In this paper we argue for a naturalistic solution to some of the methodological controversies in regulatory science, on the basis of two case studies: toxicology and health claim regulation. We analyze the debates related to the scientific evidence that is considered necessary for regulatory decision making in each of those two fields, with a particular attention to the interactions between scientific and regulatory aspects. This analysis allows us to identify two general stances in the debate: a) one that argues (...) for more permissive standards of evidence and for methodological pluralism, and b) an opposing one that not only defends strict evidence requirements but also stipulates the use of one particular scientific methodologies for data generation. We argue that the real-world outcomes produced by alternative regulatory options are a vital piece of information that allows for the empirical assessment of these two stances. In particular, this information on outcomes makes it possible to analyze which standards of evidence and scientific methods generate the most useful knowledge as input for regulatory decision making. Our conclusion is that instead of an a priori selection of methodologies and standards, such decisions ought to be based on empirical evidence related to real-world outcomes. (shrink)

Regulatory science, which generates knowledge relevant for regulatory decision?making, is different from standard academic science in that it is oriented mainly towards the attainment of non?epistemic (practical) aims. The role of uncertainty and the limits to the relevance of academic science are being recognized more and more explicitly in regulatory decision?making. This has led to the introduction of regulation?specific scientific methodologies in order to generate decision?relevant data. However, recent practical experience with such non?standard methodologies indicates that they, too, may be (...) subject to important limitations. We argue that the attainment of non?epistemic values and aims (like the protection of human health and the environment) requires not only control of the quality of the data and the methodologies, but also the selection of the level of regulation deemed adequate in each specific case (including a decision about which of the two, under?regulation or over?regulation, would be more acceptable). The relevance of scientific knowledge for science and technology policy and regulation has led to a growing debate about the role of values. This article contributes to the clarification of what specific functions cognitive and noncognitive values adopt in knowledge generation and decisions, and what consequences the operation of values has for policy making and regulation. For our analysis, we differentiate between three different types of decision approaches, each of which shows a particular constellation of cognitive and noncognitive values. Our (...) objectives are to present a structured analysis of the varying functions that different kinds of values can adopt, as well as the value-related tensions and trade-offs they give rise to. We argue that the operation of noncognitive values in scientific knowledge generation, policy, and regulatory decision making can be understood as an enabling factor, rather than a limiting one. Mechanistic information is used in the field of risk assessment in order to clarify two controversial methodological issues, the selection of inference guides and the definition of standards of evidence. In this paper we present an analysis of the concept of mechanistic information in risk assessment by recurring to previous philosophical analyses of mechanistic explanation. Our conclusion is that the conceptual analysis of mechanistic explanation facilitates a better characterization of the concept of mechanistic information. However, it also shows that the (...) use of this kind of information in risk assessment is heavily influenced by pragmatic factors, which have not been sufficiently taken into account in philosophical analysis. Mechanistic models are like hypothesis that have to be validated empirically. Due to their dependence on the standards of evidence, they are subject to the same pragmatic factors. Therefore, recurring to mechanistic information does not lead to closure of the methodological controversies in risk assessment. (shrink)

Por ello es necesario analizar cada innovación valorando los posibles riesgos y los posibles beneficios sociales, y decidir en cada caso cuál de las dos posibilidades, la subregulación o la sobrerregulación, es más aceptable. This means that the WOE approach does not automatically lead to a higher level of health or environmental protection. It is therefore necessary to analyze each innovation on a case-by-case basis in order to evaluate its risks and benefits, and decide if to accept lower or, on the contrary, higher standards for its regulation. Is there such a thing as a “best scientific methodology” in regulatory science? By examining cases from varying regulatory processes, we argue that there is no best scientific method for generating decision-relevant data. In addition, in regulatory science, the most suitable methodologies often differ from what is considered best practice in knowledge-oriented science. In data generation for regulatory purposes, we are faced with a wide spectrum of preferred methodologies as well as controversy as to methodological choice. What goes by the (...) most adequate scientific method can and will—justifiably and rationally—vary significantly according to context and use. In order to make this argument, we analyze four case studies, two from risk assessment and two from benefit assessment. Our analysis shows that it is the noncognitive objectives of a particular regulatory process that determine what counts as the most appropriate scientific method. We use the concept of bounded rationality to indicate that those methodological choices, despite being context-dependent, can be interpreted as rational. (shrink)

The function and legitimacy of values in decision making is a critically important issue in the contemporary analysis of science. It is particularly relevant for some of the more application-oriented areas of science, specifically decision-oriented science in the field of regulation of technological risks. Our main objective in this paper is to assess the diversity of roles that non-cognitive values related to decision making can adopt in the kinds of scientific activity that underlie risk regulation. We start out, first, by (...) analyzing the issue of values with the help of a framework taken from the wider philosophical debate on science and values. Second, we study the principal conceptualizations used by scholars who have applied them to numerous case studies. Third, we appraise the links between those conceptualizations and learning processes in decision-oriented science. In this, we recur to the concept of methodological learning, i.e., learning about the best methodologies for generating knowledge that is useful for science-based regulatory decisions. The main result of our analysis is that non-cognitive values can contribute to methodological improvements in science in three principal ways: as basis for critical analysis, for contextualizing methodologies, and for establishing the burden of proof. The issue of internalism and externalism in historiography of science was intensely debated two decades ago. The conclusions of such debate on the ‘context of science’ appear to be a reinstatement of the positivist view of the ‘content of science’ as comprising only ideas and concepts uninfluenced by extra-scientific factors. The description of the roles of politics, economy, and socio-cultural factors in science was limited only within the ‘context of science’. This article seeks to resituate the ‘content of science’ debate (...) within the historical accounts of the Scientific Revolution to illustrate that their resort to historicism indicates that such content does not emerge from the void. It argues that, though some historicist accounts like Alexandre Koyré’s reinstate the positivist argument on the nature of the ‘content of science’, such historicist internalism greatly differs from positivist internalism, largely due to its acceptance of metaphysics in science. Therefore, as long as historicism is relied on to describe the content of science, a clear-cut distinction of the historicist internalism and externalism will be difficult to establish. (shrink)

This paper argues for the theoretical and practical validity of similarity as a useful epistemological tool in scientific knowledge generation, specifically in chemistry. Classical analyses of similarity in philosophy of science do not account for the concept’s practical significance in scientific activities. We recur to examples from chemistry to counter the claim of authors like Quine or Goodman to the effect that similarity must be excluded from scientific practices . In conclusion we argue that more recent conceptualizations of the notion (...) of similarity, particularly Giere’s one, are appropriate for a philosophical analysis that considers scientific practices on equal terms with scientific theory. En el primer capítulo de su libro Duchesneau aborda la cuestión de lo que es una especie, algo de difícil solución porque el de especie es un concepto de una potencia heurística inmensa y, a la vez, está lleno de agujeros que se hacen patentes en cuanto se pretende hilar fino para definirlo. Las alternativas entre la especie como grupo reproductivo -la "especie biológica"- y como secuencia evolutiva -la "especie filogenética"-, con sus respectivas precisiones internas, están bien planteadas por el (...) autor. También lo está la más reciente "especie ecológica", de talante adaptacionista. Duchesneau no pretende argumentar en favor de uno u otro concepto, sino indicar que existen, y de su postura aséptica se deduce que, probablemente, es imposible reducir ninguno de esos conceptos al otro. Pero esa conclusión tropieza de inmediato con el asunto que aborda Duchesneau en el epígrafe siguiente de su libro: la taxonomía. Porque en algo coinciden al menos quienes emplean especies biológicas, filogenéticas y ecológicas: en darles un nombre. No es raro, pues, que la sistemática sea en estos momentos una de las disciplinas que tenga más interrogantes por resolver. (shrink)

Essays on the role of the body in self-consciousness, showing that full-fledged, linguistic self-consciousness is built on a rich foundation of primitive, nonconceptual self-consciousness. These essays explore how the rich and sophisticated forms of self-consciousness with which we are most familiar—as philosophers, psychologists, and as ordinary, reflective individuals—depend on a complex underpinning that has been largely invisible to students of the self and self-consciousness. José Luis Bermúdez, extending the insights of his groundbreaking 1998 book, The Paradox of Self-Consciousness, (...) argues that full-fledged, linguistic self-consciousness is built on a rich foundation of primitive, nonconceptual self-consciousness, and that these more primitive forms of self-consciousness persist in ways that frame self-conscious thought. They extend throughout the animal kingdom, and some are present in newborn human infants. Bermúdez makes the case that these primitive forms of self-awareness can indeed be described as forms of self-consciousness, arguing that they share certain structural and epistemological features with full-fledged, linguistic self-consciousness. He offers accounts of certain important classes of states of nonconceptual content, including the self-specifying dimension of visual perception and the content of bodily awareness, considering how they represent the self. And he explores the general role of nonconceptual self-consciousness in our cognitive and affective lives, examining in several essays the relation between nonconceptual awareness of our bodies and what has been called our “sense of ownership” for our own bodies. This article argues that bodily awareness is a basic form of self-consciousness through which perceiving agents are directly conscious of the bodily self. It clarifies the nature of bodily awareness, categorises the different types of body-relative information, and rejects the claim that we can have a sense of ownership of our own bodies. It explores how bodily awareness functions as a form of self-consciousness and highlights the importance of certain forms of bodily awareness that share an important epistemological property with (...) canonical forms of self-consciousness such as introspection. It is now 25 years since Gareth Evans introduced the distinction between conceptual and nonconceptual content in The Varieties of Reference. This is a fitting time to take stock of what has become a complex and extended debate both within philosophy and at the interface between philosophy and psychology. Unfortunately, the debate has become increasingly murky as it has become increasingly ramified. Much of the contemporary discussion does not do full justice to the powerful theoretical tool originally proposed by Evans (...) and subsequently refined by theorists in the late 1980’s and early 1990’s – most effectively, I think, by Christopher Peacocke (particularly in his 1992). Even worse, significant parts of the discussion are somewhat confused. This paper makes a start on clarifying what I think ought to be the central issues in debates about nonconceptual content. I begin in §1 by pointing out how narrowly focused contemporary discussion is relative to Evans’s original discussion. We are not making as much use as we should of nonconceptual content as a tool for understanding subpersonal information processing and the complexities of its status relative to perception and thought at the personal level. In §2 I turn to what is the central focus of contemporary discussion, namely, the content of perception and identify a “master argument” for nonconceptualism based on the relation between conceptual capacities and capacities for perceptual discrimination. The aim of §3 is to clarify the relation between the claim that perception has nonconceptual content and some superficially similar claims discussed by philosophers of perception. Finally, in §4 I explain why the attention recently focused on what is sometimes called the state version of the nonconceptualist thesis seems to me to be misdirected. (shrink)

Philosophical accounts of self-deception can be divided into two broad groups – the intentionalist and the anti-intentionalist. On intentionalist models what happens in the central cases of self-deception is parallel to what happens when one person intentionally deceives another, except that deceiver and deceived are the same person. This paper offers a positive argument for intentionalism about self-deception and defends the view against standard objections.

Frames and framing make one dimension of a decision problem particularly salient. In the simplest case, framesprimeresponses (as in, e.g., the Asian disease paradigm, where the gain frame primes risk-aversion and the loss frame primes risk-seeking). But in more complicated situations frames can function reflectively, by making salient particular reason-giving aspects of a thing, outcome, or action. For Shakespeare's Macbeth, for example, his feudal commitments are salient in one frame, while downplayed in another in favor of his personal ambition. The (...) role of frames in reasoning can give rise torational framing effects. Macbeth can prefer fulfilling his feudal duty to murdering the king, while also preferring bravely taking the throne to fulfilling his feudal duty, knowing full well that bravely taking the throne just is murdering the king. Such patterns ofquasi-cyclicalpreferences can be correct and appropriate from the normative perspective of how one ought to reason. The paper explores three less dramatic types of rational framing effects: (1) Consciously framing and reframing long-term goals and short-term temptations can be important tools for self-control. (2) In the prototypical social interactions modeled by game theory, allowing for rational framing effects solves longstanding problems, such as the equilibrium selection problem and explaining the appeal of non-equilibrium solutions (e.g., the cooperative solution in the Prisoner's Dilemma). (3) Processes for resolving interpersonal conflicts and breaking discursive deadlock, because they involve internalizing multiple and incompatible ways of framing actions and outcomes, in effect create rational framing effects. In Thinking without Words I develop a philosophical framework for treating some animals and human infants as genuine thinkers. This paper outlines the aspects of this account that are most relevant to those working in animal ethics. There is a range of different levels of cognitive sophistication in different animal species, in addition to limits to the types of thought available to non-linguistic creatures, and it may be important for animal ethicists to take this into account in exploring issues of (...) moral significance and the obligations that we might or might not have to non-human animals. In a recent paper, Fredérique de Vignemont has argued that there is a positive quale of bodily ownership . She thinks that tactile and other forms of somatosensory phenomenology incorporate a distinctive feeling of myness and takes issue with my defense in Bermúdez of a deflationary approach to bodily ownership. That paper proposed an argument deriving from Elizabeth Anscombe’s various discussions of what she terms knowledge without observation . De Vignemont is not convinced and appeals to the Rubber Hand Illusion (...) to undercut my appeal to Anscombe. Section 1 of this article restates the case against the putative quale of ownership. Section 2 explains why de Vignemonts’ objections miss the mark. Section 3 discusses in more detail how to draw a principled distinction between bodily awareness and ordinary perceptual awareness. My topic in this paper is social understanding. By this I mean the cognitive skills underlying social behaviour and social coordination. Normal, encultured, non-autistic and non-brain-damaged human beings are capable of an impressive degree of social coordination. We navigate the social world with a level of skill and dexterity fully comparable to that which we manifest in navigating the physical world. In neither sphere, one might think, would it be a trivial matter to identify the various competences which underly this (...) impressive level of performance. Nonetheless, at least as far as interpersonal interactions are concerned, philosophers show a rare degree of unanimity. What grounds our success in these interactions is supposed to be our common mastery of folk psychology. (shrink)

In their recent book The Inessential Indexical Herman Cappelen and Josh Dever take issue with what has become close to philosophical orthodoxy – the view, most often associated with John Perry and David Lewis, that psychological explanations are essentially indexical. Cappelen and Dever claim that claims of essential indexicality are typically driven by intuitions rather than supported by arguments. They issue a challenge to supporters of essential indexicality: Produce an argument to back up the intuitions. This paper answers their challenge.

Philosophers have often argued that ascriptions of content are appropriate only to the personal level states of folk psychology. Against this, this paper defends the view that the familiar propositional attitudes and states defined over them are part of a larger set of cognitive proceses that do not make constitutive reference to concept possession. It does this by showing that states with nonconceptual content exist both in perceptual experience and in subpersonal information-processing systems. What makes these states content-involving is their (...) satisfaction of certain basic conditions deriving from a general account of representation-driven behaviour that is neutral on the question of concept possession. It is also argued that creatures can be in states with nonconceptual content even though they possess no conceptual abilities at all. (shrink)

Decision Theory and Rationality offers a challenging new interpretation of a key theoretical tool in the human and social sciences. This accessible book argues, contrary to orthodoxy in politics, economics, and management science, that decision theory cannot provide a theory of rationality.

Debates about bodily ownership and psychological ownership have typically proceeded independently of each other. This paper explores the relation between them, with particular reference to how each is illuminated by psychopathology. I propose a general framework for studying ownership that is applicable both to bodily ownership and psychological ownership. The framework proposes studying ownership by starting with explicit judgments of ownership and then exploring the bases for those judgments. Section 3 discusses John Campbell’s account of ψ-ownership in the light of (...) that general framework, emphasizing in particular his fractionation of ψ-ownership into two dissociable components. Section 4 briefly presents an account of φ-ownership that I have developed in more detail elsewhere. Section 5 explores the suggestion, originating with Alexandre Billon, that there needs to be an integrated account of φ-ownership and ψ-ownership because depersonalization disorders typically involve breakdowns of both φ-ownership and ψ-ownership. The argument from depersonalization is not compelling, but Section 6 proposes a different way of reaching the same conclusion. Section 7 shows how reflecting on agency and practical reasoning offers a common thread between the models of φ-ownership and ψ-ownership discussed earlier in the paper. (shrink)

This commentary defends intentionalist accounts of self-deception against Mele by arguing that: (1) viewing self-deception on the model of other-deception is not as paradoxical as Mele makes out; (2) the paradoxes are not entailed by the view that self-deception is intentional; and (3) there are two problems for Mele's theory that only an intentionalist theory can solve.

This paper argues that, while there is a difference between personal and sub-personal explanation, claims of autonomy should be treated with scepticism. It distinguishes between horizontal and vertical explanatory relations that might hold between facts at the personal and facts at the sub-personal level. Noting that many philosophers are prepared to accept vertical explanatory relations between the two levels, I argue for the stronger claim that, in the case of at least three central personal level phenomena, the demands of explanatory (...) adequacy require postulating horizontal explanatory relations. Psychiatric treatment and diagnosis rests upon a richer conception of normativity than, for example, cognitive neuropsychology. This paper explores the role that considerations of rationality can play in defining this richer conception of normativity. It distinguishes two types of rationality and considers how each type can break down in different ways in delusional psychiatric disorders.
