In 1985, Swiss legal philosopher Walter Ott visited Herbert Hart in Oxford and made this record of their meeting, which casts novel light on some of Hart’s ideas. Ott engaged Hart in a fresh encounter with the legal philosophy of Gustav Radbruch, particularly Hart’s and Radbruch’s reasons for a minimum content of justice in law. They also discussed the grudge informer, state responsibility under laws of an earlier régime, and questions of the definition and falsifiability of legal theories. Hart surprisingly (...) reported Hans Kelsen as stating, when they had met at Berkeley in 1961, that Hume (and not Kant, and certainly not Wittgenstein) was the greatest philosopher who had ever lived. Mishara (bio)Arens situates Wilhelm Griesinger in a historical context with which we are no longer familiar. In doing so, she has performed an important task for contemporary clinicians, philosophers, and historians. We find ourselves working and thinking (both in everyday clinical practice and in the construction of our models of mental disorder) with the same categories that Griesinger struggled to sort out and (...) redefine; we often do so, however, without awareness of their history or lack of permanence. Ackerknecht writes that all the dominant trends in modern psychiatry can be traced back to Griesinger; he states that Griesinger is the “founder of neuropsychiatry,” a “merging of the two disciplines” neurology and psychiatry. Griesinger presents us with a “systematic synthesis of the anatomical, physiological, psychological and clinical points of view” (Ackerknecht 1959, 63). Somewhat contrarily, Karl Jaspers, in his General Psychopathology, groups Griesinger with the great observers and describers of clinical experience rather than among the systematic analyzers (Jaspers 1963, 849–50). Although Griesinger is best known for his identification of mental disorders as a subset of brain diseases, Karl Bonhoeffer, a successor to Griesinger as director of the Charité Clinic in Berlin, cautions that Griesinger “continued to see in psychological causes the most frequent and abundant source of mental disorders” (Bonhoeffer 1911, 53). Kales, Kales, and Vela-Bueno, however, write, “Griesinger was representative of a clinical movement that minimized the value of psychological concepts in the understanding of mental diseases” (Kales, Kales, and Vela-Bueno 1990, 15). Precisely because of his importance, contention surrounds his legacy.If Griesinger is the pioneer of empirical approaches in biological neuropsychiatry (as Ackerknecht and others claim), he is also precursor to philosophical criticisms of their limits. It is not so easy to lump Griesinger to one side of the oppositions with which we think today: Griesinger’s scientific psychiatry (formed on the basis of the newly emergent empirical physiology) was meant to steer between the Scylla of the previously reigning overspeculative romantic medicine and the Charybdis of the antitheoretical and “positivistic” materialism of Magendie. As Arens suggests, even during the same generation of university psychiatry which Griesinger was critical in forming, he was posthumously denounced as belonging to the Hegelian idealists; later, he was proclaimed to be an empiricist. Griesinger’s work contained both idealism and empiricism in a fragile synthesis that soon broke asunder.Hermeneutic theory points out that we inevitably interpret an author, in this case, Griesinger, in terms of the prejudices of our own present context of understanding and our current problems of application to clinical practice (Gadamer 1993). On the one hand, we benefit from the advantage of seeing all that follows Griesinger’s work and are able to “understand the author [End Page 165] better than he understood himself.” We are able to see what he only anticipates but is still not able to explicitly articulate as the unpredicted effects of his work. On the other hand, our interpretations are encumbered by the sedimentations of the views of his successors: his work lies buried under the subsequent interpretations and vicissitudes of a reception with its own agendas, contexts of interpretation, and realms of application. It would be easier if we could simply assign him to one side of our current debates concerning mind/body, individual/culture, and explanation/understanding rather than seeing that our present quandaries in understanding, classifying, and treating mental disorder result precisely from a reading of Griesinger that is not careful enough. It is here that Arens can help us develop our present views further by reviewing their past.Although Griesinger is heralded as the pioneer of an empirical physiological approach which employs a natural scientific concept of mechanism (Ackerknecht, O. Marx, Verwey), Arens situates him in the tradition of Kant and German idealism. It is perhaps this solution of being both philosophical and empirical which seems hard for us, today, to understand. We have come to view these directions as contradictory, to be necessarily in a mutually exclusive relationship. Proclus' commentary on Plato's dialogue Timaeus is arguably the most important commentary on a text of Plato, offering unparalleled insights into eight centuries of Platonic interpretation. It has had an enormous influence on subsequent Plato scholarship. This edition offers the first new English translation of the work for nearly two centuries, building on significant recent advances in scholarship on Neoplatonic commentators. In this article I examine several related views expressed by Robin Hendry concerning molecular structure, emergence and chemical bonding. There is a long-standing problem in the philosophy of chemistry arising from the fact that molecular structure cannot be strictly derived from quantum mechanics. Two or more compounds which share a molecular formula, but which differ with respect to their structures, have identical Hamiltonian operators within the quantum mechanical formalism. As a consequence, the properties of all such isomers yield precisely the (...) same calculated quantities such as their energies, dipole moments etc. The only means through which the difference between the isomers can be recovered is to build their structures into the quantum mechanical calculations, something that is carried out by the application of the Born-Oppenheimer approximation. Consequently, it has been argued by many authors that molecular structure is written in ‘by hand’ rather than derived. Robin Hendry is one such author, but he goes a great deal further by proposing that this situation implies the existence of emergence and downward causation. In the current article I argue that there are alternative explanations which render emergence and downward causation redundant. Such an alternative lies in the notion of quantum decoherence and the appeal to work in the foundations of physics, which posits that the various isomers exist as a superposition until their wavefunctions are collapsed either by observation or by interacting with their environment. Hendry also alludes to a debate among chemists as to whether chemical bonds are real or not, in the sense of directional connections between two or more nuclei in any given molecule. I reject this view and propose that the structural and energetic views of chemical bonding, that have been discussed by some philosophers of chemistry including Hendry, do not refer to any essential ontological differences. I agree that chemists view bonding in a more realistic fashion and may consider bonds to be in some senses real, while physicists may consider bonding in more abstract energetic terms. However, I do not believe that such differences in scientific practice and attitudes should be considered to offer a window as to the ontological status of bonding or whether bonding is real. Finally, I discuss the kinetic energy school of chemical bonding which would seem to challenge any notion of bonds as directional entities, since bonding is no longer regarded as being primarily due to the build-up of electron density between nuclei. Simplicius’ project of harmonizing previous philosophers deserves to be taken seriously as both a philosophical and an interpretive project. Simplicius follows Aristotle himself in developing charitable interpretations of his predecessors: his distinctive project, in the Neoplatonic context, is the rehabilitation of the Presocratics (especially Parmenides, Anaxagoras and Empedocles) from a Platonic-Aristotelian perspective. Simplicius’ harmonizations involve hermeneutic techniques which are recognisably those of the serious historian of philosophy; and harmonization itself has a distinguished history as a constructive philosophical method.

Pierre Bayle’s Philosophical Commentary was a major attempt to deal with very similar problems three centuries ago. His argument is that if the orthodox have the right and duty to persecute, then every sect will persecute, since every sect considers itself orthodox. The result will be mutual slaughter, (...) something God cannot have intended. -/- The Philosophical Commentary takes its starting point from the words attributed to Jesus Christ in Luke 14:23, “And the lord said unto the servant, Go out into the highways and hedges, and compel them to come in, that my house may be full.” Bayle contends that the word compel cannot mean “force.” From this perspective, he constructs his doctrine of toleration based on the singular importance of conscience. His point is not that coercion usually is ineffective in matters of faith but that, even when effective, it is wrong because it ignores the indispensability of the free conscience. (shrink)

The commentary on Plato's Republic by Proclus (d. 485 CE), which takes the form of a series of essays, is the only sustained treatment of the dialogue to survive from antiquity. This three-volume edition presents the first complete English translation of Proclus' text, together with a general introduction that argues for the unity of Proclus' Commentary and orients the reader to the use which the Neoplatonists made of Plato's Republic in their educational program. Each volume is completed by (...) a Greek word index and an English-Greek glossary that will help non-specialists to track the occurrence of key terms throughout the translated text. The second volume of the edition presents Proclus' essays on the tripartite soul and the virtues, female philosopher rulers, and the metaphysics and epistemology of the central books of the Republic. Sartre’s Critique of Dialectical Reason ranks with Being and Nothingness as a work of major philosophical significance, but it has been largely neglected. The first volume, published in 1960, was dismissed as a Marxist work at a time when structuralism was coming into vogue; the incomplete second volume has only recently been published in France. In this commentary on the first volume, Joseph S. Catalano restores the Critique to its deserved place among Sartre’s works and within philosophical discourse as (...) a whole. Sartre attempts one of the most needed tasks of our times, Catalano asserts—the delivery of history into the hands of the average person. Sartre’s concern in the Critique is with the historical significance of everyday life. Can we, he asks, as individuals or even collectively, direct the course of our history? A historical context for our lives is given to us at birth, but we sustain that context with even our most mundane actions—buying a newspaper, waiting in line, eating a meal. In looking at history, Sartre argues, reason can never separate the historical situation of the investigator from the investigation. Thus reason falls into a dialectic, always depending upon the past for guidance but always being reshaped by the present. Clearly showing the influence of Marx on Sartre’s thought, the Critique adds the historical dimension lacking in Being and Nothingness. In placing the Critique within the corpus of Sartre’s philosophical writings, Catalano argues that it represents a development rather than a break from Sartre’s existentialist phase. Catalano has organized his commentary to follow the Critique and has supplied clear examples and concrete expositions of the most difficult ideas. He explicates the dialogue between Marx and Sartre that is internal to the text, and he also discusses Sartre’s Search for Method, which is published separately from the Critique in English editions. In this commentary on Yashar Saghai's article "Salvaging the Concept of Nudge" (JME 2013) I discuss his distinction between a 'prod' (which is 'substantially controlling') and a 'nudge' (which is ‘substantially non-controlling’).

The discussion of extended cognition is premised on a metaphysical distinction between causation and constitution. For example, Rowlands (2009) notes that “EM [extended mind] is a claim about the composition or constitution of (some) mental processes” (2009, p. 54). Or, as Wheeler puts it: “Bare causal dependency of mentality on external factors […] is simply not enough for genuine cognitive extension. What is needed is constitutive dependence” (2010, p. 246). In this sense, Krickel (this volume) rightly notes that the current (...) disagreement between friends and foes of extended cognition turns on a metaphysical dispute about what is constitutive of mentality and how to locate those constituents. Krickel (this volume) argues that our account of diachronic constitution fails to provide a convincing answer to the metaphysical dispute about ‘what is constitutive’ of mentality and ‘how to locate’ the relevant constituents. The central reason is that diachronic constitution fails the so-called ‘co-location condition,’ which Krickel argues is a necessary condition that an account of constitution must meet in the discussion over the extended mind. The co-location condition asserts that ‘cognition is located where and only where its constituents are located.’ We expose an ambiguity in the co-location condition, and show why this condition is no threat to our account of diachronic constitution. We conclude that the co-location condition is not a necessary condition that an account of constitution in the discussion over the extended mind must adhere to. (shrink)

In the present volume Proclus describes the 'creation' of the soul that animates the entire universe. This is not a literal creation, for Proclus argues that Plato means only to convey the eternal dependence of the World Soul upon higher causes. In his exegesis of Plato's text, Proclus addresses a range of issues in Pythagorean harmonic theory, as well as questions about the way in which the World Soul knows both forms and the visible reality that comprises its body. This (...) part of Proclus' Commentary is particularly responsive to the interpretive tradition that precedes it. Many studies of world politics fail to take evidence seriously or consider basic moral truisms (for example, that the standards we apply to others we must apply to ourselves). This commentary illustrates these assessments in relation to two subjects which have attracted much interest in the West recently – terrorism and just war to combat terrorism. The evidence shows that the United States has engaged extensively in terrorism and that application of just war principles would entitle the victims of (...) that terrorism to use force against the United States to defend themselves if the United States is accorded that right. The history of physical anthropology has most often been situated and studied in the context of specific colonial powers and nation states.
