If conduct must be wrongful in order to be justifiably criminalised, how should its wrongfulness be established? I examine a conception of wrongfulness put forward by A. P. Simester, which makes wrongfulness turn on whether the reasons favouring the performance of an action are, all things considered, defeated by the reasons against its performance. I argue that such a view can only generate appropriate substantive constraints in the context of criminalisation if it can distinguish between the sorts of reasons that (...) a verdict of wrongfulness, as a concept distinct from stupidity or selfishness, should attend to, and the sorts of reasons it should leave out. Assuming that this conception of wrongfulness should operate as a constraint on criminalisation in a liberal-democratic state, the only reasons it should include are other-regarding reasons. What matters is whether the agent commits an other-regarding wrong. This conception of wrongfulness helps us further to resolve fundamental questions concerning mala prohibita and the legitimate reach of any duty to obey the law. (shrink)

_Five Faces of Modernity_ is a series of semantic and cultural biographies of words that have taken on special significance in the last century and a half or so: _modernity_, _avant-garde_, _decadence_, _kitsch_, and _postmodernism_. The concept of modernity—the notion that we, the living, are different and somehow superior to our predecessors and that our civilization is likely to be succeeded by one even superior to ours—is a relatively recent Western invention and one whose time may already have passed, if (...) we believe its postmodern challengers. Calinescu documents the rise of cultural modernity and, in tracing the shifting senses of the five terms under scrutiny, illustrates the intricate value judgments, conflicting orientations, and intellectual paradoxes to which it has given rise. _Five Faces of Modernity_ attempts to do for the foundations of the modernist critical lexicon what earlier terminological studies have done for such complex categories as _classicism_, _baroque_, _romanticism_, _realism_, or _symbolism_ and thereby fill a gap in literary scholarship. The relationship between preaching, music and liturgy. In the Reformed liturgy in South Africa the sermon has traditionally been reserved a special place, taking precedence over the liturgy and music. In this article an argument is put forward for a better balance between preaching, liturgy and music in the Reformed liturgy in churches in South Africa. In order to do so, the South African Reformed liturgical context is briefly sketched and thereafter a theological and liturgical-historical argument is presented. Existing approaches (...) with regard to the relationship between liturgy, music and preaching by some established scholars are discussed before the implications of the argument are examined in conclusion. L'idée essentielle de ce travail est que la perception est, d'abord etavant tout, perception d'un monde phénoménal pourvu d'une certaine organisationgéométrique, de sorte qu'il nous paraît impossible de comprendre comment lesstructures perceptives se constituent sans que l'on précise le rôle que jouentcertaines propriétés géométriques fondamentales du monde physique et de sesobjets. En fait, ces propriétés géométriques, au lieu d'être un élément certesimportant mais somme tout accidentel du monde phénoménal, comme encore lecroient les théoriciens de la Gestalt, jouent un rôle essentiel (...) dansle processus de constitution de ce monde. Nous cherchons à montrer qu'il doitexister un petit nombre de modèles géométriques qui très vraisemblablementrégissent les mécanismes perceptifs assurant la reconnaissance de la forme desobjets dans l'espace ambiant. Par ailleurs, nous soulignons que toute théoriede la perception spatiale doit viser à expliquer les rapports entre les espacessensible, physique et géométrique. Husserl y a contribué de façon essentielle,en mettant notamment en évidence le type de proto-géométrie qui intervient dansla structuration du monde phénoménal, ou dans la constitution de la « chosespatiale ». Il a par là anticipé un certain nombre d’idées importantes, entreautres, l’idée selon laquelle l’espace de la perception serait un « espacequotient global » produit de plusieurs sous-espaces sensibles. Les érudits discutent de la possibilité du phénomène en reconsidérant les théories de la génération (...) spontanée et en enquêtant sur ces merveilleux coquillages présents dans certains cabinets de curiosités. On assiste aujourd’hui à l’émergence d’une nouvelle langue euro-polonaise, version polonaise de l’euro-langue, à moins que ce ne soit l’euro-version du polonais. Cette langue a toutes les apparences du polonais, mais elle est si imprégnée de termes bureaucratiques que l’on est en droit de se demander s’il s’agit toujours de la même langue. Par quel mécanisme ce problème d’ordre linguistique est-il apparu ? Pourquoi l’euro-polonais est-il si inutilement compliqué (...) ? Pourquoi éprouve-t-on autant de difficultés à comprendre les textes de l’UE, et singulièrement les appels d’offre ? Telles sont les questions auxquelles répond l’article, qui plaide pour une plus grande lisibilité des textes, sans laquelle il n’est pas de réelle démocratie.This article shows how the EU’s structural funds have influenced the Polish language. What is emerging today is a new language called Euro-Polish, the Polish version of Eurospeak – or possibly the Euro-version of Polish. It certainly looks like Polish, but it is so saturated with bureaucratic terms that one may well wonder whether it is really the same language. How did this problem – a linguistic one – arise? Why is Euro-Polish so pointlessly complicated? Why are EU texts so difficult to understand, and particularly its calls for tenders? This article answers these questions, and pleads in favour of the plain language, without which true democracy cannot exist. (shrink)

A moving cultural biography of abolitionist martyr John Brown, by one of the most important African-American intellectuals of the twentieth century. The physicist's conception of space-time underwent two major upheavals thanks to the general theory of relativity and quantum mechanics. Both theories play a fundamental role in describing the same natural world, although at different scales. However, the inconsistency between them emerged clearly as the limitation of twentieth-century physics, so a more complete description of nature must encompass general relativity and quantum mechanics as well. The problem is a theorists' problem par excellence. Experiment provide little guide, and the inconsistency mentioned above (...) is an important problem which clearly illustrates the intermingling of philosophical, mathematical, and physical thought. In fact, in order to unify general relativity with quantum field theory, it seems necessary to invent a new mathematical framework which will generalise Riemannian geometry and therefore our present conception of space and space-time. Contemporary developments in theoretical physics suggest that another revolution may be in progress, through which a new kind of geometry may enter physics, and space-time itself can be reinterpreted as an approximate, derived concept. The main purpose of this article is to show the great significance of space-time geometry in predetermining the laws which are supposed to govern the behaviour of matter, and further to support the thesis that matter itself can be built from geometry, in the sense that particles of matter as well as the other forces of nature emerges in the same way that gravity emerges from geometry. Scientific research is not a process of steady accumulation of absolute truths, which has culminated in present theories, but rather a much more dynamic kind of process in which there are no final theoretical concepts valid in unlimited domains. The history and philosophy of science are destined to play a fundamental role in an epoch marked by a major scientific revolution. This ongoing revolution, principally affecting mathematics and physics, entails a profound upheaval of our conception of space, space–time, and, consequently, of natural laws themselves. Briefly, this revolution can be summarized by the following two trends: by the search for a unified theory of the four fundamental forces of nature, which are known, as of now, as gravity, electromagnetism, and (...) strong and weak nuclear forces; by the search for new mathematical concepts capable of elucidating and therefore explaining such a relationship. In fact, the first search is essentially dependent on the second; that is to say, that in order for a new theory of physics to come to light, the development of a deeper geometric theory capable of explaining the structure of space–time on a quantum scale appears to be necessary. On careful consideration, we notice that both of these developments converge in the direction of a unitary and fundamental tendency of modern science—which is the geometrization of theoretical physics and of natural sciences. This new emergent situation carries within it a profound conceptual change, affecting the way in which relations are conceived of, first and foremost, between mathematics and physics. This new paradigm can be summed up by the intimately interdependent points: the immense variety of physical phenomena and of natural forms follows from the equally infinite variety of geometric and topological objects that can be made out in space and from which space is made up; the second point, which ensues from the former one and which is of great historical and epistemological significance, is that mathematics is involved in rather than applied to phenomena. In other words, phenomena are effects that emerge from the geometrical structure of space–time. There is no doubt that this new conception of the relationship between the universe of mathematical ideas and objects and the world of natural phenomena is the true scientific revolution of our century, of great conceptual importance, and consequently, capable of changing our view of science and of nature at one and the same time. According to Kant, the axioms of intuition, i.e. space and time, must provide an organization of the sensory experience. However, this first orderliness of empirical sensations seems to depend on a kind of faculty pertaining to subjectivity, rather than to the encounter of these same intuitions with the real properties of phenomena. Starting from an analysis of some very significant developments in mathematical and theoretical physics in the last decades, in which intuition played an important role, we argue that nevertheless (...) intuition comes into play in a fundamentally different way to that which Kant had foreseen: in the form of a formal or “categorical” yet not sensible intuition. We show further that the statement that our space is mathematically three-dimensional and locally Euclidean by no means follows from a supposed a priori nature of the sensible or subjective space as Kant claimed. In fact, the three-dimensional space can bear many different geometrical and topological structures, as particularly the mathematical results of Milnor, Smale, Thurston and Donaldson demonstrated. On the other hand, it has been stressed that even the phenomenological or perceptual space, and especially the visual system, carries a very rich geometrical organization whose structure is essentially non-Euclidean. Finally, we argue that in order to grasp the meaning of abstract geometric objects, as n-dimensional spaces, connections on a manifold, fiber spaces, module spaces, knotted spaces and so forth, where sensible intuition is essentially lacking and where therefore another type of mathematical idealization intervenes, we need to develop a new form of intuition.
