Abstract

En este trabajo intento discutir la interpretación de R.-P. Horstmann del concepto de derecho originario defendido en Grundlage des Naturrechts de Fichte. Horstmann considera que el derecho de propiedad es una ficción teórica pero sin realidad práctica. Contra su interpretación, intentaré mostrar que el derecho originario es el puente entre la teoría de la subjetividad y el derecho aplicado, porque contiene en su núcleo al derecho de propiedad.In this paper I try to argue against R.-P. Horstmann’s concept of original right upheld at Fichte’s Grundlage des Naturrechts. Horstmann thinks that the property right is a theoretical fiction but without any practical reality. Against his interpretation, I’ll try to show that the originary right is the bridge between the theory of subjectivity and applied right because it contains the property right in its core
