An important contribution of Alan Patten’s Equal Recognition is the conception of neutrality that grounds his defence of minority cultural rights. Built in to his conception of neutrality of treatment is a notion of ‘fairness’ whose effect is to provide an upfront, across the board limitation on the demands cultural minorities may legitimately make on the rest of society. There must be limits on the duty to accommodate, but it obscures more than it illuminates to build this into the content (...) of the right to equal recognition itself. We see more clearly what is at stake in these conflicts by articulating the value of self-determination independently and taking account of necessary limits to its satisfaction as part of a second-stage analysis of what duties may be claimed and against whom. Familiar principles of discrimination law exemplify this alternative model. This presents the interest in self-determination more robustly, while acknowledging that the claims of duty arising out of it are defeasible. The result is a more flexible and nuanced exploration of the complex moral issues involved when fundamental interests clash. (shrink)

This article examines the personal values and private motivations of legal practitioners who engage in the provision of legal services pro bono publico. It analyses the results of a 2014 empirical study of lawyers in Queensland, Australia, who regularly undertake pro bono work. The findings suggest strong moral and professional motivations for engaging in pro bono legal practice, as well as a distinct ‘community of practice’ of large law firms in forming and sharing sophisticated structures and approaches to addressing social (...) justice needs. However, the study also revealed a range of potential drawbacks arising from the dominance of the large law firm sector in this field. In addition, respondents from small firms and sole practitioners indicated the many ways in which they are excluded from the pro bono community. The article draws on US scholarship which urges us to think about the ‘content and impact’ of pro bono work to achieve real outcomes and to address the widening gap in provision of legal assistance created by decreasing government funding. We conclude that a particular sensitivity to the context of practice is needed in our conception of pro bono practice. (shrink)

An idea is a public good. The use of an idea by one person does not hinder others to benefit from the same idea. However in order to generate new life-saving ideas, e.g. inventions in the life sciences, a huge amount of human and material resources are needed. Powerful, but highly criticized tools to speed up the rate of innovation are exclusive rights, most prominently the use of patents and plant breeders’ rights. Exclusive rights leave by nature a number of (...) people empty-handed, with starvation, stuntedness, prevalence of disease and death as preventable and quotidian consequences. To stimulate a human rights compatible use of exclusive rights a wide range of moral frameworks have been developed to condemn current praxes. Most prominent in the debate are theories building on (1) utilitarian calculations of weighing benefits with Peter Singer as a prominent advocate, (2) Pogge’s vindication of compensatory duties for institutional harms, (3) a comprehensive analysis on how the current innovation incentive system fails to secure human rights and human capabilities and lastly (4) showing how the status quo nurtures misrecognition. With help of those theories modest targets as well as a thorough restructure of the innovation incentive system can be justified. Those theories have the mammoth task of restraining well-established ideas supporting the permissibility of a reckless use of property rights that are deeply anchored in the property law discourse. Life sciences raise a range of special problems when justifying pro-poor innovation. Healthy people living in a society with a good sanitary infrastructure need far less resources to tackle health problems than people in places with a poor infrastructure. Patents that involve gene sequences (or part thereof) make inventing around impossible, making the seeking of licenses mandatory for investigators wanting to make follow-up research with the molecule. Speedy sharing of data concerning public health hazards or threats to food security are vital to maintain living standards. (shrink)

In their recent article, Porsdam Mann et al propose to share biomedical research data more widely, securely and efficiently using blockchain technologies. 1 They present compelling arguments for how the blockchain presents both a technological innovation, and a deontologically grounded policy innovation to traditional research consent. Their proposal can be read in conversation with a rich body of evidence to suggest current consent processes are problematic on at least one of tripartite bases in biomedical research: that it be fully (...) informed. This response attempts to further the author’s discussion of social justice discourse in, and of their proposed prosent model to enhance engagement among under-represented and vulnerable populations in research, specifically. Motivating this response is the view that advancing technological capabilities is no doubt necessary, but on its own insufficient to reinvigorate distributive, procedural and social justice as guiding principles for con/prosent processes. I offer three pros and cons to consider in effort to deepen the model’s commitments to social justice to historically marginalised groups in the biomedical research enterprise. (shrink)

Alan Hazen has claimed that Buridan’s theory of truth does not escape semantic paradox.In this paper, I claim that Buridan's theory is untouched by Hazen's case.My solution to Hazen's paradox requires the recognition of the exceptionability of what I shall call T-Elimination, namely, the principle that from a statement that such and such is true, we may deduce such and such. The exceptions are explained by reference to the role of what I shall call the meta-content of a locution, that (...) is, that information conveyed by any locution that tells us what sort of a locution it is intended to be. The exceptionability of T-Elimination turns out to be shared by other well-accepted principles of deduction also—and for the same reasons. (shrink)

Based on ethnographic fieldwork with panhandlers who provide services while asking for money, informal interviews with pedestrians who have interacted with them, and formal interviews with twenty people who regularly interact with panhandlers, this article unpacks the relationship between temporality and ambiguity of meaning in exchange. In line with previous research, I find that providing a service while asking for money allows panhandlers to manage stigma by recasting their relationship with pedestrians who give as a market exchange. More surprisingly, I (...) find that this kind of recasting makes giving less compelling for the pedestrians in fleeting encounters with panhandlers: they resist service provision in fleeting encounters with panhandlers on the grounds that the exchange is experienced as a coldly rational quid pro quo. In contrast, pedestrians who have long-term relationships with panhandlers experience the interaction as a gift exchange and the service as an expression of gratitude and subservience. The development of an open-ended temporal horizon and of a cycle of exchange, I argue, allows the service and the money given to operate as boundary objects, enabling panhandlers and pedestrians to attach different meanings to the exchange of money for services. This emergent ambiguity allows them to carry out interaction and exchange successfully. Contrary to models of interaction and everyday economic transactions that frame shared definitions of the situation as necessary for successful and repeated interactions, I find that ambiguity and polysemy may be productive and sustaining in interactions between participants from distinct social worlds. In the current era, building more innovative teams is key to organizational success, yet there is little consensus on how best to achieve this. Common wisdom suggests that positive reinforcement through shared positive rewards builds social support within teams, and in turn facilitates innovation. Research on basic group processes, cultural rituals, and the evolution of pro-group behavior has, however, revealed that sharing adverse experiences is an alternative path to promoting group bonding. Here, we examined whether sharing an adverse experience not (...) only builds social support within teams, but also in turn enhances creativity within novel teams. Drawing on behavioral observation of an experimental group interaction we find evidence that sharing an adverse (vs. non-adverse) experience leads to increased supportive interactions between team members and this in turn boosts creativity within a novel team. These effects were robust across different indicators of creativity: objective measures of creativity, third party ratings of the creativity of group products, and participants’ own perceptions of group creativity. Our findings offer a new perspective from which to understand how best to boost innovation and creative output within teams. (shrink)

Robert Fogelin claims that interlocutors must share a framework of background beliefs and commitments in order to fruitfully pursue argument. I refute Fogelin’s claim by investigating more thoroughly the shared background required for productive argument. I find that this background consists not in any common beliefs regarding the topic at hand, but rather in certain shared pro-cedural commitments and competencies. I suggest that Fogelin and his supporters mistakenly view shared beliefs as part of the required background for productive argument (...) because these procedural com-mitments become more difficult to uphold when people’s beliefs diverge widely regarding the topic at hand. In the Phaedrus, Plato’s Socrates distinguishes himself from the natural scientists of his day and indicates that the true philosophical attitude, the love of realhuman wisdom, shares something essential with the mythical attitude. In the following essay, I argue that Socrates criticizes science here for its failure to attend to aporia, to recognize an essentially questionworthy aspect of the world of human experience, an aspect I will refer to as distance. Worldwide, human lives are rapidly improving. Education, health-care, technology, and political participation are becoming ever more universal, empowering human beings everywhere to enjoy security, economic sufficiency, equal citizenship, and a life in dignity. To be sure, there are some specially difficult areas disfavoured by climate, geography, local diseases, unenlightened cultures or political tyranny. Here progress is slow, and there may be set-backs. But the affluent states and many international organizations are working steadily to extend the blessings of modernity through trade (...) and generous development assistance, and it won't be long until the last pockets of severe oppression and poverty are gone. Heavily promoted by Western governments and media, this comforting view of the world is widely shared, at least among the affluent. Pogge's new book presents an alternative view: Poverty and oppression persist on a massive scale; political and economic inequalities are rising dramatically both intra-nationally and globally. The affluent states and the international organizations they control knowingly contribute greatly to these evils - selfishly promoting rules and policies harmful to the poor while hypocritically pretending to set and promote ambitious development goals. Pogge's case studies include the $1/day poverty measurement exercise, the cosmetic statistics behind the first Millennium Development Goal, the War on Terror, and the proposed relaxation of the constraints on humanitarian intervention. A powerful moral analysis that shows what Western states would do if they really cared about the values they profess. (shrink)

Post‐Marxist critical sociology of education has influenced the development of indigenous (‘kaupapa’) Maori educational theory and research. Its effects are examined in four claims made for Maori education by indigenous theorists. The claims are: indigenous kaupapa Maori education is a revolutionary initiative; it is a cultural solution to Maori educational under‐achievement; it has reversed the decline of the Maori language; it provides a valid educational alternative for an ethnically and culturally distinctive population. The analysis suggests that the indigenous theory approach (...) is representative of the position‐taking strategy that characterises post‐Marxist critical sociology of education, concluding that claims made in kaupapa Maori voice discourse are not supported by the empirical evidence which indicates a more complex social reality. Recent work has suggested that our cognitive biases and moral psychology may pose significant barriers to tackling climate change. Here, we report evidence that through status and group-based social influence processes, and our moral sense of justice, it may be possible to employ such characteristics of the human mind in efforts to engender pro-environmental action. We draw on applied work demonstrating the efficacy of social modeling techniques in order to examine the indirect effects of social model status and group membership (...) on pro-environmental action tendencies. We find evidence that high- status models increase pro-environmental action, in part, through making such actions seem morally fairer to undertake. This effect of high-status models only occurs when they share a meaningful ingroup membership with the target of influence. Further, we find evidence that this conditional effect of high-status models may also have a direct impact on action tendencies. While the exact behaviors that are influenced may vary across student and non-student samples, we argue that a focus on the “justice pathway” to action and the social-cognitive features of models may offer a good opportunity for cognitive and behavioral scientists to integrate insights from basic research with those stemming from more applied research efforts. Hinduism and Zoroastrianism have strong historical bonds and share similar value-systems. As an instance, both of these religions are pro-life. Abortion has been explicitly mentioned in Zoroastrian Holy Scriptures including Avesta, Shayast-Nashayast and Arda Viraf Nameh. According to Zoroastrian moral teachings, abortion is evil for two reasons: killing an innocent and intrinsically good person, and the contamination caused by the dead body. In Hinduism, the key concepts involving moral deliberations on abortion are Ahimsa, Karma and reincarnation. Accordingly, abortion deliberately (...) disrupts the process of reincarnation, and killing an innocent human being is not only in contrast with the concept of Ahimsa, but also places a serious karmic burden on its agent. The most noteworthy similarity between Zoroastrianism and Hinduism is their pro-life approach. The concept of Asha in Zoroastrianism is like the concept of Dharma in Hinduism, referring to a superior law of the universe and the bright path of life for the believers. In terms of differences, Zoroastrianism is a religion boasting a God, a prophet, and a Holy book, while Hinduism lacks all these features. Instead of reincarnation and rebirth, Zoroastrianism, like Abrahamic religions, believes in the afterlife. Also, in contrast with the concept of Karma, in Zoroastrianism, Ahura Mazda can either punish or forgive sins. (shrink)

Toward a Shared Metaphoric Meaning in Children's Discourse: The Role of Argumentation The text deals with the phenomenon of understanding and interpreting metaphoric expressions in children. Of the many metaphoric figures, one type was selected: the ‘so-called’ psychological-physical metaphors that illuminate a psychological experience by appealing to an event in the physical domain. The data consist of children's discussions in pairs, in which they make a joint interpretation of metaphors including a dual-function adjective, e.g., a hard person, a sweet person, (...) an empty person. A hundred and forty-four dialogues between peer dyads were recorded from three age groups : 6;6-7;6, 8;6-9;6, and 10;6-11;6. The children's task was to prepare an interpretation of metaphorical expressions for two television quiz shows, one for peers and one for young preschoolers. The research design was balanced for age, gender, and order of metaphoric interpretation in the two experimental variants. Following Quignard's model, we analyzed children's argumentation as a particular case of dialogical problem solving, whereby children had to understand the metaphoric meaning and convey it to the potential addressee. The results show an interesting dynamic in the argumentative orientation of the pro and the contra type, depending on the age of interlocutors. The frequency of metaphoric interpretations in opposition to those presented by the partner decreases with the children's age, but the frequency of compound proposals with the use of the partner's contribution increases. For the younger addressee, children most frequently interpret metaphors as descriptions of magical situations. (shrink)

The ethnic or “racial” classification of Maori and non-Maori is a pivotal feature of New Zealand’s health system and affects government policy and professional practice within the context of Treaty of Waitangi “partnership” politics. Although intended to empower Maori, ethnic categorization can have unintended and negative consequences by ignoring the causality of material forces in social phenomena. The authors begin by showing how the use of ethnic categories in health policy is justified by the Treaty of Waitangi partnership policies. This (...) provides the context for the argument made in the manuscript that an understanding of the social experience of ethnicity within the complex interaction of sociocultural factors such as socioeconomic location and lifestyle is more useful than using the political construct of ethnic categories in explaining the persistence of low health status for a section of the Maori population. Abstract:The paper argues for the primacy of disciplinary knowledge in music education. We claim that the epistemic structure of this form of knowledge has two separate but ultimately interdependent functions. First, when used as the main principle in the design of the curriculum, such knowledge may be made accessible to students by being connected to procedural or practice knowledge. We introduce the term 'curriculum design coherence' to refer to the ways in which this connection is made. Second, the abstract nature (...) of disciplinary knowledge contains two features, "generalizability" and "universalizability." These are pre-conditions for the creation of the collective representations that allow modern pluralist societies to cohere around the principles of democracy. In making the argument for a pedagogy in music education which combines "knowledge-in-the-mind" and "knowledge-from experience," we critique the current emphasis on experience to suggest that this approach does not provide the access to transformative knowledge despite claims for its democratic imperative. Environmentalists commonly offer three motives for why human populations need to be reduced or stabilized. One group maintains that human numbers threaten natural goods that should be preserved: biodiversity and ecosystems. A more extreme group maintains that we are taking up more than our fair share of the planet, eliminating species that have just as much right to be here. A third group advocates controlling human populations in order to prevent the environment from being degraded to the point that (...) it harms people. I intend to examine in light of Catholic social teaching whether these proposed motives for controlling population are always anti-life. (shrink)

Study 1 examined how personality and attitudes are related to daily pro-environmental behavior and whether these relationships are moderated by perceived behavioral costs and benefits. One hundred and seventy-eight participants responded to scales measuring the dark and light side of personality, as well as their pro-environmental attitude. Afterward, they were notified three times a day for 7 days in a row. Each time they reported their PEB that had occurred in the past four hours and indicated their behavioral costs and (...) benefits. Multilevel analyses showed a positive relationship between the frequency of PEB and the light triad of personality and pro-environmental attitude, while the dark tetrad was negatively related to PEB. Unexpectedly, less environmentally aware participants reported to engage in PEB with higher costs and lower benefits than did pro-environmental participants. A second study suggests that less environmentally aware people do not actually engage in PEB with high costs and low benefits, but rather that they only perceive their behavior to be costly and of little benefit. Overall, our findings suggest that the way people perceive their daily PEB is not necessarily shared by others. (shrink)

Clients may feel trapped into sharing their private digital data with insurance companies to get a desired insurance product or premium. However, private insurance must collect some data to offer products and premiums appropriate to the client’s level of risk. This situation creates tension between the value of privacy and common insurance business practice. We argue for three main claims: first, coercion to share private data with insurers is pro tanto wrong because it violates the autonomous choice of a (...) privacy-valuing client. Second, we maintain that irrespective of being coerced, the choice of accepting digital surveillance by insurers makes it harder for the client to protect his or her autonomy. The violation of autonomy also makes coercing customers into digital surveillance pro tanto morally wrong. Third, having identified an economically plausible process involving no direct coercion by insurers, leading to the adoption of digital surveillance, we argue that such an outcome generates further threats against autonomy. This threat provides individuals with a pro tanto reason to prevent this process. We highlight the freedom dilemma faced by regulators who aim to prevent this outcome by constraining market freedoms and argue for the need for further moral and empirical research on this question. Knowledge forms a crucial source for gaining competitive advantage and its sharing a dominant challenge facing several organizations. In this paper we propose a positive role of workplace spirituality on knowledge sharing intention by employing the theory of decomposed planned behaviour. We argue that WPS with its focus on inner spirit, meaningful work, sense of interconnectedness and alignment with organizational values and mission positively strengthens an individual’s knowledge sharing attitude, subjective norms and perceived behavioural controls by affecting the underlying behavioural, (...) normative and control beliefs. We also take into account the role of transformational leadership in creating a pro-social working environment, which facilitates knowledge sharing. In proposing a holistic and multi-level framework linking WPS and TL with KSI, this paper contributes to both, knowledge sharing and WPS literatures. (shrink)

Mitotic entry and exit are switch‐like transitions that are driven by the activation and inactivation of Cdk1 and mitotic cyclins. This simple on/off reaction turns out to be a complex interplay of various reversible reactions, feedback loops, and thresholds that involve both the direct regulators of Cdk1 and its counteracting phosphatases. In this review, we summarize the interplay of the major components of the system and discuss how they work together to generate robustness, bistability, and irreversibility. We propose that it (...) may be beneficial to regard the entry and exit reactions as two separate reversible switches that are distinguished by differences in the state of phosphatase activity, mitotic proteolysis, and a dramatic rearrangement of cellular components after nuclear envelope breakdown, and discuss how the major Cdk1 activity thresholds could be determined for these transitions. Policies on reproduction have become an increasingly important tool for governments seeking to meet the so-called demographic ‘challenge’ created by the combination of low fertility and lengthening life expectancies. However, the tension between the state and the market in health care is present in all countries around the world due to the scare resources available and the understandable importance of the health issues. The field of assisted reproduction, as part of the health care system, is affected by this tension with (...) both—the state’s and the market’s involvements—carrying important implications. Bulgaria and Israel share the same size of population, are markedly paternalistic and both have strong pro-natalist cultures by which large families are expected. For a range of reasons the two countries contrast sharply, however, in terms of their capacity to intervene in the health system, and also in terms of the political will to act on matters of reproduction. This paper examines how assisted reproduction, as reflected by present policies in both countries, influences women’s welfare and considers whose interests the practices of assisted reproduction in these countries actually serve. By reviewing some of the present data on women’s status in Bulgaria and Israel and assessing both states’ policies and involvement in assisted reproduction this paper helps to identify some of the intended and unintended consequences of assisted reproduction policies in different countries. Charles Fourier propounded a socialist and, at the same time, libertarian utopia: a harmonious project of living together in solidarity, of cooperative work and sexual freedom. Historians interested in its reception in Spain have underlined the lack of thinkers capable of developing Fourier’s thinking along original lines or from a certain theoretical level. Moreover, it has been affirmed that Fourier’s original doctrine was impoverished in Spain because it was stripped of a large part of its utopian aspects and reduced to (...) a doctrinaire framework for social criticism and reform.1 Nonetheless, the evolution of Spanish Fourierism is comparable to that which the movement underwent in other countries, including France..
