This paper focuses on Confucian formulations of personhood and the implications they may have for bioethics and medical practice. We discuss how an appreciation of the Confucian concept of personhood can provide insights into the practice of informed consent and, in particular, the role of family members and physicians in medical decision-making in societies influenced by Confucian culture. We suggest that Western notions of informed consent appear ethically misguided when viewed from a Confucian perspective.

Previous research has established that the success of strikes, and social movements more broadly, depends on their ability to garner support from the public. However, there is scant published research investigating the response of the public to strike action by healthcare workers. In this study, we address this gap through a study of public responses to UK nursing strikes in 2022–2023, using a data set drawn from Twitter of more than 2300 publicly available tweets. We focus on negative tweets, investigating (...) which societal discourses social media users draw on to oppose strike action by nurses. Using a combination of corpus‐based approaches and discourse analysis, we identified five categories of opposition: (i) discourse discrediting nurses; (ii) discourse discrediting strikes by nurses; (iii) discourse on the National Health System; (iv) discourse about the fairness of strikers' demands and (v) discourse about potential harmful impact. Our findings show how social media users operationalise wider societal discourses about the nursing profession (e.g., associations with care, gender, vocation and sacrifice) as well as recent crises such as the Covid‐19 pandemic to justify their opposition. The results also provide valuable insights into misconceptions about nursing, strike action and patient harm, which can inform strategies for public communication. (shrink)

Patient requests for “inappropriate” medical treatment based on religious beliefs should have special standing. Nevertheless, not all such requests should be honored, because some are morally disturbing. The trouble lies in deciding which ones count. This paper proposes criteria that would qualify a religious belief as medically valid to help physicians decide which requests to respect. The four conditions suggested are that the belief is shared by a community, is deeply held, would pass the test of a religious interpreter and (...) does not harm others. (shrink)

Previous studies show evidence of double standards in terms of individuals being more tolerant of questionable consumer practices than of similar business practices. However, whether these double standards are necessarily due to the fact that one party is a business company while the other is a consumer was not addressed. The results of our two experimental studies, conducted among 277 (Study 1) and 264 (Study 2) participants from a Western European country by means of an anonymous self-administered online survey, demonstrate (...) that the respondents were not only harsher in their judgments of unethical business (vs. consumer) behavior, but also harsher in their judgments of unethical behavior by prosperous (vs. non-prosperous) consumers and prosperous (vs. non-prosperous) business companies (Study 1). Further, they were also less tolerant of unethical behavior by consumers (vs. one's best friend) and business companies with which they have a less than good (vs. a good) relationship (Study 2). These results indicate that double standards are due to differences in perceived wealth between subjects and in the individual's relationship with subjects. These two factors imply that double standards are not strictly reserved to consumer-business relations, but might also be used in business-business and consumer-consumer relations. Further, these results indicate that companies need to be aware of the fact that good financial figures may backfire as they might lead individuals to be more critical of a company's deceptive practices. Moreover, these findings point to the importance of businesses investing resources-and to keep investing resources-in developing a good relationship with stakeholders as these good relationships lead to stakeholders being less prone to make moral condemnations. Abstract:Many scientists argue that the world is becoming increasingly dominated by human activity, much to the detriment of the natural world. In what scholars have dubbed the Anthropocene, the current geological epoch during which time human activity has been the dominating force over climate and the environment, many questions of environmental ethics have arisen. Who does the earth belong to? What is the relationship between humans and the environment? What is the moral standing of non-human life? Locke and Rousseau provide (...) varying answers to these questions, which are central to discussions of environmental ethics. In many ways, Locke and Rousseau's answers are opposed to each other, suggesting a differing world view when it comes to environmental ethics. Locke's understanding of environmental ethics seems to dominate, and perhaps even cause, the onset of the Anthropocene, but Rousseau's response, and a potential turn toward his understanding of environmental ethics marks an ideological shift in the way that humans understand their relationship with the world around them. This paper argues that the writings of Locke and Rousseau correspond to different stages of the Anthropocene with significant effects on both environmental ethics and environmental governance and policy. Current advances in assisted reproductive technologies aim to promote the health and well-being of future children. They offer the possibility to select embryos with the greatest potential of being born healthy (eg, preimplantation genetic testing) and may someday correct faulty genes responsible for heritable diseases in the embryo (eg, human germline genome modification (HGGM)). Most laws and policy statements surrounding HGGM refer to the notion of ‘serious’ as a core criterion in determining what genetic diseases should be targeted by these (...) technologies. Yet, this notion remains vague and poorly defined, rendering its application challenging and decision making subjective and arbitrary. By way of background, we begin by briefly presenting two conceptual approaches to ‘health’ and ‘disease’: objectivism (ie, based on biological facts) and constructivism (ie, based on human values). The basic challenge under both is sorting out whether and to what extent social and environmental factors have a role in helping to define what qualifies as a ‘serious’ disease beyond the medical criteria. We then focus on how a human rights framework (eg, right to science and right to the highest attainable health) could integrate the concepts of objectivism and constructivism so as to provide guidance for a more actionable consideration of ‘serious’. Ultimately, it could be argued that a human rights framework, by way of its legally binding nature and its globally accepted norms and values, provides a more universal foundation for discussions of the ethical, legal and social implications of emerging or disruptive technologies. At the level of our platitudinous background knowledge about things, speech is the expression of thought. And understanding what such expressing involves is central to understanding the relation between thinking and speaking. Part of what it is for a speech act to express a mental state is that the speech act accurately captures the mental state and can convey to others what mental state it is. “Walter Benjamin, Reader of Kafka: Study, Oblivion and Justice”. In this paper we propose to explore an aspect of Franz Kafka. On the Tenth Anniversary of his Death, an essay that Walter Benjamin wrote in 1934 for the Jüdische Rundschau, and to investigate an idea that does not develop there in extenso: the “study”. Throughout the text, we find that Benjamin relates this idea with two other concepts: first, he argues that study is opposed to “oblivion”, and, on the other (...) hand, links study with the notion of justice. In this way, both characterizations seem to coexist in the essay about Kafka, without the author developing them in depth. The objective of this work is, then, to delve into each of them in order to clarify how Benjamin conceives the study so that it can be associated with both a struggle against oblivion and with justice. This essay compares and contrasts pragmatic naturalism with the more well known position of epistemological naturalism on several pivotal issues, in the process offering a pragmatic critique of the latter. It highlights their common rejection of both foundationalism and a priori methods and their positive claims that: what needs examination is not our concept of knowledge but knowledge itself; knowledge must be understood as tied to the world and as a natural phenomenon to be examined in its natural setting; the (...) epistemic endeavor involves unifying its three traditional projects of giving an account of what knowledge is, explaining how knowledge is possible, and providing useful epistemic advice, thus involving normative considerations; and the method of gaining knowledge in general is continuous with the method of science. Yet, there are very great divergences between the two naturalisms concerning the answers offered, and these are explored and evaluated in the development of the essay. (shrink)

: The main contribution of this paper to current philosophical and sociological studies on modeling is to analyze modeling as an object-oriented interdisciplinary activity and thus to bring new insights into the wide, heterogeneous discourse on tools, forms and organization of interdisciplinary research. A detailed analysis of interdisciplinarity in the making of models is presented, focusing on long-standing interdisciplinary collaboration between specialists in infectious diseases, mathematicians and computer scientists. The analysis introduces a novel way of studying the elements of the (...) models as carriers of interdisciplinarity. These elements, being functionally interdependent building blocks, evolve during the modeling work and carry the disciplinary tensions in the process. This shows how the long and challenging process of defining and reformulating the object of research is crucial for understanding the dynamics of interdisciplinarity in the making. (shrink)

An absolute decline in US life expectancy in low education whites has alarmed policy makers and attracted media attention. Depending on which studies are correct, low education white women have lost between 3 and 5 years of lifespan; men, between 6 months and 3 years. Although absolute declines in life expectancy are relatively rare, some commentators see the public alarm as reflecting a racist concern for white lives over black ones. How ought we ethically to evaluate this lifespan contraction in (...) low education whites? Should we care, or is it racist to care? Does it constitute an injustice or reflect justice being done? I argue that the lifespan contraction in low education whites violates key normative criteria used to make determinations of health justice, and that these judgments do not vitiate concerns about racism. I conclude with reflections on US population health policy and building an inclusive health equity movement. (shrink)

All mental states, including thoughts, feelings, perceptions, and sensations, often occur consciously. But they all occur also without being conscious. So the first thing a theory of consciousness must do is explain the difference between thoughts, feelings, perceptions, and sensations that are conscious and those which are not.

Existing whistle-blowing models rely on “cold” economic calculations and cost-benefit analyses to explain the judgments and actions of potential whistle-blowers. I argue that “hot” cognitions – value conflict and emotions – should be added to these models. I propose a model of the whistle-blowing decision process that highlights the reciprocal influence of “hot” and “cold” cognitions and advocate research that explores how value conflict and emotions inform reporting decisions. I draw on the cognitive appraisal approach to emotions and on the (...) social-functional value pluralism model to generate propositions. (shrink)

Plastids and mitochondria arose through endosymbiotic acquisition of formerly free-living bacteria. During more than a billion years of subsequent concerted evolution, the three genomes of plant cells have undergone dramatic structural changes to optimize the expression of the compartmentalized genetic material and to fine-tune the communication between the nucleus and the organelles. The chimeric composition of many multiprotein complexes in plastids and mitochondria (one part of the subunits being nuclear encoded and another one being encoded in the organellar genome) provides (...) a paradigm for co-evolution at the cellular level. In this paper, we discuss the co-evolution of nuclear and organellar genomes in the context of environmental adaptation in species and populations. We highlight emerging genetic model systems and new experimental approaches that are particularly suitable to elucidate the molecular basis of co-adaptation processes and describe how nuclear-cytoplasmic co-evolution can cause genetic incompatibilities that contribute to the establishment of hybridization barriers, ultimately leading to the formation of new species. Intraspecific niche variation can differentially impact community processes and can represent the initial stages of adaptive radiation. Here we test for intraspecific differences in niche use in a keystone species, the alewife (Alosa pseudoharengus). To test whether feedbacks between predator foraging traits and prey communities have led to differences in niche use, we compare the diet composition and trophic position of anadromous and landlocked alewife populations. These populations differ in phenotypic traits related to foraging (gill raker spacing, gape width, and (...) prey selectivity). Trait differences appear to have resulted from eco-evolutionary feedbacks between alewives and their zooplankton prey, and suggest that these two life history forms are exploiting different niches. Direct diets show that anadromous alewives consume a greater biomass of predatory copepods than do landlocked alewives. Anadromous alewives also consume more ostracods—a littoral prey item—as the growing season progresses. These diet differences do not translate into a significant difference in trophic position, as estimated from stable isotopes. However, stable-isotope estimates of diet source show that during early fall, anadromous alewives obtain significantly more of their dietary carbon from the littoral food web. This increased reliance on littoral prey is likely a result of a diet switch that occurs in response to the alewife-driven exhaustion of large-bodied prey items available in the pelagic zone, i.e., alewife niche construction. These findings show the existence of important intraspecific niche differences in the alewife and support the role of eco-evolutionary feedbacks in shaping these niche differences. The initiation of alewife divergence is the result of dam building by humans. Therefore, alewife niche differentiation can be considered to be an eco-evolutionary byproduct of human cultural niche construction. (shrink)

A focused review of the literature on reasoning suggests that mechanisms based upon contraries are of fundamental importance in various abilities. At the same time, the importance of contraries in the human perceptual experience of space has been recently demonstrated in experimental studies. Solving geometry problems represents an interesting case as both reasoning abilities and the manipulation of perceptual–figural aspects are involved.In this study we focus on perceptual changes in geometrical problem solving processes in order to understand whether a mental (...) manipulation in terms of opposites might help. Four conditions were studied, two of which concerned the search for contraries as an implicit or explicit strategy.Results demonstrated that contraries, when used explicitly in solution processes, constitute an effective heuristic: The number of correct solutions increased, less time was needed to find a solution and participants were oriented towards the use of perception-based solutions—not only wer.. Women and men are biologically and reproductively dissimilar. This sexual distinctiveness gives rise to a “sexual asymmetry”—the fundamental reality that the potential consequences of sexual intercourse are far more immediate and serious for women than for men. Advocates of contraception and abortion sought to cure sexual asymmetry by decoupling sex from procreation, relieving women from the consequences of sex, and thus equalizing the sexual experiences of men and women. But efforts to suppress or reject biological difference have not relieved women (...) of the consequences of sex and the vulnerabilities of pregnancy, even as they have further relieved men. Although secular feminist responses to biological difference have served to exacerbate sexual asymmetry, Catholic teaching on abortion, sex, and marriage—even contraception—provides an authentically pro-woman cultural response. To what extent are artists and sitters (or researchers and “objects” of investigation) implicated in their representations of others? How implicated are we when we identify with the way different cultures or perspectives represent ourselves? Understanding how specific forms of representation reveal differently authored perceptions of the individual is a critical concern. My overarching concern, as an artist, is to start mapping contemporary practices of identity formation and expression through the investigation of specific non- Western and subcultural modes that prioritise (...) different codes and social processes of cultural production – modes that do not privilege the gaze. Crucially, the case studies operate a strategic reversal of the classical artistic and scientific approaches: both sides in this dialogue of interpretation and representation involving the artist/researcher and the cultural actor are equally subject and object. The resulting artworks present distinct cultural practices as new possibilities for portrayal, and acts of selection, interpretation and definition as forms of cultural production. (shrink)

En el presente trabajo nos proponemos analizar un pasaje de El caso Wagner, en el que Nietzsche condensa una serie de problemáticas referidas al vínculo entre Wagner, la decadencia y la psicología. El carácter condensado de las afirmaciones que allí se presentan, suscitan una serie de interrogantes que intentamos responder a lo largo de nuestro escrito. En primer lugar, indagamos las razones por las cuales Nietzsche afirma que los alemanes malentendieron a Wagner y cómo se relaciona esto con el hecho (...) de que nunca hayan sido psicólogos. En segundo lugar, rastreamos por qué Nietzsche sostiene que existe una “afinidad” entre Wagner y la décadence francesa. A los fines de dilucidar estas cuestiones, recurrimos como estrategia interpretativa a una fuente central de la que se nutrió Nietzsche: los Essais de psychologie contemporaine de Paul Bourget. Finalmente, planteamos una tensión que encontramos entre el diagnóstico crítico de la decadencia y la práctica psicológica que Nietzsche reivindica. (shrink)

El presente trabajo busca reconstruir una tensión entre el pensamiento de Marx y Benjamin en relación al valor que cada uno le otorga a la memoria. En principio, podría afirmarse que estos autores asumen puntos de vista contrapuestos: mientras en El Dieciocho Brumario Marx sostiene que toda apelación al pasado es superstición, por lo que la revolución no puede sacar de allí su lírica; para Benjamin, el cambio revolucionario cita al pasado. Lo que llama la atención, sin embargo, es que (...) Benjamin en la Tesis XIV afirma que el salto al pasado que él reivindica es “la revolución tal y como la entendió Marx”. Nuestro objetivo aquí será indagar los motivos por los que Benjamin incluye esta referencia a Marx, considerando que él conocía su negativa a que la revolución se nutriera del pasado. (shrink)

In seinen Vorlesungen über die Ästhetik hat Hegel einen der wichtigsten und wirkmächtigsten Beiträge zur Ästhetik und Philosophie der Kunst entwickelt. Von der systematischen Klärung der Idee des Schönen über die geschichtliche Unterscheidung der symbolischen, klassischen und romantischen Kunstform bis hin zur Darstellung der einzelnen Künste (Architektur, Skulptur, Malerei, Musik, Poesie) werden alle relevanten Aspekte entfaltet und miteinander vernetzt. Eindrucksvoll ist nicht nur Hegels plastischer Zugriff auf die Fülle konkreten Materials. Bedeutsam ist vor allem sein kulturphilosophischer Ansatz, der die Kunst (...) auf dem Rang des "absoluten Geistes" als zentrales Medium menschlicher Selbstverständigung begreift. Die vieldiskutierte These vom "Ende der Kunst" in der Moderne hängt damit direkt zusammen. Hegel hat seine vier Berliner Ästhetik-Kollegien nicht selbst publiziert. Dieser Kommentarband orientiert sich an der Edition des Hegel-Schülers H.G. Hotho und zieht ergänzend die Nachschriften, insbes. des letzten Kollegs von 1828/29 hinzu. In dieser Form wird Hegels Ästhetik auf dem aktuellen Forschungsstand für ein breites philosophisches und kulturwissenschaftliches Interessenfeld erschlossen. Mit Beiträgen von B. The knowledge representation and reasoning of both humans and artificial systems often involves conditionals. A conditional connects a consequence which holds given a precondition. It can be easily recognized in natural languages with certain key words, like “if” in English. A vast amount of literature in both fields, both artificial intelligence and psychology, deals with the questions of how such conditionals can be best represented and how these conditionals can model human reasoning. On the other hand, findings in the psychology (...) of reasoning, such as those in the Suppression Task, have led to a paradigm shift from the monotonicity assumptions in human inferences towards nonmonotonic reasoning. Nonmonotonic reasoning is sensitive for information change, that is, inferences are drawn cautiously such that retraction of previous information is not required with the addition of new information. While many formalisms of nonmonotonic reasoning have been proposed in the field of Artificial Intelligence, their capability to model properties of human reasoning has not yet been extensively investigated. In this paper, we analyzed systematically from both a formal and an empirical perspective the power of formal nonmonotonic systems to model possible explicit defeaters, as in the Suppression Task, and more implicit conditional rules that trigger nonmonotonic reasoning by the keywords in such rules. The results indicated that the classical evaluation for the correctness of inferences has to be extended in the three major aspects regarding the inference system, the knowledge base, and possible assumed exceptions for the rule. Despite apparent political concern and action—often fuelled by high-profile cases and campaigns—legislative and institutional responses to image-based sexual abuse in the UK have been ad hoc, piecemeal and inconsistent. In practice, victim-survivors are being consistently failed: by the law, by the police and criminal justice system, by traditional and social media, website operators, and by their employers, universities and schools. Drawing on data from the first multi-jurisdictional study of the nature and harms of, and legal/policy responses to, image-based sexual abuse, (...) this article argues for a new joined-up approach that supports victim-survivors of image-based sexual abuse to ‘reclaim control’. It argues for a comprehensive, multi-layered, multi-institutional and multi-agency response, led by a government- and industry-funded online or e-safety organisation, which not only recognises the diversity of victim-survivor experiences and the intersection of image-based sexual abuse with other forms of sexual and gender-based violence and discrimination, but which also enables victim-survivors to reclaim control within and beyond the criminal justice system.
