Abstract

A modernidade e suas instituições, Estado e mercado, significaram a vidahumana como uma potência produtiva para seu poder, biopoder. A inclusão davida humana nas estratégias do poder revela algumas contradições do Estadoe do direito. Na vida excluída opera um tipo de exceção jurídica em que osdireitos são suspensos realmente, embora estejam reconhecidos formalmente.É uma exceção não reconhecida como tal nem pelo Estado nem pelo direito.Essa falta de reconhecimento torna invisível, para o Estado e para o direito, avida excluída, incluindo-a como vida normal. O reconhecimento formal detodos os direitos e a suspensão, total ou parcial, dos mesmos opera como umaestratégia de inclusão/excludente da vida humana na lógica dos dispositivosde poder do Estado e do mercado.Modernity and its institutions, State and market, all have marked human lifeas a productive power giving room to biopower. The inclusion of this humanlife in the new strategies of power reveals some contradictions between Stateand Right. In the life that is excluded, these strategies operate a kind of judicialexception according to which, all rights are suspended in spite of their formalrecognition. The exception is not admitted by the State or by the instances ofRight. This very fact makes the excluded life invisible, both for the State andfor the instances of Right. It appears as normal. Thus, formal recognition ofrights or their suspension operate as a strategy of inclusion inthe logic of power devices that characterizes both State and market
