Social scientific evidence suggests that labor migration can increase resilience to climate change. For that reason, some have recently advocated using labor migration policy as a tool for climate adaptation. This paper engages with the normative question of whether, and under what conditions, states may permissibly use labor migration policy as a tool for climate adaptation. I argue that states may use labor migration policy as a tool for climate adaptation and may even have a duty (...) to do so, subject to two moral constraints. First, states must also provide acceptable alternative options for adaptation so that the vulnerable are not forced to sacrifice their morally important interests in being able to remain where they are. Second, states may not impose restrictive terms on labor migrants to make accepting greater numbers less costly for themselves because doing so unfairly shifts the costs of adaptation onto the most vulnerable. How should we understand the political morality of migration? Are travel bans, walls, or carrier sanctions ever morally permissible in a just society? This book offers a new approach to these and related questions. It identifies a particular vision of how we might apply the notion of justice to migration policy - and an argument in favor of expanding the ethical tools we use, to include not only justice but moral notions such as mercy.

Nursing migration: global treasure hunt or disaster‐in‐the‐making?International nurse migration — moving from one country to another in the search of employment — is the focus of this article. The majority of member states of the World Health Organization report a shortage, maldistribution and misutilisation of nurses. International recruitment has been seen as a solution. The negative effects of international migration on the ‘supplier’ countries may be recognised today but are not effectively addressed.Nurse migration is motivated by (...) the search for professional development, better quality of life and personal safety. Pay and learning opportunities continue to be the most frequently reported incentives for nurse migration, especially by nurses from less‐developed countries. Career opportunities were considered key incentives for nurses emigrating from high‐income countries. Language was reported to be a significant barrier. The positive global economic/social/professional development resulting from international migration needs to be weighed against a substantial ‘brain and skills drain’ experienced by supplier countries. The vulnerable status of migrant nurses is also of concern in certain cases. The focus on short‐term solutions as opposed to resolving the problem of a worldwide shortage of nurses causes great concern. Recent initiatives attempt to curb or channel international recruitment. The delicate balance between recognising the right of individual nurses to migrate and a collective concern for the health of a nation’s population must be achieved. (shrink)

Written by an international team of leading political and legal theory scholars whose writings have contributed to shaping the field, Migration in Political Theory presents seminal new work on the ethics of movement and membership. This study investigates whether and how the corporate social responsibility (CSR) profile of a company transfers to another company when an executive leaves a firm. We integrate upper echelon and institutional theories, and develop a novel measure of CSR profiles to explore this issue with a longitudinal data set of executive migrations over a 14-year period. We find that migrated executives assimilate elements of their old firms’ CSR profiles into their new firms (i.e., narrowing the distance between the two firms’ (...) CSR profiles), and this is true for both CSR and corporate social irresponsibility (CSiR). This relationship is stronger when the migrating executive comes from a bigger firm with better social and financial performance than that of the new firm. We also find that the potential for improvement in CSR profiles in migration holds true for CSiR, but not CSR. Our findings have import for upper echelon theory and the managerial discretion afforded to executives regarding CSR decisions. (shrink)

Climate change intersecting with complex socio-economic and political processes has produced distinctive patterns of crisis migration. However there exists a significant gap in understanding and theorizing these forms of migration creating significant policy challenges. Using a case study of an interstate migrant settlement in Bengaluru, India this article unpacks migration as an adaptation strategy through the lens of emotions. The article offers significant insights into how emotions affect the choice of migration as an adaptation strategy and (...) shapes the differential experiences of risks and vulnerability for different groups of people. Emphasizing such relational aspects of migration, the article calls for more research that develops a nuanced understanding of the emotional landscapes of migrants across migration pathways. In response to Albrecht et al.’s (J Agric Environ Ethics 26(4):827–845, 2013) discussion on the ethics of assisted migration, we emphasize the issues of risk and scientific uncertainty as an inextricable part of a comprehensive ethical evaluation. Insisting on a separation of risk and ethical considerations, although arguably common in many policy contexts, is at best misguided and at worst damaging.

The fluid use of the terminology associated with “migration governance” can obscure its intention and implications. Different meanings of core terminology risks allowing troubling policies that are not really about migration, understood widely as border crossing, or even more broadly as human movement, to be legitimized. UN-level coordination with regard to “migration governance” needs to be part of addressing this concern. For example, this article advocates explicitly engaging with this risk through the implementation of the Global Compact (...) for Safe, Orderly and Regular Migration. It considers this issue from the perspectives of a handful of countries, each of which has its own complex relationship to the compact. It argues that in each of these apparently very different contexts, policies identified as being directed at “migration control” can be found to be directed not at controlling migration but at reconfiguring existing and stable state societies along ethnic, racial, linguistic, and other lines. The development of implementation plans for the Global Compact for Migration provides the opportunity to interrogate the purposes of “migration governance” and to find mechanisms to address its hidden uses. Migration und Armut sind eng miteinander verbunden. Für die meisten Migrant*innen ist Armut der Grund, ihre Heimat zu verlassen, um anderswo ein günstigeres wirtschaftliches Umfeld zu finden. Der Internationalen Organisation für Migration zufolge lag die Zahl der sogenannten Arbeitsmigrant*innen im Jahr 2015 weltweit bei 150,3 Millionen, bei einer Gesamtzahl von 247,6 Millionen Migrant* innen. Diese Zahlen erfassen Migrant* innen mit offizieller Arbeitserlaubnis und es ist anzunehmen, dass die Zahl von Arbeitsmigrant*innen ohne legale Dokumente deutlich höher ist.

Das Thema Migration wird in Politik, Medien und Offentlichkeit, aber auch in der Philosophie kontrovers diskutiert. Die vorliegende Studie geht von der These aus, dass sich Kants Uberlegungen zum Weltburgerrecht in einer produktiven Disharmonie zu gegenwartig vertretenen philosophischen wie politischen "Lagern" in der Migrationsdebatte befinden. Zur Begrundung dieser These wird zunachst die neuere Debatte um Migration anhand dreier Theoriestrange vorgestellt, die diese massgeblich strukturieren: der Kommunitarismus, der egalitaristische Kosmopolitismus und der liberale Nationalismus. Anschliessend werden die fur die Migrationsdebatte (...) entscheidenden Theoriegange in Kants politischer Philosophie erschlossen. Auf dieser Grundlage wird schliesslich die Produktivitat und systematische Relevanz von Kants Theorie fur die Hauptfragen der gegenwartigen Debatte herausgearbeitet und eine rechtsmoralische Migrationstheorie entworfen. Es werden dabei insbesondere die Themengebiete Asyl, (il-)legitime Abweisungsgrunde, Staatenlosigkeit, der Erwerb der Staatsburgerschaft, das Recht auf Auswanderung und individuelle Hilfspflichten sowie die Frage nach der Notwendigkeit einer "weltburgerlichen Gesinnung" diskutiert. The migration of constitutional ideas across jurisdictions is one of the central features of contemporary constitutional practice. The increasing use of comparative jurisprudence in interpreting constitutions is one example of this. In this 2007 book, leading figures in the study of comparative constitutionalism and comparative constitutional politics from North America, Europe and Australia discuss the dynamic processes whereby constitutional systems influence each other. They explore basic methodological questions which have thus far received little attention, and examine the complex relationship (...) between national and supranational constitutionalism - an issue of considerable contemporary interest in Europe. International migration of work force is presently a high amplitude phenomenon. Romanian people have emigrated for work around the world, being engaged both in the physically hardest jobs and in activities that require completion of specialized courses and certification in a particular field. This last category includes social workers who, following schooling and certification and even having a minimal experience in the home country, apply for jobs in the field of social assistance. These recruiters aim to distribute social workers (...) at the workplace of interest, according to certain well-defined criteria. In the present paper we describe international migration of work force, and we illustrate it by adding case studies of life experience of social workers who underwent the process of emigration to the United Kingdom. Throughout the emigration process, these workers experienced certain changes in their life principles, mentality, values, and were marked by professional dilemmas in extreme situations. (shrink)

Little work has been done to explore the moral foundations of the state’s right to territory.1 In modern times, the state has mostly been assumed to be a territorial unit, and no need was perceived to reflect on precisely what justifies its territorial jurisdiction. The state’s territoriality is related to another topic that has remained under-theorized: immigration. There is, moreover, an obvious relationship between these topics: the more powerful a state’s rights over its territory, the more powerful the right to (...) constrain access to that territory might become – or so, at any rate, we might suppose. Rights to territory and rights to immigration are usefully theorized together.2 Our starting point is a Lockean analysis of the moral foundations of territoriality offered by Simmons (2001). This is a natural starting point not only because Simmons is one of the very few contemporary writers who have taken up philosophical questions about territoriality in the first place, but also because Locke’s thought, as Simmons makes clear, actually allows for the development of a sophisticated account of territoriality. The Trafficking Victims’ Protection Act of 2000 has been presented as an important tool in combatingthe exploitation and abuse of undocumented workers, especially those forced into prostitution. Through a close reading of the legislation and the debates surrounding its passage, this article argues that the law makes strategic use of anxieties over sexuality, gender, and immigration to further curtail migration. The law does so through the use of misleading statistics creating a moral panic around “sexual slavery,” through the creation (...) of a gendered distinction between “innocent victims” and “guilty migrants,” and through the demand that aid to victims be tied to their willingness to assist in the prosecution of traffickers. As a result, the legislation is less a departure from, than of a piece with, other recent antisex and antiimmigrant policies. (shrink)

Writing Migration through the Body builds a study of the body as a mutable site for negotiating and articulating the transnational experience of mobility. At its core stands a selection of recent migration stories in Italian, which are brought into dialogue with related material from cultural studies and the visual arts. Occupying no single disciplinary space, and drawing upon an elaborate theoretical framework ranging from phenomenology to anthropology, human geography and memory studies, this volume explores the ways in (...) which the skin itself operates as a border, and brings to the surface the processes by which a sense of place and self are described and communicated through the migrant body. Through investigating key concepts and practices of transnational embodied experience, the book develops the interpretative principle that the individual bodies which move in contemporary migration flows are the primary agents through which the transcultural passages of images, emotions, ideas, memories - and also histories and possible futures - are enacted. The notion of a migration system is often invoked but it is rarely clearly defined or conceptualized. De Haas recently provided a powerful critique of the current literature highlighting some important flaws that recur through it. In particular, migration systems tend to be identified as fully formed entities, and there is no theorization as to how they come into being and how they break down. The internal dynamics which drive such changes are not examined. Such critiques of (...) class='Hi'>migration systems relate to wider critiques of the concept of systems in the broader social science literature, where they are often presented as black boxes in which human agency is largely excluded. The challenge is how to theorize system dynamics in which the actions of people at one time contribute to the emergence of systemic linkages at a later time. This article focuses on the genesis of migration systems and the notion of pioneer migration. It draws attention both to the role of particular individuals, the pioneers, and also the more general activity of pioneering which is undertaken by many migrants. By disentangling different aspects of agency, it is possible to develop hypotheses about how the emergence of migrations systems is related to the nature of the agency exercised by different pioneers or pioneering activities in different contexts. The migration of nursing professionals from developing countries such as Zimbabwe to industrialised countries is taking place at an alarming rate, with little signs of slowing down. In Africa, nurses form the backbone of the healthcare delivery system and their migration has a huge negative impact on health service provision. Drawing on evidence from selected health institutions, the paper shows the magnitude of migration of nurses from Zimbabwe. The paper also shows that public to private health sector (...) migration of nurses is occurring at a significant rate. The effects of such movements are examined in detail. For instance, at the health institution level, nurse migration has led to staff shortages, and health institutions located in the disadvantaged areas have been the worst affected. The paper calls for the adoption of an integrated approach in managing and addressing the concerns of the nursing professionals. (shrink)

Putting migrant remittances into house construction and rebuilding is generally seen as either conspicuous consumption or productive investment, but in both cases the perspective is economistic. This article argues that only when the cultural dimension of economic action is understood will it be possible to comprehend migrant spending on houses. Specifically, this article seeks to understand why, in the case of the rural Tagalog village in this study, located in upland Batangas Province in the Philippines, overseas labour migrants build houses (...) that they do not even live in, but are given to parents or simply left unoccupied. The explanation is framed in relation to the meanings of houses in a culture of bilateral kinship, which the Philippines shares with most parts of Southeast Asia, but inflected by distinct colonial influences. The article demonstrates the ways in which houses as memorials serve as idioms of ties of relatedness within kin groups and the broader community, ties that are being transformed by global migration and experienced differently yet maintained, renegotiated yet sustained transnationally. Various contributions have recently called to move away from the court-like assessment of claims by host states and foreigners and to engage more frankly with empirical work more attentive to concrete experiences and power relations. I contend that Sayad’s sociological work constitutes a substantial empirical and normative resource for ethical and political theory of migration, pointing to the persistence of ‘state thought’ (...) and presenting original normative perspectives on emigration, inclusion in democracy, naturalization or postcolonial relationships. Such a reading of Sayad from a political theory perspective would then constitute a prime example of the cross-fertilization of empirical and normative approaches. (shrink)

Studying student migration trends is a significant task in studying human capital development as one of the leading factors in sustainable socio-economic development. The migration potential of students impacts the opportunities and prospects for sustainable development. The study of factors influencing the migration behavior of students acquires special significance in this article. The interpersonal competencies of the population impact its migration potential. Migration processes impact the differentiation of regions in terms of human capital. This article (...) is based on theoretical and practical research on human capital, its formation, development, and migration as a factor in human capital development. The practical part of the study presents an analysis of data obtained from a sociological study of the factors that determine internal and international migration. An anonymous sociological survey of students in Ekaterinburg, Kursk, and Tomsk (Russia) was conducted in several stages. The first stage was implemented in October and December 2020 (N = 958). The second stage was implemented in October and November 2021 (N = 960). This study allows for tracing how the COVID-19 pandemic affects the migration potential of students and their desire for a satisfactory career path. (shrink)

Cet article analyse un rapport de l’Immigrants’ Protective League à Chicago (1931) qui porte sur le paiement des pensions alimentaires dans des familles séparées par la migration. Rédigé dans le cadre d’un projet de convention internationale sur l’assistance aux étrangers indigents, ce rapport présente les différentes tactiques utilisées par les travailleuses sociales de l’organisation pour réunir les familles afin d’éviter le recours aux tribunaux. L’analyse de la mise en récit des histoires de couples et de familles montre le processus (...) de légitimation du travail social international et met en évidence les pratiques des travailleuses sociales qui s’appuient sur les émotions pour rétablir un modèle social familial fragilisé par la migration. In this chapter, I bring non-ideal theory to bear on the ethics of immigration. In particular, I explore what the obligations of liberal states would be if they were to attempt to implement migration arrangements that conform to liberal-cosmopolitan principles. I argue that some of the obligations states have are feasibility-insensitive, while some are feasibility-sensitive. I show that such obligations can have as their content both the inclusion and exclusion of prospective immigrants, and that they can be grounded in (...) the requirements of liberal justice, mere capacity to assist, as well as past or foreseeable contribution to harm. The chapter therefore explores the possibility of an international migration regime that takes human rights seriously whilst avoiding the twin pitfalls of strict immigration restrictions and the complete liberalization of immigration. Two important recent books on migration and justice argue for different approaches to how we should view borders. Alex Sager defends open borders, while Sarah Song argues for the rights of democratic communities to find their own balance between open and closed borders. While both authors present significant considerations in defence of their views, in this article I argue that a human-rights-oriented account of migration justice captures their strengths well while not sharing the weaknesses I identify with each. In addition, the approach I favour offers some progressive pathways for holding each other to account in reducing migration injustice in our actual world, in ways that are both feasible and normatively compelling. The philosophical debate on the freedom of movement focuses almost exclusively on long-term migration, what I call, migration as settlement. The normative justifications defending border controls assume that the movement of people across political borders, independent of its purpose and the length of stay, refers to migration as settlement. “Global mobility,” “international movement,” and “immigration” are oftenused interchangeably. However, global mobility also refers to the movements of people across international borders for a short length of time such (...) as travel, short-term and circular migration. While most scholarly attention has focused on long-term migration, the vast majority of cross-border movement of people (approximately 85% of all cross-border movements in 2019) is short-term. The existing literature offers normative arguments for border controls, which are grounded on states’ right to self-determination, the freedom of (dis)association, the welfare state, the duty to compatriots, and brain drain. In this paper, I argue that these arguments do not justify excluding travelers, short-term and circular migrants from the territory. (shrink)

The assumption that human socializing instincts are restricted to the community of birth and upbringing was long accepted without question. But today’s modern states have passed from the nation-building stage into that of multicultural belonging, and fluidity of membership allied to perpetual population shifts is the norm. This article traces changing patterns of global migration: first, territoriality plus rooted identity plus ‘gardening’; second, emigration to supposedly ‘empty’ lands; third, interlocked diasporas. How may we now live with and in the (...) right to difference? Identity formation is never fixed, never final, veering between the pole of freedom and that of security. It is an intertwining of continuity and discontinuity that may now hold society together. (shrink)

Given that cities are now bearing the brunt of migration and integration, it might seem that we should shift our normative focus away from the state towards the city. This is the suggestion of Avner de Shalit’s (2018) Cities and Integration: Political and Moral Dilemmas in the New Era of Migration. In this article, we suggest that this move is not so straightforward. Other levels, including the global, the state, and the neighbourhood, on top of the city, are (...) also impacted by migration and so also have claims for normative priority, which need to be addressed. And even if the city is responsible for integration, we argue that de Shalit’s promotion of Amsterdam’s ‘Milkshake Model’ – a form of respect and appreciation of difference – is, despite its clear initial appeal, not an ideal for accommodating diversity. This article examines dominant socio-political questions regarding migration, ‘multiculturalism’, and ‘integration’, as a politics of citizenship (and race) in contemporary (post-colonial) Europe. The argument unfolds through a critique of the nationalist complacencies and racial complicities in Jürgen Habermas’s remarks on ‘multiculturalism’ during the 1990s. With recourse to ‘underclass’ discourse, Habermas’s reflections were themselves a trans-Atlantic metastasis of a distinctly US ‘American’ hegemonic sociological commonsense with regard to, but actively disregarding, the fact of white supremacy. Habermas’s thoughts are critically situated (...) alongside their subsequent metastasis, back across the Atlantic, into Francis Fukuyama’s recent invocations of ‘terrorism’ and his advocacy of the ‘American melting pot’ model as a trans-Atlantic prescription for Europe’s ailments. Treating ‘immigrants’ as a kind of societal illness, both are preoccupied by the same ‘problem’ — non-Europeans (as disaffected ‘minorities’). Thus, these discourses of ‘immigration’ manifest a distinctly post-colonial cancer coursing restlessly through the larger social formation of ‘the West’. (shrink)

Much modern discussion of the morality of migration begins with the concept of coercion, and takes the coercive nature of border enforcement as especially salient in the moral analysis of migration policy. Much migration control, however, begins not with overt coercion, but with what I term manipulations; these are ways of making migration more difficult that do not resemble canonical cases of coercion. Examples include the alteration of the physical pathways between states, attempts to deceive or (...) mislead prospective migrants about what they will discover upon arrival, and the deliberate use of abstract and complex rules to make legal migration difficult or impossible. I argue that these manipulations are worthy of independent moral examination—and that the tradition of classical liberalism has resources with which to undertake this examination. (shrink)

This article sets out the principal ethical considerations for a just immigration policy. Advocates of a more liberal immigration regime have called for open borders or at least a more relaxed immigration policy. They argue that it is incompatible with basic rights such as freedom of movement, association, and opportunity. Furthermore, the use of coercion to prevent needy people from seeking opportunities abroad sits uneasily in a world of massive inequalities divided along geographical and state lines, as well as the (...) large number of refugees. At the other end of the spectrum, many individuals and groups protest immigration levels and their real or imagined effect on jobs, wages, and culture. The article briefly discusses the causes of migration and the implications of moral theory for immigration policy. It gives special consideration to the case of refugees and addresses the difficult question of how states should treat guest workers and undocumented immigrants. (shrink)

It is often argued that development aid can and should compensate the restrictions on migration. Such compensation, Shachar has recently argued, should be levied as a tax on citizenship to further the global equality of opportunity. Since citizenship is essentially a ‘birthright lottery’, that is, a way of legalizing privileges obtained by birth, it would be fair to compensate the resulting gap in opportunities available to children born in rich versus poor countries by a ‘birthright privilege levy’. This article (...) sets out a defence of three theses. The first states that equality of opportunity is incompatible with, and cannot be achieved in, segregated territories. The second posits that to believe that material equality compensates the injustice of restrictions on movement is to commit a ‘sedentarist mistake’. The third affirms that any citizenship levy, including the egalitarian and non-sedentarist formula I’m proposing, would be better understood as a penalty rather than a tax. (shrink)

The study examines the consequences of the COVID‐19 pandemic‐induced lockdown on the socio‐economic status of 212 female migrant workers employed in the informal sector, originating from four underprivileged districts of West Bengal, India. The study assesses the changes in their scope of employment, financial instability, and the level of violence experienced within households and workplaces in the pre‐pandemic and post‐lockdown phases. We apply the binary logistic regression to identify factors influencing their low employment scope, the t‐test to observe changes in (...) their income as a consequence of the pandemic, and the Wilcoxon signed‐rank test alongside effect size analysis to detect any rise in experiences of violence and exploitation against women. The findings suggest a notable decrease in their employment scope due to the absence of previous jobs, low wages, insecure workplaces, and family constraints; a decline in earnings; and an increased incidence of violence against them. The research suggests designing reforms to improve the current situation of female migrants, who represent one of the most marginalized sections of society. Formalizing the labor market and ensuring proper registration of these women would enable them to gain access to social security benefits, pension schemes, and relief packages that are vital for their well‐being. In this article I call for an awareness of the mobile commons– the informal support that exists among migrating people, NGOs, and activists – in relation to the realization of family reunification. Taking its point of departure in a concrete case of family reunification for young unaccompanied children, the article seeks to expose how the traditional legal notion of the liberal subject fails to provide protection in the context of legal practice. In order for a state to rightfully exercise self-determination by means of setting policies concerning migrants and migration, they must be legitimate, Gillian Brock argues in _Justice for People on the Move_. Legitimacy, in Brock’s view, requires that states satisfy three (jointly sufficient) conditions: they must respect their own citizens’ human rights; they must be a part of a legitimate state system; and they must adequately contribute to the maintenance of this state system. In her new book, Brock also (...) argues persuasively for a variety of migration-related policies that states ought to adopt (concerning, for example, addressing the needs of refugees, regularization of undocumented migrants, and protections for temporary labor migrants). In previous work (Brock, _Global Justice: A Cosmopolitan Account_, Oxford University Press, New York, 2009; Brock and Blake, _Debating Brain Drain: May Governments Restrict Emigration?_, Oxford University Press, New York, 2015), Brock has compellingly defended the justice of policies designed to allay the harmful effects of brain drain. In this commentary, I wish to argue that the legitimacy standard Brock defends in _Justice for People on the Move_ is an obstacle to the justified adoption of the migration-related policies Brock demonstrates here and in previous work to be substantively morally justified, if not required by justice. If a state is not legitimate, then it lacks the moral standing to adopt migration policies that are otherwise morally justified. I do not intend to question the importance of the concept of state legitimacy for political philosophy generally. However, I wish to argue that that in the context of migration justice, considerations of state legitimacy may be contrary to the goal of defending a view on what policies a state ought to adopt. It may be more useful simply to consider whether or not there is moral justification for a particular state to adopt a particular policy. (shrink)

This article reviews and contrasts research findings in a variety of disciplines seeking corroboration for theories of settlement in Madagascar. Evidence is considered from the fields of linguistics, archaeology (studies of pottery), cultural anthropology and genetic analysis, leading to conclusions broadly supporting the thesis of Austronesian migrations directly to Madagascar from Kalimantan and Sulawesi around the 5th and 7th centuries CE, which combined with a Bantu group originating from the region of Mozambique. The article nevertheless warns against attributing too much (...) to individual discipline studies, concluding that only genetic analysis can provide conclusive proof, and this only when informed by prior anthropological and historical indicators. Migration and Islamic Ethics, Issues of Residence, Naturalization and Citizenship addresses how Islamic ethical and legal traditions can contribute to current global debates on migration and displacement; how Islamic ethics of muʼakha, ḍiyāfa, ijāra, amān, jiwār, sutra, kafāla, among others, may provide common ethical grounds for a new paradigm of social and political virtues applicable to all humanity, not only Muslims. The present volume more broadly defines the Islamic tradition to cover not only theology but also to encompass (...) ethics, customs and social norms, as well as modern political, humanitarian and rights discourses. The first section addresses theorizations and conceptualizations using contemporary Islamic examples, mainly in the treatment of asylum-seekers and refugees; the second, contains empirical analyses of contemporary case studies; the third provides historical accounts of Muslim migratory experiences.
