Franchising in the business format sector accounted for approximately 35 percent of retail sales in the U.S. in 1991. Consequently, the franchising industry has a clear ethical responsibility to the public. At the same time, there exists an ethical obligation of the two major factors in the industry — the franchisor and the franchise — toward each other. Because the franchise agreement, which is the basis of the relationship, is originated by the franchisor, an asymmetrical distribution of power often exists, (...) resulting in opportunistic behavior by the franchisor. In other cases, questionable or unethical practices by franchisees likewise result in conflict. This paper examines some of the basic areas of the franchise relationship which result in conflict, and discusses the situation analysis in business format franchising, which shows promise for reduction of conflict and unethical behavior for the future. Eifersucht, Habgier, Ehrgeiz, Wetteifer, Geiz, etc., die Frage nach dem Wesen des Neides als einem reflexartigen und unkontrollierbaren Affekt, als einer dauerhaften und unbewussten Stimmung, als einem momentanen, intentionalen und bewussten Gefühl, (...) als einem selbst erzeugten Konstrukt aus Gedanken und Gefühlen, etc. und schließlich die Frage nach den Ursachen des Neides als einem gewissen Mangel an Selbstsein und als Folge einer langfristig scheiternden Selbstverwirklichung. -/- Der Neid wirft als Thema der philosophischen und psychologischen Reflexion aber auch verschiedene Fragen auf, die praktischer Natur sind. Diese Fragen gehören weitgehend in dem Umkreis der Probleme der philosophischen Lebenskunst. Zu den Fragen der philosophischen Lebenskunst, der ars vivendi, die als die wohl wichtigste menschliche Kunst auch die philosophische Kunst des Alterns und Sterbens, die ars moriendi umfasst, gehört einerseits das Problem der Abwehr der Neider durch die Beneideten und andererseits das Problem der Überwindung des Neides beim Neider selbst. In der Geschichte der europäischen Philosophie wurden seit der Antike vor allem immer wieder lebensphilosophische Ratschläge zur Bewältigung beider Probleme erteilt. Dabei standen jedoch die Ratschläge zur Abwehr der Neider im Vordergrund. Das kommt weitgehend daher, dass vor allem in der Antike, aber auch im Mittelalter und selbst noch in der Neuzeit diese Art von Literatur den Begüterten und Gebildeten diente, die auf Grund ihrer privilegierten sozialen Stellung im Großen und Ganzen eher ein Interesse an der Abwehr der Neider als an der Neidüberwindung hatten. Dennoch darf man nicht meinen, dass diese klassischen Autoren und ihre Leser selbst ganz ohne äußere und innere Anlässe für Neidgefühle und -gedanken gewesen wären. Deswegen darf man vermuten, dass auch die Scheu davor, sich selbst als einen gewohnheitsmäßig neidischen Menschen oder zumindest als einen Gelegenheitsneider zu präsentieren, dazu geführt haben mag, dass man sich aus einem gewissen Selbstschutz zurückgehalten hat, Überlegungen und Ratschläge zur Überwindung des eigenen Neides öffentlich zu äußern und zu erörtern. Was macht ExpertInnen aus? Was ist gute wissenschaftliche Praxis? Was bedeutet 'evidenzbasiert'? Welchen sozialen und globalen Einflüssen ist unser Wissenserwerb ausgesetzt? (...) In der Ausbildung von Philosophie- und Ethikstudierenden gibt es oft eine große Scheu, Disziplinen wie Erkenntnistheorie und Wissenschaftsphilosophie zu erlernen und zu unterrichten. Zu abstrakt und lebensweltlich irrelevant, sagen viele. Dieses Buch soll diese Berührungsängste beseitigen helfen, indem die theoretischen Grundlagen auf die Probleme der Gegenwart angewendet und mit vielseitigen Methoden erschlossen werden. The philosopher Max Scheler was born August 22, 1874, in Munich. His mother was of Jewish extraction, his father Lutheran. He became a member of the Roman Catholic Church early in his youth, probably because of its concept of love. He studied medicine and philosophy in Munich and Berlin, and received his doctorate at Jena University in 1899 where he began teaching from 1900 to 1906. He then joined the fledgling phenomenological movement but, in his own phenomenological researches, he remained (...) independent of it. Due to a divorce in 1910, the predominantly Catholic University of Munich discontinued his contract. He remarried in 1912, but remained without a university affiliation until 1919 when he was hired by the University of Cologne as professor of philosophy and director of the Institute of Sociology. During this period he produced an unusual amount of work, which quickly drew attention throughout Germany. In 1924 he married Maria Scheu, who, after his demise on May 19, 1928, was the devoted curator of thousands of posthumous manuscripts. Scheler's work was suppressed by the German Nazi regime. FORD SCHELLING, ALONGWITH FICHTE, has suffered the fate of being labelled one of tIegel's predecessors. Richard Kroner provides the classic expression of this viewpoint in his monumental study, Von Kant bis Hegel, which examines Schelling's thought primarily for its contribution to Hegel's final synthesis.I In English we have Josiah Royce's sympathetic and lively account of Schelling's early romantic exuberance, regarded as (...) a transitional stage in the development of German idealism. 2 But this emphasis on the early ScheUing has led to an unfortunate neglect of his work subsequent to the break with Hegel in 1807. Schelling's romanticism, so ably documented by E. D. Hirsch, Jr., 3 can only be regarded as one phase in the total sweep of his thought, for, after the break with Hegel, Schelling produced at least three major works: the essay •ber das Wesen der menschlichen Freiheit,4 wrestling with the problem of evil and human freedom, the fragmentary Weltalter, 5 which in scope and dialectical intricacy should be compared with Hegel's Logic, and the Philosophie der Mythologie und Offenbarung, 6 furnishing a fundamental critique of the whole dialectical enterprise. It does indeed go (...) some way towards supplying some of the materials that Adickes meant to supply, and it thus represents indeed a first step towards a better edition of Kant's works.
