Florentino Ameghino was probably the most important naturalist in nineteenth-century Argentina, being a self-taught palaeontologist, whose theories rivalled the most advanced of the time in Europe and the United States. On top of his vast palaeontological discoveries, Ameghino’s fame came from his theory of the origin of the human species in the Argentine Pampas, published in 1880. The idea of Ameghino’s followers was to create a place of secular pilgrimage for the new Argentine nation to honour their own (...) secular hero or saint, as Ingenieros had called him. A few accusations by the local Catholic Church were posed with Ameghino’s followers denying them. The education of the nation was one of the greatest concerns that Catholics had, and some saw in the positivist liberal position a rejection of the education on the virtues required for the building of a nationally educated society in Argentina for the twentieth century. -/- . This volume is a welcome, exciting, and unusually informative addition to what now seems a definite trend toward introducing Latin-American philosophers to the English-reading world. The preface contains a brief review of milestones in this development, which the interested reader will find handy as reference. The principal features common to post-revolutionary Latin-American intellectual history are very present in Lipp's examination of Argentine thought; namely, the dedication to some principle of activism, the search for an authentic national character, a national (...) ethos fashioned in the crucible of European traditions and the specific conditions confronting the new nations, the linkage of philosophy to the economic, social, and political conditions of the time and the rejection of abstract speculative philosophy as inconsistent with, and alien to, the needs of the struggling young societies. Lipp's chosen area is the study of twentieth-century Argentine intellectual development as seen through the prewar period of positivism, the postwar reaction against positivism, and the contemporary period. Each period is studied by examining the work of an outstanding Argentine philosopher: positivism and naturalism through Jose Ingenieros, the ethics of human freedom and personalism through Alejandro Korn, and transcendentalist anthropology through the works of Francisco Romero. There is something fresh and appealing in the philosophical expressions of these youthful, undeveloped, or under-developed societies which should find responsive echoes among student youth in this country. Ingenieros' book, The Mediocre Man, inspired generations of Latin-American students to revolt and reform the universities and their respective societies. Korn's strongly ethical views led him to sympathize openly with student revolt and to oppose the divorcing of philosophy from historic reality. Romero put his life where his philosophy was and went to jail for his opposition to Peron. Romero's dream of a humanized transformation of society and Korn's view of man as a "rebellious animal" who strives for human freedom through rebellion and creativity are but two sparks of the book's vitality that recommend it to the English-speaking reader.--H. This paper addresses the reception of Hegel’s philosophy in Argentina from an exploratory point of view. For this, it offers a preliminary state of the art in which the sources and materials for a study of this type are determined, and a periodization of the reception is proposed that includes the following periods: 1) from the 19th century to the Argentine University Reform of 1918, the time of Hegel’s indirect presence; 2) from 1918 to the First National Congress of (...) Philosophy in 1949, the true beginning of the reception of Hegel; 3) from 1949 to 1982/83, a period of dispute between the existentialist, Marxist, theological and Peronist interpretations of Hegel; and 4) from the democratic restoration to the present, when an institutional consolidation of Hegelian Studies is perceived in the country. As first conclusions, the federal character of the reception of Hegel’s philosophy and the two main moments of the institutionalization of Hegelian Studies in 1931 and 1983 stand out. The first one, in the context of the anti-positivist reaction and the vindication of German philosophy, and the second one, in the framework of the stabilization of academic activity due to the democratic transition. Three Chilean Thinkers, a companion piece to Three Argentine Thinkers, attempts to examine some of the outstanding characters of Chile's intellectual development by way of analyzing the contribution of three of her distinguished representatives. Each thinker or philosopher, whichever the case may be, is symbolic of a definite sociopolitical movement which left its unmistakable imprint upon the cultural scene. Moreover, each thinker, no doubt, was strongly influenced by European philosophical trends, but should in now way be considered a mere (...) imitator. It would be more accurate to say that they adapted these currents to their particular situation, utilizing the various component elements in order to explain or reform the Spanish American scene. Since each of the three represents a separate epoch, it was thought best to present them in chronological fashion in order to insure a measure of historical continuity. Thus, the first author treated is Francisco Bilbao, representative par excellence of the Romantic period. He is followed by Valentín Letelier, who can be said to have been one of the foremost exponents of what may well be considered as a reaction to Romanticism, namely, the Positivist era. Finally, Positivism, in turn, also produced a reaction in the form of the various idealistic tendencies which blossomed forth at the turn of the century--reaction to the dominant position exercised by evolutionism and scientism--represented in Chile by Enrique Molina. Coriolano Alberini was an outstanding philosopher of history in Argentina and a major influence on his country's philosophical thought. A keen student of Kant and Herder, a vigorous opponent of positivism, and a strong admirer of Bergson and Ortega y Gasset, Alberini's distinctive feature was an approach to history which stressed action over speculation. His passion was to promote the development of Argentina's national independence and a genuine national culture. The present volume of his writings was compiled and edited (...) posthumously. Logical positivism is often characterized as a set of naive doctrines on meaning, method, and metaphysics. In recent decades, however, historians have dismissed this view as a gross misinterpretation. This new scholarship raises a number of questions. When did the standard reading emerge? Why did it become so popular? And how could commentators have been so wrong? This essay reconstructs the history of a “caricature” and rejects the hypothesis that it was developed by ill-informed Anglophone scholars who failed to (...) appreciate the subtleties of European scientific philosophy. It argues that the received view has a more complicated history and was frequently promoted by the European positivists themselves. The essay shows that the view has roots in both American and European scientific philosophy and emerged as a result of the complex interplay between the two communities in the years before the intellectual migration. The aim of this paper is to analyze a selection of arguments used by the Argentine Supreme Court to reduce the sentence of individuals convicted of crimes against humanity. The focus will be primarily centered on “Muiña´s case”, in which a lenient outdated ruling was made. The questions that this work will try to answer revolve around the court´s merit in issuing this lenient ruling to Muiña´s case and its justification. First, Muiña´s case is analyzed in depth. Then, a (...) critical analysis about the ruling and a decision concerning the existence of a true justification will be developed. Finally, we will discuss the appropriateness of the Court’s decision in Muiña´s case as opposed to the decision made in “Batalla´s case”, in which a less beneficial law was applied retroactively. Legal positivists maintain that the legality of a rule is fundamentally determined by social facts. Yet for much of legal history, ordinary officials used legal terminology in ways that seem inconsistent with positivism. Judges regularly cited, analyzed, and predicated their decisions on the ‘laws of justice’ which they claimed had universal legal import. This practice, though well-documented by historians, has received surprisingly little philosophical attention; I argue that it invites explanation from positivists. After taxonomizing the positivist’s explanatory options, I (...) suggest that the most viable option appeals to conceptual change: classical Romans, early modern Europeans, founding-era Americans were not using ‘law’ (or ‘lex’ or ‘jus’) to refer to the subject matter of contemporary legal philosophy. But the strategy is costly. It renders positivism’s truth surprisingly parochial. And it supplies new reasons for doubting positivist accounts of contemporary practices, including the treatment of moral principles in modern adjudication. (shrink)

In the history of relations between the Argentinean government and the Holy See, two ideas are permanently intertwined: signing the Concordat and defending national patronage. The changes that occurred in the 1960s indicated that exercising the right of patronage, based on the principles outlined in the Constitution, was impossible, and the peaceful establishment of the principles of bilateral relations could only be indicated through an international agreement. The Concordat signed by Argentina in 1966 removed the national patronage, but the changes (...) to the content of the Constitution were introduced only in 1994. The aim of the study is to show the concordat agreement concluded in 1966 by Argentina with the Holy See as an example of an international agreement. The main focus is the presentation of concordat standards for the institution of patronage. Due to the subject and purpose of the study, the work uses methods typical of social sciences in the legal science discipline. The dogmatic-legal method is the basis for consideration of the Concordat as a source of Argentine law, and as an auxiliary method, the historical-legal method was used to show the historical background of the presented issue. Since its publication in 1982, _Beyond Positivism _has become established as one of the definitive statements on economic methodology. The book’s rejection of positivism and its advocacy of pluralism were to have a profound influence in the flowering of work methodology that has taken place in economics in the decade since its publication. The book contains the first systematic study of the ontology and metaphysics of Gustav Bergmann, tracing their development from early (1940s) criticisms of Carnap’s semantical theories in Introduction to Semantics, to their culmination in his 1992 _New Foundations of Ontology_. This involves a detailed study of the implicit metaphysical doctrines in Carnap’s important, but long neglected, 1942 book and their connection to his influential views on reference, truth and modality, (including, contrary to current opinion, Carnap’s initiating the development of predicate (...) modal logic) that culminated in _Meaning and Necessity_. In dealing with various fundamental issues in ontology and metaphysics, the book discusses relevant views of major philosophers, such as Russell, Moore, Bradley, Wittgenstein, Meinong, Brentano, Husserl, Broad, McTaggart, and Quine, and of contemporary and recent figures, including D. M. Armstrong, D. Lewis, S. Kripke, J. Searle, W. Sellars, D. Davidson, J. J. C. Smart, and H. Feigl. Building on the critical studies of Bergmann, Carnap and such other philosophers, the author argues for a form of Logical Realism derived from important, but long misunderstood and ignored, aspects of Russell’s theories of descriptions, reference and truth. It has become increasingly popular to argue that legal positivism is actually a normative theory, and that it cannot be purely descriptive and morally neutral as H.L.A. Hart has suggested. This article purports to disprove this line of thought. It argues that legal positivism is best understood as a descriptive, morally neutral, theory about the nature of law. The article distinguishes between five possible views about the relations between normative claims and legal positivism, arguing that some of (...) them are not at odds with Hart’s thesis about the nature of jurisprudence, while the others are wrong, both as expositions of legal positivism or as critiques of it. In Beyond Positivism, Behaviorism, and Neoinstitutionalism in Economics, Deirdre Nansen McCloskey zeroes in on the authoritarian cast of recent economics, arguing for a re-focusing on the liberated human. The behaviorist positivism fashionable in the field since the 1930s treats people from the outside. It yielded in Williamson and North a manipulative neoinstitutionalism. McCloskey argues that institutions as causes are mainly temporary and intermediate, not ultimate. They are human-made, depending on words, myth, ethics, ideology, history, identity, professionalism, gossip, movies, (...) what your mother taught you. Humans create conversations as they go, in the economy as in the rest of life. In engaging and erudite prose, McCloskey exhibits in detail the scientific failures of neoinstitutionalism. She proposes a "humanomics," an economics with the humans left in. Humanomics keeps theory, quantification, experiment, mathematics, econometrics, though insisting on more true rigor than is usual. It adds what can be learned about the economy from history, philosophy, literature, and all the sciences of humans. McCloskey reaffirms the durability of "market-tested innovation" against the imagined imperfections to be corrected by a perfect government. In this paper, we investigate how the life and work of Louis Rougier relate to the broader political dimension of logical empiricist philosophy. We focus on three practical projects of Rougier in the 1930s and 1940s: first, his attempts to integrate French-speaking philosophers into an international network of scientific philosophers by organizing two Unity of Science conferences in Paris; second, his role in the renewal of liberalism through the organization of the Walter Lippmann Colloquium; and third, his attempts at political (...) negotiations between Great Britain and the Vichy regime during the Second World War. These activities of Rougier in the 1930s and 1940s have so far never been discussed as part of a unified project on his part. Based on our investigations of these practical projects of Rougier, we argue that his relation to logical empiricist philosophers should primarily be understood on the level of action. His projects aimed to proliferate the concrete improvement of society and the lives of its citizens by expunging all metaphysical questions and speculations from the sphere of social discourse. In Unifying Biology, Smocovitis offers a series of claimsregarding the relationship between key actors in the synthesisperiod of evolutionary studies and positivism, especially claimsentailing Joseph Henry Woodger and the Unity of Science Movement.This commentary examines Woodger''s possible relevance to key synthesis actors and challenges Smocovitis'' arguments for theexplanatory relevance of logical positivism, and positivism moregenerally, to synthesis history. Under scrutiny, these arguments areshort on evidence and subject to substantial conceptual confusion.Though plausible, Smocovitis'' minimal interpretation – that somegeneralised (...) form of Comtean positivism had a role in synthesishistory – requires more of an evidential basis and must engageexisting scholarship on epistemic reforms in the biological sciencesprior to the synthesis period. Smocovitis is right to investigateepistemology in the synthesis period of evolutionary studies and tolook for links to wider changes in science and philosophy. This book is a compact, accessible treatment of the main ideas advanced by the positivists, including Schlick, Carnap, Ayer, and the early Wittgenstein. Oswald Hanfling discusses such ideas as the 'verification principle' ('the meaning of this statement is the method of its verification') and the 'elimination of metaphysics, ' an attempt to show that metaphysical statements, for example about God, are unverifiable and therefore meaningless.

Judging Positivism is a critical exploration of the method and substance of legal positivism. Margaret Martin is primarily concerned with the manner in which theorists who adopt the dominant positivist paradigm ask a limited set of questions and offer an equally limited set of answers, artificially circumscribing the field of legal philosophy in the process. The book focuses primarily but not exclusively on the writings of prominent legal positivist, Joseph Raz. Martin argues that Raz's theory has changed over (...) time and that these changes have led to deep inconsistencies and incoherencies in his account. Some philosophers argue that many contemporary debates in metaphysics are “illegitimate,” “shallow,” or “trivial,” and that “contemporary analytic metaphysics, a professional activity engaged in by some extremely intelligent and morally serious people, fails to qualify as part of the enlightened pursuit of objective truth, and should be discontinued” (Ladyman and Ross, Every thing must go: Metaphysics naturalized , 2007 ). Many of these critics are explicit about their sympathies with Rudolf Carnap and his circle, calling themselves ‘neo-positivists’ or ‘neo-Carnapians.’ Yet (...) despite the fact that one of the main conclusions of logical positivism was that metaphysical statements are meaningless, many of these neo-positivists are themselves engaged in metaphysical projects. This paper aims to clarify how we may see a neo-positivist metaphysics as proceeding in good faith, one that starts with serious engagement with the findings of science, particularly fundamental physics, but also has room for traditional, armchair methods. This book represents a serious and philosophically sophisticated guide to modern American legal theory, demonstrating that legal positivism has been a misunderstood and underappreciated perspective through most of twentieth-century American legal thought. Anthony Sebok traces the roots of positivism through the first half of the twentieth century, and rejects the view that one must adopt some version of natural law theory in order to recognize moral principles in the law. I distinguish several doctrines that economic methodologists have found attractive, all of which have a positivist flavour. One of these is the doctrine that preference assignments in economics are just shorthand descriptions of agents' choice behaviour. Although most of these doctrines are problematic, the latter doctrine about preference assignments is a respectable one, I argue. It doesn't entail any of the problematic doctrines, and indeed it is warranted independently of them.

Approaches to the “Indian Issue” which fail to go beyond the mere charting of evolutions in legal norms or the articulation between neoliberalism and multiculturalism do not allow us to take the full measure of indigenous policies, in terms of the goal set for the enlargement of the spaces for public interpellation and the reconfiguration of ideas and practices pertaining to citizenship. Starting from the Argentine experience, the aim of this article is to examine the question of the sedimentation (...) of neoliberal procedures, in a context marked by the will to re-appropriate national and popular sovereignty over territories and resources. The Indian question thus poses both the problem of the model of development that has been adopted and the question of the characterizing of the pleb (the category of the popular, or of those most underprivileged) as a part of the populus, that is, as part of the people of the nation, and therefore of the demos, understood as the space open to those who can legitimately give form and content to populus and who can put words on the world. Legal positivism and natural law theory have traditionally been construed as mutually exclusive theories about the relationship between morality and the law. Although I endorse a good deal of this traditional wisdom, I shall argue that we can and should construe LP and NL as complementary theories. So construed, they not only are compatible but also state important truths.
