This paper argues that “free will” is vague. The argument has two steps. First, I argue that free will is a matter of degrees and, second, that there are no sharp boundaries separating free decisions and actions and non‐free ones. After presenting the argument, I focus on one significant consequence of the thesis, although others are mentioned along the way. In short, considerations of vagueness help understand the logic behind so‐called manipulation arguments, but also show why these arguments are ultimately (...) flawed. (shrink)

This paper argues that habits, just like beliefs, can guide intentional action. To do this, a variety of real-life cases where a person acts habitually but contrary to her beliefs are discussed. The cases serve as dissociations showing that intentional agency is possible without doxastic guidance. The upshot is a model for thinking about the rationality of habitual action and the rationalizing role that habits can play in it. This is a draft of my chapter on Negligence for the forthcoming Oxford Handbook in Moral Psychology. It discusses philosophical, psychological, and legal approaches to the attribution of culpability in cases of negligent wrongdoing.

This paper defends a version of the Simple View, the claim that someone intentionally φs only if the person intends to φ. To do this, I raise a problem for Bratman’s classic argument (1984, 1987) against it. The problem brings into focus an evaluative dimension behind the View, whose recognition allows for an improved version of it. With this improved version, I then go on to answer other criticisms that have been raised to it.

Philosophical accounts of moral responsibility are standardly framed by two platitudes. According to them, blame requires the presence of a moral defect in the agent and the absence of excuses. In this chapter, this kind of approach is challenged. It is argued that (a) people sometimes violate moral norms due to performance mistakes, (b) it often appears reasonable to hold them responsible for it, and (c) their mistakes cannot be traced to their moral qualities or to the presence of excuses. In this article, I examine recent debates concerning the existence and the nature of basic actions. The discussion is structured around four theses, with which Arthur Danto introduced basic actions to contemporary theorists. The theses concern (i) the relationship between agency and causality, (ii) the distinction between basic and complex actions, (iii) the regress argument for basic actions, and (iv) the structure of practical knowledge in the light of these actions.

:In this essay, I present an account of forgiveness as a process of emotional distancing. The central claim is that, understood in these terms, forgiveness does not require a change in judgment. Rationally forgiving someone, in other words, does not require that one judges the significance of the wrongdoing differently or that one comes to the conclusion that the attitudes behind it have changed in a favorable way. The model shows in what sense forgiving is inherently social, shows why we (...) should be pluralists about it, and provides a basis for arguing against the existence of necessary conditions of forgiving. In this review, I discuss recent advances in philosophical and psychological approaches to self-control. The review is divided in 4 parts, in which I discuss: a) different conceptions of self-control; b) standard methods for studying it; c) some models of how self-control is exercised; and d) the connections between self-control and other relevant psychological constructs. The review was originally commissioned by the John Templeton Foundation to provide an informative overview that would knit together different strands of current debates in the (...) field. Most human actions are complex, but some of them are basic. Which are these? In this paper, I address this question by invoking slips, a common kind of mistake. The proposal is this: an action is basic if and only if it is not possible to slip in performing it. The argument discusses some well-established results from the psychology of language production in the context of a philosophical theory of action. Philosophers of perception are familiar with the argument from illusion, at least since Hume formulated it to challenge a naïve form of realism. In this paper, I present an analogous argument but in the domain of action. It focuses on slips, a common kind of mistake. But, otherwise, it is structurally similar. The argument challenges some contemporary views about the nature of action inspired by Wittgenstein. The discussion shows how thinking about these common mistakes helps illuminate aspects of human agency (...) that tend to be overlooked whenever too much emphasis is placed on the rationality of human actions. In this introduction, we argue for a basic idea. Community-based spaces for promoting forgiveness and memory-making bear the promise of promoting some of the cultural transformations needed for thick, structural reconciliation. As we show by discussing some recent examples taken from the Colombian context of the past decade, these spaces do not compete, but actually complement a pragmatic, thin institutional design for reconciliation. This idea, as we discuss here, serves as the common thread connecting the articles in this special issue. (...) This is a draft of my chapter on Agency and Mistakes for the Routledge Handbook of Philosophy of Agency. In it, I focus on performance mistakes and distinguish them from other "derivative" mistakes that we make as agents. I argue that a proper understanding of these mistakes recommends a generalized fallibilism about human agency.

This volume brings together work in free will, ethics, metaethics, feminist theory, disability studies, experimental philosophy, and psychology. The theme for both the workshop and these papers was “Non-Ideal Agency and Responsibility,” and in these essays, our authors take a number of different and creative angles on this theme. Roughly half of the essays fall under the rubric of non-ideal agency. They discuss ways in which our agency is impacted by inherent psychological limitations, by the social contexts in which we (...) act, or by different ways in which our abilities can break down. The other half fall under the rubric of non-ideal responsibility. They discuss both the modes by which we assess imperfect exercises of our agency and the ways in which common forms of assessment are themselves imperfect. (shrink)

Fitouchi et al. claim that seemingly victimless pleasures and nonproductive activities are moralized because they alter self-control. Their account predicts that: (1) victimless excesses are negatively moralized because they diminish self-control, and (2) restrained behaviors are positively moralized because they enhance self-control. Several examples run contrary to these predictions and call into question the general relationship between self-control and cooperation.

This text, commissioned by the OSUN Global Observatory of Academic Freedom, discusses how the concept of academic freedom is codified in Colombian Law and regulations of public and private higher education institutions. It also explores common conceptions of academic freedom among Colombian scholars, as well as commonly observed threats to it.

Are we ever morally permitted to do what is morally wrong? It seems intuitive that we are, but evidence for dissociations among judgment of permissibility and wrongness are relatively scarce. Across 4 experiments (N = 1,438), we show that people judge that some behaviors can be morally wrong and permissible. The dissociations arise because these judgments track different morally relevant aspects of everyday moral encounters. Judgments of individual rights predicted permissibility but not wrongness, while character assessment predicted wrongness but not (...) permissibility. These findings suggest a picture in which moral evaluation is granular enough to express reasoning about different types of normative considerations, notably the possibility that people can exercise their rights in morally problematic ways. Being compassionate and empathic while making rational decisions is expected from healthcare workers across different contexts. But the daily challenges that these workers face, aggravated by the recent COVID-19 crisis, can give rise to compassion and decision fatigue, which affects not only their ability to meet these expectations but has a significant negative impact on their wellbeing. Hence, it is vital to identify factors associated to their exhaustion. Here, we sought to describe levels of compassion and decision fatigue during the (...) pandemic, and to identify factors related to these forms of exhaustion. We collected data using self-reported questionnaires to measure compassion fatigue, decision fatigue, and grit in five intervals from April to November, 2020 (N = 856). Our results showed a negative correlation between grit and compassion and decision fatigue. We also found that under the circumstances studied grit tends to be higher in technicians, nurses, other professionals (psychologists, social workers), and workers at the Emergency Room (ER), and lower in general practitioners. Compassion fatigue tend to be higher for technicians, whereas decision fatigue was lower for specialists, general practitioners, and technicians, and higher for those working at private hospitals. En este artículo se sostiene que existe una primacía de la práctica y la acción sobre el conocimiento intelectual y la contemplación. Si esta tesis fuese falsa, no resulta comprensible por qué la prudencia y el hombre prudente son la virtud suprema y el modelo de la vida buena en Aristóteles. La cuestión inicial es 1) ¿Cómo entender la racionalidad del deseo o qué significa deseo razonado?, y esto implica dos cuestiones adicionales: 2) ¿Qué es el silogismo práctico y qué (...) relación tiene con la recta razón? y 3) ¿cuál es la relación entre el razonamiento práctico, la prudencia y el hombre prudente? Estas cuestiones son analizadas para establecer algunas de las semejanzas y diferencias entre el silogismo práctico , los diversos tipos de inferencias prácticas y otros tipos de razonamientos, tratando de mostrar la relación que existe entre la formación del carácter o modo de ser, la recta razón y el silogismo práctico. This book explores the relevance of virtue theory to law from a variety of perspectives. The concept of virtue is central in both contemporary ethics and epistemology. In contrast, in law, there has not been a comparable trend toward explaining normativity on the model of virtue theory. In the last few years, however, there has been an increasing interest in virtue theory among legal scholars. 'Virtue jurisprudence' has emerged as a serious candidate for a theory of law and adjudication. Advocates (...) of virtue jurisprudence put primary emphasis on aretaic concepts rather than on duties or consequences. Aretaic concepts are, on this view, crucial for explaining law and adjudication. This book is a collection of essays examining the role of virtue in general jurisprudence as well as in specific areas of the law. Part I puts together a number of papers discussing various philosophical aspects of an approach to law and adjudication based on the virtues. Part II discusses the relationship between law, virtue and character development, with some of the essays selected analysing this relationship by combining both eastern perspectives on virtue and character with western approaches. Parts III and IV examine problems of substantive areas of law, more specifically, criminal law and evidence law, from within a virtue-based framework. Last, Part V discusses the relevance of empathy to our understanding of justice and legal morality. (shrink)

Hasta ahora, las discusiones sobre el multiculturalismo se han presentado como una revisión progresista de los límites del liberalismo en cuanto a políticas de inclusión y reconocimiento. Este artículo plantea que la recepción del multiculturalismo en Latinoamérica, si no quiere ser puramente procedimental, puede plantearse como una deconstrucción de los conceptos de Sujeto y Estado. Para ello hemos adoptado el punto de vista de comunidades étnicamente diferenciadas (que Deleuze y Guattari han categorizado como máquinas territoriales), de modo que sus relaciones (...) de poder y sus procesos de subjetivación puedan ser vistos como expresión de lo intraestatal y lo preindividual, respectivamente. Aunque esta diferencia de perspectiva se plantea, básicamente, como un diferendo entre teorías, al final se sugieren criterios para un debate más amplio sobre las relaciones entre Estado y capitalismo alrededor de las condiciones de existencia de las sociedades premodernas. The purpose of this paper is to compare disagreement in two different WhatsApp groups: one for members of the same family, and another for work colleagues. After the analysis, 427 instances of disagreement were identified in the family group, and 161 in the interactions between work colleagues. The most common strategy in both corpora is ‘Giving opposite opinions’. Nevertheless, the rest of the results present very significant dissimilarities, most notably the higher presence of disagreement in the family WhatsApp group. This (...) higher tolerance for disagreement is corroborated by the choice of linguistic strategies made. Whereas the family members tended to give emotional or personal reasons for disagreement, as well as negative comments on the topic, the colleagues preferred to express their disagreement with mitigating expressions and token agreement. Thus, in the corpora studied, the expression of disagreement seems to be less face threatening for family members than for work colleagues. (shrink)

Resumo: Meu objetivo aqui é indagar como devemos entender a literatura das sagas, textos em prosa islandeses da Idade Medía; O ápice da produção de sagas ocorreu entre a segunda metade do século XIII e a primeira metade do XIV. Estou interessado de modo geral na representação que essas sagas produziram a respeito do período alto-medieval dos “vikings”, onde frequentemente sucede a ação contida em seus relatos; e pontualmente, na figura dos pagãos e dos magos do período pré-cristão ali apresentada.

RESUMEN En este artículo propongo revisar las aproximaciones de Mabel Moraña y Antonio Cornejo Polar al clivaje paradigmático entre las figuras de José María Arguedas y Mario Vargas Llosa en la cultura latinoamericana. En ese marco, tanto Cornejo Polar como Mabel Moraña desarrollan, en su propio lenguaje, preguntas por los dispositivos de poder y por las estrategias de resistencia que derivan de las relaciones entre literatura y máquinas sociales planteadas por Deleuze y Guattari, en una perspectiva decolonial. Este será el (...) contenido de la primera parte. En la segunda, quisiera seguir el derrotero de Cornejo Polar en la creación del concepto de 'subjetividad heterogénea', que condensa la experiencia de la migración interna en los países andinos y está presente con especial intensidad lingüística y performativa en El zorro de arriba y el zorro de abajo, la última obra de Arguedas. ABSTRACT This article intends to review the approaches of Mabel Moraña and Antonio Cornejo Polar to the paradigmatic cleavage between the figures of José María Arguedas and Mario Vargas Llosa in Latin American culture. Within this framework, both Cornejo Polar and Mabel Moraña develop, in their own language, questions about power devices and resistance strategies derived from relationships between literature and social machines raised by Deleuze and Guattari, from a decolonial perspective. This will be the content of the first part. In the second, it would like to follow Cornejo Polar's path in creating the concept of 'heterogeneous subjectivity', which condenses the experience of internal migration in the Andean countries and is present with particular linguistic and performance intensity in El zorro de arriba y el zorro de abajo, the last work of Arguedas. The aim of this essay is to develop a coherence theory for the justification of evidentiary judgments in law. The main claim of the coherence theory proposed in this article is that a belief about the events being litigated is justified if and only if it is a belief that an epistemically responsible fact finder might hold by virtue of its coherence in like circumstances. The article argues that this coherentist approach to evidence and legal proof has the resources to (...) meet some of the main objections that may be addressed against attempts to analyze the justification of evidentiary judgments in law in coherentist terms. It concludes by exploring some implications of the proposed version of legal coherentism for a jurisprudence of evidence. (shrink)

This paper argues for a coherentist theory of the justification of evidentiary judgments in law, according to which a hypothesis about the events being litigated is justified if and only if it is such that an epistemically responsible fact-finder might have accepted it as justified by virtue of its coherence in like circumstances. It claims that this version of coherentism has the resources to address a main problem facing coherence theories of evidence and legal proof, namely, the problem of the (...) coherence bias. The paper then develops an aretaic approach to the standards of epistemic responsibility which govern legal fact-finding. It concludes by exploring some implications of the proposed account of the justification of evidentiary judgments in law for the epistemology of legal proof. (shrink)

El presente artículo propone un modelo de análisis para orientar el discernimiento y posicionamiento en torno al uso de la IA en educación superior. Analizaremos los cuatro posibles usos de la IA que más incidencia tendrán en esta si se considera el actual desarrollo de esta tecnología. Ellos son: la co-construcción de conocimiento, el uso de IA para tutoría o mentoreo, el auge de las plataformas adaptativas y la capacidad predictiva. Propondremos un ejercicio de análisis para cada uso apelando a (...) algunas de las dimensiones del modelo propuesto para orientar sobre su utilización. El resultado es fecundo, en tanto advierte sobre el riesgo de parcializar el análisis perdiendo de vista las implicancias y los compromisos más profundos que exige el discernimiento sobre el uso de la IA. In _Basic Concepts_, Heidegger claims that "Being is the most worn-out" and yet also that Being "remains constantly available." Santiago Zabala radicalizes the consequences of these little known but significant affirmations. Revisiting the work of Jacques Derrida, Reiner Schürmann, Jean-Luc Nancy, Hans-Georg Gadamer, Ernst Tugendhat, and Gianni Vattimo, he finds these remains of Being within which ontological thought can still operate. Being is an event, Zabala argues, a kind of generosity and gift that generates astonishment in those who experience (...) it. This sense of wonder has fueled questions of meaning for centuries-from Plato to the present day. Postmetaphysical accounts of Being, as exemplified by the thinkers of Zabala's analysis, as well as by Nietzsche, Dewey, and others he encounters, don't abandon Being. Rather, they reject rigid, determined modes of essentialist thought in favor of more fluid, malleable, and adaptable conceptions, redefining the pursuit and meaning of philosophy itself. (shrink)

This paper articulates an egalitarian conception of judicial humility and justifies its value on the grounds that it importantly advances the legal and political ideal of fraternity. This account of the content and value of the virtue of humility stands in sharp contrast with the dominant view of judicial humility as deference or judicial restraint. The paper concludes by discussing some ways in which the account of humility and of its value provided in the paper furthers our understanding of the (...) judicial virtues and of the political implications of giving virtue a role in adjudication. In this paper, we argue for an instrumental form of existence, inspired by Hilbert’s method of ideal elements. As a case study, we consider the existence of contradictory objects in models of non-classical set theories. Based on this discussion, we argue for a very liberal notion of existence in mathematics.

First collected in Italy in 1985, _Art's Claim to Truth_ is considered by many philosophers to be one of Gianni Vattimo's most important works. Newly revised for English readers, the book begins with a challenge to Plato, Aristotle, Kant, and Hegel, who viewed art as a metaphysical aspect of reality rather than a futuristic anticipation of it. Following Martin Heidegger's interpretation of the history of philosophy, Vattimo outlines the existential ontological conditions of aesthetics, paying particular attention to the works of (...) Kandinsky, which reaffirm the ontological implications of art. Vattimo then builds on Hans-Georg Gadamer's theory of aesthetics and provides an alternative to a rationalistic-positivistic criticism of art. This is the heart of Vattimo's argument, and with it he demonstrates how hermeneutical philosophy reaffirms art's ontological status and makes clear the importance of hermeneutics for aesthetic studies. In the book's final section, Vattimo articulates the consequences of reclaiming the ontological status of aesthetics without its metaphysical implications, holding Aristotle's concept of beauty responsible for the dissolution of metaphysics itself. In its direct engagement with the works of Gadamer, Heidegger, and Luigi Pareyson, _Art's Claim to Truth_ offers a better understanding of the work of Vattimo and a deeper knowledge of ontology, hermeneutics, and the philosophical examination of truth. Theories of emotional justification investigate the conditions under which emotions are epistemically justified or unjustified. I make three contributions to this research program. First, I show that we can generalize some familiar epistemological concepts and distinctions to emotional experiences. Second, I use these concepts and distinctions to display the limits of the ‘simple view’ of emotional justification. On this approach, the justification of emotions stems only from the contents of the mental states they are based on, also known as their (...) cognitive bases. The simple view faces the ‘gap problem’: If cognitive bases and emotions (re)present their objects and properties in different ways, then cognitive bases are not sufficient to justify emotions. Third, I offer a novel solution to the gap problem based on emotional dispositions. This solution (1) draws a line between the justification of basic and non-basic emotions, (2) preserves a broadly cognitivist view of emotions, (3) avoids a form of value skepticism that threatens inferentialist views of emotional justification, and (4) sheds new light on the structure of our epistemic access to evaluative properties. The university that Alasdair MacIntyre defines as liberal is that which rejects the tradition as something pre-modern and with an impediment for the progress, including the pedagogic one. This university model has been extended in all instances, giving priority to the technical education in a pragmatic way. Thus, the global and sapiential vision of the university has been relegated. This last approach is the key for unifying the knowledge and to pass it onto other people and, therefore, to educate and (...) mold intellectually and morally. However, the professionalization of the philosophy and the criteria of the modern liberalism seem to dominate and inspire most universities in the present day. This situation has plainly shown an inability to become aware of their incompetence to properly educate professors and students alike, in a sapiential and moral manner, threfore deceiving themselves with a naive rhetoric.
