de ellas. En el apartado conclusivo, sugerimos algunas vías para desanudar esos asuntos críticos en la investigación educativa.: This article deals with method and its relation to educational research. The objective is to analyze the relevance of method in human and social sciences, especially in education. To this end, we divide this article into three sections: 1. Is there a method? 2. Is there one or more methods? 3. The discussion on method in educational research. To the first question, we answer that there is a method. We answer the second question by pointing out the need to adopt methodological pluralism. The third section argues that discussions on the method of educational research involve ontological, epistemological, and ethical dimensions that have become critical, and a review is made of each of them. En honor al elemento Estado Social, cuando menos, es que la misma sistemática ha previsto un novísimo juez a partir del acto legislativo número 03 de 2002 y se le ha otorgado la competencia, que no jurisdicción, de controlar ciertos ejercicios de investigación cumplidos por la fiscalía con su binomio policía judicial, algo así como el juez de la constitucionalización de los actos de ese binomio.Por regla general, pues, cuando los actos de indagación y de investigación afecten de alguna manera (...) un derecho fundamental del indiciado o del imputado antes de practicar el acto el fiscal debe solicitar la correspondiente autorización al juez de control de legalidad, caso por ejemplo cuando se precisa inspeccionar el cuerpo de aquél, o una vez cumplido el acto ir dentro de las siguientes treinta y seis horas ante el mismo funcionario con miras a que éste ejerza el control posterior.La regla de exclusión del artículo 23 del nuevo código de procedimiento penal se justifica porque de esa manera se desestimula la práctica de actos de investigación con violación a derechos fundamentales, se preserva la integridad judicial y se impide el beneficio que puede derivar de la prueba ilícita su autor. La Araucanía tiene una población rural que alcanza al 31% del total, lo que la convierte en una de las regiones con mayor ruralidad del país. Así mismo, La Araucanía es el referente histórico y territorial del pueblo mapuche, cuya población alcanza al 23,4% del total regional, de la cual el 70% son habitantes rurales. La Araucanía en las últimas cinco décadas ha experimentado profundas transformaciones derivadas de la aplicación de diversos modelos político-económicos y sus respectivas políticas públicas, que han (...) afectado al mundo rural. Estas políticas públicas incluyen un proceso de reforma agraria, contrarreforma agraria, división de la propiedad mapuche, instalación de una economía abierta, fomento forestal de plantaciones artificiales y la promulgación de una nueva ley indígena, entre otras. Este artículo pretende identificar y hacer una revisión de las principales políticas y sus consecuencias, con el propósito de sugerir orientaciones para elaborar programas públicos pertinentes. We present a mathematical approach to defeasible reasoning based on arguments. This approach integrates the notion of specificity introduced by Poole and the theory of warrant presented by Pollock. The main contribution of this paper is a precise, well-defined system which exhibits correct behavior when applied to the benchmark examples in the literature. It aims for usability rather than novelty. We prove that an order relation can be introduced among equivalence classes of arguments under the equi-specificity relation. We also prove (...) a theorem that ensures the termination of the process of finding the justified facts. Two more lemmas define a reduced search space for checking specificity. In order to implement the theoretical ideas, the language is restricted to Horn clauses for the evidential context. The language used to represent defeasible rules has been restricted in a similar way. The authors intend this work to unify the various existing approaches to argument-based defeasible reasoning. Recent work in formal semantics suggests that the language system includes not only a structure building device, as standardly assumed, but also a natural deductive system which can determine when expressions have trivial truth-conditions (e.g., are logically true/false) and mark them as unacceptable. This hypothesis, called the `logicality of language', accounts for many acceptability patterns, including systematic restrictions on the distribution of quantifiers. To deal with apparent counter-examples consisting of acceptable tautologies and contradictions, the logicality of language is often paired (...) with an additional assumption according to which logical forms are radically underspecified: i.e., the language system can see functional terms but is `blind' to open class terms to the extent that different tokens of the same term are treated as if independent. This conception of logical form has profound implications: it suggests an extreme version of the modularity of language, and can only be paired with non-classical---indeed quite exotic---kinds of deductive systems. The aim of this paper is to show that we can pair the logicality of language with a different and ultimately more traditional account of logical form. This framework accounts for the basic acceptability patterns which motivated the logicality of language, can explain why some tautologies and contradictions are acceptable, and makes better predictions in key cases. As a result, we can pursue versions of the logicality of language in frameworks compatible with the view that the language system is not radically modular vis-a-vis its open class terms and employs a deductive system that is basically classical. Bi-intuitionistic logic is the result of adding the dual of intuitionistic implication to intuitionistic logic. In this note, we characterize the expressive power of this logic by showing that the first order formulas equivalent to translations of bi-intuitionistic propositional formulas are exactly those preserved under bi-intuitionistic directed bisimulations. The proof technique is originally due to Lindstrom and, in contrast to the most common proofs of this kind of result, it does not use the machinery of neither saturated models nor elementary (...) chains. Estos apuntes gozan de significativa importancia ya que, vistos desde una amplia perspectiva, muestran la preocupación del joven filósofo por clarificar a partir de esa temprana época el horizonte conceptual del cual parte; a su vez, desde un punto de vista más específico, nos permiten rastrear algunos de los elementos iniciales que motivarán la (...) posterior crítica radical a la filosofía schopenhaueriana. En este ensayo se analizan los distintos cuestionamientos formulados por Nietzsche frente a la homologación de la voluntad como cosa en sí y la argumentación con la que se define su tránsito hacia el plano de la representación. Este artículo analiza los argumentos biologicistas a través de los cuales Paul Valéry interpreta el fenómeno de la vida. Para ello, se empieza por mostrar el poder creativo que revela la naturaleza en virtud de las leyes de estructuración y orden que comienzan a hacerse visibles a nivel de las estructuras moleculares que dan forma al universo. Después de eso, se estudia la redefinición que el autor hace del concepto de materia, a la luz de los hallazgos científicos alcanzados en (...) su época. Luego, son expuestas las características esenciales de la vida, determinadas por la integración complementaria entre la ley de conservación y la ley de transformación de la naturaleza. Asimismo, son presentados los planteamientos por los cuales el fenómeno de la muerte es tomado como una propiedad característica de la vida, al igual que los argumentos por los cuales la vida es considerada como producto del azar. Finalmente, se hace referencia a la precariedad y finitud de la vida, explicitadas por Valéry desde la teoría del evolucionismo. (shrink)

Lindström’s theorem obviously fails as a characterization of first-order logic without identity ( $\mathcal {L}_{\omega \omega }^{-} $ ). In this note, we provide a fix: we show that $\mathcal {L}_{\omega \omega }^{-} $ is a maximal abstract logic satisfying a weak form of the isomorphism property (suitable for identity-free languages and studied in [11]), the Löwenheim–Skolem property, and compactness. Furthermore, we show that compactness can be replaced by being recursively enumerable for validity under certain conditions. This paper is a step toward showing what is achievable using non-classical metatheory—particularly, a substructural paraconsistent framework. What standard results, or analogues thereof, from the classical metatheory of first order logic can be obtained? We reconstruct some of the originals proofs for Completeness, Löwenheim-Skolem and Compactness theorems in the context of a substructural logic with the naive comprehension schema. The main result is that paraconsistent metatheory can ‘re-capture’ versions of standard theorems, given suitable restrictions and background assumptions; but the shift (...) to non-classical logic may recast the meanings of these apparently ‘absolute’ theorems. This paper is devoted to the problem of existence of saturated models for first-order many-valued logics. We consider a general notion of type as pairs of sets of formulas in one free variable that express properties that an element of a model should, respectively, satisfy and falsify. By means of an elementary chains construction, we prove that each model can be elementarily extended to a $\kappa $-saturated model, i.e. a model where as many types as possible are realized. In order (...) to prove this theorem we obtain, as by-products, some results on tableaux and their consistency and satisfiability and a generalization of the Tarski–Vaught theorem on unions of elementary chains. Finally, we provide a structural characterization of $\kappa $-saturation in terms of the completion of a diagram representing a certain configuration of models and mappings. (shrink)

The logicality of language is the hypothesis that the language system has access to a ‘natural’ logic that can identify and filter out as unacceptable expressions that have trivial meanings—that is, that are true/false in all possible worlds or situations in which they are defined. This hypothesis helps explain otherwise puzzling patterns concerning the distribution of various functional terms and phrases. Despite its promise, logicality vastly over-generates unacceptability assignments. Most solutions to this problem rest on specific stipulations about the properties (...) of logical form—roughly, the level of linguistic representation which feeds into the interpretation procedures—and have substantial implications for traditional philosophical disputes about the nature of language. Specifically, contextualism and semantic minimalism, construed as competing hypotheses about the nature and degree of context-sensitivity at the level of logical form, suggest different approaches to the over-generation problem. In this paper, I explore the implications of pairing logicality with various forms of contextualism and semantic minimalism. I argue that to adequately solve the over-generation problem, logicality should be implemented in a constrained contextualist framework. (shrink)

Under a proper translation, the languages of propositional (and quantified relevant logic) with an absurdity constant are characterized as the fragments of first order logic preserved under (world-object) relevant directed bisimulations. Furthermore, the properties of pointed models axiomatizable by sets of propositional relevant formulas have a purely algebraic characterization. Finally, a form of the interpolation property holds for the relevant fragment of first order logic.

Se investiga el alcance y los límites de la concepción política de Jacques Rancière. En primer lugar, se hace una presentación esquemática de lo que el filósofo francés entiende por “política” (en donde se trata la distinción entre policía y política, el desacuerdo y la subjetivación). En segundo lugar, y tomando una disposición máscrítica, se busca evidenciar el alcance y los límites de esta concepción de la política como interrupción. Con ello se ponen de presente las ventajas y los problemas (...) del pensamiento político rancieriano. Por último, vinculando estas reflexiones con lahistoria y la memoria, se busca proponer una nueva concepción de la política como interrupción que supere los límites antes mencionados. (shrink)

Confusa, difusa, profusa, la «muerte del hombre» después de cinco décadas de su proclamación sigue siendo una cuestión punzante para no pocos lectores de Foucault. Sin embargo, llama la atención que la mayoría de esos preocupados lectores no considera las rectificaciones que el autor hace a esa formulación. Examinar esas rectificaciones, en relación con los desplazamientos del pensamiento de Foucault, es el propósito de estas reflexiones e inflexiones.

Montaigne compone una ética moderna definida por el ejercicio de su pensamiento autocritico que acompañado de un método filosófico aborda la construcción de sÍ mismo como una "manera" filosófica. Las reflexiones intentan responder simultáneamente a dos cuestiones: ¿cómo le es posible proveerse de una ética que le permita una existencia ordenada y sensata, cuando la condición humana está signada por el desorden y la extravagancia? ¿Cómo le es posible fundar una ética moderna -antes que Descartes- con una posición escéptica?
