This book presents the first accessible analysis of Spinoza's Tractatus Theologico-politicus, situating the work in the context of Spinoza’s general philosophy and its 17th-century historical background. According to Spinoza it is impossible for a being to be infinitely perfect and to have a legislative will. This idea, demonstrated in the Ethics, is presupposed and further elaborated in the Tractatus Theologico-politicus. It implies not only that on the level of truth all revealed religion is false, but also that all (...) authority is of human origin and that all obedience is rooted in a political structure. The consequences for authority as it is used in a religious context are explored: the authority of Scripture, the authority of particular interpretations of Scripture, and the authority of the Church. There are several reasons that have contributed to the neglect of the Treatise as a classic of modern democratic theory. In the first place, Spinoza's political theory is buried three quarters of the way through the Treatise and comes to light only after the reader has slogged through a long and painstaking discussion of biblical philology and criticism. Second, Spinoza's defense of democracy is undergirded by a naturalistic metaphysics that is more immoralist than Hobbes and scarcely to (...) the taste of most modern readers. And third, Spinoza remained wedded to certain premodern notions about the difference between the intellectuals and the vulgar which, it is believed, undercut his democratic commitments. (shrink)

Its main goal was to claim that the freedom of philosophizing can be allowed in a free republic and that it cannot be abolished without also destroying the peace and piety of that republic. Kant’s discussion of the highest good is subject to continuous disagreement between the proponents of two interpretations of this concept. According to the secular interpretation, Kant conceived of the highest good as a political ideal which can be realized through human agency alone, albeit only from the Critique of the Power of Judgement onwards. By way of contrast, proponents of the theological interpretation find Kant’s treatment of the highest good in his later works to be wholly coherent with the (...) discussions of this concept found in the second Critique. In their view, however, Kant never conceived of the highest good as a political ideal, and some go as far as to argue that it is the work of God alone. This book is the first detailed reconstruction of the late work of John Rawls, who was perhaps the most influential philosopher of the twentieth century. Rawls's 1971 treatise, A Theory of Justice, stimulated an outpouring of commentary on 'justice-as-fairness,' his conception of justice for an ideal, self-contained, modern political society. Most of that commentary took Rawls to be defending welfare-state capitalism as found in Western Europe and the United States. Far less attention has been given to Rawls's 2001 (...) book, Justice as Fairness: A Restatement. In the Restatement, Rawls not only substantially reformulates the 'original position' argument for the two principles of justice-as-fairness but also repudiates capitalist regimes as possible embodiments. When Benjamin Franklin suggested that man is by nature a tool-making animal, he summed up what was for his fellow Americans the common sense of the matter. It is not, then, surprising that, when Britain's colonists in North America broke with the mother country over the issue of an unrepresentative parliament's right to tax and govern the colonies, they defended their right to the property they owned on the ground that it was in a most thorough-going sense an extension of (...) themselves: the fruits of their own labor. This understanding they learned from John Locke, who based the argument of his Two Treatises of Government on the unorthodox account of providence and of man's place within the natural world that Sir Francis Bacon had been the first to articulate. The first complete English translation of Spinoza's Tractatus theologico-politicus was published anonymously in London in 1689 under the title A treatise partly theological and partly political, though prior to it Charles Blount had incorporated a liberal translation of chapter 6 of the Tractatus in his Miracles no violations of the laws of nature. The language employed in the 1689 translation suggested a decidedly political intention for the work and thus certain liberties were taken with the text. (...) Since that time there have been translations of passages or chapters from the Tractatus into English. Most recently, A. G. Wernham has translated and edited selections from the Tractatus theologico-politicus and Tractatus politicus in The Political Works of Spinoza. Still, the standard source for English language readers of Spinoza has been R. H. M. Elwes's two-volume translation of The Works of Spinoza, published originally in 1883 and reprinted without emendations in 1951. His translation, however useful, is far from adequate and the appearance of Samuel Shirley's translation of Spinoza's Tractatus is most welcome. (shrink)

I argue that in the seven “dogmas of the universal faith,” which are introduced in chapter XIV of the Theological-Political Treatise, Spinoza reinterprets the traditional view of a minimal credo required for salvation. The dogmas are dialectical propositions that are true insofar as they are practically useful. Instead of obtaining salvation for the soul, the dogmas aid in the preservation of the body, particularly through the regulation of religion within the state. I show that reading the dogmas in (...) light of Spinoza’s method of interpreting Scripture is crucial to the understanding of their function in religion. In conclusion, I claim that the dogmas do not lead to the abolition of traditional religion, as some have claimed, but rather support the toleration of diverse religious practices. (shrink)

Three times between 1640 and 1651, once at considerable length, Hobbes used and accepted, and then mocked, repudiated and discarded, the ancient/medieval term recta ratio/right reason. These repeated fluctuations in his thinking and rhetorical strategy occurred during the writing of his three major treatises on moral and political theory, one additional note on the term in De Cive, and an unpublished commentary on Thomas White's De Mundo. They are made obvious by his substitution of recta ratio for reason or (...) natural reason when recycling passages from Elements of the Law for use in De Cive, and by his subsequent reversal of that substitution when revising other passages in De Cive for use in Leviathan. Despite incorporating recta ratio as a structural element in De Cive, he finally reverted in Leviathan to regarding the term as a deceptive verbal construct, non-existent in rerum natura, and ridiculing its users and proponents. Right reason carried connotations linked to it in antiquity and in the Middle Ages, and Hobbes's reversals in his view and use of it, and his final dismissal of it, provide further evidence and justification for the now familiar modern claim that he was a herald of modernity. This essay is an explication and analysis of the work of Sergei Kotliarevskii, a major Russian liberal theorist, focusing on his 1915 treatise Vlast’ i pravo. Problema pravovogo gosudarstva (Power and Law: The Problem of the Lawful State). Although the “lawful state” has long been a subject of interest and controversy (even at the definitional level) among historians and political scientists, curiously Kotliarevskii has not received the attention he deserves. His study of the concept of the lawful state, (...) which for him was integrally related to the ideal of the rule of law, is an important Russian contribution to the history and philosophy of law and the state. This essay explores the philosophical sources and contexts of his work; his understanding of the relationship among power, law, and thestate; his thesis that religious ideas and institutions were most important in the historical development of legal consciousness; his consideration of the modern constitutional state; and his conviction that personhood—the absolute value and dignity of the human person—was the ultimate justification for the rule of law.
