This article probes the usefulness of selected theories from Cognitive Linguistics in the context of statutory interpretation. The presumption of legal language is a well-established rule of statutory construction in Polish legal practice that comes from the internationally recognised theory by Jerzy Wróblewski. It rests on a controversial assumption that there are different levels of generality in legal language (i.e. the language of statutes) and a single term may be given different meanings depending on the level of generality that (...) is referred to. The authors use the notion of basic level categorisation from the cognitive theory of prototypes to explain this mechanism. Legal concepts, not unlike ordinary concepts, form hierarchical taxonomies. A single term may denote concepts that are situated at different levels in different conceptual taxonomies. In the absence of special circumstances, a legal term should be given the meaning that resides at a higher level of categorisation in the respective legal taxonomy. This way, the presumption of legal language is found to be justified on both linguistic and psychological grounds. (shrink)

The skeptical solution is based on two assumptions — the rejection of semantic facts and the denial of semantic nihilism. On the basis of the non-factualist interpretation of this solution, these two assumptions are reconciled by stating that meaning ascriptions possess non-descriptive function. Nonetheless, Alexander Miller argues that this position is self-refuting since, as despite its non-descriptivism, by rejecting any kind of semantic facts, it inevitably leads to semantic nihilism. In this text, I demonstrate that Miller’s argument is not (...) sound. I argue that a coherent non-factualist way of formulating the conditions of correct use of meaning ascriptions may be performed by rejecting the closure principle of assertibility of meaning ascriptions. On this basis, I demonstrate that argument formulated against non-factualist interpretation by Miller may be refuted. What is more, I argue that rejection of the closure principle should be regarded as the central aspect of Kripke’s skeptical solution. (shrink)

Are interpersonal comparisons of desire possible? Can we give an account of how facts about desires are grounded, that underpins such comparisons? This paper supposes the answer to the first question is yes, and provides an account of the nature of desire that explains how this is so. The account is a modification of the interpretationist metaphysics of representation that the author has recently been developing. The modification is to allow phenomenological affective valence into the “base facts” on which correct (...) interpretation is grounded. To use this extra resource within that theory to vindicate interpersonal comparisons, we will need to appeal rational connections between level of valence and level of desire, which this paper sets out and examines. Theorists of public reason such as John Rawls often idealize constitutional courts as exemplars of public reason. This paper raises questions about the seduction and limits of analogies between theorists’ account of public reason and actual constitutional jurisprudence. Examining the work product of the United States Supreme Court, the paper argues that while it does engage in reason-giving to support its decisions—as the public reason strategy suggests— those reasons are (largely) legalistic and specifically juristic reasons—not the theorists’ idealized moral-political reasons (...) on matters of fundamental principle. But if constitutional courts do not engage on matters of fundamental principle, then a public reason strategy for assuaging democratic worries about judicial review would no longer be open: prominent liberal and deliberative democratic theorists could no longer point to the alleged superiority of constitutional courts to speak in the name of, and for, the people’s shared political principles. The paper extends beyond the U.S. case study by pointing to three institutional factors explaining the disanalogy between what some constitutional courts do and what public reason theories require them to do. It concludes with considerations about whether the public reason strategy might be more successfully applied to international courts. (shrink)

Statutory interpretation involves the reconstruction of the meaning of a legal statement when it cannot be considered as accepted or granted. This phenomenon needs to be considered not only from the legal and linguistic perspective, but also from the argumentative one - which focuses on the strategies for defending a controversial or doubtful viewpoint. This book draws upon linguistics, legal theory, computing, and dialectics to present an argumentation-based approach to statutory interpretation. By translating and summarizing the existing legal (...) interpretative canons into eleven patterns of natural arguments - called argumentation schemes - the authors offer a system of argumentation strategies for developing, defending, assessing, and attacking an interpretation. Illustrated through major cases from both common and civil law, this methodology is summarized in diagrams and maps for application to computer sciences. These visuals help make the structures, strategies, and vulnerabilities of legal reasoning accessible to both legal professionals and laypeople. (shrink)

We propose a formal framework for interpretable machine learning. Combining elements from statistical learning, causal interventionism, and decision theory, we design an idealised explanation game in which players collaborate to find the best explanation for a given algorithmic prediction. Through an iterative procedure of questions and answers, the players establish a three-dimensional Pareto frontier that describes the optimal trade-offs between explanatory accuracy, simplicity, and relevance. Multiple rounds are played at different levels of abstraction, allowing the players to explore overlapping causal (...) patterns of variable granularity and scope. We characterise the conditions under which such a game is almost surely guaranteed to converge on a optimal explanation surface in polynomial time, and highlight obstacles that will tend to prevent the players from advancing beyond certain explanatory thresholds. The game serves a descriptive and a normative function, establishing a conceptual space in which to analyse and compare existing proposals, as well as design new and improved solutions. (shrink)

In _Feminist Interpretations of John Rawls_, Ruth Abbey collects eight essays responding to the work of John Rawls from a feminist perspective. An impressive introduction by the editor provides a chronological overview of English-language feminist engagements with Rawls from his Theory of Justice onwards. She surveys the range of issues canvassed by feminist readers of Rawls, as well as critics’ wide disagreement about the value of Rawls’s corpus for feminist purposes. The eight essays that follow testify to the continuing ambivalence (...) among feminist readers of Rawls. From the perspectives of political theory and moral, social, and political philosophy, the essayists address particular aspects of Rawls’s work and apply it to a variety of worldly practices relating to gender inequality and the family, to the construction of disability, to justice in everyday relationships, and to human rights on an international level. Timothy Williamson has proposed that we should give a ‘knowledge first’ twist to David Lewis’s account of content, maintaining that for P to be the content of one’s belief is for P to be the content that would be attributed by an idealized interpreter working under certain constraints, and that the fundamental constraint on interpretation is a principle of knowledge maximization. According to this principle, an interpretation is correct to the extent that it maximizes the number of knowledgeable (...) judgments the subject comes out as making. Here I will argue against knowledge maximization and two fallback positions suggested by Williamson’s discussion. Williamson intends the principle of knowledge maximization to form the basis of an argument against a certain sort of skepticism about judgment. In the final section I argue that the kind of general response to judgment skepticism envisaged by Williamson is neither desirable nor necessary. (shrink)

A simple, bivalent semantics is defined for Łukasiewicz’s 4-valued modal logic Łm4. It is shown that according to this semantics, the essential presupposition underlying Łm4 is the following: A is a theorem iff A is true conforming to both the reductionist and possibilist theses defined as follows: rt: the value of modal formulas is equivalent to the value of their respective argument iff A is true, etc.); pt: everything is possible. This presupposition highlights and explains all oddities arising in Łm4.
