Abstract

By countermeasures that the system of representative litigation, litigation representative is likely to collude with the other party to be representative of the interests of the damage, therefore, improve the supervision system of representative litigation mechanism, safeguard the legal representative of the replacement representative rights, the introduction of liability for damages is extremely necessary. Through game theory analysis, this paper draws a conclusion that in representative's lawsuit system, law representative will probably gang up with the other side party to damage the interests of representative's principal. So it's extremely essential to perfect the supervision mechanism in representative's lawsuit system, maintain the principal's rights by changing the lawsuit representative, and introduce compensation system for damage
