This article is a theoretical treatment of feminist epistemology of crime, which advocates the centrality of gender as a theoretical starting point for the investigating of digital crimes. It does so by exploring the synergy between the feminist perspectives and the Tripartite Cybercrime Framework (TCF) (which argues that three possible factors motivate cybercrimes – socioeconomic, psychosocial, and geopolitical) to critique mainstream criminology and the meaning of the term “cybercrime”. Additionally, the article examines gender gaps in online harassment, (...) cyber‐bullying, cyber‐fraud, revenge porn, and cyber‐stalking to demonstrate that who is victimised, why, and to what effect are the critical starting points for the analysis of the connections between gender and crimes. In turn, it uses the lens of intersectionality to acknowledge that, while conceptions of gender and crime interact, they intersect with other categories (e.g., sexuality) to provide additional layers of explanation. To nuance the utilitarian value of the synergy between the TCF and the feminist perspectives, the focus shifts to a recent case study (which compared socioeconomic and psychosocial cybercrimes). The article concludes that, while online and offline lives are inextricably intertwined, the victimisations in psychosocial cybercrimes may be more gendered than in socioeconomic cybercrimes. These contributions align the TCF to the feminist epistemology of crime in their attempt to move gender analysis of digital crimes “from margin to centre”. (shrink)

Do men and women perceive cybercrime types differently? This article draws on the distinction between socio-economic and psychosocial cybercrime proposed by Lazarus (2019) to investigate whether men and women hold different perceptions of digital crimes across these two dimensions. Informed by the synergy between feminist theory and the Tripartite Cybercrime Framework (TCF), our survey examined respondents’ differential perceptions of socio-economic cybercrime (online fraud) and psychosocial cybercrime (cyberbullying, revenge porn, cyberstalking, online harassment) among men and women in the United Kingdom. (...) The results revealed that women considered psychosocial cybercrime worse than men. Conversely, we found no differences between men and women with regard to socio-economic cybercrime. The article concludes that psychosocial cybercrimes are more gendered than socio-economic cybercrime, suggesting problems with the meaning of ‘cyber-enabled crimes’, and substantiating the synergy between the TCF and feminist perspectives. Changes in government policy over the last two decades have seen the traditional goals of criminal justice, namely prosecution and punishment, being replaced by an emphasis on prevention, fear reduction, security and harm reduction. During this time domestic abuse has gained a place on the political agenda, which has resulted in legislative initiatives in the form of civil protection orders across the U.K. which primarily focus on prevention but have also more recently begun to rely on the traditional criminal justice (...) responses should they fail to prevent further abuse. Drawing on international evaluations and a recent study conducted in Scotland (the Scottish study), the article examines whether legislation in the form of civil protection orders has the effect of curtailing the actions of abusers and if not, what occurs when the traditional criminal justice response comes into play. The strengths of civil protection orders and some explanations for the weaknesses of these orders are considered alongside the question of whether there is any value in women continuing to engage with the law in response to domestic abuse. The role of the victim in the discourse of victimology, a branch of criminology, is assessed and applied to the work of Rajeswari Sunder Rajan and Lata Mani who both examine the construction of women's subjectivity in the practice of "sati" in India.

This thesis, which is based on six peer-reviewed publications, is a theoretical and qualitative treatment of the ways in which social and contextual factors serve as a resource for understanding the particularities of ‘cybercrime’ that emanates from Nigeria. The thesis illuminates how closer attention to Nigerian society aids the understanding of Nigerian cybercriminals (known as Yahoo Boys), their actions and what constitutes ‘cybercrime’ in a Nigerian context. ‘Cybercrime’ is used in everyday parlance as a simple acronym for all forms of (...) crimes on the internet, whereas ‘cybercrime’ in a Nigerian context is rooted in socioeconomics and determined by it. In particular, the defrauding of victims for monetary benefit is the most significant theme that emerged from the analysis of Yahoo Boys. While all six publications are situated at the intersections of multiple fields of study, they all share a common endorsement of the constructionist/interpretivist position. The six published works comprise: [a] three conceptual publications; and [b] three empirical publications. The conceptual publications deconstruct the meanings of multiple taken-for-granted concepts in cybercrime scholarship and develop more robust conceptual lenses, namely: (1) ‘Digital Spiritualization’; (2) ‘The Tripartite Cybercrime Framework – TCF’; and (3) ‘The Synergy between Feminist Criminology and the TCF’. These new conceptual lenses represent the candidate’s contribution to developing theory in the field. Alongside this, the empirical section includes three sets of qualitative data, which include: (1) interviews with seventeen Nigerian parents; (2) lyrics from eighteen Nigerian musicians; and (3) interviews with forty Nigerian law enforcement officers. These diverse sources of qualitative data provide a more fully-developed understanding of ‘cybercrime’ in the Nigerian context (and elsewhere). All six-published works, while individually contributing to knowledge, collectively shed clearer light on the centrality of cultural context in the explanation of ‘cybercrime’. (shrink)

Intersectionality has utilized various feminist theories that continue subculture of violence thinking about Black men and boys. While intersectional feminists often claim that intersectionality leads to a clearer social analysis of power and hierarchies throughout society and within groups, the categories and claims of intersectionality fail to distinguish themselves from previously racist theories that sought to explain race, class, and gender, based on subcultural values. This article is the first to interrogate the theories used to construct the gendered categories (...) and the assumptions behind Black male positionality under intersectional analyses. Contrary to its promises for more liberated Black identities, intersectionality merely replicates the pseudo-science of racist criminology and presents decades old theories as cutting-edge gender analyses. In short, while intersectionality has allowed Black women to create nuanced experiences and epistemological accounts of Black womanhood, the very same theory has confined Black male experience to the perpetration of violence and defined Black manhood as lesser—merely the exemplification of white masculinity’s pathological excess. Carceral spaces such as prisons are designed to restrict freedoms and keep inhabitants confined and under surveillance through various mechanisms. As a result, prisons are spaces where movement is restricted through confinement, while prisoners’ ability to move is conflated with freedom. We aim to move beyond this dichotomy and consider a complex rethinking of the body in criminological theory and practice through dance in carceral space. In doing so, we explore under what conditions movement represents agentic practices. Understanding these nuances (...) requires an interrogation of prisoner agency, including prisoners’ subtle maneuverability of power dynamics within the prison. We explore these dynamics using feminist and arts-based methods, specifically dance workshops delivered to twenty participants incarcerated in a Canadian provincial women’s prison. We find that movement and expression in prison may create moments of agentic freedom for incarcerated women under certain conditions. We argue that more nuanced understandings of incarcerated women’s agency can be found in their daily negotiations of time and space, and movement can provide numerous meanings. Our findings suggest arts-based approaches within prison environments create opportunities for women to express their identity and sexuality through movement in ways otherwise not permitted in prison. For many incarcerated women in this study, this sense of freedom may be associated with the ability to focus and take care of themselves while confined. (shrink)

In the case of Michel Foucault the impact (...) of his work is felt in a wide range of disciplinary fields, including philosophy and history, disciplines to which he explicitly directed his attention, as well as other areas of intellectual endeavor, notably, sociology, criminology, political science, cultural studies, feminism, architecture, and literary analysis. Indeed, there are now few disciplinary fields that have not experienced the Foucault effect.Writing an introduction to Foucault's work is not an easy task. There are so many interpretations and issues to address, and there are already a large number of texts published on his work. Undaunted by the magnitude of the task, Philip Barker has produced a fine text, one that simultaneously manages to offer a clear introduction to the key elements of Foucault's work as well as provide food for thought for those already relatively familiar with the Foucaultian legacy. In an impressively wide-ranging text, Barker opens his discussion with a consideration of the question of how we are to read Foucault. Reflecting on Foucault's discussion of the author function, discourse, the circulation and meaning of texts, as well as the difficulties of commentary, Barker introduces the reader to the features of a "Foucauldian style of textual criticism." From here the text proceeds to cover such key substantive concerns in Foucault's work as the articulation of power, truth and strategy (Chapter 2) and discipline, subjectivities and selves (Chapters 3 and 4), before turning to a discussion of Foucault's "archaeological strategy," conception of historical analysis, and critical interrogation of the sovereign subject (Chapter 5). In the two final chapters of the book Barker seeks to encourage the reader to be more than a passive consumer of Foucault and to develop a "critical interaction" with Foucault's work. Through a series of brief reflections on philosophy, the politics of theory, and the notion of "thinking against," Barker, drawing on a text by Longinus, attempts, with a good deal of success, to put into practice Foucault's idea of "thinking differently" (Chapter 6). The book ends on a more personal and somewhat self-indulgent note, but one hopefully that will still encourage introductory readers to get to grips with Foucault's work for themselves.Barker has succeeded in producing a concise and generally stimulating introduction to Foucault's work, and it should encourage readers to try to make sense of Foucault's work for themselves. In researching women’s involvement in economic crime, the concept of the ‘economic’ is problematic. Women’s crime for economic gain and women’s crime in economic terms are inadequately catered for. In reviewing criminologists’ uses of the notion of ‘economic crime’ I suggest that criminological understandingin relation to crime for economic gain is poor and that gender freedom/blindness/specificity variously operate. Building Abolition: Decarceration and Social Justice explores the intersections of the carceral in projects of oppression, while at the same time providing intellectual, pragmatic, and undetermined paths toward abolition. While the low conviction rate for cases of sexual violence is often justified by the so-called ‘he-said-she-said’ nature of these cases, the increasing presence of digital evidence has begun to challenge this justification. This digital evidence can provide new opportunities for intervening in and prosecuting sexual violence. However, it may also be used against complainants or deemed still insufficient for proving guilt. Thus, while digital evidence may be challenging typical criminal justice responses to sexual violence, it may equally be utilised (...) to buttress entrenched stereotypes and criminal justice practices that lead to complainant dissatisfaction and serve to support low conviction rates. I draw on critical feminist legal theory, feminist engagements with digital technology and sexual violence, and visual criminology to theorise the burgeoning role of the digital witness in sexual violence cases. This article refers to the criminological analysis of the state registration of victimological data about criminal victimization in Lithuania. The period of analysis is 2004-2009. Following the validation of new criminal laws on 1 May 2003, from 2004 a period of stable state registration of crime victims, i.e. a period without significant changes in criminal laws, commenced. The article deals with the analysis of spreading of criminal victimization among natural persons and juridical persons in Lithuania. The registered number of crime (...) victims in Lithuania during 2004-2007 decreased in consecutive order (14.3%, compared to 2004). Since 2008 the new changes have become clear—the registered number of persons mentioned above has gone up, though insignificantly, by 5%. The registered number of juridical persons as victims over this period increased (29%, compared to 2005). But juridical persons became victims of misdemeanors more often than natural persons—so their situation was better than that of natural persons. (shrink)

This paper explores the visual construction and representation of co-accused women offenders in court drawings. It utilises three case studies of female co-defendants who appeared in the England and Wales court system between 2003 and 2013. In doing so this paper falls into three parts. The first part considers the emergence of the sub-discipline, visual criminology and examines what is known about the visual representation of female offenders. The second part presents the findings of an empirical investigation, which involved (...) engaging in a critical, reflexive visual analysis of a selection of court drawings of three female co-offenders. The third part discusses the ways in which the court artists' interpretation, the conventions of court sketching, and motifs of female offenders as secondary actors, drew on existing myths and prejudices by representing the women as listening, remorseless ‘others’.
