This paper examines the relationship between organizational ethical culture in two large international CPA firms, auditors'' personal values and the ethical orientation that those values dictate, and judgments in ethical dilemmas typical of those that accountants face. Using an experimental task consisting of multiple judgments designed to vary in "moral intensity" (Jones, 1991), and unique as well as tried-and-true approaches to variable measurements, this study examined the judgments of more than three hundred participants in our study. ANCOVA and path analysis (...) results indicate that: (1) Ethical judgments in situations of high moral intensity are affected by personal values and by environmental variables, such as the professional code of conduct (direct and indirect effects) and previous ethics instruction (direct effect only). (2) Corporate ethical culture, and a relatively strong firm rules-orientation, affect auditors'' idealism but not relativism, and therefore indirectly affect ethical judgments. Jones'' (1991) moral intensity argument is supported: differences in the characteristics of specific judgment tasks apparently result in different decision processes. (shrink)

This study developed and tested a model of culture’s effect on budgeting systems, and hypothesized that system variables and reactions to them are influenced by culture-specific work-related and ethical values. Most organizational and behavioral views of budgeting fail to acknowledge the ethical components of the problem, and have largely ignored the role of culture in shaping organizational and individual values. Cross-cultural differences in reactions to system design variables, and in the behaviors motivated or mitigated by those variables, has implications for (...) the design and effectiveness of budgeting systems. The data largely support our research model, demonstrating the hypothesized national cultural differences in system design variables (e.g., participation, standards tightness, budget emphasis, etc. which we characterized as the opportunity and incentives to create budgetary slack), and the expected relationship between incentives (but not opportunity) to create slack and slack creation behavior. The data demonstrate hypothesized cultural differences in ethical ideology but show ethical ideology related to slack creation behavior only for U.S. managers. The "Ibercorp affair" was front-page news in Spain at various times between 1992 and 1995. In itself, there was nothing particularly new about it: a newly formed financial group engaged in legally and ethically reprehensible behaviour that eventually came to light in the media, ruining the company (and the careers of those involved). What aroused public interest at the time was the fact that it involved individuals connected with Spanish public and political life, the media and certain business circles. Above (...) all, it demonstrated the personal, economic, social and political consequences of a business culture based on the pursuit of easy profits at any price (what came to be known as the cultura del pelotazo or "culture of the fast buck"). Again, this is all too familiar in business ethics. But it served to goad Spanish society into a rejection of such behaviour. This article describes the facts and their ethical implications. O campo interdisciplinar dos novos estudos sociais das infâncias parte de uma ruptura epistemológica com as abordagens clássicas das ciências que adotam visões biologizantes, essencialistas e universais da criança e encontra na etnografia uma possibilidade de conceituação de criança enquanto sujeito ativo e de infância enquanto categoria social geracional. O reconhecimento desses conceitos de criança e de infância pela etnografia na pesquisa com crianças implica voltar-se para a criança como o outro, o diferente, o estrangeiro. A proposta de ruptura teórico-conceitual (...) na investigação das infâncias exige a implementação de metodologias que focalizem as experiências, os pontos de vista e as vozes das crianças, compreendendo-as enquanto processo, em outras palavras, constante construção. Portanto, para essa perspectiva, a criança não é o objeto do estudo, mas é sujeito que interage com o pesquisador na construção dos sentidos e significados da pesquisa. O texto está organizado em três partes que abordam os aspectos epistemológicos, teórico-conceituais e metodológicos do debate proposto. Ao final, procura-se uma articulação entre os diferentes aspectos da discussão, propondo uma reflexão sobre a ética e a alteridade, reconhecendo que a diferença atravessa as relações humanas e, portanto, é o diferente, o incomum, o incompreensível, o oposto, o desigual, o inalcançável que marca e define a pesquisa com criança. This study examined the efficacy of corrected feedback for improving consent recall throughout the course of an ongoing longitudinal study. Participants were randomly assigned to either a corrected feedback or a no-feedback control condition. Participants completed a consent quiz 2 weeks after consenting to the host study and at months 1, 2, and 3. The corrected feedback group received corrections to erroneous responses and the no-feedback control group did not. The feedback group displayed significantly greater recall overall and in specific (...) content areas. Results support the use of corrected feedback for improving consent recall. (shrink)

This article addresses a common yet rarely discussed aspect of hospital care—a pro-active approach to ethical dilemmas. Potential ethical conflicts often present warning signs to clinicians, analogous to the warning lights on a car’s dashboard. Using a recent case study, a commonly encountered clinical decision—a conflict about whether to terminally extubate a critically ill patient versus whether to offer a tracheostomy— we describe a pro-active approach to ethical conflicts and outline three learning objectives: (1) the need for a robust understanding (...) of the term “futility,” (2) the need for an appreciation of the various and often conflicting interpretations of “improved/improving,” and (3) the need to understand the challenges of surrogate decision making. Is the flavor of mint reducible to the minty smell, the taste, and the menthol-like coolness on the roof of one’s mouth, or does it include something over and above these—something not properly associated with any one of the contributing senses? More generally, are there features of perceptual experiences—so-called novel features—that are not associated with any of our senses taken singly? This question has received a lot of attention of late. Yet surprisingly little attention has been paid to the question (...) of what it means to say that a feature is associated with a sensory modality in the first place. Indeed, there is only one fully developed proposal in the literature, due to Casey O’Callaghan. I argue that this proposal is too permissive to inform the debate over novel features. I go on to argue that all attempts to formulate a better proposal along these lines fail. The corollary of my arguments is that the question of the existence of novel features is poorly formed. Furthermore, the problem generalizes, with the result that we should not rely on our pre-theoretical notions of the senses as the basis of theorizing about the features of perceptual experiences. We examined the efficacy of including a research intermediary (RI) during the consent process in reducing participants' perceptions of coercion to enroll in a research study. Eighty-four drug court clients being recruited into an ongoing study were randomized to receive a standard informed consent process alone (standard condition) or with an RI (intermediary condition). Before obtaining consent, RIs met with clients individually to discuss remaining concerns. Findings provided preliminary evidence that RIs reduced client perceptions that their participation might influence how (...) clinical and judicial staff view them. This suggests that using RIs may improve participant autonomy in clinical studies. (shrink)

Philosophy is commonly criticized for being too abstract and detached from practical spheres. Upon chronicling how philosophy has gained this reputation, the authors explore the philosophical fields of phenomenology and hermeneutics that have explicitly attempted to merge philosophy with everyday life contexts. In recent decades, phenomenology and hermeneutics have been applied to healthcare. In the realm of nursing, Patricia Benner's nursing theory is especially informed by phenomenology, which is briefly explored through her relationship with one of her mentors, the (...) philosopher Hubert Dreyfus. The authors then turn their attention to Hans-Georg Gadamer's philosophy in an attempt to mine concepts relevant to the practice of nursing. Gadamer juxtaposed the human sciences from the natural sciences and thought that both needed different approaches: whereas natural sciences are guided by episteme, that is, universal knowledge, human sciences are guided by phronesis, that is, practical wisdom. Gadamer's philosophy is especially helpful in understanding how to cultivate phronesis in nursing wherein a nurse relies upon one's clinical experience to masterfully navigate each unique patient relationship. Nurses must serve as authorities in the realm of healthcare but also be open to the authority of their patients, who ultimately choose their course of treatment in our contemporary era of patient autonomy. Gadamer's philosophy can help us understand why phronesis requires not only practice but also reflection on that practice to be appropriately cultivated. The authors apply this to the realm of nursing in showing how both practice—clinically and via simulation—and reflection—through journaling or dialogue—are necessary for phronesis to emerge. Hence, just as Roe has been critical to the changing politics of gender, it has been the focus of a political debate about the meaning of personhood and morality of abortion, the (...) scope of individual freedom, and the judiciary's role in effecting social change. One of the most common threads in the Caribbean tapestry races which have populated the region over the last five centuries largely through forced or voluntary migration, is that there have emerged mixtures of the different racial groups. A large proportion of Caribbean women and men are referred to euphemistically as ‘mixed race’. The terms used to describe people of mixed race vary by territory and have been incrementally added to or changed over time. The original nomenclatures such as sambo, (...) musteephino, mulatto, creole, etc. have been replaced at present to include terms like brown skin, mulatto, clear skin, light skin, red-nigger, dougla and browning. The title of the article comes from a contemporary dancehall song in Jamaica in which the black singer, Buju Banton, unwittingly echoes an unspoken yet shared notion of female desirability in the Caribbean: a preference for ‘brown’ as opposed to black women or unmixed women. In the ongoing constructions of femininity in the region, class and skin colour have intersected with race to produce hierarchies and stereotypes of femininity based on racial mixing. Drawing on some of the historical data available, particularly that of the pioneering research in this area produced by Lucille Mathurin in 1974, this article interrogates some aspects of miscegenation in the Jamaican past, to configure these with gender, race and class relations in the present. The article does not attempt to arrive at conclusive findings but to contribute to the ongoing process in the region, and elsewhere, of differentiating the category ‘woman’ in historiography and sociology. We can see from the analysis set out here that the two accounts that were the focus of consideration are complementary to one another. It has been my contention that a problem like specifying a concept such as ‘refrain’ is highly complex. One part of it is the problem of determining the relation between the action (or event) and the result. Another part of the problem is that of describing the event itself; what kind of an event is it? These (...) two projects are related and so it is clear that the results must be consistent. However, it is equally clear that the definition which is useful for one project is not the same as that which is helpful for another. The point is that it should not be assumed that an account that initially looks incompatible with one's own must be refuted. It is sometimes better to consider what is needed for a complete account, and whether many different approaches may contribute pieces to the puzzle.We have here one puzzle piece: an analysis of refraining. It should not be assumed that we have thereby completed the puzzle of omission, but omission can be approached the same way; that is, by coordinating parallel projects.Accordingly, the first benefit of the present analysis is that it sets up an approach which is modular in nature. It allows for parallel projects to be pursued separately and coordinated. This kind of approach is sorely needed in this area to counter unproductive dispute.To see how such an approach can be applied to further problems profitably consider the following persistent controversy. Many philosophers are at odds over the importance of the notion of duty, or more informally, reasonable expectation in the understanding of refraining. A number of them (e.g., Hart and Honore, John Casey, and Phillipa Foot) hold that the determining feature for the ascription of responsibility to an agent for not doing something to prevent a harm (say, a death) is the presence of a duty or reasonable expectation that the agent do something about the situation. For example, John Casey holds, “If a man does not do x, we cannot properly say that his not doing x is the cause of some result y, unless in the normal course of events he could have been expected to do x.” Casey, Actions and Consequences (1978).Other philosophers object that a person can cause a result by refraining from (causally) preventing it, and that such an event can be explained without any reference to duty. These two views appear to conflict, but in fact they are both right (but both incomplete). The reason that the above statements are generally thought to constitute a disagreement is that ‘refrain’ is generally taken as the fundamental term of analysis for omissions. Thus, if Casey says, “If a man does not do x...” he is taken to mean “...if a man refrains from doing x...” But he need not mean that. He may mean to say only that the man failed to do x. See my analysis in “Contemplating Failure,” supra note 10. Failing to do something can be, and ordinarily is, thought of as stronger than simple nonaction. But it is much weaker than refraining. For one thing, it has no awareness requirement. Thus, an account like Casey's can explain the ascription of responsibility and the presence of an omission where Green's account (or the account offered here) cannot, and vice versa. Casey's view can explain why we hold (or at least that we hold) responsible the night watchman who forgets to check one of the windows, the bookkeeper who (accidentally) omits an entry in the accounts, or the private duty nurse who fails to prevent a death by falling asleep on the job. No refraining is present in any of these cases. Consequently, any thesis based on refraining alone cannot explain them. But in many cases refraining is precisely what is important, and Green (and others of the same persuasion) are correct to point out that no reference to duty is necessarily required to account for these cases. Analysis based on refraining best explains intentional or conscious omission. Analysis based on duty or reasonable expectation is the only way to explain unconscious omission. More often than not, both elements are present. A complete account of omission needs both. So here again, the better way to view these putatively competing accounts is as parallel projects which work toward a common, but complex end. The approach taken here allows for this kind of much needed coordination. The second benefit of the present analysis is that it clarifies and focuses on the significance of the mental element of refraining. Refraining is conscious omission. Consciousness and omission are its distinguishing features. The effects of seeing the concept this way are pervasive. Here is one example. If I refrain from reporting my full income to the IRS, I have committed fraud, and punitive or even criminal sanctions may be reasonable. If I fail to report my full income through ignorance or mistake (say, I misunderstood the instructions) correcting the error and requiring payment is reasonable, but certainly criminal sanction is not. This oversimplifies the distinction, but it illustrates the focus of my pursuit.With regard to positive actions, law and philosophy have long recognized this important distinction as manifested in the difference between negligence and intentional tort, or manslaughter and murder. Due (I think) to the extraordinary flexibility of language and the weakness and variability of social conventions regarding omissions, this distinction has not been clearly articulated. I think such an analysis is worth pursuing. The present account is one step in that pursuit. (shrink)

This chapter concentrates on the edges of the lived body, which act to mediate between the outermost and innermost edges. The prospects for construing bodily edges are explored. Bodily edges realise the paradigm of definitive but incomplete self-knowledge in a very particular way: namely, that such edges are parts of parts. The internal and external edges of bodily parts are not only glimpsed in the course of ongoing experience but also offer a grip for hands. Inside/outside is an especially significant (...) binary edge structure, and is altogether central to edges that inhere in bodies. Bodily edges act as the mediatrix between the edges of the perceived earth and those of the inner psyche, and also provide the conjunctures for many things in experienced life-worlds. (shrink)

There are two alternative approaches to accommodating an agent-centered restriction against, say, φ-ing. One approach is to prohibit agents from ever φ-ing. For instance, there could be an absolute prohibition against breaking a promise. The other approach is to require agents both to adopt an end that can be achieved only by their not φ-ing and to give this end priority over that of minimizing overall instances of φ-ing. For instance, each agent could be required both to adopt the end (...) of minimizing their own promise-breakings and to give this end priority over that of minimizing promise-breakings overall. The former is what I’ll call the side-constraint approach, and the latter is what I’ll call the teleological approach. In this chapter, I argue that, when it comes to accommodating restrictions, we should (1) favor the teleological approach over the side-constraint approach, (2) favor an act-consequentialist approach over a non-consequentialist, teleological approach (such as Rossian pluralism), and (3) favor a Kantsequentialist approach over other act-consequentialist approaches, where Kantsequentialism is a version of act-consequentialism that holds that persons are ends-in-themselves who are inherently and unconditionally valuable and are, thus, owed our respect. The study of the virtues has largely dropped out of modern philosophy, yet it was the predominant tradition in ethics fom the ancient Greeks until Kant. Traditionally the study of the virtues was also the study of what constituted a successful and happy life. Drawing on such diverse sources as Aristotle, Augustine, Aquinas, Shakespeare, Hume, Jane Austen, Hegel, Nietzsche, and Sartre, Casey here argues that the classical virtues of courage, temperance, practical wisdom, and justice centrally define the good for (...) humans, and that they are insufficiently acknowledged in modern moral philosophy. He suggests that values of success, worldliness, and pride are active parts of our moral thinking, and that the conflict between these and our equally important Christian inheritance leads to tensions and contradictions in our understanding of the moral life. Reports of the Intergovernmental Panel on Climate Change (IPCC) employ an evolving framework of calibrated language for assessing and communicating degrees of certainty in findings. A persistent challenge for this framework has been ambiguity in the relationship between multiple degree-of-certainty metrics. We aim to clarify the relationship between the likelihood and confidence metrics used in the Fifth Assessment Report (2013), with benefits for mathematical consistency among multiple findings and for usability in downstream modeling and decision analysis. Since the development of assisted reproductive technologies, infertile individuals have crossed borders to obtain treatments unavailable or unaffordable in their own country. Recent media coverage has focused on the outsourcing of surrogacy to developing countries, where the cost for surrogacy is significantly less than the equivalent cost in a more developed country. This paper discusses the ethical arguments against international surrogacy. The major opposition viewpoints can be broadly divided into arguments about welfare, commodification and exploitation. It is argued that the (...) only valid objection to international surrogacy is that surrogate mothers may be exploited by being given too little compensation. However, the possibility of exploitation is a weak argument for prohibition, as employment alternatives for potential surrogate mothers may be more exploitative or more harmful than surrogacy. It is concluded that international surrogacy must be regulated, and the proposed regulatory mechanism is termed Fair Trade Surrogacy. The guidelines of Fair Trade Surrogacy focus on minimizing potential harms to all parties and ensuring fair compensation for surrogate mothers. (shrink)

Fundamentals of Critical Argumentation presents the basic tools for the identification, analysis, and evaluation of common arguments for beginners. The book teaches by using examples of arguments in dialogues, both in the text itself and in the exercises. Examples of controversial legal, political, and ethical arguments are analyzed. Illustrating the most common kinds of arguments, the book also explains how to evaluate each kind by critical questioning. Douglas Walton shows how arguments can be reasonable under the right dialogue conditions (...) by using critical questions to evaluate them. The book teaches by example, both in the text itself and in exercises, but it is based on methods that have been developed through the author's thirty years of research in argumentation studies. Through extensive training, experts acquire specialized knowledge and abilities. In this paper, I argue that experts also acquire specialized visual experiences. Specifically, I articulate and defend the account that experts enjoy visual experiences that represent gestalt properties through perceptual learning. I survey an array of empirical studies on face perception and perceptual expertise that support this account. I also look at studies on perceptual adaptation that some might argue present a problem for my account. I show how the data are (...) subject to an interpretation that is friendly to it. ABSTRACT ‘Modus Darwin’ is the name given by Elliott Sober to a form of argument that he attributes to Darwin in the Origin of Species, and to subsequent evolutionary biologists who have reasoned in the same way. In short, the argument form goes: similarity, ergo common ancestry. In this article, I review and critique Sober’s analysis of Darwin’s reasoning. I argue that modus Darwin has serious limitations that make the argument form unsuitable for supporting Darwin’s conclusions, and that Darwin did (...) not reason in this way. (shrink)

Marina Sbisà’s remarks on illocutionary pluralism suggest but do not constitute a full-blown theory. In this chapter I discuss two different attempts to build on those remarks. The first, illocutionary relativism, is my own attempt to develop the ideas presented in Sbisà’s remarks. The second, from Marcin Lewiński, differs in important ways. I then briefly compare these two varieties of illocutionary pluralism.
