In 1985, Swiss legal philosopher Walter Ott visited Herbert Hart in Oxford and made this record of their meeting, which casts novel light on some of Hart’s ideas. Ott engaged Hart in a fresh encounter with the legal philosophy of Gustav Radbruch, particularly Hart’s and Radbruch’s reasons for a minimum content of justice in law. They also discussed the grudge informer, state responsibility under laws of an earlier régime, and questions of the definition and falsifiability of legal theories. Hart surprisingly (...) reported Hans Kelsen as stating, when they had met at Berkeley in 1961, that Hume (and not Kant, and certainly not Wittgenstein) was the greatest philosopher who had ever lived. Aristotle (b. 322 BC) was the first philosopher in the history of thought to examine all modes and types of belief acquisition such as knowledge, supposition, error and indirectly imagination. In his _Prior Analytics_, which he wrote primarily to clarify his theory of demonstration, Aristotle examined in detail the syllogism, which he saw as the most important form of reasoning, and his analysis was subject to interpretation by different traditions of thought for centuries. Aristotle’s _Prior Analytics_ was translated into Arabic (...) in the classical period and later interpreted by many Islamic logicians. This article aims to show how Aristotle’s definition of the syllogism in the _Prior Analytics_ was taken up and interpreted in the Peripatetic Islamic logical tradition. These interpretations of the definition of the syllogism will provide us with an idea about the unique features of the commentaries on the _Prior Analytics_ in the Islamic world. Here, introductory information about the translation of the _Prior Analytics_ into Arabic and its commentators in Arabic will be given, Aristotle’s definition of the syllogism and its versions in Peripatetic Islamic logicians will be indicated, and the interpretation of the basic terms in the definition by Peripatetic Islamic logicians will be revealed. Barely a decade after the discovery of the chromosomal basis of inheritance, and the articulation of the genetical theory of population change, the gene came to be widely regarded as the fundamental unit of biological organization. This is hardly surprising. The gene concept is a powerful one; it plays a unifying role in our understanding of evolution. Darwin told us that evolution by natural selection occurs in a population when organisms survive, die and reproduce differentially on account of their heritable (...) form. This is a very schematic theory. It requires an account of the process of inheritance and also an account of the generation of phenotype. The gene concept plays a prominent role in explaining, and uniting, these phenomena. Genes are the units of inheritance; they are passed from parents to offspring in reproduction. Moreover, they are seen as units of phenotypic control. Evolutionary biologists often speak of the genome as a program for the production of an organism. Genes also became the elements of which populations are composed. Our best theory of population dynamics—inherited from Fisher, Haldane, and Wright—is a theory of changes in the relative frequencies of gene types. Genes are not just the principal causes of evolutionary change, they are also the units over which evolutionary change is defined and measured. This commentary is part of a symposium on my book 'Getting Our Act Together: A Theory of Collective Moral Obligations' (Routledge, 2021). Here, I respond to the members of the North American Society for Social Philosophy’s 2022 Book Award Committee. I discuss whether most moral theory is individualistic, arguing that “traditional ethical theories” - meaning the traditions of Virtue Ethics, Kantian ethics as well as consequentialist ethics - certainly are. All of these focus on what individual agents ought to (...) do or how they ought to be. The commentators wonder whether any substantive moral theory can accommodate the idea of collective obligations? I suggest that one of my conditions for collective moral obligations is incompatible with objectivist versions of act-utilitarianism, which require moral agents to choose the option that actually maximises utility. Having said that, core elements of my account of collective moral obligations can be used with any substantive theory. Further, the theory—in its entirety—can be used with several substantive theories, including versions of all the major types of moral theory. How common are collective obligations? On my understanding, as fundamentally social thinkers, we are fairly flexible at switching between the we-mode and the I-mode, and will regularly respond to contextual cues for framing collective action scenarios. As such, I am not worried that there would be too few circumstances under which we have all-out collective obligations. What is more, we can generate such obligations by providing contextual cues for others that prompt them to frame situations as opportunities for joint action and to perform contributory actions. Another question raised by the commentators was if for having collective obligations it is crucial that we believe others will contribute? My answer is that such obligations do not necessarily depend on having positive evidence that concrete others are or will be contributing. Having said that, where we have positive evidence that others will not contribute and in particular where we know that their failure to contribute will unilaterally undermine the possibility of success of any collective action (as in strict joint necessity cases) this may undermine collective obligations. On my theory, what happens if people disagree on what is morally best? On my view, where such divergence between moral positions comes as a result of disagreement between morally motivated, reasonable, and well-informed people it undermines their collective obligation. Finally, are there “negative” collective duties? Yes, in fact collective harm cases can be conceived of as generating “negative” duties to collectively refrain from generating these kinds of harms, including our obligations to mitigate climate change through reducing greenhouse emissions. The work helped consolidate the logic of the "later scholars" (such as Khunaji). It also shows that commentators did much more than merely explain the original work and (...) instead regularly discussed and assessed received views. This is the first English translation of Proclus' commentary on Plato's Parmenides. Glenn Morrow's death occurred while he was less than halfway through the translation, which was completed by John Dillon. A major work of the great Neoplatonist philosopher, the commentary is an intellectual tour de force that greatly influenced later medieval and Renaissance thought. As the notes and introductory summaries explain, it comprises a full account of Proclus' own metaphysical system, disguised, as is so much Neoplatonic philosophy, (...) in the form of a commentary. Norman Kemp Smith's Commentary elucidates not only textural questions and minor issues, but also the central problems which arise, he contends, from the conflicting tendencies of Kant's own thinking. The commentaries on the Ethica nova and the Ethica vetus written by some masters of the arts – presumably operating in the Paris faculty – in the first half of the thirteenth century expound in an original way the doctrine of the virtutes consuetudinales which Aristotle, at the end of the first book of his Ethica (I 13), distinguishes into the two main classes of the “moral virtues” and the “intellectual virtues”. The present paper aims at highlighting the particularly important (...) task which is assigned to the intellectual virtues in these early commentaries: joining man to God directly, through a contemplation which becomes love. The masters of the arts maintain that the moral virtues, in spite of the definition given by Aristotle (habitus a quo quis bonus est et opus eius bene reddit), are not sufficient alone to bring man to perfection, but that other more perfect virtues, namely the intellectual ones, are needed in order to make him know and love the supreme good. Having no knowledge of the sixth book of the Ethica, in which Aristotle deals in particular with the intellectual virtues, our masters know only their general description and are concerned with clarifying their relationships with the moral virtues, compared to which they appear to be sometimes really distinct and sometimes united to them in sharing the recta ratio, so much that they may constitute a double virtue. Although the masters of the arts seem to be well-informed about the teaching of the theologians – which they often cite without opposing to it, albeit stressing their own philosophical point of view –, it is significant that no reference whatsoever is made by them to the theological virtues and that they have recourse to the themes of Avicennian mysticism such as the doctrine of the two faces of the soul. Besides presenting the commentaries on the Ethica vetus from a general point of view, I will focus on the Paris commentary in Ethicam veterem (Paris BN lat. 3804A, ff. 152ra-159vb, 241ra-247vb; Paris BN lat. 3572, ff. 226ra-235ra), of which I am preparing a critical edition. The Paris commentary contains in fact a special and original discussion of the doctrine of the virtutes intellectuales. (shrink)

Commentary on the first Ukrainian translation of Thomasius’ work entitled “Nucleus disputationis de plagio literario maxime theoreticus, thesibus paucis & brevibus comprehensus”, which is one of the Appendices to the famous “Philosophical dissertation on literary plagiarism”.

Autumn Fiester identifies an important element in clinical ethics consultation (CEC) that she labels, from the Greek, aporia, “state of perplexity,” evidenced in CEC as ethical ambiguity. Fiester argues that the inherent difficulties of cases so characterized render them inappropriate for voting and more amenable to mediation and the search for consensus. This commentary supports Fiester’s analysis and adds additional reasons for rejecting voting as a process for resolving disputes in CEC including: it distorts the analysis by empowering individual (...) voters preferences and biases rather than focusing on the interests and wishes of the patient and family; it offers an insufficiently sensitive model for resolving the awesome, nuanced, conflicted, and ethically complex issues surrounding life and death; it marginalizes minority opinions that may have moral validity. Offering the first complete translation into modern English of Aquinas' unfinished commentary on Aristotle's Politics, this translation follows the definitive Leonine text of Aquinas and reproduces in English those passages of William of Moerbeke's exacting yet elliptical translation of the _Politics_ from which Aquinas worked. Bekker numbers have been added to passages from the _Politics_ for easy reference. Students of the history of political thought will welcome this study of a great classic, a commentary by a student of (...) Aristotle who is also a great political theorist in his own right. This is the first comprehensive commentary on the Athenaion Politeia since that of J.E. Sandys in 1912. The Introduction discusses the history of the text; the contents, purpose and sources of the work; its language and style; its date, and the evidence for revision after the completion of the original version; and the place of the work in the Aristotelian school. The Commentary concentrates on the historical and institutional facts which the work sets out to give, their sources (...) and their relation to other accounts. This is an invited commentary on "Physical Time within Human Time" (Gruber, Block, & Montemayor, 2022) and "Bridging the Neuroscience and Physics of Time" (Buonomano & Rovelli, 2021). I’m very sympathetic to aspects of each proposal. In this article, I offer some comments, starting with (Buonomano & Rovelli, 2021).

This commentary provides a critical examination of a recent article by Allen and Knight in which the authors claim to provide the long-sought explanation for the Madelung, or n + ℓ, n rule for the order of orbital filling in many-electron atoms. It is concluded that the explanation is inadequate for several reasons.

This book focuses upon the perennial question of the existence and nature of an obligation to obey the law. Leading writers have, at one time or another, emphasized considerations such as gratitude, 'divine ordering, ' prudence, contract, autonomy, and utility in seeking to justify, or to deny any justification for, some sort of obligation to obey the positive law. The book provides relevant selections from a sampling of the historical approaches to legal obligation taken by writers such as Plato, Augustine, (...) Aquinas, Hobbes, Locke, Hume, Rousseau, Thoreau, Bentham, Marx and Engels, and Martin Luther King, Jr. These classical discussions are augmented by critical questions and commentary, by independent discussions of the question of legal obligation by a wide range of contemporary writers, and by relevant judicial cases discussing matters such as conscientious objection and civil disobedience. In this commentary, I consider variability as an ordinary and irremediable feature related to the indexicality not only of transcripts but first of all of transcribing. In this sense, it is not just a characteristic of transcripts as texts, which can be assessed in a kind of philological comparison comparing formal features of autonomous and fixed textual objects, but a characteristic of transcribing as a situated practice. Practices are irremediably indexical, reflexively tied to the context of their production and (...) to the practical purposes of their accomplishment. Thus, a transcript is an evolving flexible object; it changes as the transcriber engages in listening and looking again at the tape, endlessly checking, revising, reformatting it. Transcribing relies in a fundamental way not only on the possibility of fixing the relevant details in a complex multilayered representation but also on the possibility of manipulating them, playing them again and again, at different paces, positions, fragments, while transcribing their finely tuned coordination, their synchronization, the fine articulation between different projections and sequential implicativenesses. These manipulations are one of the ways in which transcribing is accomplished as a situated practice. (shrink)

It deals with the problems of the Latin text (taking account of Michael Winterbottom's new edition), it delineates the work's structure and sometimes elusive train of thought, clarifies the underlying Greek and Latin concepts, and provides starting points for approaching the philosophical and historical problems that De Officiis raises.

Simplicius’ project of harmonizing previous philosophers deserves to be taken seriously as both a philosophical and an interpretive project. Simplicius follows Aristotle himself in developing charitable interpretations of his predecessors: his distinctive project, in the Neoplatonic context, is the rehabilitation of the Presocratics (especially Parmenides, Anaxagoras and Empedocles) from a Platonic-Aristotelian perspective. Simplicius’ harmonizations involve hermeneutic techniques which are recognisably those of the serious historian of philosophy; and harmonization itself has a distinguished history as a constructive philosophical method.

The Meno, one of the most widely read of the Platonic dialogues, is seen afresh in this original interpretation that explores the dialogue as a theatrical presentation. Just as Socrates's listeners would have questioned and examined their own thinking in response to the presentation, so, Klein shows, should modern readers become involved in the drama of the dialogue. Klein offers a line-by-line commentary on the text of the Meno itself that animates the characters and conversation and carefully probes each (...) significant turn of the argument.
