This paper is concerned with the normative content of Kant's formula of humanity (FH). More specifically, does FH, as some seem to think, imply the specific and rigid prescriptions in 'standard' deontological theories? To this latter question, I argue, the answer is 'no'. I propose reading FH largely through the formula of autonomy and the formula of the kingdom of ends, where I understand FA to describe the nature of the capacity of humanity-a capacity for (...) self-governance. The latter, I suggest, is akin to the capacity for planning and intentional action described in Michael Bratman's work. A significant part of what FH requires, I then propose, is that we exercise these capacities for planning in such a way that we accommodate and coordinate with the (permissible) plans and intentions of others. Kant himself, as do many commentators, emphasizes the idea that our human capacities give us a distinctive kind of value. On my interpretation, by contrast, what is fundamentally important is not the value of the capacities but rather what they make possible: distinctive ways of mistreating (using) persons, but also a distinctive kind of morally desirable relationship. This paper examines the issue of abortion from a Kantian perspective. More specifically, it focuses on Kant’s Formula of Humanity of the Categorical Imperative and the prohibition against treating humanity merely as a means. It has been argued by feminists that forcing a woman to continue a pregnancy against her will is treating her as a mere means for sustaining the fetus, a mere “fetal incubator”. Accordingly, feminists believe, this constitutes an assault on her humanity, the (...) capacity for rationally setting and pursuing her own ends. On the other hand, the woman who aborts her fetus can be seen as treating a being which has the potential for humanity merely as a means for her own ends. The Kantian discussion of abortion gives rise to a number of important questions: Does respecting the pregnant woman’s humanity, and hence enabling her to have an abortion if she chooses that way, go against appropriately respecting the fetus? What does it really mean to respect a fetus’ potential for humanity? Attempting to answer these questions helps us to see the Kantian prohibition against treating humanity merely as a means from a different, less familiar perspective, and puts out some new challenges to Kant’s theory. At the same time, it gives us new and useful insights on the much-discussed issue of the fetus’ status in the abortion debate. (shrink)

Kant’s Formula of Humanity (FH) is considered by many, Kant included, to be the most intuitively appealing formulation of the categorical imperative. FH tells us that to treat persons with dignity and respect we must always treat them as ends in themselves and never as mere means. One set of issues raised by FH revolves around how FH is to be justified or grounded and how it relates to the other formulations of the categorical imperative. This set of (...) issues, though important, is not our focus here. Instead, we shall focus on a different set of issues: how do we apply or use this formula in practice, that is, how does this principle work as a moral guide to what duties and obligations we have in particular cases? This paper will seek to answer that question by defending an interpretation and rational reconstruction of FH in terms of two subsidiary principles, the Mere Means Principle (MMP), which grounds perfect duties, and the Ends in Themselves Principle (ETP), which grounds imperfect duties. These two principles will then be applied to a number of examples to illustrate how they work. (shrink)

Kant's Formula of Humanity famously forbids treating others merely as a means. It is unclear, however, what exactly treating someone merely as a means comes to. This essay argues against an interpretation of this idea advanced by Christine Korsgaard and Onora O'Neill. The essay then develops a new interpretation that suggests an important connection between the Formula of Humanity and Kant's political philosophy: the content of many of our moral duties depends on the results of political (...) philosophy and, indeed, on the results of actual political decision making. Kant offers the following argument for the formula of humanity (FH): Each rational agent necessarily conceives of her own rational nature as an end in itself and does so on the same grounds as every other rational agent, so all rational agents must conceive of one another's rational nature as an end in itself. As it stands, the argument appears to be question-begging and fallacious. Drawing on resources from the formula of universal law (FUL) and Kant's claims (...) about the primacy of duties to oneself, I propose a contractualist reconstruction of this puzzling line of reasoning. Abstract: This essay examines two interpretations of Kant's argument for the formula of humanity. Christine M. Korsgaard defends a constructivist reading of Kant's argument, maintaining that humans must view themselves as having absolute value because their power for rational choice confers value on their ends. Allen Wood, however, defends a realist interpretation of Kant's argument, maintaining that humans actually are absolutely valuable and that their choices do not confer value but rather reflect their understanding of how the objects (...) of their choices fulfill their needs and wants and contribute to their flourishing. Though Korsgaard's reading is more consistent with Kant's prioritizing of the right over the good, this essay raises a metaethical question regarding her constructivist position, namely, “What is meant by her claim that rational choice ‘confers’ value on objects?” In developing this question, it presents a realist account of goodness that is taken from Peter Geach's “Good and Evil.”. Definition of the problem The creation and selection of children as tissue donors is ethically controversial. Critics often appeal to Kant’s Formula of Humanity, i.e. the requirement that people be treated not merely as means but as ends in themselves. As many defenders of the procedure point out, these appeals usually do not explain the sense of the requirement and hence remain obscure. Arguments This article proposes an interpretation of Kant’s principle, and it proposes that two different instrumental (...) stances be distinguished. I argue that the creation of “saviour children” is a form of instrumentalization that I dub “preemptive instrumentalization” and that it is categorically different from earlier forms of instrumental attitudes concerning human reproduction. Conclusion Critics are wrong to claim that Kant’s principle is either compatible with the selection of saviour siblings or too vague to serve as an ethical principle. (shrink)

My aim in this paper is to explore different ways of understanding Kant’s Formula of Humanity as a formal principle. I believe that a formal principle for Kant is a principle that is constitutive of some domain of cognition or rational activity. It is a principle that both constitutively guides that activity and serves as its internal regulative norm. In the first section of this essay, I explain why it is desirable to find a way to understand the (...) Formula of Humanity as a formal principle in this sense. In sections II and III I discuss two interpretive approaches to Kant’s idea that rational nature or humanity is an end in itself, both of which may be construed as treating the Formula of Humanity as a formal principle. By focusing on the notion of formal principle, I hope to raise a set of issues about how to understand the idea of rational nature or humanity as an end in itself, and about the relation of the Formula of Humanity [FH] to the Formula of Universal Law [FUL]. Immanuel Kant’s categorical imperative can be expressed as the formula of humanity. This states that rational beings ought always to treat humanity, whether in our own persons or in others, as ends in themselves and never as mere means. In this essay, I argue that if God exists, then the Kantian formula of humanity is false. The basic idea behind my argument is that if God exists, then he has knowingly created a world with all (...) kinds of naturally occurring threats, such as disease, flood, drought, etc. and he has knowingly placed human beings in such a world without their consent, knowing that many innocent human beings will be led to suffer, and he allows this suffering to occur. I argue that even if this is somehow for their own good or the good of others or contributes to the goodness of the world as a whole, God treats these innocent human beings as mere means when he places humans in such a world without their consent and allows this suffering to occur. An epistemic deontology modelled on Kant’s ethics—in particular the humanity formula of the categorical imperative—is a promising alternative to epistemic consequentialism because it can forbid intuitively impermissible epistemic trade-offs which epistemic consequentialism seems doomed to permit and, most importantly, it can do so in a way that is not ad hoc.

This is a survey article in which I explore some important recent work on the topic in question, Kant’s formula of the end in itself (or “formula of humanity”). I first provide an overview of the formulation, including what the formula seems roughly to be saying, and what Kant’s main argument for it seems to be. I then call the reader’s attention to a variety of questions one might have about the import of and argument for (...) this formula, alluding to some of the works in which philosophers have recently raised or tried to answer these questions. Then, for the bulk of the paper, I focus my discussion on two issues of contention: the identity of the “end in itself” that the formula refers to, and the relation between the value of the end in itself and the value of other ends. I do not attempt to argue for a particular position of my own regarding these issues. Instead, I explain a number of the more interesting or influential recent attempts to answer these questions, compare these approaches in various ways, draw implications from them, and raise concerns about some of them. I also suggest that an important link connects the question about the identity of the end in itself and the question about the relation between the value of the end in itself in relation to the value of other ends: How one answers these questions commits one to a position on the thorny issue of whether, how, and how fully, autonomy is manifested through empirical (not simply pure) practical reason. This is the first comprehensive overview of the influence of Platonism on the English literary tradition, showing how English writers, including Chaucer, Shakespeare, Milton, Blake, Wordsworth, Yeats, Pound and Iris Murdoch, used Platonic themes and images within their own imaginative work.

Kant’s formula of universal law (FUL) is standardly understood as a test of the moral permissibility of an agent’s maxim: maxims which pass the test are morally neutral, and so permissible, while those which do not are morally impermissible. In contrast, I argue that the FUL tests whether a maxim is the cause or determining ground of an action at all. According to Kant’s general account of causality, nothing can be a cause of some effect unless there is a (...) law-like relation between the putative cause and effect. Applied to the case of action, no maxim can be the cause of an agent’s action unless there is a law-like relation between maxims of that kind and actions of that kind. The special capacity to act according to maxims as law-like causes is what Kant calls a will; the basic constitutive principle of the will is a non-normative principle I call the categorical declarative. While the actions of a perfectly good will would be described by the categorical declarative alone, human action is determined not only by the causality of the will, but also by competing causes, namely those stemming from inclination. There is thus need for a causal test for putative maxims. The test contained in the FUL is meant to determine whether an action could be grounded solely on the agent’s maxim, or whether it requires a cause external to the will. This account permits one to build eventual distinctions concerning the morality of actions on prior and independent distinctions concerning their causality. (shrink)

Gandhi’s writings on moral issues propose an easiest formula to the world to establish harmony and peace in the global society. In a world where people are confronting a psychological fear of sudden terror and violence, the Gandhian formula of ‘non-violence (ahimsa) as a means’ to form a perfect harmonious world is getting strong attention of the world-community. Truth and non-violence are the two most valuable ingredients of Gandhian moral thoughts. For him, Truth or God is the end (...) and non-violence is the mean and the two can not be separated. They are more effective in life when they are used in their united form. This unity can be actualized only through the motive of ‘love to humanity’ without separating one person from another on any ground. He argues that the unity of truth and non-violence is a better way to have a moral and harmonious life. In this paper, I will focus upon the Gandhian formula in wider perspective, which reflects in his political activities and his writings as well, with the contention that it is highly applicable to normalize the violence rooted in different parts of the world at both the levels of religious and political. I will contend that Gandhian notion of truth and non-violence in terms of ends and means may play a medicinal role to harmonize the world suffering from extremism and terrorism. (shrink)

The formula of universal law (FUL) is a natural starting point for philosophers interested in a Kantian perspective on the morality of abortion. I argue, however, that FUL does not yield much in the way of promising or substantive conclusions regarding the morality of abortion. I first reveal how two philosophers' (Hare's and Gensler's) attempts to use Kantian considerations of universality and prescriptivity fail to provide analyses of abortion that are either compelling or true to Kant=s understanding of FUL. (...) I then turn to some recent interpretations of Kant=s FUL contradiction in conception (CC) and contradiction in will (CW) tests. I argue that none of the interpretations of the CC testBincluding the practical interpretation favored by KorsgaardBdoes much to reveal moral problems with maxims of abortion. The CW test (as developed by Herman) is more helpful. Nevertheless, I argue that neither by considering abortion maxims as a subset of maxims of convenience killing, nor by considering such maxims as maxims of refusing to aid, can the CW test generate a general prohibition of abortion. At best, the CW test illuminates the abortion issue because by forcing us to think about how killing a fetus differs from killing other human beings, what attitudes we may reasonably have toward a fetus, and whether Kant's moral theory must be amended to do justice to the problem of abortion. But to pursue these questions, we must look beyond FUL; Kant’s formula of humanity and doctrine of virtue may well have more to offer. (shrink)

Human rights are rights which all persons equally have simply insofar as they are human. But are there any such rights? How, if at all, do we know that there are? It is with this question of knowledge, and the related question of existence, that I want to deal in this paper. 1. CONCEPTUAL QUESTIONS The attempt to answer each of these questions, however, at once raises further, more directly conceptual questions. In what sense may human rights be said to (...) exist? What does it mean to say that there are such rights or that persons have them? This question, in turn, raises a question about the nature of human rights. What is the meaning of the expression “human rights”? Within the limits of the present paper I cannot hope to deal adequately with the controversial issues raised by these conceptual questions. But we may make at least a relevant beginning by noting that, in terms of Hohfeld's famous classification of four different kinds of rights, the human rights are primarily claim-rights, in that they entail correlative duties of other persons or groups to act or to refrain from acting in ways required for the right-holders' having that to which they have rights. It will help our understanding of this and other aspects of human rights if we note that the full structure of a claim-right is given by the following formula: A has a right to X against B by virtue of Y. There are five main elements here: first, the Subject of the right, the person or persons who have the right; second, the Nature of the right; third, the Object of the right, what it is a right to; fourth, the Respondent of the right, the person or persons who have the correlative duty; fifth, the Justifying Basis or Ground of the right. The article presents a historical and philosophical analysis of happiness as a socio-cultural phenomenon, considers the proposed criteria and components of the state of happiness as well as proposes the author's integrative definition of happiness. The relevance of this study is determined by the importance of the actual humanitarian indicators in assessing socio-political progress. As a result of the analysis of how the concept of happiness was historically formed and developed, it was shown that (a) the concept of happiness became (...) widespread in the humanitarian discourse relatively late, (b) its predecessors are the ancient Greek concepts ofagathon(the good) andeudaimonia(welfare, prosperity, supreme good), (c) in Western European philosophy, the understanding of good is contradictory and includes a wide range of meanings, from utilitarian to axiological, (d) the content of the concept of happiness includes two aspects: one is in the person's power and the other is determined by external factors. The article analyzes modern theories of happiness and feelings of life satisfaction as well as scientific studies of the components of the state of happiness. As a result of the analysis of these approaches, it is shown that in most modern studies, the emphasis in understanding happiness is placed on either socio-biological or socioeconomic factors. The author examines the criteria for the state of happiness. The author quotes other researchers and proposes certain steps as an algorithm for determining happiness, i.e., a formula for happiness. The importance of harmony of the following components of the human personality and life is substantiated: the belief system (and living in accordance with one's beliefs), abilities (and the possibility of their implementation in professional, cognitive activity), geographical location of residence, as well as social circle (and the balance of socio-psychological proximity and distancing). Writers like Christine Korsgaard and Allen Wood understand Kant's idea of rational nature as an end in itself as a commitment to a substantive value. This makes it hard for them to explain the supposed equivalence between the universal law and humanity formulations of the categorical imperative, since the former does not appear to assert any substantive value. Nor is it easy for defenders of value-based readings to explain Kant's claim that the law-giving nature of practical reason makes all (...) beings with practical reason regard the idea of a rational nature as an end in itself. Kant's formulae ought to effectively produce the same result when applied to the moral validity of any particular maxim; further, no valid maxim produces contradictory results when applied against Kant's Universal Law and Humanity formulae. Where one uses all formulae in the assessment of a maxim, one gains a more complete understanding of the moral law, thereby bridging principles of reason with intuition within the agent who has undertaken to evaluate the morality of a particular action. These formulae command (...) without regard to any particular interests, but are instead unconditional; further, these formulae effectively limit choice of action and therefore give rise to duty. Kant implies that the structure of all maxims requires different formulae of the same moral law, i.e., all maxims have a ‘form’ and a ‘matter’, which prompt reconfiguring of the categorical imperative into different formulae in order to test the morality of a maxim. This article is concerned with examining Kant's derivation of the various formulae of his Categorical Imperative. It is in agreement with Paton in maintaining that Kant actually mentions five formulae. But it is not in agreement with him, and some others, in maintaining that they are ultimately reducible to three. Nor is it in agreement with those who maintain that they are ultimately reducible to just one. According to the present article, they are ultimately reducible to two: that about a (...) moral law being a universal law; and that about a moral law involving treating human beings as ends in themselves. In the First Section of the Groundwork of the Metaphysics of Morals, Kant argues that a good-willed person “under subjective limitations and hindrances” (G 397) is required “never to act except in such a way that [she] could also will that [her] maxim should become a universal law” (G 402).2 This requirement has come to be known as the Formula of Universal Law (FUL) version of the Categorical Imperative, an “ought” statement expressing a command of reason that “represent[s] an (...) action as objectively necessary of itself, without reference to another end” (G 414). The question of how to understand and apply the FUL has received a great deal of attention in recent years. But Kant’s reasoning for the claim that a good-willed person (of a certain kind) acts in accordance with the FUL has not been investigated with the same degree of thoroughness. My purpose in this paper is to render the structure of Kant’s argument perspicuous, and thereby contribute to its proper evaluation by identifying its true strengths and weaknesses.3 Let us call Kant’s argument “K” and its conclusion “C”. The task at hand requires identification of K’s premises and of the reasoning by means of which C is derived. One of the advantages of clarifying K’s structure in this way is that doing so permits us to answer questions that continue to puzzle even the most sympathetic readers of the First Section. Some of these questions concern three “Propositions” to which Kant 1 draws our attention in the course of his presentation. The First Proposition (call it “P1”) is left unstated, but most commentators agree that it (or at least part of it) should be rendered as follows: (P1) A human action has moral worth only if it is done from duty.4 Kant states the other two propositions (call the Second “P2” and Third “P3”) explicitly: (P2) An action from duty has its moral worth not in the purpose to be attained by it but in the maxim in accordance with which it is decided upon. The philosophic notion of human vulnerability cannot be pinpointed as such in the corpus of classic philosophy. Nevertheless, death and suffering as essential philosophical and theological problems make reference to the dimension of vulnerability inherent to the human condition. Since times immemorial, the fear of death, the avoidance of suffering, or the crisis situations of human existence have laid at the basis of philosophical and religious systems. According to Freud, in the futile pursuit of happiness humans often face misery, which (...) stems from a suffering that threatens them from three different directions: their own body, the outside world, and the relationships with other people. Starting from this angle, the present article furthers the notion of vulnerability by identifying its archetypal themes in relation to human life and its conditions of existence. Two main concepts will guide this study of human vulnerability: a vulnerability inherent to human subjectivity, and one consubstantial to the process of human socialisation. For Levinas, vulnerability has become alike an obsession for others, a full responsibility, which leads to the following formula: it is only a vulnerable person who can love one’s neighbour. In accordance with Habermas, the manner in which a human being leaves natural law and accesses social justice is here re-examined, as it stands for a vulnerability structurally determined by the forms of socio-cultural life. The dynamic process of karmic activity is one of the key philosophical concepts of the Buddhist doctrine, and is traditionally explained as the operation of a chain of 12 mutually interlinked members of dependent origination. Textual research, however, reveals that a series of alternative chains of members of dependent origination coexisted prior to the systematization of this earlier textual material into the standardized list of 12 members. Such an alternative list consists of 10 members. This article examines the importance of (...) this particular list of 10 members in the development of Yogācāra Buddhist philosophy. This philosophy, the basic interpretation of the mundane world of which is that the world around us only xists as the working of the human mind, i.e. the domain of perceptual consciousness, matured in the late fourth–early fifth century CE. This examination of the 10-fold formula of dependent origination also adds to our knowledge of the region of origin of Yogācāra philosophy, and thus on the geographical diversities within the development of Buddhist philosophy. In this paper, I contrast two arguments, based on Kant ’s text, for the Formula of Humanity. The first, which I call the “Valued Ends” argument, is an influential and appealing argument developed most notably by Christine Korsgaard and Allen Wood. Notwithstanding the appeal and influence of this argument, it ultimately fails on several counts. In the first ever commentary on the Groundwork, one of Kant’s earliest critics, Gottlob August Tittel, argues that the categorical imperative is not a new principle of morality, but merely a new formula. This objection has been unjustly neglected in the secondary literature, despite the fact that Kant explicitly responds to it in a footnote in the second Critique. In this paper I seek to offer a thorough explanation of both Tittel’s ‘new formula’ objection and Kant’s response to (...) it, as well as illustrate its significance. I argue that the objection is in fact the third step in a line of argument that Tittel presents in his commentary, and that the objection is best understood within this context. I analyze Kant’s response in the second Critique footnote line-by-line so as to show that Kant both clarifies that it was never his aim to offer a new principle, but only ‘establish’ the principle that common human reason already implicitly employs. Furthermore, I show that Kant uses the opportunity to clarify the sense in which the categorical imperative is a ‘formula [Formel]’, namely as a representation of a complicated and abstract principle, like the moral law, in a way that is easier to understand and apply. I conclude by illustrating the fourth step in Tittel’s line of argument, which makes the overall significance of the ‘new formula’ objection clear: for Tittel, the problem is not that Kant seems to be offering merely a new formula, but that the categorical imperative lacks a foundation. Therefore, in Methexiology: Philosophical Theology and Theological Philosophy for the Deification of Humanity, Nicolas Laos elucidates the significance of methexiology for the study of ontology, epistemology, ethics, philosophical psychology, theory of justice, philosophy of history, and philosophy of religion. Laos argues that, faced with the modern and the postmodern crises of meaning, we need a new myth, a new spiritual formula, for the resacralization of humanity (...) and the cosmos, without restoring defunct totems, without using tales as "cheap" substitutes for the lack of a life-giving myth, and without negating history. In his Methexiology, Laos studies the "genealogy" of the modern and the postmodern crises of meaning, and, based on his new interpretation of classical Greek philosophy and Hesychasm, proposes methexiology as a way of overcoming the crises of meaning and as a way of resacralizing humanity and the cosmos through a new metaphysically grounded humanism. ABSTRACT The question of human consciousness is a crucial part of Novalis’ aim of construing a self-critique of the I, or critique of human identity, as it is proposed in his “Fichte-Studien”. Namely, this question is an intermediary stage in said critique, serving as proof for Novalis’ theory of the opposites, the fundamental stage, and his position on philosophizing, the final stage of this endeavor, which will be at the basis of his whole philosophical system; and as such, it is (...) a topic of great importance, as it is not only a link in a chain of thought which aims at proving the organicity or living heterogeneity - and not Fichte’s machine-like homogeneity - of the human but is also a key topic towards the resolution of Novalis’problem of philosophy as an existential problem. Given this, the present article intends to situate the question of human consciousness in the framework of Novalis’greater scope of a critique of the I; and from then, to comment on Novalis’own position on the problem of human consciousness, as it is stated in the formula “Consciousness is the Being outside of Being, within Being”; a position which further separates the young poet from Fichte, as it renders him closer and closer to other young idealists, such as Hölderlin or Schelling. RESUMO A questão da consciência humana é uma parte crucial no intento novaliano de construir uma autocrítica do Eu, ou crítica da identidade humana, como ela é proposta nos seus “Fichte-Studien”. Designadamente, esta questão constitui um estado intermédio em tal crítica, servindo como prova da teoria dos contrários de Novalis, o estádio fundamental desta, e a posição de Novalis sobre o filosofar, o estádio final da sua empresa, a qual está na base de todo o seu sistema filosófico; e, como tal, é um tópico de grande importância, visto ser não só um elo em uma linha de pensamento que visa provar a organicidade ou heterogeneidade viva - e não a maquinal homogeneidade de Fichte - do humano, mas também um tópico-chave tendo em vista a resolução da questão novaliana da filosofia enquanto problema existencial. Assim sendo, o presente artigo propõe-se situar a questão da consciência humana no contexto maior da crítica da identidade de Novalis; e, a partir daí, comentar a posição de Novalis sobre o problema da consciência humana, como ele surge exposto na fórmula “A consciência é o Ser fora do Ser, no Ser”; uma posição que decisivamente separa o jovem poeta de Fichte, enquanto o aproxima de outros jovens idealistas, tais como Hölderlin ou Schelling.
