This article explores the phenomenon of consecration, which, so far, has been neglected by sociologists of intellectuals. Contrary to the common Bourdieusian approach to consecration, which conflates it with legitimization, consecration is conceptualized as a process of the symbolic elevation of a figure, or an object, to the level of sacred symbols relevant to a particular community. The principal objective of this study is to present and discuss the elements that emerge from Michel Foucault's archeological undertakings, which, in our view, configure the existence of a new rhetoric that deals with what the French philosopher called the rarefaction of the subject and rarefaction of discourse in his inaugural lecture at the Collège de France (Foucault, 1996). This new rhetoric would be in charge of reflecting and analyzing the phenomena that result from both the rarefaction of the (...) subject and the rarefaction of discourse, that is, such rhetoric invests in what is responsible for imposing on the speaking subject what to say and how to say it. Therefore, it turns to certain mechanisms of control of discourses that Foucault presented in The Discourse on Language, a work that completes five decades of its publication. This Foucauldian rhetoric also has as its main function to deal with the history of the present, that is, to reflect on what we do and think at this exact moment, which, in turn, would be in charge of contributing to the history of how we became subjects in a culture like ours, at this stage of high modernity and the Information Age. From this perspective, she would be interested in the processes of identification and subjectivation that result from the ways in which we become subjects. This article is about Gilles Deleuze's book Le Pli. Leibniz et le Baroque from 1988. It shows how Deleuze's notion of folding captures some basic intuitions in Leibniz and how they relate to each other. To this purpose, I propose five figures, all referring to the same basic fold, all illustrating how the consideration of such figures allows developing central elements of Leibniz's monadology. These figures can help, I hope, alleviate some of the fundamental difficulties in understanding Deleuze's (...) approach to the Monadology from the non-Deleuzian perspective of contemporary Leibniz scholarship and give a sense of the synthetic, explanatory force that Deleuze's notion of folding has in relation to Leibniz's monadological metaphysics. There is at least one immediate sense in which legal discourse is perspectival: it qualifies acts and facts in the world on the basis of rules. Legal concepts are for the most part constituted by rules, both in the sense that rules define these concepts’ semantic content and that, in order to engage with legal practice, we must act according to those rules, not necessarily complying with them but at least having them in mind. This is the distinctive perspective of (...) law: however, it would be misleading to think that this is the only perspective we can have in legal discourse. That of rule-constituted legal concepts is the fundamental perspective -- the inevitable presupposition of most legal assertions -- but other perspectives are possible on top of this fundamental background: perspectives on law, stemming from the basic perspective of law. -/- In this paper, I will try to argue that some different perspectives regarding law can be accounted for by analyzing different kinds of concepts that emerge in connection with legal institutions. My argument will consist of three steps as follows. First, I will explain how legal concepts are constituted by rules, referring in this regard to John Searle’s analysis of institutional concepts as it emerges in his Making the Social World, of 2010, and amending this analysis according to some criticisms that in 1986 Neil MacCormick had raised against Searle with specific reference to the legal domain. -/- Second, I will show that there are some kinds of concepts relevant for an institution which are not captured by Searle’s analysis in terms of constitutive rules, even if this is amended according to MacCormick’s criticisms. This I will do by considering the game of chess as a simple system of rule-constituted concepts (concepts such as 'checkmate,' 'bishop,' 'king'). I will consider four examples of perfectly legitimate assertions regarding a match of chess -- these being (1) ‘I won’; (2) 'you made a good attack'; (3) 'you are cheating'; (4) 'you made good use of the first-move advantage,' and I will show that, while the first three assertions can be analyzed in terms of concepts (those of 'victory,' 'attack,' and 'cheating') which are not constituted by the rules of chess but are rather common to several different competitive games, being typical of the broader practice of competitive game-playing of which chess is an instance, the fourth assertion includes a concept (that of 'first-move advantage') which is peculiar to chess, just like a rule-constituted element, but is not constituted by the rules of chess. This analysis will lead to a new categorization of institutional concepts. Apart from rule-constituted institutional concepts, which are the only ones recognized by Searle, in order to account for cases (1), (2), and (3) I will distinguish between three kinds of meta-institutional concepts, namely, goal-oriented, mode-oriented, and value-oriented meta-institutional concepts, and then I will introduce the category of para-institutional concepts to account for case (4). -/- Finally -- and this is the third step of my argument -- I will explain how these different kinds of institutional concepts appear when we adopt different perspectives on the institutional frameworks we deal with. This will lead us to a categorization of possible perspectives regarding law that corresponds to the previous one regarding concepts. There is first a structural perspective regarding the instantiation of institutional elements which clearly involves rule-constituted institutional concepts -- as when we say 'I am making a will.' There is then a teleological perspective regarding the goal of our institutional acts which calls into question goal-oriented meta-institutional concepts -- as when we say 'I wrote that will in order for you to have a distinctive right to my property.' Then, we can adopt a strategical perspective regarding some peculiar ways in which institutional acts can be performed, and this has often to do with mode-oriented meta-institutional concepts -- as when we say 'the Labour Party is making parliamentary obstructionism so that the Government will fall before the enactment of the labour reform,' or 'workers start today a work-to-rule action.' Clearly, we can also adopt an evaluative perspective over institutional facts or acts, and here typically value oriented meta-institutional concepts emerge -- as when we say 'that rule is clearly unjust' or 'that contract is unfair.' Finally, we can limit ourselves to a descriptive perspective on phenomena which are peculiar to a given institutional setting, and here para-institutional concepts are often useful -- as when we say 'the Italian electoral system before 1990 led to a sort of reform paralysis' or 'a strict use of the criterion requiring proof beyond any reasonable doubt can be expected to entail a low conviction rate.'. The big five personality traits and entrepreneurial mindset are crucial individual-level elements that determine entrepreneurial intention. This study examines the impact of big five personality traits and EM, on EI using the theory of planned behavior. Besides, this study examined the role of entrepreneurial self-efficacy and attitude toward entrepreneurship influences EI. To achieve the research objectives, a quantitative approach was used. Structural equation modeling and path analysis were conducted using SmartPLS software. Data were collected from 270 respondents (...) through online questionnaires. Findings of the study revealed that big five personality traits influence ESE and ATE which led to EI. Finally, the moderating role of entrepreneurial passion was also found to have strong effect on influence ESE and ATE. This study offers evidence and insights that academics, educators, and others involved in the creation or expansion of entrepreneurial knowledge can use as a reference point. (shrink)

Social, legal and health-care changes have created an increasing need for ethical review within end-of-life care. Multiprofessional clinical ethics committees (CECs) are increasingly supporting decision-making in hospitals and hospices. This paper reports findings from an analysis of formal summaries from CEC meetings, of one UK hospice, spanning four years. Using qualitative content analysis, five themes were identified: timeliness of decision-making, holistic care, contextual openness, values diversity and consensual understanding. The elements of an engaged clinical ethics in a hospice (...) context is not generally acknowledged nor its elements articulated. Findings from this study have the potential to explain some of the most challenging ethical problems and to contribute to their resolution. How to participate proactively in a process of change and transformation, to shape our path within an uncertain future? This article outlines a new theory of humor. The concept of humor is developed in the sense of five dialectical levels, respectively, sequential phenomenalities of humorous consciousness. These range from a level of most inferior humor up to a stage of most sublime humor. Systematically speaking, humor is viewed from an enhanced perspective of transcendental philosophy, namely as a medium of self-unfolding practical reason. It is considered as a complementary potency to the practical force of the latter’s regulative principle, (...) and it fulfils several important functions. The first section provides basic definitions of concepts like humor, sublimity, comicality, etc. Here, the five phenomenalities of humor are introduced. The second section explores and develops these contents more in detail. Some references to the German-speaking tradition in the philosophy of humor provide further input for discussion. Twenty-five years ago Paul Wilpert called for a thorough re-examination of our knowledge of the content of Aristotle's lost workDe Philosophia. Expressing his reservations about the validity of our current reconstruction of the work, he wrote: ‘On the basis of attested fragments, we form for ourselves a picture of the content of a lost writing, and this picture in turn serves to interpret new fragments as echoes of that writing. So our joy over the swift growth of our collection (...) of fragments is clouded by the thought that we are not thereby really nearing the original character of the work, but we are entangling ourselves ever more tightly in a picture we ourselves have created.’ As a corrective Wilpert called for a critical retracing of our steps since 1830 to establish a more secure reconstruction of this important lost work.Since then there have been numerous, searching analyses of the ideas and fragments ofDe Philosophia, but at least one venerable old theory has escaped critical reappraisal: namely, the theory that inDe PhilosophiaAristotle discussed his doctrine of a fifth element, i.e. his belief that the heavenly bodies are composed of an element distinct from the four earthly elements, earth, water, air, and fire. This theory has become so widely accepted that it has virtually become a fact. When support is needed, most modern authors simply cite one or both of the two modern authorities on the early Aristotle, namely W. Jaeger and E. Bignone. The more meticulous restate the traditional evidence with complete confidence that this evidence proves their case. If Wilpert's hope for a firmly grounded reconstruction of theDe Philosophiais ever to be achieved, one of the importantdesideratatoday is a critical re-examination of the evidence for the fifth element in this work. Differences in socioeconomic and infrastructural elements among nations, differing conceptions about childhood, and the failure to distinguish between child work and child labor render a simple ban on child labor abroad idealistic and impractical.

We present a formalization of collections that Cornelius Castoriadis calls “magmas”, especially the property which mainly characterizes them and distinguishes them from the usual cantorian sets. It is the property of their elements to depend on other elements, either in a one-way or a two-way manner, so that one cannot occur in a collection without the occurrence of those dependent on it. Such a dependence relation on a set A of atoms (or urelements) can be naturally represented by (...) a pre-order relation $$\preccurlyeq $$ of A with the extra condition that it contains no minimal elements. Then, working in a mild strengthening of the theory $$\textrm{ZFA}$$, where A is an infinite set of atoms equipped with a primitive pre-ordering $$\preccurlyeq $$, the class of magmas over A is represented by the class $$LO(A,\preccurlyeq )$$ of nonempty open subsets of A with respect to the lower topology of $$\langle A,\preccurlyeq \rangle $$. The non-minimality condition for $$\preccurlyeq $$ implies that all sets of $$LO(A,\preccurlyeq )$$ are infinite and none of them is $$\subseteq $$ -minimal. Next the pre-ordering $$\preccurlyeq $$ is shifted (by a kind of simulation) to a pre-ordering $$\preccurlyeq ^+$$ on $${{\mathcal {P}}}(A)$$, which turns out to satisfy the same non-minimality condition as well, and which, happily, when restricted to $$LO(A,\preccurlyeq )$$ coincides with $$\subseteq $$. This allows us to define a hierarchy $$M_\alpha (A)$$, along all ordinals $$\alpha \ge 1$$, the“magmatic hierarchy”, such that $$M_1(A)=LO(A,\preccurlyeq )$$, $$M_{\alpha +1}(A)=LO(M_\alpha (A),\subseteq )$$, and $$M_\alpha (A)=\bigcup _{\beta <\alpha }M_\beta (A)$$, for a limit ordinal $$\alpha $$. For every $$\alpha \ge 1$$, $$M_\alpha (A)\subseteq V_\alpha (A)$$, where $$V_\alpha (A)$$ are the levels of the universe V(A) of $$\textrm{ZFA}$$. The class $$M(A)=\bigcup _{\alpha \ge 1}M_\alpha (A)$$ is the “magmatic universe above A.” The axioms of Powerset and Union (the latter in a restricted version) turn out to be true in $$\langle M(A),\in \rangle $$. Besides it is shown that three of the five principles about magmas that Castoriadis proposed in his writings (mildly modified and adapted to the needs of formalization), $$M2^*$$, $$M3^*$$ and $$M5^*$$, are true of M(A).
