Resumo: Este texto discute a hipótese de que a crise das democracias contemporâneas é indissociável de dois fenômenos políticos distintos, porém correlatos, analisados a partir das teorizações de Michel Foucault sobre a biopolítica e o neoliberalismo: a) a crescente disseminação de atos e discursos de violência, de ódio e de preconceito contra populações vulneráveis, obedecendo à lógica biopolítica da proteção da vida de alguns ao custo da exposição à morte de vastas parcelas da população; b) a disseminação de políticas neoliberais (...) para a gestão da vida de populações vulneráveis. Considera-se que a articulação entre biopolítica e neoliberalismo produz o paradoxo de uma democracia sem demos, no sentido da desvalorização das lutas políticas coletivas por direitos iguais e por melhores condições de vida. Na conclusão, sugere-se que a reinvenção da democracia exige repensar o poder do demos, isto é, repolitizar o poder político de categorias sociais sujeitas a processos históricos de vulneração. Democracy in crisis: biopolitics and neoliberal government of populations: This text discusses the hypothesis that the crisis of contemporary democracy relates to two distinct political phenomena, however correlated, analyzed thru Michel Foucault’s concepts about biopolitics and neoliberalism: a) the ascending dissemination of acts and discourses of hate, violence and prejudgment against vulnerable populations, according to the biopolitical logics of protecting the life of some at the expense of exposing the life of others to death; b) the dissemination of neoliberal policies to administrate the life of vulnerable populations. I argue that both phenomena seem to imply the paradox of a democracy without the demos, in the sense of the devaluation of collective political struggles for equal rights and for better life conditions. At the conclusion, it is suggested that the reinvention of democracy requires rethinking the power of the demos in the sense of re-politicizing the political power of social categories subjected to historical process that render them vulnerable. The end of the world is a seemingly interminable topic; at least, of course, until it happens. Environmental catastrophe and planetary apocalypse are subjects of enduring fascination and, as ethnographic studies show, human cultures have approached them in very different ways. Indeed, in the face of the growing perception of the dire effects of global warming, some of these visions have been given a new lease on life. Information and analyses concerning the human causes and the catastrophic consequences of the (...) planetary crisis have been accumulating at an ever-increasing rate, mobilising popular opinion as well as academic reflection. In this book, philosopher Deborah Danowski and anthropologist Eduardo Viveiros de Castro offer a bold overview and interpretation of these current discourses on the end of the world, reading them as thought experiments on the decline of the West's anthropological adventure; that is, as attempts, though not necessarily intentional ones, at inventing a mythology that is adequate to the present. This work has important implications for the future development of ecological practices and it will appeal to a broad audience interested in contemporary anthropology, philosophy, and environmentalism. We are going to analyse the issue of alterity in the philosophy of Miguel de Unamuno through the study of Abel Sánchez. In this nivola, Unamuno examines the concept of envy and establishes the bases of a theory of alterity based on the specular relationship with the other, which it is constituted by the scarcities of the one who looks. We will also look at what are the philosophical premises of this narration, in which way it is linked with (...) the organic philosophy of Unamuno, and what its relationship with the theatre piece El Otro is, released more than a decade after but of a quite similar subject. Finally, we will outline a possible theory of the alterity by Unamuno that it is formulated through the fraternity and altruistic help. (shrink)

This paper analyses the actual meaning of a transcendental philosophy of biology, and does so by exploring and actualising the epistemological and metaphysical value of Kant's viewpoint on living systems. It finds inspiration in the Kantian idea of living systems intrinsically resisting objectification, but critically departs from Kant's philosophical solution in as far as it is based in a subjectivist dogmatism. It attempts to overcome this dogmatism, on the one hand by explicitly taking into account the conditions of possibility at (...) the side of the subject, and on the other hand by embedding both the living and the knowing system into an ontology of complexly organized dynamical systems. This paper fits into the transcendental perspective in acknowledging the need to analyse the conditions of knowability, prior to the contents of what is known. But it also contributes to an expansion and an actualisation of the issue of transcendentality itself by considering the conditions of possibility at the side of the object as intrinsically linked to the conditions of possibility at the side of the subject. The purpose of this contribution is to analyse climate change litigation in an innovative way, considering it as an example of “privatisation” of international law, and unravelling the “ecological” side of conflict-of-laws climate change litigation. The paper will first explain the concept of privatisation of law as applied to international law and what it means in the context of climate change litigation, before moving to a landmark case, whose appeal is still pending in front of a domestic court in (...) Europe: Milieudefensie et al. v. Royal Dutch Shell plc. The focus of the analysis of the cases will be limited to the use of the conflict-of-laws mechanism present in the Rome II Regulation, namely Article 7. The paper critically assesses the principle of ubiquity included in this provision, by looking at the concept of “event giving rise to the damage” as applied in CO2 reduction claims in the existing legal scholarship and using an underexplored ecofeminist perspective. Inspired by the work “A relational feminist approach to conflict of laws” by Roxana Banu (2017), the paper argues for a relational understanding of the concept of “event” and goes further to consider in an ecofeminist perspective the environment as composed of human, non-human beings and natural objects, and of their relations with each other. The article is meant to be a starting point for further research, which for the first time applies ecofeminist theories to private international law. (shrink)

English Summary: This book focuses on how the Parmenides, one of the most mysterious Platonic dialogues, and more particularly the first hypothesis of the second part of the dialogue, was received and understood by the ancient writers claiming Plato. French Description: Ce livre se concentre sur la facon dont le Parmenide, un des dialogues platoniciens les plus mysterieux, et plus particulierement la premiere hypothese de la deuxieme partie du dialogue, a ete recu et compris par les auteurs antiques se reclamant (...) de Platon. Ce parcours historique a propos de la reception du Parmenide permet de mettre en evidence les presupposes exegetiques, parfois implicites, qui ont conduit a voir dans ce dialogue, tantot un exercice ou un traite logique, tantot une exposition d'une realite ontologique fondamentale, tantot la mise en evidence d'un principe transcendant et d'une theologie paienne systematique. L'etude des lectures antiques de la premiere hypothese du Parmenide presente en effet un triple interet, essentiel dans l'histoire de la philosophie occidentale, et que cet ouvrage analyse en detail : Un interet hermeneutique : l'etude ici presentee eclaire l'impense des lectures modernes de ce texte majeur. Un interet historique : l'auteur montre comment le Parmenide, loin d'etre un dialogue parmi d'autres, est le lieu ou s'est invente le neoplatonisme comme phenomene unitaire, construit autour de l'existence d'un principe radicalement transcendant, source de toute realite. This article will contribute to a synthetic understanding of the factors that influence the subject’s experience with digital data, in the presence of a new kind of ‘materiality’ that is formed in the confluence of physical matter and Information and Communication Technologies that I call Material-ict. The aim is to offer society a critical and creative way to deal with the process in which the electronic and physical dimensions of reality merge and enhance the awareness of the paradigm change that (...) the Internet of Things is bringing to our experience. The article can contribute to the development of a new cognitive paradigm to challenge the current view that objects and environments are inanimate, and the shaping of a framework from which to reconsider interactions between people, social processes, things and environments in the society of knowledge. This framework offers insights into educative, technological developments and cultural programmes to integrate actants (actor–network theory) and citizens in the hybrid experience in which Internet, social processes and matter merge. The objective is to construct the first steps of an analysis framework to understand a few of the most important features that support the emergent model of representation that is impacting the subject’s experience with digital data. In order to construct this framework, this research is grounded in the intersection of art, media and experience. The main dimensions analysed in the article are (1) the merging of digital and analogue forms of experience; (2) new actors and forms of interaction; (3) forms of heterogeneous knowledge construction; (4) lively interfaces and animated environments; and (5) biotechnological convergence. The article will show how the outcome of this confluence is taking shape in different forms of (1) indexation, (2) simulation, (3) translation of matter into data and (4) ubiquitous hybrid networks (social+matter/nature). ArgumentThis paper aims at contributing to the ongoing efforts to get a firmer grasp of the systematic significance of the entanglement of idealism and empiricism in Helmholtz's work. Contrary to existing analyses, however, the focal point of the present exposition is Helmholtz's attempt to articulate a psychological account of objectification. Helmholtz's motive, as well as his solution to the problem of the object are outlined, and interpreted against the background of his scientific practice on the one hand, and that of (...) empiricist and (transcendental) idealist analyses of experience on the other. The specifically psychological angle taken, not only prompts us to consider figures who have hitherto been treated as having only minor import for Helmholtz interpretation (most importantly J.S. Mill and J.G. Fichte), it furthermore sheds new light on some central tenets of the latter's psychological stance that have hitherto remained underappreciated. For one thing, this analysis reveals an explicit voluntarist tendency in Helmholtz's psychological theory. In conclusion, it is argued that the systematic significance of Helmholtz's empirico-transcendentalism with respect to questions of the mind is best understood as an attempt to found his empirical theory of perception in a second order, normative account of epistemic subjectivity. Earlier discussions by Hempel and others had branded scientific understanding a mere subjective state or feeling, one to be studied by psychologists perhaps, but not an important or fruitful focus for philosophers of science. Even as scientific explanation became a central topic in philosophy of science, little attention was given to understanding. Over the last decade, however, this situation has changed. Health care has become increasingly patient-centred and medical guidelines are considered to be one of the instruments that contribute towards making it so. We reviewed the literature to identify studies on this subject. Both normative and empirical studies were analysed. Many studies recommend active patient participation in the process of guideline development as the instrument to make guidelines more patient-centred. This is done on the assumption that active patient participation will enhance the quality of the guidelines. We found no empirical (...) evidence, however, to support this assumption. Moreover, the studies show that patients experience several difficulties in the participation process, which cannot solely be traced back to flawed practices. Given this poor track record we conclude that the plea to actively involve patients in the guideline development process should be reconsidered. (shrink)

This study investigates bath the relationship between evaluation of personality traits of party-leaders and party identification, and the evaluation of personality traits as a determinant of voting behaviour. One month before the Belgian national elections of November 81 201 voters evaluate personality traits of four welt known leaders of the main Flemish political parties.Factor analysis indicated three main dimensions in the evaluation of personality traits of politicians : reliability, expertness and self-control. The personality profiles of every party-leader were quite similar (...) when comparing the profiles of groups of subjects with different party preferences. However, subjects who identificated with a certain party rated the party-leader of this party more favorable on all personality traits than did subjects who identificated with another party. These discrepancies in favorableness were rather small for expertness and selfcontrol, but big for reliability and attractiveness. Analysing determinants of voting behaviour we differentiated four types of voters. Convinced voters were determined mainly by party preference and political views. Policyoriented and routine-voters taak into account in the first instance their political views and secondly their party preference. Personality traits of party-leaders functioned as the main determinant only for the voting behaviour of our indifferent subjects. Between these personality traits, mainly the evaluation of expertness had predictive power. (shrink)

Resumo: Por intermédio da análise dos gêneros carta e conto escritos por Machado de Assis, procuramos oferecer uma resposta à questão do horizonte ético e moral que opera nos textos do autor. Trabalhamos numa perspectiva interdisciplinar, pois dialogamos com filósofos, historiadores e críticos literários procurando, num primeiro momento, demonstrar que a noção de cuidado de si se mostra na correspondência machadiana a partir da perspectiva de cura de si, isto é, um tipo de sabedoria dos antigos gregos e romanos que (...) o autor lança mão para realizar e organizar o pensamento literário, seu e de seus pares, na direção das publicações e conquistas no âmbito da literatura. Num segundo momento, demonstramos que o cuidado de si terá outro sentido nos textos de ficção, pois se volta para um cuidado da alma no sentido do desenvolvimento do pensamento crítico do sujeito em relação ao eu e ao outro, ao indivíduo e ao mundo social. The care of the self as an ethical perspective in Machado de Assis Abstract : Through the analysis of the genres letter and short story written by Machado de Assis, we try to offer an answer to the question of the ethical and moral horizon that operates in the author's texts. We work in an interdisciplinary perspective, as we dialogue with philosophers, historians and literary critics, trying, in a first moment, to demonstrate that the notion of self-care is shown in Machado's correspondence from the perspective of self-cure, that is, a kind of wisdom from the ancient Greeks and Romans that the author uses to accomplish and organize the literary thought, his own and his peers', in the direction of publications and achievements in the field of literature. In a second moment, we demonstrate that the care of the self will have another meaning in fiction texts, since it turns to a care of the soul in the sense of the development of the subject's critical thought in relation to the self and to the other, to the individual and to the social world. Nous travaillons dans une perspective interdisciplinaire, car nous dialoguons avec des philosophes, des historiens et des critiques littéraires en essayant, dans un premier temps, de démontrer que la notion d'auto-soin apparaît dans la correspondance de Machado dans la perspective de l'auto-cure, c'est-à-dire une sorte de sagesse des anciens Grecs et Romains que l'auteur utilise pour accomplir et organiser la pensée littéraire, la sienne et celle de ses pairs, vers des publications et des conquêtes dans le domaine de la littérature. Dans un deuxième temps, nous démontrons que le souci de soi aura un autre sens dans les textes de fiction, car il se transforme en soin de l'âme au sens du développement de la pensée critique du sujet par rapport au moi et à l'autre, à l'individu et au monde social. This paper argues that lexical and operator-based analyses of distributivity are not in conflict, but are both necessary components of any theory of distributivity that aims to account for all the relevant data. I use several contrasts between plural definites and group NPs to show that we need an operator-based analysis of distributivity; this kind of distributivity is available with plural definites but not with group subjects, which can be explained under the common assumption that group NPs denote atoms rather (...) than sums and hence do not allow quantification over their individual parts. At the same time, we need a lexical theory of distributivity to account for the various distributive interpretations that we do find with groups; a formalisation of such a theory is outlined in the final section of this paper. This paper discusses the role of attention in the phenomenological analysis of intentional experience in light of the problem of the relation between consciousness, intentionality, and transcendental subjectivity. Are these concepts equivalent? Or should we rather say that there is more to intentionality (and subjectivity) than consciousness? Does subjectivity embrace an unconscious domain? And, if so, how does this unconscious, yet intentional, life of subjectivity operate and how is it related to consciousness? A series of experiments was performed in which subjects indicated whether two four-dot patterns were the same, although possibly viewed from different directions, or different, paired at random. Analyses of responses times and error rates suggest that the subjects' performance in this affine matching task is based on non-accidental properties such as convexity, parallelism, collinearity, and proximity, rather than on real affine invariants such as the ratio of triangular areas.

We investigated the influence of the compatibility between mood and decision strategies on the subjective value of a decision outcome. Several studies have provided evidence for the idea that a sad mood induces people to analyse information carefully, probably fitting well with a deliberative decision strategy. In a happy mood, people tend to act more strongly on their feelings, probably fitting well with an intuitive decision strategy. However, sometimes the situation demands the use of decision strategies that seem incompatible (...) with mood states. We expected that decision makers would value a decision outcome higher in the case of a fit between mood and decision strategy than in the case of a non-fit. After a mood manipulation, participants were instructed to decide either based on their first affective reaction or after deliberation. Results confirmed our expectations: fitting decisions enhanced the subjective value of a decision outcome. (shrink)

L’utilitarisme de Bentham transforme profondément la doctrine antérieure de la liberté de parole en la mettant au service de la recherche de la vérité et en réfléchissant à la portée du contrôle exercé par le gouvernement. Il préserve la distinction entre les affirmations portant sur des opinions et celles portant sur des faits et accorde aux premières une moindre protection. Comme l’avait fait son père James Mill, John Stuart Mill conserve cette distinction dans ses écrits de jeunesse mais ces analyses (...) souffrent de faiblesses logiques et de naïveté politique. Dans De la liberté, John Stuart Mill cherche à dépasser ces difficultés et propose une nouvelle défense de la liberté d’expression en tant que liberté de délibération. Contrairement à la plupart des interprétations, cet article démontre que cette nouvelle approche ne remet pas en cause la distinction fondamentale entre l’expression des opinions (qui sont protégées de façon absolue) et les affirmations portant sur des faits, qui ne sont protégées que de façon contingente, ce qui laisse ouverte la possibilité de restreindre l’expression d’affirmations fausses portant sur des faits. In those proverbs, Latin and French, we find the classical opposition between appearance and reality—between the accessory (the superficial, the beard, the clothing) and the essential (the profound, the philosopher, the monk), the latter being independent from and unchanged by the former. Berliner questions this dichotomy. As an anthropologist, he reviews many situations in which humans wear masks or use other techniques to cover their identities: cosplaying, puppy play, historical reenactments, (...) live-action role-playing, and the use of pseudonyms. Cosplayers, the subject of Berliner's first case study, impersonate characters from movies or video games. On the basis of lengthy interviews, he concludes that role-players change when they wear the costumes of their favorite heroes, behaving, for instance, with more self-confidence. A little psychological experiment not cited in this book suggests the same. In 2012, Hajo Adam and Adam Galinsky asked a group of students to perform a task demanding concentration. Those given a white medical coat to wear during the experiment performed better, probably because they were more prone to adopt traits and postures attributed to doctors—postures thought to enhance concentration. Berliner believes that, in the case of more immersive games, such changes are not necessarily temporary. They can persist after the acting is done. In other words, in some contexts at least, clothes can change the man.To impersonate a historical figure such as Napoleon, another case covered in Berliner's book, the reenactor must pay attention to minute details of the figure's life, habits, and social environment. The reenactor may then experience a moment de bascule, during which he is so much absorbed in his role that he forgets he is playing a character. As such, the activity of imitating is a way of learning some particular forms of paying attention to the individual serving as model. I regret that this aspect of disguise is not discussed when Berliner approaches animal role-playing. He affirms instead that identification with animals “rests upon our imagining what an animal is.” To imitate animals, however, we must first learn about, watch, and interact with them. Imitation is never fully based on the imagination; our imaginations are opened by prior, more or less proximate interactions with the beings that serve as models. It is far from easy to imagine, out of the blue, using our bodies in the ways that imitating animals requires.Despite the book's title, Becoming Other, Gilles Deleuze is barely mentioned in it, probably because he was very critical of the concept of imitation, which is omnipresent in Berliner's thought. Still, the way in which Berliner uses the concept is Deleuzian to a degree. Deleuze is skeptical of the concept of imitation because the success of an imitation is usually judged by whether the model and the imitation correspond in appearance—the imitation, in that case, does not bring any novelty to the world. In contrast to Deleuze, who proposes to abandon the concept of imitation, Berliner invites us to study it in new ways. Indeed, his book teaches us how creative imitation can be. What counts is not whether an imitation is successful but whether it is fruitful, and that we measure by whether it transforms us. The imitator does not become an alter ego of the model impersonated but a superego, an ego more aware of all its capacities. Even if it is never made explicit, the contrast between successful and fruitful—a contrast dear to Vinciane Despret—structures Berliner's analyses, which are a valuable contribution not only to anthropology but also to philosophy. Objective: To examine how research ethics boards review research projects in emerging disciplines such as functional neuroimaging.Design: To compare the criteria applied and the decisions reached by REBs that reviewed the same mock research protocol in functional neuroimaging.Participants: 44 Canadian biomedical REBs, mostly working in public university or hospital settings.Main measurements: The mock research protocol “The Neurobiology of Social Behavior” included several ethical issues operating at all three levels: personal, institutional and social. Data consisting of responses to closed questions were (...) analysed quantitatively. Qualitative analysis of open-question responses used mixed classification.Results: Similar criteria were used by most participating REBs. Yet the project was unconditionally approved by 3 REBs, approved conditionally by 10 and rejected by 30.Conclusions: The results point to the difficulty for REBs of reviewing all kinds of research projects, regardless of field, by relying on international and national norms framed in general terms and a possible variation between REBs in the interpretation of their mandate for the protection of research subjects. Utilitarianism may well be the most influential secular ethical theory in the world today. It is also one of the most controversial. It clashes, or is widely thought to clash, with many conventional moral views, and with human rights when they are seen as inviolable. Would it, for example, be right to torture a suspected terrorist in order to prevent an attack that could kill and injure a large number of innocent people? In this Very Short Introduction Peter Singer and (...) Katarzyna de Lazari-Radek provide an authoritative account of the nature of utilitarianism, from its nineteenth-century origins, to its justification and its varieties. Considering how utilitarians can respond to objections that are often regarded as devastating, they explore the utilitarian answer to the question of whether torture can ever be justified. They also discuss what it is that utilitarians should seek to maximize, paying special attention to the classical utilitarian view that only pleasure or happiness is of intrinsic value. Singer and de Lazari-Radek conclude by analysing the continuing importance of utilitarianism in the world, indicating how it is a force for new thinking on contemporary moral challenges like global poverty, the treatment of animals, climate change, reducing the risk of human extinction, end-of-life decisions for terminally-ill patients, and the shift towards assessing the success of government policies in terms of their impact on happiness. Max Stirner has often been considered a Young Hegelian, or even the 'last Hegelian'. Such a reading implies that Stirner drew the logical conclusions of Hegel’s philosophy, thereby ignoring the way his thought marks a fundamental break with the philosophical tradition as a whole. Stirner’s notions of 'egoism', 'ownness' and 'Der Einzige' ('the ego') were not philosophical concepts but, in a Foucauldian sense, tools to dismantle the subject-object dichotomy and its social and political bearings in the wake of modernity. It (...) is argued, furthermore, that his ideas cannot be reduced to a traditional philosophy of the subject (existentialism). This chapter analyses both Stirner’s quest to 'dissolve' philosophy, as well as its radical implications for political theory as a whole. Stirner’s notion of Der Einzige not only questions the revolutionary subject in a strictly Marxist sense, but eventually any form of (political) subjectivity. Stirner’s radical criticism of the emancipatory claims of his contemporaries allows us to question and rethink the concepts of contemporary social and political theory, not only by criticizing the way political power is commonly conceived and by refraining from positing essentialist guarantees, but also by laying bare the problem of political subjectivity. Background: The banking of biological samples raises a number of ethical issues in relation to the storage,export and re-use of samples. Whilst there is a growing body of literature exploringparticipant perspectives in North America and Europe, hardly any studies have been reportedin Africa. This is problematic in particular in light of the growing amount of research takingplace in Africa, and with the rise of biobanking practices also on the African continent. Inorder to investigate the perspectives of African research participants, we (...) conducted a studywith research participants in a TB study in the Western Cape, South Africa. Methods: Semi-structured interviews were conducted using an interview guide which drew on the mostprominent themes expressed in current literature on sample storage, re-use and exportation.Interviews were conducted in Afrikaans and subsequently translated into English by the sameinterviewer. Interviews were transcribed verbatim and analysed qualitatively. Results: The results of our study indicate that the majority of participants were supportive of givingone-time consent to the storage and re-use of their samples. The concept of research being fora "good cause" was a central prerequisite. Additionally, a significant minority requested thatthey be re-contacted if a future use was not stipulated on the original consent. There was alsoconsiderable variation in how participants understood the concept of a 'good cause', withparticipants describing three distinct categories of research, of which two were generallythought to constitute 'good cause' research. Research that was for-profit was considered tofall outside the spectrum of 'good cause' research. Participants displayed confidence in theabilities of the researchers to make future decisions regarding sample use, but seemedunaware of the role of ethics committees in either this process or more generally. Conclusions: Participants expressed a wide and complex range of views about issues of sample storage andre-use, and they showed a great deal of trust in researchers. Participants' willingness to havetheir samples stored and re-used is consistent with findings from existing studies. However,in contrast to existing literature, participants were generally not in favour of for-profitresearch. Further research needs to be done to explore these ideas in other communities, bothin South Africa and other countries. (shrink)

In Logique du Fantasme, Lacan argues that the compulsion to repeat does not obey the same discharge logic as homeostatic processes. Repetition installs a realm that is categorically different from the one related to homeostatic pleasure seeking, a properly subjective one, one in which the mark “stands for,” “takes the place of,” what we have ventured to call “an event,” and what only in the movement of return, in what Lacan calls a “thinking of repetition,” confirms and ever reconfirms this (...) point of no return, which is also a qualitative cut and a structural loss. The kind of “standing for” Lacan intends here with the concept of repetition is certainly not something like an image or a faithful description. No, what Lacan wishes to stress is that this mark is situated at another level, at another place, it is “entstellt,” and as such, it is punctually impinging upon the bodily dynamics without rendering the event, without having an external meta-point of view, but cutting across registers according to a logics that is not the homeostatic memory logics. This paper elaborates on this distinction on the basis of a confrontation with what Freud says about the pleasure principle and its beyond in Beyond the Pleasure Principle, and also takes inspiration from Freud’s Project for a Scientific Psychology. We argue that Lacan’s theory of enjoyment takes up and generalizes what Freud was after in Beyond the Pleasure Principle with the Wiederholungszwang, and pushes Freud’s thoughts to a more articulated point: to the point where a subject is considered to speak only when it has allowed the other, through discourse, to have impacted and cut into his bodily pleasure dynamics. The Vrolik ethnographical collection consisted of roughly 300 skulls, mummified heads, skeletons, pelvises, wet-preserved preparations, and plaster models, collected by Gerard Vrolik (1775–1859) and his son Willem (1801–1863). Most prominent in this collection were the skulls, of which 177 remain in the collection of present-day Museum Vrolik. These skulls—a troubling heritage of colonialism and scientific racism—are the central subjects of this paper, which considers the changing meanings and values of these skulls for racial science over approximately 160 years, between ± (...) 1800 and 1960. These shifting meanings are analysed using the skulls themselves as primary sources, including the labels, numbers and handwriting present on them or their stands. Central topics addressed will be matters of classification, hierarchy, scientific bias, and disciplinary development of racial anthropology from the study and collection of idealized national types to a quantitative craniometry of populations. This paper demonstrates that during 160 years of study of this same set of crania, the skulls of white European origin gradually lost racial relevance and were increasingly normalized, whereas the skulls of dark-skinned people of African descent continued to be categorized in a typological racial scheme and as such were increasingly othered. The financial crisis that currently besets Europe not only disturbs the life of many citizens, but also affects our economic, political and philosophical theories. Clearly, many of the contributing causes, such as the wide availability of cheap credit after the introduction of the euro, are contingent. Analyses that aim to move beyond such contingent factors tend to highlight the disruptive effects of the neoliberal conception of the market that has become increasingly dominant over the last few decades. Yet while the (...) financial sector has received most of the blame, and rightly so, few commentators seem willing to take into account the role played by representative democracy in its current form. Even if it is granted that actual democratic policies fall short of what they ought to achieve, contemporary representative democracy itself is seldom regarded as part of the tangle it was supposed to resolve. David Merill touches upon this issue when he notes, in the preceding issue of thisBulletin, that ‘the economic dilemmas faced today may be ultimately the consequences of state failure’. The state that has failed to regulate the markets is described as ‘weak’ and ‘subject to external blows, blind to its ends, merely one actor among many in the events of the day’ (Merill 2012: 28). Yet Merill does not seem to consider this weakness to be an inherent feature of the constellation of which contemporary democracy is a part.There are, of course, excellent reasons not to take this path. First, representative democracy has in many cases proved to be the best way of preventing small elites from acquiring political power, and many of the impressive social and political achievements of the twentieth century are the result of democratic processes. The aim of the article is to discuss Jasmila Žbanić’s Esma’s Secret, On the Path and For Those Who Can Tell No Tales as a trilogy addressing the consequences of Bosnian War. The films are considered in the theoretical framework of women’s cinema as world cinema, exploring their location in relation to globalization. The article hence analyses each film’s aesthetic in light of influential feminist concepts and theories such as Rey Chow’s age of the world target, Adriana Cavarero’s horrorism and (...) caring, E Ann Kaplan’s trauma and Judith Butler’s ethics. In these films the violated body is neither victimized nor considered as a natural being: each character is a biopolitical subject, geo-culturally located, and produced through processes originating from dynamics of power and responsibility, guilt and care. Milgram’s series of obedience experiments and Zimbardo’s Stanford Prison Experiment are probably the two best-known psychological studies. As such, they can be understood as central to the broad process of psychologization in the postwar era. This article will consider the extent to which this process of psychologization can be understood as a simple overflow from the discipline of psychology to wider society or whether, in fact, this process is actually inextricably connected to the science of psychology as such. In so (...) doing, the article will argue that Milgram’s and Zimbardo’s studies are best usefully understood as twin experiments. Milgram’s paradigm of a psychology which explicitly draws its subject into the frame of its own discourse can be said to be the precondition of Zimbardo’s claim that his experiment offers a window onto the crucible of human behaviour. This will be analysed by drawing on the Lacanian concepts of acting out and passage à l’acte. The question then posed is: if both Milgram and Zimbardo claim that their work has emancipatory dimensions — a claim maintained within mainstream psychology — does a close reading of the studies not then reveal that psychology is, rather, the royal road to occurrences such as Guantanamo and Abu Ghraib? The drama of a psychology which is fundamentally based on a process of psychologization is that it turns its subjects into homo sacer of psychological discourse. (shrink)

The article investigates the potential of mysticism to revitalise theology. It firstly traces how aesthetics was understood in theology and provides reasons for this view. It then investigates how the predominant epistemological approach in theology privileged conceptual knowledge and relativised aesthetics as being subjective and therefore unreliable. It gives special attention to this epistemology by spelling out how the intellectualisation of contemporary theology intensified the process of obfuscating and sidelining aesthetics. In a third part, the article spells out the consequences (...) of this position by analysing how theology is becoming a disenchanted enterprise. The article then investigates how aesthetics often is taking over the role of theology and its formative role in social discourse. It focuses on the epistemological nature of this turn towards aesthetics, arguing that aesthetics with its profound notion of beauty, is increasingly reappraised as a legitimate, but different kind and source of knowledge. The article then argues how aesthetics can reinvigorate theology as a source of knowledge together with conceptual knowledge. It ends by investigating how theology can be re-enchanted by learning from the prominent role and invigorating forms of aesthetics in mysticism. (shrink)

The combination of student Self-Regulation (SR) and the context of Regulatory Teaching (RT), each in varying degree, has recently been demonstrated to have effects on achievement emotions, factors and symptoms of stress, and coping strategies. The aim of the present research study is to verify its possible further effects, on academic behavioral confidence and procrastination. A total of 1193 university students completed validated online questionnaires with regard to specific subjects in their degree program. Using an ex post facto design, multivariate (...) analyses and structural equation modeling (SEM) were carried out in order to test the relationships predicted by the model. SR and RT had a significant joint effect in determining the degree of academic behavioral confidence and of procrastination. Academic behavioral confidence also significantly predicted reasons for procrastinating, and these in turn predicted activities of procrastination. Conclusions are discussed, insisting on the combined weight of the two variables in determining academic behavioral confidence, reasons for procrastinating and activities subject to procrastination, in university students. Implications for guidance and educational support of university students and teachers are analyzed. (shrink)

Charles Peirce (1839-1914) est aujourd'hui considéré comme l'une des figures majeures de l'histoire de la philosophie. De plus en plus étudiée de par le monde, sa pensée se révèle profondément subtile, féconde et contemporaine. Philosophes, linguistes, psychologues, scientifiques de tous bords, nombreux sont les chercheurs qui trouvent chez le père du pragmatisme une source abondante d'idées neuves. C'est en 1867 que Peirce écrivit le texte inaugural de son œuvre, On a New List of Catégories. Texte dense et d'un abord difficile, (...) cet essai renouvelle l'ancienne recherche des premiers éléments de la pensée, apportant à cette quête fondamentale, menée précédemment par Aristote et Kant, une solution solidement ancrée dans la logique qui préside à chacune de nos représentations. Quels sont les éléments (les catégories universelles) qui constituent l'acte de représentation? La « Nouvelle liste » propose une réponse qui pour Peirce est à la fois l'aboutissement des dix premières années de son enquête philosophique (1867-1867) et le fondement de toute sa réflexion ultérieure. Le présent ouvrage s'efforce de reconstituer pas à pas cette recherche en offrant une analyse serrée de chacun des paragraphes de la « Nouvelle liste » ainsi que de très nombreux textes antérieurs souvent inédits et traduits ici pour la première fois. In view of the incompatibility between scientific and manifest image one can either consider the scientific world as true and the sensuous world as merely subjective or consider the latter as true and the former as a subjective construction. Sellars holds the first position, namely scientific realism. By relying on Husserl, who holds the second position, I try to show that the first position has absurd consequences and is idealistic. For the measure of all things is not science, but perception.

At first glance, one of the most obvious places to look for moral progress is in individuals, in particular in moral development from childhood to adulthood. In fact, that moral progress is possible is a foundational assumption of moral education. Beyond the general agreement that moral progress is not only possible but even a common feature of human development things become blurry, however. For what do we mean by ‘progress’? And what constitutes moral progress? Does the idea of individual moral (...) progress presuppose a predetermined end or goal of moral education and development, or not? In this article we analyze the concept of moral progress to shed light on the psychology of moral development and vice versa; these analyses are found to be mutually supportive. We suggest that: moral progress should be conceived of as development that is evaluated positively on the basis of relatively stable moral criteria that are the fruit and the subject of an ongoing conversation; moral progress does not imply the idea of an end-state; individual moral progress is best conceived of as the development of various components of moral functioning and their robust integration in a person’s identity; both children and adults can progress morally - even though we would probably not speak in terms of progress in the case of children - but adults’ moral progress is both more hard-won and to a greater extent a personal project rather than a collective effort. There are those who believe that modern society's reliance upon law, politics and science to both regulate and emancipate society has reached a crisis point and can no longer provide answers to current social problems. Toward a New Legal Common Sense engages in a series of sociological analyses of law in order to illustrate the need for a profound theoretical reconstruction of the notion of legality based on locality, nationality and globality. In this way the author shows how developments including (...) suprastate organisations such as the European Union and international human rights law can be given their proper place in the sociology of law, and suggests a new set of social structures that might sustain the emancipatory elements that have disappeared from modern society. La philosophie analytique contemporaine reste confinée à quelques attitudes paradigmatiques: croyance, savoir, désir et intention. Comment élaborer une théorie plus générale des attitudes? Descartes dans Les passions de l’âme analyse les attitudes en termes de croyances et de désirs. Selon mon analyse, les modes psychologiques ont d’autres composantes que leur catégorie de base cartésienne de cognition ou de volition. Les modes d’attitudes comme l’attente, le savoir et l’intention ont une façon propre de croire ou de désirer, des conditions (...) propres sur leur contenu propositionnel ou des conditions préparatoires particulières. Grâce à pareilles composantes je définirai récursivement l’ensemble de tous les modes psycho­logiques possibles d’attitudes propositionnelles. Comme Descartes l’avait anticipé, les deux modes de croyance et de désir sont primitifs. Les autres modes plus complexes sont obtenus en leur ajoutant des composantes nouvelles. De par leur nature, les attitudes, qui sont dirigées vers des objets et faits du monde, ont des conditions de possession et de satisfaction. Les croyances sont satisfaites quand elles sont vraies et les désirs quand ils sont réalisés. Quiconque possède une attitude est dans un certain état mental: il représente comment les choses doivent être dans le monde pour que son attitude soit satisfaite. Le but principal de cet article est d’analyser systématiquement les conditions de possession et de satisfaction des diffé­rences espèces d’attitudes individuelles des agents humains, qu’il s’agisse des attitudes propositionnelles, des sommes d’attitudes comme le doute, des dénégations d’attitudes comme le mécontentement et des attitudes conditionnelles comme l’intention de vendre en cas d’offre inté­ressante. J’utiliserai les ressources d’une théorie de la vérité selon la prédi­cation qui distingue les propositions ayant les mêmes conditions de vérité mais différentes valeurs cognitives. Je traiterai logiquement des possibilités aussi bien subjectives qu’objectives afin d’expliquer pourquoi les agents hu­mains qui sont parfois incohérents restent toujours minima­lement rationnels. Algorithmic decision-making based on profiling may significantly affect people’s destinies. As a rule, however, explanations for such decisions are lacking. What are the chances for a “right to explanation” to be realized soon? After an exploration of the regulatory efforts that are currently pushing for such a right it is concluded that, at the moment, the GDPR stands out as the main force to be reckoned with. In cases of profiling, data subjects are granted the right to receive meaningful information (...) about the functionality of the system in use; for fully automated profiling decisions even an explanation has to be given. However, the trade secrets and intellectual property rights (IPRs) involved must be respected as well. These conflicting rights must be balanced against each other; what will be the outcome? Looking back to 1995, when a similar kind of balancing had been decreed in Europe concerning the right of access (DPD), Wachter et al. (2017) find that according to judicial opinion only generalities of the algorithm had to be disclosed, not specific details. This hardly augurs well for a future right of access let alone to explanation. Thereupon the landscape of IPRs for machine learning (ML) is analysed. Spurred by new USPTO guidelines that clarify when inventions are eligible to be patented, the number of patent applications in the US related to ML in general, and to “predictive analytics” in particular, has soared since 2010—and Europe has followed. I conjecture that in such a climate of intensified protection of intellectual property, companies may legitimately claim that the more their application combines several ML assets that, in addition, are useful in multiple sectors, the more value is at stake when confronted with a call for explanation by data subjects. Consequently, the right to explanation may be severely crippled. (shrink)
