De acuerdo a este artículo, la extensión realizada por Rawls de su concepción de justicia doméstica al contexto de las relaciones internacionales contradice premisas básicas de su propia teoría de justicia. Una extensión de la teoría doméstica consistente con sus propias premisas debería llevar a considerar una clase mayor de demandas como derechos humanos y a aceptar algún principio de distribución global.

Neste texto, investiga-se a extensão diacrônica da comuni- dade moral no âmbito de teorias contratualistas. Para isso, examinam-se críticas à possibilidade lógica de sustentar obrigações em relação a gerações futuras e se abordam modelos argumentativos contratualistas de justificação dessas obrigações que se baseiam no interesse próprio e na imparcialidade. De acordo com essa pesquisa, a melhor defesa dessas obrigações se pode articular recorrendo a esse último tipo de contratualismo.

El artículo indaga la legitimidad libertaria de las fronteras estatales para excluir inmigrantes. Se sostiene que en estas teorías la legitimidad de las fronteras se construye mediante la legitimidad de la propiedad. El artículo analiza las teorías libertarias de Nozick y Steiner y argumenta contra la idea de que el derecho de propiedad libertario permite excluir en las fronteras y sostiene que las condiciones de legitimidad de la propiedad implican una potestad estatal reducida para controlar fronteras. El artículo analiza cómo se relaciona la premisa normativa de la dignidad humana con la evaluación del fenómeno migratorio. Para aquello, da cuenta de una concepción de dignidad humana que no recurre a presupuestos naturalistas ni supraempíricos, y presenta tres alternativas diferentes para otorgarle contenido normativo en base a un umbral suficientarista. Desde estas perspectivas, se sostiene que el trato corriente que se da a los refugiados, a los desplazados medioambientales y a los inmigrantes económicos, amenaza su dignidad y debe, (...) por tanto, dar paso a otros modos de hacer frente al fenómeno migratorio. O artigo mostra que muitos dos casos geralmente discutidos em debates multiculturais são erroneamente entendidos como conflitos culturais que seriam supostamente resolvidos através de direitos culturais. Ao contrário, o que temos em sua base é a aspiração universalista liberal de uma igualdade de oportunidades. Desde um ponto de vista igualitário liberal, a implementação de políticas antidiscriminatórias efetivas é a estratégia correta para lidar com tais casos . O artigo enfoca casos de acesso a empregos e educação.

O artigo apresenta algumas estratégias recorrentes para justificar os direitos culturais (tais como comunidade justificativa, o valor da diversidade, as teorias do reconhecimento da diferença cultural, o valor da autonomia, a justificação de igualdade) e as examina criticamente à luz de seus próprios méritos, a partir da perspectiva do liberalismo enquanto doutrina política. De acordo com o artigo, todas essas justificativas são fadadas ao fracasso.

Tomando em consideração as teorias de Charles Taylor e de James Tully, critica-se neste artigo a tese da política do reconhecimento, segunda a qual o auto-respeito dos indivíduos depende do reconhecimento geral da sua pertença cultural. Teorias do reconhecimento, não apenas apresentam problemas na sua articulação, mas também dificuldades em relação à sua implementação.

Diese These wird durch eine Konzeption von liberaler Ausbildung untermauert, die paternalistische Elemente beinhaltet und die dementsprechend über die üblichen Argumentationen für die liberale Ausbildung hinausgeht, die Ausbildung lediglich als Funktional für die Bürgerrolle betrachtet.

What general conclusions can be drawn about the reception of zymase, its relation to the larger shift from a protoplasm to an enzyme theory of life, and its status as a social phenomenon?The most striking and to me unexpected pattern is the close correlation between attitude toward zymase and professional background. The disbelief of the fermentation technologists, Will, Delbrück, Wehmer, and even Stavenhagen, was as sharp and unanimous as the enthusiasm of the immunologists and enzymologists, Duclaux, Roux, Fernback, and Bertrand, (...) and of Pfeffer, the experimental plant physiologist. Other skeptics—Voit, Kupffer, and Fischer—were conservatives in traditional fields. In all these cases it seems clear that professional commitments and outlook profoundly influenced the reception of zymase.In some cases there is a correlation with a specific earlier statement favoring the protoplasm theory or predicting a fermentation enzyme. Reynolds Green is a striking case of both. In 1893 he stated his belief that life processes in higher plants and fungi were identical, both being mediated by protoplasm.109 Thus he claimed that digestion was not carried out by enzymes, as in higher animals, but by the whole protoplasm, and so too fermentation in yeast: “All the metabolic processes must be carried out in the unicellular organism in the same mass of protoplasm.”110 But Green also insisted that there was no essential difference between “organized” and “unorganized ferments”; enzymes were simply more highly differentiated and specialized forms of primitive protoplasm. He spoke of “the alcoholic ferment” (that is, enzyme), and of intracellular enzymes—very advanced beliefs for 1893. Thus it is understandable why Green saw no reason to doubt his first negative results with yeast juice, and rushed into print. But it is also understandable that he persisted and soon became an outspoken advocate of Buchner's view; like Wroblewski and Pfeffer, he had already accepted the idea of an intracellular fermentation enzyme.The physiological chemists also fit the pattern in a special way. Physiological chemistry is generally regarded as the source of biochemistry; indeed, many early biochemists were trained in physiological chemistry, and imbibed there a progressive interest in enzymes and metabolism. It is not surprising, therefore, that on the whole Neumeister, Madfadyen, Wroblewski, and Loew accepted cell-free fermentation. But what is surprising, and significant, is the diversity of opinion in this group, from Abeles' living protoplasm to Wroblewski's organized array of active proteins. The feelings of the physiological chemists were mixed, and there was enough of the old protoplasm view in Macfadyen's and even Wroblewski's views to allow Buchner to see them as attacks on zymase. The ideas of physiological chemistry were also changing; the idea of protoplasm was already adjusting to the new interest in enzymes in the early 1890's. But in contrast to immunochemistry, the change in physiological chemistry was gradual, uneven, undramatic, and relatively invisible. For the new biochemistry, the tradition of physiological chemistry was the source of traditional conservatism as well as of new ideas of enzymes.In general, then, I claim that it was not experimental facts that determined attitudes toward zymase so much as previous commitments, experience, and expectations. Initially, at least, zymase was less a determinant of opinion than a touchstone of pre-existing opinion. Like a prism, it revealed the spectrum of existing attitudes toward vital phenomena.Also relevant here is the fact that the experimental evidence was entirely ambiguous; the interpretation of Buchner's experiments with antiseptics or dried yeast depended entirely on how far one was willing to stretch the scope of the terms “protoplasm” and “enzyme”. Likewise, how important one judged the instability of zymase to be, or the low level of in vitro activity, depended largely on one's point of view. There was no crucial experiment, no certain proof. Logically zymase could be regarded as protoplasm. A. Fischer did so in 1900;111 Macfadyen was still wavering in 1907;112 and Beijerinck was holding out as late as 1916.113 There were undoubtedly others. Besides the special case of Reynolds Green and the technologists, there are no recorded cases of conversion.But if there was no evidence to convert a dedicated protoplasmist, there was plenty to encourage a dedicated belief in the enzyme theory, and that, I believe, is precisely what happened. The arguments of Buchner et al in support of zymase had the greatest effect not on the protoplasmists but on those who were already predisposed toward the biochemical view. The zymase debate enabled the emerging group of biochemists to recognizethemselves as a group with a community of out-look and objectives; it brought the issue of protoplasm vs. enzyme into the open and gave it a specific and concrete issue on which to turn. The debate sharpened the biochemists' awareness that their point of view was becoming the new mainstream of biochemical thought.All this of course had an important secondary effect on those who opposed the new view, or who were not immediately concerned with it. After the zymase debate, it would have been almost impossible to ignore the new ideas; the dramatic and wide publicity the debate enjoyed would have made it difficult not to take sides. Buchner's successful defense of zymase itself became an important influence on opinion; the new movement had to be looked at with respect. But the primary effect of the debate, I assert, was on those who were already inclined to the new view. The outcome was not a mass conversion of individuals, nor the ejection of one idea by another. The sides probably did not change much; the real change was in the way each side regarded itself and its place in history. The zymase debate may perhaps best be regarded as a process of selection. Buchner's party became aware of itself as the new progressive point of view, while those holding the traditional view could no longer expound it publicly without appearing obstinate or old-fashioned. Thus the way was clear for the gradually wider establishment of the new ideas, especially among the new generation of biochemists. In this specific sense, the acceptance of zymase was a social phenomenon.This way of looking at the zymase debate also illuminates its coincidence with the emergence of biochemistry as a profession. The new professional trappings and organizations were the social manifestation of the new self-awareness gained from the zymase controversy. One of the most important effects on those disposed toward the new view was the awareness of an intellectual community and of the need to give that community social forms. The almost mythical importance of Buchner's “victory” over the old protoplasm theory that later became current is readily understandable. It was a useful ideology for a group anxious to assert the novelty of their approach, a novelty which they in fact felt quite keenly.But if the primary effect of the zymase controversy was on those predisposed to accept zymase, then obviously the success of zymase depended on the fact that change had already begun to occur. Indeed, one of the most striking, and again unexpected, results of this study is the extent to which the importance of enzymes was already recognized in the early 1890's. The new immunology clearly pointed the way. Macfadyen and Hans Buchner were looking for active proteins inside the cell in 1893. Reynolds Green, Wroblewski, and Pfeffer had all anticipated the discovery of a fermentation enzyme. Other discoveries in enzymology in the 1890's pointed the same way.114 Moreover, it is clear from this study that the old protoplams theory was adapting to the new discoveries concerning the importance of enzymes. The sidechains of the old protoplasm molecule were simply reinterpreted as enzymes, as in Wroblewski's theory, for example, or in Paul Ehrlich's extremely influential “sidechain theory” of antibody formation (1897). Despite the later views of Hopkins et al., the old protoplasm and the new enzyme theories were not irreconcilable; a continuity of development had already begun when zymase came so dramatically on the scene. Buchner himself observed that the difference between the two views had become largely verbal; in retrospect we might say, not verbal, but social and historical. The gap between the continuous change in ideas and the contemporary feeling of sharply discontnuous change is a measure of the elusive but real social and historical implications of the zymase debate, of the demise of an old establishment, and the emergence of a new.In retrospect, then, it is clear that a trend was already under way in various quarters when zymase appeared. But it was still a collection of isolated and dispersed events. The zymase controversy made the trend visible and gave it a dramatic unity. The debate influenced those who had already begun to change. It was so effective because things had begun to change and because it coincided with the direction of that trend. (shrink)

His categories of myth, sacred history, and philosophy are meant to be more or less adequate characterizations of the shape of the expression of the sacred in the Sumero-Babylonian and Egyptian, Hebraic, and Greek cultures respectively. Of course there is overlap, e.g., the obviously mythic roots of Greek literature. Loew is best on the Sumero-Babylonian and Egyptian religions. When he comes to the Hebraic religions he oversimplifies the picture to a considerable degree, as is the case also with his treatment of the Greeks. That family of Manilius' MSS which is now usually called the second, and is designated by the letter β, made its first decisive entrance into criticism in the year 1739. The early vulgate had shaped itself out of hybrid copies in which the tradition of the two families α and β was indistinguishably blended; one good and ancient representative of α, the Gemblacensis, was brought into employment by Scaliger in 1600: but the testimony of β was never disengaged and isolated (...) until Bentley's edition made public the readings of the Leyden codex Vossianus 390. The next member of the family to emerge was Matritensis M 31, discovered in 1879 by Gustav Loewe and brought to general notice in the middle of 1893 by the simultaneous publication of two papers,—one by Mr Breiter in the Neue Jahrbuecher vol. 147 pp. 417–423, one by Prof. Ellis in Hermathena no. xix pp. 261–286. Two other MSS closely akin to this, Vrbinates 667 and 668 in the Vatican library, containing the first 82 verses of the poem, which the Matritensis has lost, are employed in an edition of Book i which I published in 1903. Having read Prof. Housman's article in the Classical Quarterly of October 1907, it seemed to me worth while, when I was in Madrid last year, to examine the MS of Manilius, Matritensis 31, in those places where Prof. Housman notes that the testimony of Loewe and of Mr Ellis disagree, with the result that I have found Loewe's account of the reading, as given by Prof. Housman, to be correct in all places except the following.

Humean Supervenience is a metaphysical model of the world according to which all truths hold in virtue of nothing but the total spatiotemporal distribution of perfectly natural, intrinsic properties. David Lewis and others have worked out many aspects of HS in great detail. A larger motivational question, however, remains unanswered: As Lewis admits, there is strong evidence from fundamental physics that HS is false. What then is the purpose of defending HS? In this paper, we argue that the philosophical merit (...) of HS is largely independent of whether it correctly represents the world’s fundamental structure. In particular, we show that insofar as HS is an apt model of the world’s higher-level structure, it thereby provides a powerful argument for reductive physicalism and explains otherwise opaque inferential relations. Recent criticism of HS on the grounds that it misrepresents fundamental physical reality is, therefore, beside the point. (shrink)

Humean reductionism about laws of nature appears to leave a central aspect of scientific practice unmotivated: If the world’s fundamental structure is exhausted by the actual distribution of non-modal properties and the laws of nature are merely efficient summaries of this distribution, then why does science posit laws that cover a wide range of non-actual circumstances? In this paper, we develop a new version of the Humean best systems account of laws based on the idea that laws need to organize (...) information in a way that maximizes their cognitive usefulness for creature like us. We argue that this account motivates scientific practice because the laws’ applicability to non-actual circumstances falls right out of their cognitive usefulness. (shrink)

In this paper, we argue that the Consequence Argument relies on empirical premises. In particular, we show how the argument depends upon assumptions about the character of the laws of nature.

Humean Laws for Human Agents presents cutting-edge research by leading experts on the Humean account of laws, chance, possibility, and necessity. A central question in metaphysics and philosophy of science is: What are laws of nature? Humeans hold that laws are not sui generis metaphysical entities but merely particularly effective summaries of what actually happens. In the framework of the rigged Hilbert space, unstable quantum systems associated with first-order poles of the analytically continued S-matrix can be described by Gamow vectors which are generalized vectors with exponential decay and a Breit-Wigner energy distribution. This mathematical formalism can be generalized to quasistationary systems associated with higher-order poles of the S-matrix, which leads to a set of Gamow vectors of higher order with a non-exponential time evolution. One can define a state operator from the set of higher-order (...) Gamow vectors which obeys the exponential decay law. We shall discuss to what extent the requirement of an exponential time evolution determines the form of the state operator for a quasistationary microphysical system associated with a higher-order pole of the S-matrix. This paper explores the gendered discourses of the – seemingly favourable – media coverage that certain Heads of State received for their handling of the COVID-19 pandemic. Looking at media reports published in different English-speaking outlets in the US, the UK, India, Bangladesh, Singapore, New Zealand, Australia, and Ireland, and using multimodal feminist critical discourse analysis, we identify and describe strategies that on the surface appear to challenge hegemonic – and largely masculine – discourses of leadership. Upon closer scrutiny, these (...) superficially complimentary reports rather reinforce and naturalise discriminatory gender ideologies, and, as we demonstrate, they do so to different degrees along a continuum of essentialising, contextualising, and problematising. We critically discuss the discursive and visual processes involved and show that complimenting these leaders on their performance compares them against a masculine norm to construct their leadership as ‘alternative’, exceptional, and hence marked. This gendered portrayal of political leadership in times of crisis illustrates how the discursive construction of identities, responsibilities, and relationships during COVID-19 largely hinges on power relations and political ideologies that systematically disadvantage and undermine women. The purportedly positive form in which this occurs makes it particularly difficult to challenge and subvert these discriminatory discourses and their underlying gendered ideologies. (shrink)

Humean reductionism about laws of nature is the view that the laws reduce to the total distribution of non-modal or categorical properties in spacetime. A worry about Humean reductionism is that it cannot motivate the characteristic modal resilience of laws under counterfactual suppositions and that it thus generates wrong verdicts about certain nested counterfactuals. In this paper, we defend Humean reductionism by motivating an account of the modal resilience of Humean laws that gets nested counterfactuals right.

Standard models of adolescent risk taking posit that the cognitive abilities of adolescents and adults are equivalent, and that increases in risk taking that occur during adolescence are the result of socio emotional differences in impulsivity, sensation seeking, and lack of self-control. Fuzzy-trace theory incorporates these socio emotional differences. However, it predicts that there are also cognitive differences between adolescents and adults, specifically that there are developmental increases in gist-based intuition that reflects understanding. Gist understanding, as opposed to verbatim-based analysis, (...) generally has been hypothesized to have a protective effect on risk taking in adolescence. Gist understanding is also an essential element of informed consent regarding risks in medical decision- making. Evidence thus supports the argument that adolescents’ status as mature minors should be treated as an exception rather than a presumption, because accuracy in verbatim analysis is not mature gist understanding. Use of the exception should be accompanied by medical experts’ input on the bottom-line gist of risks involved in treatment. (shrink)

Our ordinary causal concept seems to fit poorly with how our best physics describes the world. We think of causation as a time-asymmetric dependence relation between relatively local events. Yet fundamental physics describes the world in terms of dynamical laws that are, possible small exceptions aside, time symmetric and that relate global time slices. My goal in this paper is to show why we are successful at using local, time-asymmetric models in causal explanations despite this apparent mismatch with fundamental physics. (...) In particular, I will argue that there is an important connection between time asymmetry and locality, namely: understanding the locality of our causal models is the key to understanding why the physical time asymmetries in our universe give rise to time asymmetry in causal explanation. My theory thus provides a unified account of why causation is local and time asymmetric and thereby enables a reply to Russell’s famous attack on causation. (shrink)

A central question in the philosophy of science is: What is a law of nature? Different answers to this question define an important schism: Humeans, in the wake of David Hume, hold that the laws of nature are nothing over and above what actually happens and reject irreducible facts about natural modality (Lewis, 1983, 1994; cf. Miller, 2015). According to Non-Humeans, by contrast, the laws are metaphysically fundamental (Maudlin, 2007) or grounded in primitive modal structures, such as dispositional essences of (...) powerful properties (Bird, 2007), necessitation relations (Armstrong, 1983), or primitive subjunctive facts (Lange, 2009). The Great Psychotherapy Debate: Models, Methods, and Findings comprehensively reviews the research on psychotherapy to dispute the commonly held view that the benefits of psychotherapy are derived from the specific ingredients contained in a given treatment (medical model). Resumen Este trabajo revisa algunas de las objeciones más frecuentes contra la versión que Nozick ofrece de la estipulación lockeana. Se detiene especialmente en dos de ellas: aquella que afirma que la estipulación es contraproducente y aquella que, por el contrario, sostiene que es insuficiente. Se rechazarán ambas críticas. La primera porque pasa por alto la distinción que Nozick hace entre no disminuir las oportunidades de usar un bien y las oportunidades de apropiárselo; la segunda porque asume erróneamente que la (...) línea de base de la estipulación se encuentra siempre en el estado de naturaleza. Finalmente se ofrece una formulación del principio de justicia en la adquisición que recoge las restricciones de estipulación.This paper reviews some of the most frequent objections against Nozick's version of Lockean Proviso. In particular, it examines two of them: the one that affirms that the stipulation is self-defeating and the one that, on the contrary, maintains that it is insufficient or to weak. Both criticisms are rejected. The first because it ignores Nozick's distinction between not diminishing the opportunities to use a specific good and the opportunities to appropriate it; the second because it erroneously assumes that the baseline of the stipulation is always in the state of nature. Finally, a formulation is offered on the principle of justice in acquisition that includes the stipulation restrictions. (shrink)

Humeans about laws maintain that laws of nature are nothing over and above the complete distribution of non-modal, categorical properties in spacetime. ‘Humean compatibilists’ argue that if Humeanism about laws is true, then agents in a deterministic world can do otherwise than they are lawfully determined to do because of the distinctive nature of Humean laws. More specifically, they reject a central premise of the Consequence argument by maintaining that deterministic laws of nature are ‘up to us’. In this paper, (...) we present a new argument for Humean compatibilism. We argue that Humeans about laws indeed have resources for defending compatibilism that non-Humeans lack. Moreover, we show that utilizing these resources does not lead to objectionable consequences. Humeans about laws should thus embrace Humean compatibilism. (shrink)

An influential version of the Consequence argument, the most famous argument for the incompatibility of free will and determinism, goes as follows: For an agent to be able to do otherwise, there has to be a possible world with the same laws and the same past as her actual world in which she does otherwise. However, if the actual world is deterministic, there is no such world. Hence, no agent in a deterministic world can ever do otherwise. In this paper, (...) I discuss a recent version of this argument due to Christopher Franklin: the ‘No Opportunity argument’. I argue that the No Opportunity argument overgeneralizes. If its premises were true, things would be obstacles to doing otherwise that have nothing to do with determinism and that intuitively are not obstacles. (shrink)

The Humean best systems account identifies laws of nature with the regularities in a system of truths that, as a whole, best conforms to scientific standards for theory-choice. A principled problem for the BSA is that it returns the wrong verdicts about laws in cases where multiple systems, containing different regularities, satisfy these standards equally well. This problem affects every version of the BSA because it arises regardless of which standards for theory-choice Humeans adopt. In this paper, we propose a (...) Humean response to the problem. We invoke pragmatic aspects of Humean laws to show that the BSA, despite violating some of our intuitive judgements, can capture everything that is relevant for scientific practice. (shrink)

It is natural to think of causes as difference-makers. What exact difference causes make, however, is an open question. In this paper, I argue that the right way of understanding difference-making is in terms of causal processes: causes make a difference to a causal process that leads to the effect. I will show that this way of understanding difference-making nicely captures the distinction between causing an outcome and helping determine how the outcome happens and, thus, explains why causation is not (...) transitive. Moreover, the theory handles tricky cases that are problematic for competing accounts of difference-making. (shrink)
