‘Enlightenment’ (in German, ‘Aufklärung’) is not simply the name of a movement or development whose existence is uncontroversial. Rather, the claim ‘The 18th century was the age of enlightenment’ or ‘In Germany, there was the Enlightenment’ entail certain claims which need to be discussed. This article argues that some of these claims are false and that therefore the claim ‘The Enlightenment does not exist’ is true.

After a general remark about Armstrong’s conception of ontology, I raise objections against this view and defend an alternative account of the connection between particulars and their properties, involving a kind of ontological dependence which is different from Armstrong’s necessary connection between particulars and their properties.

Einrichtungen der Altenpflege weisen spezifische ethische Spannungsfelder und ethische Fragestellungen auf. Das Strukturinstrument EMMA (Ethik Multiprofessionell Methodisch Anwenden) zur Moderation einer Ethik-Fallberatung wurde für den Einsatz in Einrichtungen der Altenpflege konzipiert. Inhaltlich werden die Besonderheiten dieses Settings unter Bezugnahme auf den Schlüsselbegriff Privatheit in den Mittelpunkt gestellt. EMMA eignet sich aufgrund seiner Kontextsensitivität darüber hinaus zum Einsatz in der Ethik-Fallberatung in unterschiedlichen außerklinischen Settings.

In October 2016, the White House, the European Parliament, and the UK House of Commons each issued a report outlining their visions on how to prepare society for the widespread use of artificial intelligence. In this article, we provide a comparative assessment of these three reports in order to facilitate the design of policies favourable to the development of a ‘good AI society’. To do so, we examine how each report addresses the following three topics: the development of a ‘good (...) AI society’; the role and responsibility of the government, the private sector, and the research community in pursuing such a development; and where the recommendations to support such a development may be in need of improvement. Our analysis concludes that the reports address adequately various ethical, social, and economic topics, but come short of providing an overarching political vision and long-term strategy for the development of a ‘good AI society’. In order to contribute to fill this gap, in the conclusion we suggest a two-pronged approach. (shrink)

Since approval of the EU General Data Protection Regulation (GDPR) in 2016, it has been widely and repeatedly claimed that the GDPR will legally mandate a ‘right to explanation’ of all decisions made by automated or artificially intelligent algorithmic systems. This right to explanation is viewed as an ideal mechanism to enhance the accountability and transparency of automated decision-making. However, there are several reasons to doubt both the legal existence and the feasibility of such a right. In contrast to the (...) right to explanation of specific automated decisions claimed elsewhere, the GDPR only mandates that data subjects receive meaningful, but properly limited, information (Articles 13-15) about the logic involved, as well as the significance and the envisaged consequences of automated decision-making systems, what we term a ‘right to be informed’. Further, the ambiguity and limited scope of the ‘right not to be subject to automated decision-making’ contained in Article 22 (from which the alleged ‘right to explanation’ stems) raises questions over the protection actually afforded to data subjects. These problems show that the GDPR lacks precise language as well as explicit and well-defined rights and safeguards against automated decision-making, and therefore runs the risk of being toothless. We propose a number of legislative and policy steps that, if taken, may improve the transparency and accountability of automated decision-making when the GDPR comes into force in 2018. (shrink)

Artificial intelligence (AI) is increasingly relied upon by clinicians for making diagnostic and treatment decisions, playing an important role in imaging, diagnosis, risk analysis, lifestyle monitoring, and health information management. While research has identified biases in healthcare AI systems and proposed technical solutions to address these, we argue that effective solutions require human engagement. Furthermore, there is a lack of research on how to motivate the adoption of these solutions and promote investment in designing AI systems that align with values (...) such as transparency and fairness from the outset. Drawing on insights from psychological theories, we assert the need to understand the values that underlie decisions made by individuals involved in creating and deploying AI systems. We describe how this understanding can be leveraged to increase engagement with de-biasing and fairness-enhancing practices within the AI healthcare industry, ultimately leading to sustained behavioral change via autonomy-supportive communication strategies rooted in motivational and social psychology theories. In developing these pathways to engagement, we consider the norms and needs that govern the AI healthcare domain, and we evaluate incentives for maintaining the status quo against economic, legal, and social incentives for behavior change in line with transparency and fairness values. To create fair and accountable AI and robotics, we need precise regulation and better methods to certify, explain, and audit inscrutable systems.

Firms are increasingly personalising their offers and services, leading to an ever finer-grained segmentation of consumers online. Targeted online advertising and online price discrimination are salient examples of this development. While personalisation's overall effects on consumer welfare are expectably ambiguous, it can lead to concentration in the distribution of advertising and commercial offers. Constellations are possible in which a market is generally open to competition, but the targeted consumer is only made aware of one possible seller. For the consumer, such (...) a market could effectively resemble a monopoly. We call such extreme cases ‘targeting pockets’. Competition-law metrics such as the Herfindahl–Hirschman Index and traditional means of public oversight of adverts would not detect this concentration. We, therefore, suggest a novel metric, the Concentration-after-Personalisation Index (CAPI). The CAPI treats every consumer as a separate ‘market’, computes a measure of concentration for personalised adverts and offers for each individual consumer separately, and then averages the result to measure the exposure experienced by an average consumer. We demonstrate how the CAPI can serve as a monitoring tool for regulators and auditors and thus help to enforce existing consumer law as well as proposed new regulations such as the European Union's Digital Services Act and its Artificial Intelligence Act. We further show how adding noise via randomly distributed non-personalised adverts can dilute the potential harm of overly concentrated personalisation. We demonstrate how the CAPI can identify the optimal degree of added noise, balancing the protection of consumer choice with the economic interests of advertisers. (shrink)

Online targeting isolates individual consumers, causing what we call epistemic fragmentation. This phenomenon amplifies the harms of advertising and inflicts structural damage to the public forum. The two natural strategies to tackle the problem of regulating online targeted advertising, increasing consumer awareness and extending proactive monitoring, fail because even sophisticated individual consumers are vulnerable in isolation, and the contextual knowledge needed for effective proactive monitoring remains largely inaccessible to platforms and external regulators. The limitations of both consumer awareness and of (...) proactive monitoring strategies can be attributed to their failure to address epistemic fragmentation. We call attention to a third possibility that we call a civic model of governance for online targeted advertising, which overcomes this problem, and describe four possible pathways to implement this model. In information societies, operations, decisions and choices previously left to humans are increasingly delegated to algorithms, which may advise, if not decide, about how data should be interpreted and what actions should be taken as a result. More and more often, algorithms mediate social processes, business transactions, governmental decisions, and how we perceive, understand, and interact among ourselves and with the environment. Gaps between the design and operation of algorithms and our understanding of their ethical implications can have severe consequences (...) affecting individuals as well as groups and whole societies. This paper makes three contributions to clarify the ethical importance of algorithmic mediation. It provides a prescriptive map to organise the debate. It reviews the current discussion of ethical aspects of algorithms. And it assesses the available literature in order to identify areas requiring further work to develop the ethics of algorithms. Nearly fifteen years after the Council of Europe first called for a pan‐European convention on issues in bioethics to harmonize disparate national regulations, in November 1996 the council's Committee of Ministers approved the Convention on Human Rights and Biomedicine for formal adoption. The draft convention, released in July 1994, provoked strong public, professional, and governmental debate among European nations, particularly regarding provisions for biomedical research with subjects unable to give informed consent. This article introduces the notion of the directedness of a process, which underlies event causation as well as the persistence of things. Using this notion it investigates what happens in typical cases of active event causation. Causes never necessitate their effects because even non- probabilistic causes can be counteracted.

The dilemma of free will is that if actions are caused deterministically, then they are not free, and if they are not caused deterministically then they are not free either because then they happen by chance and are not up to the agent. I propose a conception of free will that solves this dilemma. It can be called agent causation but it differs from what Chisholm and others have called so.

During his internship the medical student often feels a basic need for ethical discussion. The department of medical ethics at the University of Nijmegen offers a monthly discussion in single clinical departments. The ethicist is then assisted by staff responsible for guiding the interns. These discussions, based on daily experience, aim at critical evaluation of ways the profession is being exercised. As such they form an essential counterpart to the more theoretical learning in classrooms and seminars during previous years. The (...) method is rather flexible. Either an inventory of problems is made, followed by a selection and discussion of one problem. Or a discussion is initiated by an introduction by either staff or ethicist. It is generally accepted that bioethics is an interdisciplinary science. Why this is so and what it means is not always clear or agreed upon and, in this author's view, its implications are insufficiently researched. On the basis of involvement in projects which were labelled interdisciplinary, the author reflects upon the method of interdisciplinarity, especially its starting point. It is suggested that interdisciplinarity cannot thrive unless it curbs, from the very start, the inevitable reductions of all monodisciplinary approaches. This effort (...) is called methodical epochè, ideally the temporary suspension of all known methods. Its purpose is to achieve an interdisciplinary way of stating the question. Until then no breakdown of the global question by particular methods of single disciplines ought to be attempted. Realistic variations of this ideal are also discussed. The problem of the nation is articulated as the philosophical problem of the relation between the political and the non-political in the context of modernity. When the political relevance of traditional non-political bonds is removed, a new cohesion needs to be found between free and equal individuals. Three solutions are possible. The liberal-universalistic solution claims that there is no other source of unity than the political process itself; it finds the ingredients of political loyalty in the common rational agreement upon (...) principles of democracy. The nationalistic solution is an attempt to find those ingredients in particularistic allegiances of a non-political, ethnic-cultural nature. Both solutions, present in the old French-German debate on the nation, as well as in recent debates between liberalism and communitarianism, are criticized. Their revival in recent times is explained by the fact that they both represent an erosion of the political sphere that is characteristic for a post-ideological society. The first neglects the specific determinateness of the political, reducing it to the internationality of the market or to the moralism of rights. The second neglects the political nature of democratic legitimation by founding it on the claim to embody a particular culture or „Volk”. — In a discussion with Sandel, it is agreed that the political dimension needs a determinate form of collective identity and a non-contractual form of foundation. This form should not be situated however in the imaginary givenness of an ethnic-cultural context, but in the common undertaking of the moral task of institutionalizing ideals of liberty. These ideals are not an abstract set of principles, but are necessarily mediated by a particular common heritage or a political culture. Finally it is shown that such interpretation of nation or national citizenship is parallel to recent philosophical endorsement of ideals of civic republicanism or constitutional patriotism. (shrink)

In celebration of the centennial of the Institute of Philosophy of the Catholic University of Leuven, a series of lectures was organized to outline the evolution of various philosophical disciplines in the time span 1889-1989. The lcture on ethics was an attempt to depict the transition from foundational and universalist ethics into a hermeneutical type of ethics that is anti-foundational and particularistic. Such can be interpreted as a transition from modernity into post-modernity,or from ethics into post-ethics : it is the (...) abandonment of the belief that ethics might offer a rational legitimation of ethical principles, or that such principles might be shown to be universal dictates of reason. Several historical and philosophical aspects of this criticism of rationalistic ethics are traced and evaluated, in discussion with authors such as Nussbaum, Rorty, Walzer, and Lévi-Strauss. — 1. The post-modern rehabilitation of moral sensitivity correctly criticizes the poverty of a moral life that is only based on principles. However, it is shown that even loyalty to a particular person or group can only be of an ethical nature ifsome universality is presupposed. — 2. The post-modern rehabilitation of tradition is based on two arguments: moral judging can only occur within a particular way of life, and this particularism is the most efficient anti-dote against totalitarian powers of rationalization and homogenization. Nevertheless, it is evidenced that the universalism of human rights is needed to safeguard such particularism. — 3. Other motives in the criticismof a universalist ethical theory derive from the Wittgensteinian or Heideggerian rejection of humanism as a form of subjectivism or anthropocentrism. The final conclusion is that the particularity of ethos has an important role to playin the development of our moral sense, but that this role is essentially heuristic. Thisparticularity is the experiential matrix for a responsibility that is nevertheless of a universal nature. Ethics can never be equated with the articulation of a particular way of life, or ethos, because it needs the tension between facts and values. Without such atension it is reduced to a positivism of culture. The foundational questions should not be abandoned. They are not rationalistic abstractions precluding experience, but they are the reminders that our norms are norms, i.e. tasks to be fulfilled and not just actualsocial sentiments and preferences.
